Abstract

Scientific writing this expected could know how " Balance " Implementation of the Dharma of Religion and the Dharma of the State Towards Harmony social in the Unitary State Republic of Indonesia, with methodology study normative with use type approach normative applied about tree discussion with data collection is done by studies library. In The Constitution of the Republic of Indonesia as provision in Article 29 concerning Religion and Belief is implementation of the Dharma Religion for whole Indonesian nation , while in provision Article 30 regarding Defense and Security is implementation of the National Dharma for whole Indonesian nation . The discussion that will analyzed preceded with introduction / background back , then solved through base theoretical , state ideology Pancasila and implementation tree discussion , so obtained conclusions and suggestions. Penulisan ilmiah ini diharapkan dapat mengetahui bagaimana “Keseimbangan” Implementasi Dharma Agama dan Dharma Negara Menuju Kerukunan Sosial di Negara Kesatuan Republik Indonesia, dengan metodologi kajian normatif dengan menggunakan jenis pendekatan normatif yang diterapkan tentang pohon pembahasan dengan pengumpulan data adalah dilakukan oleh studi pustaka. Dalam UUD 1945 sebagaimana ketentuan Pasal 29 tentang Agama dan Keyakinan merupakan pelaksanaan Dharma Agama bagi seluruh bangsa Indonesia, sedangkan ketentuan Pasal 30 tentang Pertahanan dan Keamanan merupakan pelaksanaan Dharma Nasional bagi seluruh bangsa Indonesia. Pembahasan yang akan dianalisis didahului dengan pendahuluan/latar belakang, kemudian dipecahkan melalui landasan teoritis, ideologi negara Pancasila dan pokok bahasan implementasi, sehingga diperoleh kesimpulan dan saran.

Abstract

Doxing, as a form of cybercrime, has become a serious threat to individual privacy rights in the digital era. The practice of disclosing personal data without consent not only violates human dignity but also infringes upon the constitutional right to security guaranteed under Article 28G paragraph (1) of the 1945 Indonesian Constitution. In Indonesia, doxing is regulated under the Electronic Information and Transactions Law (ITE Law) and the Personal Data Protection Law (PDP Law). However, these two regulations emphasize different aspects: the ITE Law focuses on cybercrime’s technical dimension, while the PDP Law emphasizes the protection of personal data subjects’ rights. This difference creates normative disharmony in terms of definition, offense characteristics, and sentencing disparity, which results in legal uncertainty and weak protection for doxing victims. Using normative legal research methods, this study examines the disharmony between the ITE Law and PDP Law and its implications for privacy protection. The findings show that without regulatory harmonization, the PDP Law as lex specialis cannot optimally protect victims. Therefore, harmonization of regulations, strengthening of the personal data supervisory authority, and enhancing the capacity of law enforcement officers are urgently needed to ensure legal certainty and effective privacy protection in Indonesia.
