Abstract

There are still products in the process of issuing halal certificates, even though numerous goods circulating in society promise halalness until 2024. Consequently, comprehensive provisions are required to cover goods and services. This follows the regulations explicitly regulated in Law Number 6 of 2023, Law Number 33 of 2014, and Article 4 of Law Number 8 of 1999 about consumer protection. This writing employs normative juridical legal and field research methods to observe and collect data from real-world societal situations to obtain the necessary facts. The study's findings show that the halal certification program has been effectively implemented in Indonesia's national legal framework, as outlined in Law Number 6 of 2023, Law Number 33 of 2014 concerning Halal Guarantee Products, and Law Number 8 of 1999 concerning Consumer Protection. The government's efforts to enhance the halal certification program are demonstrated by the self-declare program and halal certification assistance in socialization and data collection for halal certification registration, facilitating business actors to obtain halal certificates that enhance consumer comfort.

Abstract

Legal protection involves safeguarding human rights violated by others and ensuring the community fully exercises its legally granted rights. In Urutsewu, the conflict arose from the differing perceptions between the TNI and local farmers. The TNI uses the area for defence and weapons testing, while farmers use it to grow crops to support their families. Both parties claim land in Urutsewu for their reasons because there is no clarity on the ownership status between them. This study uses a socio-legal approach, analysing the intersection of law and society by considering social, cultural, and political factors that affect the functioning of the legal system, which aims to examine the government’s role in the protection of law and human rights and its efforts to resolve land ownership disputes in the coastal land area of Urutsewu Kebumen. Progress is being made in recognising legal protection and human rights for land rights ownership in Urutsewu, with land specifications now being clarified for both residents and the TNI. The land disputes stem from unclear land ownership (no certificate), prompting both parties to initiate land registration to ensure legal certainty and land protection in Urutsewu.

Abstract

Kemiskinan menjadi permasalahan nasional. Program pengentasan kemiskinan terus digalakkan untuk mengentaskan masyarakat dari garis kemiskinan. Program Bantuan Pangan Non Tunai yang diinisiasi oleh Kemanterian Sosial RI merupakan terobosan dan percepatan bagi penerima program di Gedangan Grobogan. Fokus program dalam bidang ekonomi, sosial, pendidikan dan kesehatan dirasa kurang karena tidak didukung oleh kesadaran hukum. Kasus kekerasan seksual di dalam rumah tangga dialami oleh masyarakat lapisan atas, menengah dan bawah terjadi karena lemahnya pemahaman, wawasan dan kesadaran hukum, terutama di kalangan masyarakat miskin. Kegiatan penyuluhan ini dilaksanakan dengan metode ceramah dan diskusi sehingga hasil yang diharapkan adalah adanya pengetahuan hukum, wawasan hukum dan kesadran hukum tentang Tindak Pidana Kekerasan Seksual kepada peserta penerima Bantuan Pangan Non Tunai (BPNT) yang akan memunculkan pengetahuan tentang berbagai macam tindak kekerasan seksual, penanganan dan pelaporan.

Abstract

This article discusses the issue of disparity in sanctions arising from the issuance of the Regulation of the Minister of Home Affairs of the Republic of Indonesia on Name Registration in Population Documents. A case in Tuban highlights a child who was unable to obtain a birth certificate because the name was too long to be entered into the Population and Civil Registration Office system. The regulation imposes restrictions on naming children, requiring a minimum of two words and no more than sixty characters. Non-compliance with this regulation can result in the non-issuance of a birth certificate, potentially rendering the child stateless. This situation contradicts UDHR Article 15, ICCPR Article 24, CRC Articles 7-8, and the 1945 Constitution Article 26 (1) on citizenship. The purpose of this study is to highlight the imbalance between regulatory rules and sanctions, demonstrating how lower-level regulations can violate higher-level rules. This research employs a qualitative, literature-based, and normative-doctrinal approach. Secondary data sources include Permendagri No. 73/2022, the Population Administration Law, the 1945 Constitution, and international regulations related to population and citizenship. The findings indicate that birth certificates reflect the state's responsibility to provide citizens with rights, including the right to identity. However, the sanction of not issuing a birth certificate due to regulatory non-compliance creates a disproportionate disparity in naming rights. Therefore, policy revision is necessary to optimize legal protection, making the system more equitable and in line with legal norms.

Abstract

Perkawinan anak merupakan masalah yang tak berujung dan sulit diurai benang kusutnya. Peningkatan kasus paska UU No 16 Tahun 2019 dengan dinaikkannya usia perkawinan menjadi 19 tahun seperti bola salju yang terus menggelinding. Dispensasi perkawinan, hamil sebelum menikah, masalah ekonomi rumah tangga, kesehatan, pertengkaran dan berujung pada perceraian merupakan rangkaian dari perkawinan anak. Masalah ini mencapai puncaknya ketika perkawinan anak terjadi dilingkungan masyarakat penerima jaminan sosial berupa Program Keluarga Harapan (PKH) dari pemerintah yang bertujuan meningkatkan kesejahteraan masyarakat tertinggal. Justru perkawinan anak menjadi salah satu penghambat program tersebut. Penelitian kualitatif dengan pendekatan deskriptif-analitik digunakan untuk menjawab permasalahan: 1. Mengapa perkawinan anak marak terjadi di lingkungan keluarga penerima Program Keluarga Harapan Dusun Sono Mbabar Gedangan Wirosari Grobogan Jawa Tengah ? 2. Sejauh mana tingkat pemahaman masyarakat Dusun Sono Mbabar Gedangan Wirosari Grobogan terhadap perubahan Undang-undang No 16 Tahun 2019 Tentang Batas Usia Perkawinan ? 3. Bagaimana strategi untuk mengurangi perkawinan anak di lingkungan keluarga penerima Program Keluarga Harapan ? Temuan dari penelitian Pertama, Kompleksitas faktor pendorong perkawinan anak di lingkungan penerima jaring pengaman sosial Program Keluarga Harapan adalah rendahnya tingkat pendidikan yang maksimal tamat Sekolah Menengah Pertama. Pertanian menjadi mata pencaharian utama, minimnya akses informasi dan rendahnya literasi. Perkawinan menjadi alternatif penyelesaian masalah ketika jenjang pendidikan tidak ada, minimnya informasi dan ekonomi menjadi kebutuhan yang tidak bisa dielakkan. Kedua, perubahan Undang-undang No 16 Tahun 2019 jo Undang Undang Nomor 1 tahun 1974 tentang batasan usia perkawinan belum disosialisasikan secara massif. Keterkaitan antara bahaya ancaman perkawinan anak dengan kesehatan, pendidikan anak, kesiapan mental, pertengkaran dan perceraian tidak mendapat perhatian serius. Dispensasi nikah menjadi solusi dari pernikahan anak yang kerap terjadi. Ketiga, kerjasama antara Penyuluh Agama di Kantor Urusan Agama, Bidan Desa dan pendamping Program Keluarga Harapan dalam menyusun bahan penyuluhan secara bersama merupakan strategi yang diharapkan dapat menekan jumlah perkawinan anak.

Abstract

Perkawinan beda agama di Indonesia, secara yuridis formal tidak diatur secara spesifik di dalam Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan. Pasal 2 Ayat (1) Undang-Undang Nomor 1 Tahun 1974 menjelaskan bahwa, perkawinan adalah sah, apabila dilakukan menurut hukum masing-masing agamanya dan kepercayaannya itu. Rumusan pasal ini, tidak menyatakan dengan jelas bahwa perkawinan beda agama dilarang atau dibolehkan di Indonesia. Metode penelitian yang digunakan adalah yuridis normatif, yaitu penelitian hukum yang mengkaji regulasi yang telah ada untuk menganalisis fenomena-fenomena yang terjadi dan bermunculan di masyarakat, sehingga dapat diketahui kesesuaiannya. Kemudian penelitian ini mendapatkan kesimpulansebagai berikut, yaitu kompetensi Pengadilan Negeri dalam memberikan izin perkawinan beda agama menuai pro dan kontra. Dari sisi pro, terdapat beberapa argumen yakni: 1) Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan tidak menyebutkan secara jelas perihal perkawinan beda agama dan hanya mengakui perkawinan yang dilangsungkan berdasarkan agama dan kepercayaan yang sama; 2) Realitas menunjukkan di Indonesia masih banyak pasangan  yang melakukan perkawinan beda agama dengan berbagai cara baik melalui perkawinan adat atau bahkan melaksanakan perkawinan di negara lain yang memperbolehkan; 3) Perkawinan beda agama dapat dicatatkan oleh pemerintah Indonesia sebagai persyaratan formal administratif; dan 4) pencatatan kawin hanya bisa dilakukan jika kedua mempelai yang melakukan perkawinan beda agama mendapatkan izin dari Pengadilan Negeri melalui dispensasi nikah karena  PN menjadi satu-satunya instansi yang berwenang memberikan izin perkawinan beda agama sesuai dengan ketentuan dari Pasal 35 Huruf (a) Undang-Undang 23 Tahun 2006 dan yurisprudensi putusan Mahamah Agung No. 1400 K/Pdt/1986

Abstract

The transformation of the principle of legality in Article 1 paragraph (1) of the new Criminal Code and the incorporation of living law in Article 2 highlights a pivotal shift in Indonesia's legal framework. Indonesia, adhering to a civil law system, emphasizes that crimes and punishments are governed solely by statutory provisions. The principle of legality ensures that no act can be deemed criminal without a written law. However, the inclusion of living law, an unwritten customary law rooted in societal traditions, challenges this principle. This transformation, motivated by the decolonization of the Dutch-inherited Criminal Code, raises critical questions about legal certainty and the adaptability of customary law within a modern legal system. This study aims to analyze the juxtaposition of Article 1 and Article 2 in the new criminal code. Using a normative-conceptual approach and library research, the study examines statutory frameworks and the socio-legal dynamics surrounding these provisions. Findings reveal that while the previous Criminal Code lacked recognition of living law, the new criminal code incorporates it as an extension of the legality principle. However, this integration has sparked significant debate due to the inherent uncertainty of customary law, which contrasts with the clear and definitive requirements of lex certa. Customary law prioritizes community justice by adapting to time, place, and circumstances, yet its application risks undermining the predictability demanded by the principle of legality. In conclusion, the coexistence of statutory legality and living law in the new criminal code underscores a complex legal reform balancing modern legal certainty with Indonesia's pluralistic traditions. Transformasi asas legalitas dalam Pasal 1 ayat (1) Kitab Undang-Undang Hukum Pidana dan masuknya hukum yang hidup (living law) dalam Pasal 2 menyoroti adanya perubahan penting dalam kerangka hukum pidana. Indonesia yang menganut sistem hukum Eropa menekankan bahwa kejahatan dan hukuman hanya diatur oleh ketentuan undang-undang. Asas legalitas menjamin bahwa suatu perbuatan tidak dapat dianggap pidana tanpa adanya hukum tertulis. Namun, dimasukkannya hukum yang hidup, yaitu hukum adat tidak tertulis yang berakar pada tradisi masyarakat, menantang prinsip ini. Transformasi yang dilatarbelakangi oleh dekolonisasi KUHP warisan Belanda ini menimbulkan pertanyaan kritis mengenai kepastian hukum dan kesesuaian hukum adat dalam sistem hukum modern. Penelitian ini bertujuan untuk menganalisis penjajaran Pasal 1 dan Pasal 2 dalam KUHP baru. Dengan menggunakan pendekatan normatif-konseptual dan studi kepustakaan, studi ini mengkaji kerangka perundang-undangan dan dinamika sosial-hukum yang melingkupi ketentuan tersebut. Temuan menunjukkan bahwa meskipun KUHP sebelumnya kurang mengakui hukum yang hidup, KUHP yang baru memasukkannya sebagai perpanjangan dari asas legalitas. Namun, integrasi ini telah memicu perdebatan yang signifikan karena ketidakpastian hukum adat, yang kontras dengan persyaratan lex certa yang jelas dan definitif. Hukum adat mengutamakan keadilan masyarakat dengan menyesuaikan diri dengan waktu, tempat, dan keadaan, namun penerapannya berisiko melemahkan prediktabilitas yang dituntut oleh asas legalitas. Kesimpulannya, keberadaan legalitas undang-undang dan hukum yang hidup dalam KUHP yang baru menggarisbawahi adanya reformasi hukum yang kompleks yang menyeimbangkan kepastian hukum modern dengan tradisi pluralistik di Indonesia.

Abstract

The condition of world economic development has entered a new period, referred to as the digital economy. This is seen from The growing quantity of financial transactions conducted via the internet. One example is trading through internet media or e-commerce. Facing the characteristics of e-commerce, there is a possibility that there will be disputes related to the law in online transactions.  This e-commerce transaction does not only occur in a country, so it is necessary to analyze whether the existence of Law No. 8 of 1999, which addresses consumer protection in the digital economy era is still effective or not in providing legal protection to e-commerce consumers. This study's goal is to be able to contribute to the study of Consumer Protection law related to how to implement the Consumer Protection Law (UUPK) in the digital economy era, and whether it is still effective if implemented in the current digital economy era. This research method uses an empirical juridical type, which analyzes applicable provisions and regulations by examining various legal sources and literature sources as a reference based on a phenomenon that occurs or develops in society. The study's findings demonstrate that in its implementation, the Law that Protecting Consumers cannot accommodate various kinds of problems that occur in the current digital economy era such as e-commerce customer data leaks, fraud through e-commerce, etc. Meanwhile, related to its effectiveness, it is considered ineffective in providing legal safeguards for e-commerce customers because the rules in this UUPK in guaranteeing consumer rights are still very limited to conventional buying and selling.  The update of the rules in the UUPK must be carried out immediately by the Government in order to adapt to the current digital economy conditions.

Abstract

The position of the deputy regional head in Indonesia's regional government system is often unclear, particularly within constitutional and legal context. This ambiguity leads to inefficiencies and conflicts in governance. This study seeks to examine the role of the deputy regional head from the perspective of fiqh siyasah, addressing the legal uncertainties and suggesting ways to enhance their authority. Utilizing a normative juridical approach, this research draws on secondary data from legal documents, academic articles, and other pertinent sources. Data were gathered through a structured literature review, and qualitative analysis was conducted using juridical methods to create a descriptive narrative. The findings indicate that the authority of the deputy regional head is frequently overshadowed by the regional head, relegating their role to mostly ceremonial or minor administrative tasks. This disparity contradicts Islamic governance principles, which prioritize justice, consultation, and accountability. This study contributes to the field by proposing a Principle-Based Authorization Model aimed at redefining the deputy’s authority in a way that aligns with both Islamic values and contemporary governance requirements. This model is recommended as a foundation for legal and policy reforms to promote more effective and cohesive regional governance.

Abstract

Among the people of Java. Especially in the Cangkring Village of Rembang, Karanganyar, Demak. There are various rituals that are sacred and have been hereditary traditions, one of which is the earth alms tradition is a cultural ritual from the past. The community in the Cangkring Rembang Village, Karanganyar, Demak, considers that the real purpose and purpose of the earth alms tradition is a form of gratitude that created the universe namely God who has bestowed agricultural produce for the people in the Cangkring Rembang Village. Therefore, the people of Cangring Village in Rembang always carry out the tradition of alms in the earth, which is in the middle of the moon or dzulqo’dah. In this study included field research in the Cangkring Rembang Village, Karanganyar, Demak. While information is collected by interviews. The data that has been obtained is analyzed using data analysis techniques with descriptive, deductive, and inductive methods. Likewise, almsgiving is a convention of Javanese tradition with Islam. Given the earth alms tradition is a ritual passed down from ancestors to later generations, even though the earth alms tradition does not directly mention it in the Holy Qur'an and the Prophet's Hadith, but it is reviewed from the Islamic law in perspective fiqh, it is still permissible but does not contradict existing Islamic laws, and does not associate partners with Allah SWT.
