Abstract

Pengabdian kepada masyarakat melalui Program Kosabangsa ini adalah kenyataan yang diidentifikasi dari Desa Popalia menjadi paradoks dimana meskipun desa ini masuk kategori desa kecil dan kondisi ekonomi masyarakat dalam kategori miskin, namun potensi permasalahan sampah berada di pelupuk mata. Hal itu disebabkan oleh produksi sampah yang semakin meningkat secara signifikan seiring dengan pertambahan jumlah penduduk di Desa Popalia. Tujuan pengabdian adalah memberikan solusi komprehensif terhadap permasalahan mitra terkait pengelolaan sampah berbasis IPTEK kepada Bumdes Mepokoaso dan Karang Taruna Meohai Desa Popalia. Memecahkan persoalan tersebut, tim mengusulkan pendekatan baru yang disebut RuSaJU, yakni akronim dari “Rubah Sampah Jadi Uang”. Tahapan metode yang dilakukan adalah menjalin kolaborasi dan kemitraan dengan berbagai stakeholder, sosialisasi regulasi pengelolaan sampah, dan pelatihan pengolahan sampah organik dan anorganik, serta pembuatan dan penerapan aplikasi pengelolaan sampah dan manajemen keuangan Bumdes Mepokoaso dan Karang Taruna Meohai. Adapun hasil yang diperoleh adalah terjadinya peningkatan pengetahuan, keterampilan, dan kesejahteraan masyarakat terkait pengelolaan sampah melalui pendekatan RuSaJU.

Abstract

The issuance of Governmental Regulation no. 24 of 2022 on the Executory Regulation of Law no. 24 of 2019 on Creative Economy has become a zephyr for creative economy actors with regard to intellectual property-collateralized financing schemes for their businesses. The regulation also further reinforces intellectual property ownership as a standalone fiduciary object that should no longer be viewed as supplementary collateral. This paper aims to study the optimization of governmental regulation on the creative economy with respect to intellectual property-collateralized financing. To this end, a normative legal method was applied by focusing on the secondary data. The research topic was scrutinized following the prevailing regulation and relevant literature. With the issuance of Governmental Regulation no. 24 of 2022 Creative Economy, it further strengthens the ownership status of intellectual property rights as objects of material guarantees. Every citizen, especially creative economy actors, can apply for business capital loans, which can be used as collateral objects and can be classified in the form of intellectual property which must be registered or registered with the Director General of Intellectual Property, Ministry of Law and Human Rights. This consequence has an impact on the establishment of an intellectual property appraisal institution that has the task of evaluating intellectual property that will be used as collateral.

Abstract

Vigilantism (eigenrichting) is the act of punishing another person without going through the applicable legal process. This action can be categorised as a criminal offence, because it is contrary to the provisions of Article 1 of the Criminal Code which states that every person is prohibited from committing acts prohibited by law. The purpose of this study is to determine the concept of the criminal offence of vigilantism (eigenrichting) according to positive criminal law in Indonesia as well as to know and understand the form of criminal liability for the perpetrators of vigilantism (eigenrichting). This research uses normative-empirical legal research methods. The results showed that the concept of vigilantism (eigenrichting) according to positive criminal law in Indonesia that has been applied by the Public Prosecutor at the Konawe District Prosecutor's Office is Article 170 of the Criminal Code on Robbery, Article 338 of the Criminal Code on Murder, and Article 351 of the Criminal Code on Maltreatment. Criminal responsibility for the perpetrators of vigilantism (eigenrichting) in Decision Number: 194/Pid.B/2022/PN, the perpetrators are responsible for their actions based on their position and the form of their actions. The Panel of Judges applied Article 55 Paragraph (1) to 1 of the Criminal Code which regulates the position of the perpetrator in the participation of a criminal offence declared as a pleger (perpetrator) by the Panel of Judges of the Unaha District Court.

Abstract

Pertambangan di Indonesia dari berbagai riset telah menunjukan dampak positif diantaranya adalah sebagai lokomotif perekonomian yang secara langsung berkontribusi langsung pada peningkatan PDB, selain itu pada aspek ekonomi sektor riil berkontribusi terhadap peningkatan serapan tenaga kerja, peningkatan pendapatan, mempunyai multi efek player dengan meningkatkan usaha mikro masyarakat, namun disatu sisi riset yang lain menunjukan  dampak negatif terutama dampak lingkungan, konflik agraria, alih fungsi lahan dari pertanian menjadi kawasan eksploitasi pertambangan menyebabkan defisit  persediaan pangan. Khusus untuk permasalahan mitra pada pengabdian masyarakat ini karena terdapat protes warga soal kerusakan lingkungan, konflik horizontal antara masyarakat dan perusahaan, aktifitas ilegal memuat nikel tanpa memiliki syarat admininstrasi yang lengkap, untuk  itu kami melakukan pengabdian kepada masyarakat kiranya dengan informasi yang kami transformasikan masalah dapat diselesaikan oleh stake holders yang didaerah Lokasi mitra. Metode yang kami lakukan ialah metode pra pelaksanaan dan pelaksanaan; pra pelaksanaan dengan  memperhatikan base line visi misi fakultas hingga menentukan topik yang sesuai, kemudian melaksanakan observasi berita dan konfirmasi lapangan untuk memastikan urgensi kebutuhan mitra yang sesuai dengan topik, mengiventaris bahan materi lalu merumuskannnya hingga sistematis dan tersaji dengan baik, kemudian pelaksanaan  dilakukan dengan metode  service learning. Hasil dan pembahasan kami mengemukakan sumber hukum dan ketentuan inti pertambangan di Indonesia, tata kelola dan manejem lingkungan, penanganan konflik agraria, norma yang dapat diterapkan apabila perusahan badan hukum atau perorangan memuat nikel keatas kapal yang belum lengkap syarat admininstrasinya, layanan pengaduan masyarakat yang dapat diakomodir pemeritah daerah sesuai dengan norma undang-undang saat ini.

Abstract

Kampoh Malasso – Kampung Bajo Anaiwoi is a floating village located in Anaiwoi Village, Tanggetada District, Kolaka Regency, Southeast Sulawesi Province. The majority of people in this floating village live by utilizing marine products, but limitations in business management and product marketing are the main obstacles in improving their standard of living. Seeing this condition, the USN Kolaka Community Partnership Program (PKM) Team tried to collaborate with the Anaiwoi Village PKK Team to help the local community through training and mentoring that focuses on aspects of management, product packaging, and digital marketing in order to increase literacy, development of MSMEs and creative industries based on coastal tourism. The PKM implementation method is divided into 5 stages, namely: socialization, training, application of technology, mentoring and evaluation, and program sustainability. This service resulted in several important achievements related to the level of empowerment of PKK partners in Anaiwoi Village, namely: 1) Increasing Managerial Knowledge: Training participants succeeded in improving their managerial skills, especially in preparing plans and managing PKK programs; 2) Improving Packaging Skills, where partners are skilled in packaging marine products and MSMEs, such as packaging for Malasso Dried Fish, Anaiwoi Green Banana, SaPa Ongol-Ongol (Coconut Sago), Fresh Smoothies, Malasso Village Krips (Cassava Chips), as well as digital printing creative industries (shirt screen printing, etc.); and 3) Improving Digital Marketing Skills: Partners are able to utilize digital technology to market their products more widely through websites and social media, as well as improve their skills in creating promotional content that has an impact on strengthening literacy at the same time.

Abstract

Constitutional Court Decision Number 20/PUU-XII/2023 states that article 30C letter h and explanation letter h of Law Number 11 of 2021 concerning the Prosecutor's Office of the Republic of Indonesia are contrary to the Constitution of the Republic of Indonesia Year 1945 and have no binding legal force. So this is considered contrary to the purpose of law and legal principles, namely the principle of equality before the law and the principle of equality of arms principle. Therefore, this encourages the author to analyze the concept of judicial review carried out by the Public Prosecutor who actually represents the victim and even the state. The writing of this thesis uses normative juridical research methods with methods of approaching laws and regulations,cases, historical and conceptual. This legal research found that the Criminal Procedure Code for victim protection has not been optimal compared to perpetrators of crimes, where the Criminal Procedure Code only identifies or tends to lead to perpetrators only. Then, with the decision of the Constitutional Court No. 20/PUU-XII/2023, it has the effect of closing the prosecutors authority to be able to apply review as a return of position to the convict.

Abstract

Euthanasia in positive criminal law regulations in Indonesia has not been regulated firmly and specifically. And according to human rights, the act of euthanasia is a violation of a person's right to life. The act of euthanasia itself occurs because of the unbearable suffering a person experiences due to a disease that has no hope of being cured. The patient or family will ask the doctor to carry out euthanasia because they have lost hope or the opportunity to be cured with other alternatives. Juridically, criminal law, the act of euthanasia is indirectly regulated in articles 304, 344 and 345 of the Criminal Code as well as articles 461 and 462 of Law number 1 of 2023 and in human rights the act of euthanasia is very contrary to a person's right to life, the emergence of the act of euthanasia It has become a demand that euthanasia is part of human rights, namely the right to die. This right to die is not regulated either in the 1945 Constitution, Law Number 39 of 1999, and the Universal Declaration of Human Rights. The new thing that can be stated is that the process of legislation and legal reform, especially regarding this action, must continue to be carried out based on Pancasila and the 1945 Constitution of the Republic of Indonesia, taking into account the religious and cultural norms that apply in Indonesian society.

Abstract

An official order is an order given by someone who has power and position in an institution or institution. A valid official order is an official order given by someone who has the authority and the order is still in the realm of his work. The article governing official orders is contained in Article 51 of the Criminal Code. Obstruction of justice is an act that harms many parties, therefore anyone involved in obstruction of justice deserves to be punished according to applicable law. The research method used in writing this thesis is normative, namely examining laws and examining scientific papers that are in accordance with the problems that are the topic of making a thesis. The result of this research is that a person who commits an act of obstruction of justice in an official order can be given a penalty according to the provisions if with full awareness knows that the act is an act that has elements of a criminal offense and cannot be said to be obstruction of justice if the person concerned does not know at all that the order contains elements of a criminal offense.

Abstract

Penelitian ini menguraikan tentang kriteria objek tanah landreform dan pelaksanaan redistribusi tanah objek landreform di Kabupaten Kolaka. Tujuan penelitian adalah untuk mengetahui kriteria objek tanah landreform dan pelaksaan redistribusi tanahobjek landreform di Kabupaten Kolaka. Metode yang digunakan pada penelitian ini adalah penelitian normatif-empiris yaitu penelitian yang penggabungan antara pendekatan hukum normatif dengan penambahan berbagai unsur empiris. Hasil penelitian menunjukkan bahwa kriteria objek tanah landreform di Kabupaten Kolak adalah tanah pertanian, tanah non pertanian (yang berasal dari pelepasan kawasan hutan/penurunan hak), tanah eks HGU yang berakhir haknya, dengan lebih spesifiklagi bahwa kriteria tanah objek Landerform di Kabupeten Kolaka yaitu tanah pertanian lahan kering yang menjadi sumber mata pencarian masyarakat setempat. Pelaksanaan redistribusi tanah objek landreform di Kabupaten Kolaka, secara garis besar adalah: a. persiapan dan perencanaan, bertujuan untuk mengetahui potensi, permasalahan dan kebutuhan para penerima tanah melalui pemetaan sosial tentang sumber-sumber ekonomi yang tersedia dan dapat diakses oleh penerima tanah; b. melakukan penyuluhan yang mencakup pembentukan organisasi yang efektif, ketersediaan sumber-sumber ekonomi, mekanisme pendampingan dalam memperoleh akses dari pemilik sumber-sumber ekonomi; c. membentuk organisasi penerima tanah yang efektif; d. melakukan fasilitasi dan rapat koordinasi dengan para pemangku kepentingan; e. Kerjasama kemitraan.

Abstract

Corporations play a significant role in the economic development of society, but they not only have positive impacts, but also cause negative, deviant impacts. where the characteristics and movements are different from conventional crimes in general. Unclear regulations on corporate criminal liability are a major obstacle in eradicating criminal acts committed by corporations. Although corporations have been designated as legal subjects. This research focuses on the study of the regulation of corporate criminal liability based on Law Number 1 of 2023 and to determine the concept of criminalization of corporations as perpetrators of criminal acts. This research uses a normative research method, which focuses on collection and analysis with a statutory approach, a case approach, and a conceptual approach. The results of the study concluded that in Law Number 1 of 2023 concerning the Criminal Code, in addition to two forms of error (intentional and negligence), it also regulates unlawful acts that can be held criminally accountable to corporations and shareholders where each article formulation requires that every act and the consequences of the act must be intended by the perpetrator to be held criminally accountable. The imposition of corporate criminal liability is regulated in Articles 45-50 of Law Number 1 of 2023 concerning the Criminal Code, strengthening the teaching/doctrine of piercing the corporate veil in imposing criminal liability on shareholders who commit crimes.
