Abstract

This article discusses interfaith marriages and the occurrence of disharmony in Indonesian legal norms. Disharmony arose because it received legitimacy from several District Courts based on the legal norms contained in the Elucidation to Article 35 letter (a) of Law no. 23 of 2006 concerning Population Administration. Even though the legal norm of Article 2 paragraph (1) of Law no. 1 of 1974 concerning Marriage prohibits interfaith marriages which are not in line with Pancasila norms as a grundnorm. The writing method used is normative juridical through the statue approach and conceptual approach models. The research results show that the norms of Article 35 letter a in Law no. 23 of 2006 has been considered a lex specialist by District Court judges so that it allows interfaith marriages even though it threatens Pancasila norms as the highest norms and SEMA No. 23 of 2006. 2 of 2003 is a special regulatory regulation for judges so as not to legitimize interfaith marriages, then the path of constitutional review or judicial review is to end this disharmony.

Abstract

This research aims to find out what the kafa'ah concept of sayyid-syarifah marriage is and analyze this concept using Islamic Marriage Law. This research is a type of qualitative research. By using data collection techniques through observation, interviews and documentation. The data analysis techniques used are data reduction, data presentation and data verification. The results of the research show that the concept of kafa'ah applied by sayyid-syarifah in Ternate City is the concept of kafa'ah nasab. The goal is to ensure that their lineage is not interrupted. To achieve the concept of kafa'ah nasab, sayyid-syarifah carry out endogamous marriages, namely marriages carried out with members of the same group to achieve certain goals. Endogamous marriage is permitted in Islam, as long as it is not included in mawani' al-nikah. The conclusion obtained is that the sayyid-syarifah in Ternate City are strongly encouraged to maintain and carry out mutual marriages, especially the syarifah. Because they have a big responsibility for maintaining their lineage, if they marry someone who is not a sayyid then that lineage will be broken.

Abstract

This study aims to analyze the practice of adoptive siblings acting as marriage guardians for adopted children in Akeguraci Village from the perspective of fiqh munakahat. A marriage guardian (wali) is one of the essential pillars of marriage; without a guardian, a marriage is deemed invalid, especially for individuals who have not yet reached the age of accountability (mukallaf). There are two types of marriage guardians: guardians by lineage (wali nasab) and judicial guardians (wali hakim). In Akeguraci Village, there is a case where the marriage guardian did not fulfill the essential requirements for guardianship. The guardian in this marriage was the biological son of the adoptive father. The mistake in the guardianship of the adopted child's marriage, performed by the adoptive sibling, occurred because the biological father refused to act as the guardian. This qualitative research collects field data through observation and interviews to uncover the practice of adoptive siblings acting as marriage guardians in Akeguraci Village. The findings reveal two main points: first, the practice of having the biological son of the adoptive father serve as the marriage guardian occurred because the biological father was unwilling to officiate the marriage, citing the child’s adoption at a young age as the reason. Second, from the perspective of fiqh munakahat, the marriage of an adopted child officiated by an adoptive sibling is invalid, as there is no lineage (nasab) relationship between the adopted child and the adoptive sibling.Al-Jaziri, A. Abstract

This study analyzes the implications of inheritance law related to euthanasia, focusing on legal comparisons in different jurisdictions and perspectives of Islamic law. This study highlights legal loopholes that often arise in cases of euthanasia related to inheritance distribution, especially in the context of the legal system that regulates such actions. Through the approach of analyzing legal literature, sharia maqashid, and jurisdictional comparison, it was found that there was a significant variation in the legal treatment of inheritance claims by individuals involved in euthanasia. In some jurisdictions, such as the Netherlands and Belgium, inheritance claims are still possible with certain conditions, while other jurisdictions, including Indonesia, do not yet have explicit regulations. This study also emphasizes the importance of analyzing aspects of written consent, medical conditions, and moral and ethical principles in deciding inheritance rights. From the perspective of Islamic law, it is found that the principle of preserving the soul (hifz al-nafs) is the basis for rejecting the act of euthanasia. These findings make an important contribution to understanding the relationship between euthanasia and inheritance, as well as offering a legal discourse that supports the development of regulations based on justice, ethics, and human values. This research is a foothold for policymakers to overcome regulatory gaps related to euthanasia in the context of inheritance law.

Abstract

Tradisi Saro Badaka merupakan kebiasaan masyarakat kabupaten Kepulauan Sula yang selalu dilakukan sebelum akad nikah dalam perkawinan. Saro Badaka ini memiliki tahapan yang cukup panjang dan melibatkan kedua orang tua perempuan agar mendampingi calon mempelai untuk melaksanakan adat tersebut. Penelitian ini menggunakan jenis penelitian kualitatif dengan pendekatan `urf. Jenis dan sumber data terdiri dari data primer dan data sekunder yang peneliti peroleh melalui observasi, wawancara dan dokumentasi. Hasil penelitian menunjukan bahwa tradisi Saro Badaka telah hidup di tengah masyarakat secara turun temurun sebagai tradisi yang dikenal baik yang mana juga disebut dengan al-ma’ruf. Dalam tradisi Saro Badaka sendiri dikenal sebagai tradisi positif yang diyakini mendatangkan kemaslahatan berupa kesejahteraan rumah tangga sehingga rumah tangga yang akan ditempuh menjadi harmonis. Maka, tradisi Saro Badaka dalam masyarakat kabupaten Kepulauan Sula jika diamati termasuk kategori `urf Shahih, sehingga tradisi ini diperbolehkan karena praktik Saro Badaka berdasarkan analisis `urf bahwa ia tidak melampaui syariat dari ajaran Islam. Baik dilihat dari segi bentuknya tradisi Saro Badaka termasuk kategori `urf amali, karena tradisi tersebut merupakan kebiasaan masyarakat yang dilakukan berupa perbuatan yang konkrit atau transparan. Sedangkan jika ditinjau dari segi cakupannya, tradisi Saro Badaka termasuk kategori `urf am karena berlaku pada mayoritas masyarakat kabupaten Kepulauan Sula. Untuk itu dalam analisis `urf tradisi Saro Badaka dapat dilaksanakan.

Abstract

This study investigates the effectiveness and institutional dynamics of religious-based mediation practices conducted by the Marriage Advisory, Development, and Preservation Agency (BP4) at the Religious Affairs Office (KUA) in South Morotai, Indonesia, a peripheral region marked by limited legal infrastructure and strong socio-cultural traditions. Using an empirical legal approach supported by interviews, observations, and document analysis, this research assesses BP4's mediation performance in resolving domestic conflicts, particularly between married couples, through the lenses of Soerjono Soekanto's legal effectiveness theory and the normative framework of Maqāṣid al-Sharī‘ah. Findings reveal that although BP4's formal structure has been inactive since 2018, its mediatory functions are still carried out informally by religious leaders and KUA officials. Mediation efforts, grounded in spiritual counseling and community-based norms, have helped reduce emotional tensions and divorce intentions in several cases. However, their effectiveness remains limited due to the absence of institutional protocols, trained mediators, standardized documentation, and post-mediation monitoring systems. This study contributes to the discourse on non-litigation dispute resolution in Muslim-majority societies by highlighting how informal religious authority can substitute and supplement state legal frameworks, particularly in under-resourced regions. It concludes that revitalizing BP4 as a functional mediation institution requires structural and regulatory reform and integrating psychosocial expertise, gender sensitivity, and the maqāṣid-oriented paradigm to ensure a more holistic, equitable, and sustainable family conflict resolution system.

Abstract

This study analyzes the practice of SUSCATIN at KUA in East Tidore, South Tidore, and Tidore Regency. The analysis uses Bimas Decree No. DJ.II/491 of 2009 which has been in effect for a long time. This study is a field study using the CIPP Evaluation Model (Context, Input, Process, and Product) by Daniel Stufflebeam. Data collection was conducted through in-depth interviews with related parties: Head of KUA, Religious Counselors, and SUSCATIN participants. Documentation was obtained from the SUSCATIN activity archives and KUA Internal reports. The results of this study indicate that in terms of contextual evaluation, the SUSCATIN program has not fully met the needs of prospective brides and grooms because it is carried out incidentally, so it does not address the problems of couples who are going to get married. While the input evaluation is expected to provide support for the SUSCATIN system as a strategy, curriculum identification and SUSCATIN instructor education qualifications, but it is unable to accommodate the needs of the participants. In the evaluation process is still conventional, time constraints and monotonous teaching methods and participant participation has not been achieved optimally so that obstacles are not resolved properly. Thus, the evaluation of the SUSCATIN product is expected to increase the knowledge and skills of participants, but this program has not been running optimally and is still limited, which makes it impossible to create a harmonious and happy family.

Abstract

The number of divorce cases filed by wives is increasing. One of the factors considered to be the cause is the Nafkah issue. Accordingly, the discourse on the problem of sustenance as a reason for divorce among classical fiqh scholars and reinterpreting the text to find a solution to the high rate of divorce due to economic and living reasons, without having to leave the classical Islamic scholar’s legal tradition, needs to be studied more deeply. This research aims to provide a solution to prevent divorce caused by family conflicts due to economic factors by reviewing the concept of alimony from the perspective of fiqh. This research is qualitative, using a normative approach to fiqh and interpretation. The results of this study indicated that there was a need for reinterpretation of the views of the majority of scholars regarding the wife’s right to ask for a divorce from the judge if the husband does not provide a living. If the opinion of the fiqh scholars continues to be applied, it will increase the number of divorce cases for economic and livelihood reasons. Moreover, this action received legitimacy from stakeholders through marriage laws and regulations. The interpretation of KH. Husayn Muhammad’s of Q.S. al-Nisa' (4): 34 needs to be used as a reference in updating the law regarding the obligation of a living so that it is hoped that there will be no more divorces carried out for economic and livelihood reasons.

Abstract

Masyarakat Ternate memandang pernikahan sebagai sesuatu yang sangat sakral, religius dan bernilai tinggi, karena pernikahan bukan hanya sekedar ikatan batin dan lahiriah antara seorang pria dan seorang wanita tetapi lebih dari itu. Hal ini terlihat dari beberapa ritual dalam perkawinan yang dilakukan secara turun temurun oleh masyarakat Ternate. Penelitian ini merupakan penelitian kualitatif dengan pendekatan sosiologi hukum yaitu pendekatan yang menganalisis bagaimana reaksi dan interaksi yang terjadi ketika sistem norma bekerja di masyarakat. Lokasi penelitian ini berada di Kelurahan Dufa-Dufa Kecamatan Kota Ternate Utara. Hasil penelitian ini menunjukkan bahwa budaya dalam perkawinan masyarakat Ternate meliputi beberapa ritual antara lain: Sigado salam, Wosa lahi, Bido Se Hana Ma Ija, Fere Wadaka, Rorio/Yaya Segoa, Banikah/Ijab Kabul, Paha Ngoma-Ngoma, Suba Yaya Se Baba, Saro-Saro, Ngogu Adat dan dengan menggunakan beberapa simbol yang dianggap sangat berarti bagi masyarakat. Ritual yang dilakukan selain sebagai permohonan doa dan rasa syukur kepada Tuhan Yang Maha Esa, juga sebagai sarana sosialisasi dan penguatan nilai-nilai budaya yang sudah ada dan diterapkan dalam kehidupan sehari-hari.

Abstract

Polygamy, both in Islamic thought and modern social reality, has always been a controversial topic and remains a subject of interest and debate. Although it has legal and theological foundations, polygamy continues to be contentious, especially when practiced outside the prescribed regulations. This study uses a descriptive qualitative approach to explore in depth the perspectives of Wahdah Islamiyah Ternate cadres on polygamy. The primary data sources include interviews, observations, and documentation. The analysis is conducted through data reduction, presentation, and conclusion drawing. The study finds that, overall, polygamy among Wahdah Islamiyah Ternate cadres is viewed as a permissible option in Islam, with key conditions being justice, financial capability, responsibility, and official registration at the Office of Religious Affairs (KUA). Although some cadres view polygamy as a fundamental ruling, its practice must still be adapted to the social context, individual readiness, and national legal provisions. The majority agree that polygamy should not be practiced secretly (sirri), and when conducted properly, it can serve as a solution to marital problems, rather than merely fulfilling lustful desires. However, some cadres have engaged in unregistered polygamous marriages (sirri) without legal procedures, raising questions about their religious commitment and compliance with state laws. This inconsistency generates negative public perceptions and can tarnish the image of Islamic missionary organizations and Islam in general.   Keywords: Islamic Law, Maslahah (Public Interest), Polygamy, Wahdah Islamiyah Ternate.
