Abstract

The research is focused on the sustainable waste management, with the specific concern on the use of waste management platform called waste bank being driven by local organizations in Lombok, Indonesia. The study aims to investigate the factors that attract the participation of local communities in using the platform for waste management and further to explore the lessons and good practices of waste banks driven by local community-driven organizations in Lombok, Indonesia. The method used for this research was qualitative with the analytic-descriptive approach. Data collection was through literature study and survey questionnaire. Based on the findings of the research, several factors including socio-economic characteristic and the lack of waste facilities and services influence the participation of local communities in sustainable waste management in Lombok. Those factors are critically shown based on its significance in influencing the involvement of local communities in implementing sustainable waste management. Thus, one of alternatives to use the waste bank initiated by local community-driven organizations may help in some ways such as improved participation of local communities in sustainable waste management. Furthermore, the lessons and good practices of waste banks driven by the selected two organizations in Lombok are highlighted.

Abstract

The government has established various policies regarding mining in Indonesia. Still, an important question that needs to be asked is whether these policies have provided benefits, justice, and balance for indigenous and tribal peoples. This study aims to analyze the impact of Indonesian mining regulations on the protection of indigenous peoples. This is a normative legal research effort. The literature review gathers information from document analysis, which is analyzed qualitatively. Data analysis is descriptive-analytic in nature. The study results show that the impact of mining regulations still needs to reflect the recognition and protection of the rights of indigenous peoples. There is a need to improve mining management legislation and systems. Standardization of reclamation and post-mining management is required to provide implementation guidelines that meet the needs of the community. It has no negative impact on the community surrounding the mine. Licensing is one policy that can be used to implement standardization, which means keeping an eye on how the land is managed after mining, how waste is handled, and how policies are made to encourage mining and conservation activities that are good for the environment.

Abstract

The regulation of using foreign employees as a tool for technology and knowledge transfer, roadblocks that arise while implementing technology and knowledge transfer, and government initiatives to promote the quickening of technology and knowledge transfer are all examined in this study. This study is a normative legal investigation. Legal main and secondary sources are examples of primary data. The method for gathering data was a literature review, which involved reading books, looking over rules and regulations, and looking over other relevant research findings. The findings of this study suggest that Indonesia's laws governing the employment of foreign workers have not explicitly restricted the means through which technology can be transferred through foreign workers.

Abstract

This research aims to examine the problems, First see whether the implementation of non-litigation adjudication decisions on public information disputes in Central Java Province has been implemented.Second,what are the obstacles and efforts made in fulfilling the right to information in order to achieve the mandate of the 1945 Constitution Article 28F. This research is empirical legal research with a qualitative approach. Types and sources of data include primary data and secondary data. The data collection technique used was interviews with the Commissioner of the Central Information Commission and the Assistant Commissioner of the Central Java Province Information Commission, then the data analysis technique used was qualitative. The research results show thatFirst,non-litigation adjudication decisions have not been implemented due to several factors, namely the weakness of the trial procedural law regulated in the Information Commission Regulation (PERKI), the absence of authority given to the Information Commission in overseeing decisions, and the independence of the Information Commission which is still very dependent on each commissioner. The obstacles that exist at the Central Java KIP in implementing non-litigation adjudication decisions, namely the legal substance related to the weakness of the PERKI as well as the urgency of revising the KIP Law in safeguarding community dynamism, the legal structure related to the limited budget owned by the Central Java KIP and the limited number of Information Commission employees who do not followed by an increase in quality, as well as community culture regarding the number of applicants who are not serious.

Abstract

Covid-19 has interrupted the fulfillment of Indonesian migrant workers’ rights, while the State has promulgated Law Number 11 of 2020 concerning Job Creation and revised Law Number 18/2017 concerning Protection of Indonesian Migrant Workers. This research aims to find out how protection and law reinforcement are given to Indonesian migrant workers by the state during the pandemic according to Law Number 18/2017 in conjunction with Law Number 11/2020. This research employed a normative method and a statutory approach. The research results have revealed that according to Law Number 18/2017, the protection given to the migrants only took repatriation, and another form of protection is still deemed to be not optimal since it did not take the engagement of roles of the companies sending Indonesian migrants. Moreover, pursuant to Law Number 11/2020, there is no reinforcement implied since the changes taking place are likely to ease administrative measures, contrary to the fact that strict permits could reduce the likelihood of illegal and non-procedural placement of migrant workers. This issue affects the fulfillment of the rights of Indonesian migrant workers, especially during the pandemic. Thus, it is essential that the state reinforce the protection given to Indonesian migrant workers during the pandemic by reinforcing legal protection every company providing labor placement service has to take into account and by imposing administrative measures as sanctions or sentencing in case of failing to abide by regulations. Moreover, permit issuance to the companies running labor placement services for Indonesian migrants has to be made stricter to ensure that only credible companies pass the requirement of migrant placement services, allowing the status of the rights of Indonesian migrant workers to be properly met amidst the pandemic. Keywords: legal protection; Indonesian migrant workers; COVID-19 Perlindungan Hukum Buruh Migran Indonesia yang Terdampak Covid-19AbstrakCovid-19 telah mengganggu pemenuhan hak-hak pekerja migran Indonesia, sedangkan negara telah menerbitkan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja dan merevisi Undang-Undang Nomor 18 Tahun 2017 tentang Perlindungan Tenaga Kerja Indonesia. Penelitian ini bertujuan untuk mengetahui bagaimana perlindungan dan penguatan hukum yang diberikan negara kepada pekerja migran Indonesia di masa pandemi menurut Undang-Undang Nomor 18/2017 jo Undang-Undang Nomor 11/2020. Penelitian ini menggunakan metode normatif dan pendekatan perundang-undangan. Hasil penelitian mengungkapkan bahwa menurut Undang-Undang Nomor 18 Tahun 2017 perlindungan yang diberikan kepada TKI hanya berupa pemulangan, dan bentuk perlindungan lainnya masih dirasa belum optimal karena tidak melibatkan peran perusahaan pengirim TKI. Apalagi, menurut Undang-Undang Nomor 11/2020, tidak ada penguatan yang tersirat karena perubahan yang terjadi cenderung memudahkan tindakan administratif, padahal izin yang ketat dapat mengurangi kemungkinan penempatan pekerja migran ilegal dan non-prosedural. Isu ini berdampak pada pemenuhan hak-hak pekerja migran Indonesia, terutama di masa pandemi. Oleh karena itu, negara perlu memperkuat perlindungan kepada TKI di masa pandemi dengan memperkuat perlindungan hukum yang harus diperhatikan oleh setiap perusahaan penyedia jasa penempatan tenaga kerja dan dengan memberikan tindakan administratif berupa sanksi atau hukuman jika tidak mematuhi peraturan.Kata Kunci: Perlindungan Hukum; Pekerja Migran Indonesia; COVID-19. Правовая Защита Индонезийских Трудовых Мигрантов, Пострадавших от Covid-19 АннотацияCovid-19 помешал осуществлению прав индонезийских трудовых мигрантов, в то время как государство обнародовало Закон № 11 от 2020 г. о создании рабочих мест и пересмотрело Закон № 18/2017 о защите индонезийских трудовых мигрантов. Цель этого исследования - выяснить, каким образом государство обеспечивает защиту и укрепление законодательства индонезийским трудовым мигрантам во время пандемии в соответствии с Законом № 18/2017 в сочетании с Законом № 11/2020. В этом исследовании использовался нормативный метод и законодательный подход. Результаты исследования показали, что в соответствии с Законом № 18 от 2017 г. защита, предоставляемая TKI (Индонезийским трудовым мигрантам), предусматривает только репатриацию, а другая форма защиты по-прежнему считается неоптимальной, поскольку она не предполагает участия компаний, отправляющих индонезийских трудовых мигрантов. Более того, в соответствии с Законом № 11/2020 не подразумевается никакого усиления, поскольку происходящие изменения, вероятно, облегчат административные меры, вопреки тому факту, что строгие разрешения могут снизить вероятность незаконного и непроцессуального размещения трудовых мигрантов. Эта проблема влияет на соблюдение прав индонезийских трудовых мигрантов, особенно во время пандемии. Таким образом, важно, чтобы государство усилило защиту, предоставляемую индонезийским трудовым мигрантам во время пандемии, усилив правовую защиту, которую должна учитывать каждая компания, предоставляющая услуги по трудоустройству, и путем введения административных мер в виде санкций или наказания в случае несоблюдения правил. Кроме того, необходимо ужесточить выдачу разрешений компаниям, предоставляющим услуги по трудоустройству индонезийских трудовых мигрантов, чтобы гарантировать, что только заслуживающие доверия компании удовлетворяют требованиям служб трудоустройства трудовых мигрантов, что позволит должным образом соблюдать статус прав TKI в условиях пандемии.Ключевые слова: Правовая защита; Индонезийские трудовые мигранты; COVID-19.

Abstract

Surakarta City Government has established various entertainment tax rate policies; however, entertainment taxpayers must still comply with these policies. This research examines and analyzes the impact of Islamic economics principles on the tax compliance payment entertainment policy. This research is normative research equipped with interviews. This research uses descriptive secondary data. The research results show that, first, the level of tax compliance in paying massage parlor and SPA entertainment taxes in Surakarta City differs from Islamic economics principles. At the same time, the causal factor is the minimal participation of taxpayers in formulating entertainment tax rate policies. Second, the Surkarta City government has a role in increasing tax compliance in massage parlors. SPA Entertainment is maximizing the imposition of sanctions, supervision, outreach, and providing applications that make tax services easier.

Abstract

Indonesia has enacted a regulation on land acquisition for public purposes through the Job Creation Law, aiming to accelerate infrastructure development. However, a critical question arises as to whether the law effectively ensures justice for the affected communities. This study aims to analyze the legal implications of the Job Creation Law on land procurement for infrastructure projects, with a particular focus on its ability to balance public interest and individual rights. Employing normative legal research, this study is based on the analysis of secondary data, including primary, secondary, and tertiary legal materials. The findings reveal that while the regulation provides a legal framework for land acquisition with compensation mechanisms, it often leads to disputes between the government and affected communities due to conflicting interests. Furthermore, several challenges hinder the implementation of land acquisition, such as incomplete planning documents, inadequate permits, and inconsistencies in development plans. In conclusion, although the law promotes development, its implementation must be improved to better ensure fairness, legal certainty, and public justice.

Abstract

Tourism constitutes a concurrent governmental function in Indonesia, whereby regional governments are vested with the authority to regulate and manage tourism development, including the governance of tourist villages. Despite the incorporation of sustainable tourism principles into national legislation as a means of supporting the Sustainable Development Goals (SDGs), particularly through the integration of economic, environmental, social, and cultural considerations, legal scholarship remains limited in critically examining the effectiveness of their implementation at the regional level. This gap is especially evident in the context of forest-based tourist villages. This study aims to examine the implementation of sustainable tourism principles as stipulated in national legislation in the management of tourist villages located within forest areas of Karanganyar Regency and to analyze the implications of such implementation for social, economic, cultural, and environmental dimensions. This research employs a normative legal research method, focusing on the analysis of statutory regulations, legal doctrines, and relevant policy instruments, and adopts a prescriptive analytical approach. The findings demonstrate, first, that the existing normative framework governing sustainable tourist village management has contributed to local economic development and is aligned with Sustainable Development Goal (SDG) 8 concerning decent work and economic growth. Second, the study finds that significant deficiencies persist in practical implementation, particularly with regard to environmental management and the enforcement of tourism regulations. Third, these deficiencies indicate a structural disparity between normative legal objectives and their realization in practice, reflecting weaknesses in regional governance and institutional coordination. The study concludes that regulatory refinement and strengthened governance mechanisms are necessary to ensure legally consistent, environmentally sustainable, and socially inclusive tourist village management in forest areas.

Abstract

Penelitian ini membahas peran Dinas Tenaga Kerja Kota Surakarta dalam memberikan perlindungan hukum kepada pekerja penyandang disabilitas, serta mengidentifikasi faktor-faktor penghambat yang memengaruhi efektivitas kebijakan tersebut. Latar belakang penelitian ini didasarkan pada ketimpangan akses ketenagakerjaan yang masih dialami penyandang disabilitas meskipun telah adanya Peraturan Daerah Kota Surakarta Nomor 9 Tahun 2020 tentang Perlindungan dan Pemenuhan Hak Penyandang Disabilitas. Penelitian ini menggunakan penelitin hukum empiris dengan metode kualitatif. Data diperoleh melalui wawancara, observasi lapangan, penyebaran kuesioner, dan studi kepustakaan. Temuan penelitian menunjukkan bahwa peran Dinas masih bersifat administratif dan belum menyentuh perlindungan substantif. Hambatan utama meliputi lemahnya substansi hukum yang masih deklaratif, keterbatasan struktur hukum (wewenang, anggaran, data, koordinasi lintas sektor), serta rendahnya budaya hukum masyarakat termasuk penyandang disabilitas sendiri. Simpulan penelitian menunjukkan bahwa efektivitas perlindungan hukum terhadap pekerja disabilitas memerlukan penguatan norma teknis dalam regulasi, dukungan struktur pelaksana yang solid, dan budaya hukum yang inklusif. Penelitian ini merekomendasikan perlunya pembaruan substansi hukum, edukasi hukum yang masif, serta strategi koordinatif lintas sektor yang sistematis agar hukum benar-benar menjadi alat transformasi sosial yang inklusif.

Abstract

This study aims at describing the application of the expiry of the case in Indonesia 's State Administrative Court ruling, the form of analysis used is conventional legal investigation. This analysis is concise. The type of data that is used is secondary. Secondary techniques of gathering data were obtained through research into libraries. All primary and secondary data were qualitatively analyzed. The findings showed that the Semarang State Administrative Court Decision No. 64 / G/2014 / PTUN.SMG and the Surabaya State Administrative Court Decision No. 135 / B/2015 / SBY did not explore and analyze the Supreme Court Circular Letter Number 2 of 1991 concerning the Implementation Guidelines for Several Provisions in Law Number 5 of 1986 concerning State Administrative Court, section V number 3, Article 39 paragraph (1) and paragraph (2) of Law Number 32 Year 2009 concerning Environmental Protection and Management and Article 9 paragraph (1) jo Article 4 of Law No. 14 of 2008 concerning Public Information Openness.Keywords:Case Expiry, Administrative Court and Decision
