This study purposed to figure out the differences in the regulation of outsourced labor before and after the enactment of Government Regulation Number 35 of 2021. This study applying normative research method that uses positive law as a building norm system. Outsourcing is one type of work that oftenly used by companies to supporting their work load. In the regulations itslef, there are still gap that harm the rights of outsourced workers. Therefore, the government is trying to fix this gap by making a new regulation, namely Government Regulation Number 35 of 2021 Regarding Outsourcing, which is simpler and guarantees the rights of outsourced workers.

The purpose of this study was to determine the legal arrangements for divorce because husbands are mafkud in the compilation of Islamic law (KHI) and Law no. 1 of 1974 concerning Marriage, and the obstacles for judges in deciding divorce because the husband is willing to attend the Selong Religious Court. The research method used is empirical normative legal research. From the results of the study, it was analyzed that the legal arrangement because the husband is mafkud can be seen in the provisions of Article 116 part one and Article 116 letter (g). Islamic Law Compilation. In addition, Article 39 Paragraph 2 of Law Number 1 of 1974 concerning Marriage and Article 19 of Government Regulation Number 9 of 1975 Article 19 of Government Regulation Number 9 of 1975 can be used as the basis for a wife to file for divorce from her mafqud husband. The obstacles for judges in deciding divorce because Mafkud's husband at the Selong Religious Court is divided into two factors, namely internal factors and external factors. The internal factors include factors of law and factors of facilities and infrastructure. Then external factors caused by the parties and descriptions of sanctions that sometimes change.

Pengaturan batas usia minimal perkawinan yang berbeda antara pria dan wanita tidak saja menimbulkan diskriminasi dalam konteks pelaksanaan hak untuk membentuk keluarga sebagaimana dijamin dalam Pasal 28B ayat (1) UUD 1945, melainkan juga telah menimbulkan diskriminasi terhadap pelindungan dan pemenuhan hak anak sebagaimana dijamin dalam Pasal 28B ayat (2) UUD 1945. Dalam hal ini, ketika usia minimal perkawinan bagi wanita lebih rendah dibandingkan pria, maka secara hukum wanita dapat lebih cepat untuk membentuk keluarga. Oleh karena hal tersebut, dalam amar putusannya Mahkamah Konstitusi memerintahkan kepada pembentuk undang-undang untuk dalam jangka waktu paling lama 3 (tiga) tahun melakukan perubahan terhadap Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan. Terbitnya Undang-undang No 16 tahun 2019 tentang perubahan UU No1 tahun 1974 tentang Perkawinan, merupakan Perubahan norma dalam hal perkawinan khususnyan batas usia untuk melakukan perkawinan dan sekaligus perbaikan norma dengan menaikkan batas minimal umur perkawinan bagi wanita. Hal ini belum banyak diketahui masyarakat luas, oleh karena itu pengabdian yang kami lakukan di desa Malaka kabupaten Lombok Utara, kami melakukan sosialisasi mengenai perubahan ketentuan perkawinan yang dilakukan menurut hukum nasional. Dalam hal ini batas minimal umur perkawinan bagi wanita dipersamakan dengan batas minimal umur perkawinan bagi pria, yaitu 19 (sembilan belas) tahun. Batas usia dimaksud dinilai telah matang jiwa raganya untuk dapat melangsungkan perkawinan agar dapat mewujudkan tujuan perkawinan secara baik tanpa berakhir pada perceraian dan mendapat keturunan yang sehat dan berkualitas.

Penelitian ini bertujuan untuk mengetahui pelaksanaan perjanjian jasa konsultan perencana dalam pembangunan konstruksi/gedung berdasarkan UUJK, dan tanggung jawab konsultan perencana apabila terlambat dalam penyelesaian perencanaan pembangunan gedung. Jenis penelitian yang digunakan adalah penelitiam hukum empiris-normatif dengan pendekatan undang-undang, pendekatan kasus, pendekatan konseptual, dan pendekatan sosiologis. Hasil penelitian, pelaksanaan perjanjian jasa konsultan perencana dalam pembangunan konstruksi/gedung harus memenuhi persyaratan sesuai dengan Pasal 47 Ayat (1) UUJK. Bentuk tanggung jawab dari pihak konsultan perencana apabila terlambat dalam penyelesaian perencanaan pembangunan gedung akan dikenakan denda sebesar 1/1000 (satu per seribu) dari nilai kontrak untuk setiap hari keterlambatan.

The purpose of this study is to find out the implementation and obstacles of the sale and purchase agreement of building materials between PT Bale Citra Lestari (Depo Jaya Bangunan) and the contractor providing building materials. The type of his research is normative-empirical legal research. The results indicated that PT Bale Citra Lestari (Depo Jaya Bangunan) and the contractor conducted (made) a written non-standard sale and purchase agreement for building materials based on the trust of the parties and only had a note or invoice as proof of payment. The contractor bought some building materials using a term payment system, but until now the contractor has not paid the remaining terms due to several obstacles outside the agreement that has been contracted, so the contractor is in default.

This study aims to explain the legal settlement of bad loans due to the Covid-19 pandemic from the perspective of Indonesian civil law and efforts can be made by PT Finansia Multi Finance (Kredit plus) due to defaults. This research uses a type of normative research that uses a statutory approach and a conceptual approach. The results of the study determined that there are two ways of resolving disputes concerning bad loans, namely litigation, and non-litigation. If these methods cannot achieve a win-win solution or a solution that takes into account both parties, the judge must make a verdict to decide the winning party and the losing party. Dispute settlement has had a strong legal basis since the issuance of Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution.

This research’ aim was to analyses judge’s consideration on marital dispensation as accommodated in the Determination Number 1234/Pdt.P/2020/PA.Pra viewed from the perspective of Law Number 16 of 2019 on the Amendment of Law Number 1 of 1974 on Marriage and to analyze what is the “urgent reason” in the determination. This research applied normative juridical approach. Result of the study shows that in principle judge’s consideration if the child applicant was not married will cause negative impact in the future. This urgent reason as judge’s consideration are: readiness to settle down, have established long-standing relationships, and have the ability to do so.

The purpose of the research is to find out the NTB Regional Regulation Number 5 of 2011 implementation in society, especially regarding minor marriage in the Bima Regency. This study uses the empirical legal research method. The approach method uses the statute approach, the conceptual approach, and the sociological approach. However, the factors that affected minor marriage consist of: parents, promiscuity, customs, education, and economy. The result of this study showed the implementation of NTB Regional Regulation Number 5 of 2021 in the prevention of minor marriage in Bima Regency and the factor that affected minor marriage prevention in Bima Regency. The local government and KUA work together with the district government and village government, they socialized the negative effect of minor marriage.

This study aims to find out the implementation of the security guard service provider agreement at PT. Bank Danamon Indonesia and PT. Bravo Satria Perkasa and to find out the obstacles encountered in implementing the security service provider agreement at PT. Bank Danamon Indonesia and PT. Bravo Satria Perkasa. The method used is an empirical normative legal research method. The results of the study can be concluded that (1) The implementation and legal protection for contract workers at PT Bravo Satria Perkasa are in accordance with the PKWT Work Agreement and the Labor Law (2) Obstacles that arise in the implementation of work agreements for a certain time at PT Bravo Satria Perkasa in the form of contract changes every 5 years for workers (security guards) so that PT Danamon Indonesia needs to conduct training or retraining for new workers (security guards) related to knowledge about banking and with the replacement of new security guards they cannot adjust to work rhythms, therefore need to be given periodic explanations in order to meet the disciplinary standards set by Bank Danamon.

Penelitian ini bertujuan untuk membahas Pengaturan Penggunaan Tenaga Kerja Asing (TKA) di Kawasan Ekonomi Khusus Mandalika. Dengan ditetapkannya Kawasan Mandalika sebagai Kawasan Ekonomi Khusus (KEK) berdasarkan PP. Nomor 52 Tahun 2014, pariwisata menjadi sector unggulan pengembangan dan pembangunan Kawasan ini dengan perspektif distinasi wisata berdaya saing internasional. Dalam konteks ketenagakerjaan KEK Mandalika telah memiliki payung hukum pelaksanaan pengaturan di bidang penggunaan tenagakerja, khusus pada penggunaan Tenaga Kerja Asing, KEK Mandalika memiliki ketentuan dan peraturan baik yang dikeluarkan dari pusat dalam bentuk undang-undang, Peraturan Pemerintah, Peraturan Kementerian maupun regulasi yang di terbitkan di pemerintah daerah (Peaturan Daerah, Peraturan Gubernur dan Peraturan Bupati). Metode yang digunakan untuk membuat penelitian ini adalah penelitian hukum normatif. Kawasan Ekonomi Khusus (KEK) Mandalika tidak banyak diisi oleh tenaga kerja asing untuk menempati jenis-jenis pekerjaan yang tersedia karena jenis pekerjaan yang ada telah dapat di kerjakan oleh tenaga kerja Indonesia sehinnga dengan datangnya atau penggunaan TKA di Kawasan Mandalika perlindungan dan kepastian hukum tenaga kerja nasional masih berjalan dengan baik. Selain itu Peningkatan Pembinaan Perlindungan, pengawasan pelaksanaan regulasi ketenagakerjaan yang dilakukan pemerintah Daerah melalui Disnakertrans Lombok tengah terhadap perusahaan-perusahaan yang beroperasi di Kawasan KEK sudah cukup baik walaupun masih terdapat kendala dalam pelaksanaan pengawasan yang dilakukan.
