Abstract

According to article 12 letter a of the Notary Law, notaries can be dishonorably dismissedbecause they have been declared bankrupt based on a court decision that has permanent legal force. This dishonorable dismissed is a treatment that is not in accordance with the concept of bankruptcy because the bankruptcy law itself regulates legal remedies to protect the interests of creditors as regulated in article 24 paragraph 1 of the Law on Bankruptcy. So there is a conflict between the two laws regarding the relevance of dismissal of a notary. This journal discusses whether the provisions in article 12 letter a of the Law of Notary do not conflict with Law on bankruptcy relating to the dismissal of a notary person who has been declared bankrupt by the Minister and. The purpose of this journal is to find out whether the provisions in article 12 letter a of the Law on Notary Position are not in conflict with Law on bankruptcy related to whether the notary can be dismissed from his position if he has been declared bankrupt by the court and the decision has permanent legal force. This journal uses the theory of legal certainty and theory of justice. This journal is a normative juridical study using a Legislative and Conceptual Approach. The result of the writing of this journal is that there is an inconsistency between the Law of Notary and Law ong Bankruptcy because the purpose and spirit of the law are different and dismissal of a notary from his position is irrelevant when viewed from the theory of justice and legal certainty..

Abstract

Marriage aims to form a happy, eternal, and conscious family without pressure. From a marital relationship, rights and obligations, including property, are regulated in the marriage law. For certain couples, marital property needs to be separated and a special agreement is made that regulates the separation of assets and obligations of both partners. In the case that it was found that there was a couple who made a separation agreement made after the marriage took place, there is a fact that the agreement was requested to be canceled for various reasons from the plaintiff. With these facts, the purpose of this study is to examine the legal aspects of the cancellation of the marriage agreement made after the marriage took place. This research method used a normative juridical method with a conceptual approach and legislation. The conclusion of this study is that marriage is a form of relationship between a man and a woman with the aim of forming a family, that it is undeniable that marriages are carried out between Indonesian citizens and foreigners and this is that there are legal differences that apply to men and women in mixed marriages because of differences in nationality. . In mixed marriages, there will be things regarding property that are different from marriages between Indonesian citizens and Indonesian citizens. The marriage agreement made by the couple before the marriage can be in the form of an authentic deed made before a notary as a public official, if the marriage agreement is made after the marriage it will result in null and void.

Abstract

 UU RS tidak secara khusus mengatur tentang peralihan hak milik atas satuan rumah susun. Dalam Pasal 43 UU RS memang disebutkan adanya proses jual beli yang sebelum pembangunan rumah susun dibangun,sedangkan Pasal 44 mengatur mengenai proses jual beli satuan rumah susun yang dilakukan setelah rumah susun selesai dibangun. Keadaan yang bersifat parsial inilah sesekali dapat menimbulkan sengketa, karena pemegang hak milik atas rumah susun tidak seluruhnya memahami mekanisme peralihan hak atas satuan rumah susun. Metode Penulisan ini didasarkan pada penelitian hukum yuridis normatif, yaitu penelitian yang dilakukan untuk mengkaji/ menganalisa peraturan perundang-undangan yang berlaku dan sifatnya yang normatif. Pendekatan masalah yang dipergunakan dalam penyusunan penelitian ini adalah pendekatan undang-undang (statute approach) dan pendekatan konseptual (conceptual approach). Hasil pembahasan ini adalah Sebagai suatu hak milik, maka hak atas satuan rumah susun dapat diperalihkan kepada pihak lain melalui jual beli, tukar menukar atau perbuatan hukum lain yang berupa peralihan hak dan bentuk penyelesaian sengketa kepemilikan satuan rumah susun dapat dilakukan jalur non litigasi yaitu penyelesaian sengketa diluar pengadilan, dan dapat dilakukan melalui pengadilan.Kata-Kunci: Rumah Susu, Peralihan Hak, Jual Beli, Pengadilan. The Hospital Law does not specifically regulate the transfer of ownership rights to flat units. In Article 43 of the Hospital Law, it is stated that there is a buying and selling process before the construction of flats is built, while Article 44 regulates the process of buying and selling flat units which are carried out after the flats are completed. This partial situation can occasionally lead to disputes, because the holders of property rights to flats do not fully understand the mechanism for transferring rights to flats. This writing method is based on normative juridical legal research, namely research conducted to examine/analyze the prevailing laws and regulations and their normative nature. The problem approach used in the preparation of this research is the legal approach (statute approach) and the conceptual approach (conceptual approach). The results of this discussion are as a property right, the right to the apartment unit can be transferred to another party through buying and selling, exchanging or other legal actions in the form of transfer of rights and the form of dispute resolution of the ownership of the apartment unit can be carried out through non-litigation channels, namely dispute resolution. outside the court, and can be done through the court.Keywords: Dairy House, Transfer of Rights, Sale and Purchase, Court.

Abstract

Implementation of uterine rental agreement or surrogate mother is an agreement between a woman who binds herself through an agreement with another party (husband and wife) to become pregnant with the result of the fertilization of the husband and wife which is implanted into her womb, and after giving birth is required to hand over the baby to the husband and wife based on agreement made. The research method used is normative legal research, namely legal research conducted by researching library materials or secondary legal materials, while the problem approach is carried out using a legal approach and a conceptual approach. The results of the study indicate that the mother surrogate does not fulfill one of the conditions of the agreement. Then the Notary Deed is declared null and void if the deed does not meet the objective elements of the deed, namely a lawful cause. In such a case, legally without any request from the parties, thus the agreement is considered to have never existed and is not binding on anyone.

Abstract

Pengaturan mengenai penanaman modal di Indonesia terbagi atas penanaman modal dalam negeri dan penanaman modal asing. Pada Perseroan Terbatas yang termasuk jenis Perseroan Terbatas Penanaman Modal Dalam Negeri  mengharuskan 100%  modal yang umumnya dirupakan saham dalam perseroan dimiliki oleh Warga Negara Indonesia. Saham Perseroan Terbatas merupakan benda bergerak yang dapat menjadi obyek waris dan beralih kepada ahli waris yang berkewarganegaraan asing. Penelitian ini ingin menelaah dan menganalisa lebih lanjut apakah ahli waris Warga Negara Asing berhak atas warisan berupa saham Perseroan Terbatas Penanaman Modal Dalam Negeri serta bagaimana kedudukan Perseroan Terbatas Penanaman Modal Dalam Negeri setelah terjadi peralihan saham karena pewarisan kepada Warga Negara Asing. Metode penelitian yang digunakan adalah penelitian hukum normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau bahan hukum sekunder sedangkan pendekatan masalah dilakukan dengan menggunakan pendekatan undang-undang dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa kewarganegaraan seseorang tidak menghalangi hak untuk menjadi ahli waris. Atas warisan berupa saham dalam perseroan terbatas penanaman modal dalam negeri maka ahli waris berkewarganegaraan asing harus diberikan waktu tertentu untuk mengalihkan saham tersebut kepada warga negara Indonesia atau mengubah kewarganegaraannya menjadi warga negara Indonesia. Perseroan Terbatas Penanaman Modal Dalam Negeri yang sahamnya beralih kepada Warga Negara Asing harus mengubah status perusahaannya menjadi penanaman modal asing.

Abstract

Article 4 7(1) of Law No 23 of 2006 on the Administration of the Population (Adminduk) provides that the adoption of children is a legal act to transfer the rights of the child from the families of parents, legal guardians and others responsible for the care, education and bringing of children into the families of their adoptive parents by decision of the Court Basing this child acceptance on the concept or limitation of child adoption is a legal act with certain law-controlled goals and aims and inevitable legal consequences, such as the bodily and psychological responsibility of the child he or she accepts. Kid Recognition is a father's recognition of his kid born from lawful marriage with the agreement of the biological mother of the child. Kid acknowledgment is meant to provide the child a biological father/father, as well as legal civil ties. The provisions mentioned in the Elucidation of Article 49(1) of the Adminduk Law are acknowledgments that can only be made by the father/father, in this case there is no mother's acknowledgement; in other words, it is not automatically necessary to prove that the child was not born by the mother concerned. Elucidating Article 50(1) of the Child Legalization Administration Law is the ratification of the status of a child born outside the legal marital bond while registering the marriage of the child's two parents. Article 50(1) of the Administrative Law requires parents to notify the child's ratification to the Implementing Agency no later than 30 (thirty) days after the child's father and mother marry and acquire a marriage certificate. Child Recognition or Child Ratification can be performed for children born outside formal marriage. If the child's acknowledgement is restricted to a disclosure from his biological father, accepted by his birth mother, without being followed by the parents' marriage, yet in the Child Legalization, the child's mother and father are married. When documenting the wedding, the youngster is recognized as their biological kid. And this kid's ratification is a legal endeavor (rechtsmiddel) to offer a position as a legitimate kid through marriage by his parents.

Abstract

In the stages of transplanting human organs from prospective donors to recipients, they must first fulfill the provisions contained in Article 24 Paragraph (1) letter d and Article 32 of the Regulation of the Minister of Health of the Republic of Indonesia Number 38 of 2016 concerning Organ Transplantation Regarding Approval for Human Organ Transplantation, namely there is a written statement with a notary deed. That in the transplant there is no indication of buying and selling or any other special agreement. The sentence (phrase) in the article is "a form of notary certificate or a written statement legalized by a notary public". Sentences (phrases) in the article need to be understood and interpreted by referring to the Notary Position Law (UUJN), in this case whether in the form of a Notary deed or legalized underhand deed (Legalization) or a book (Waarmerking).

Abstract

Untuk mengatasi kesulitan di mana kebutuhan dana dapat dipenuhi tanpa kehilangan barang-barang berharga, maka masyarakat dapat menjaminkan barang-barangnya ke lembaga tertentu. Barang yang dijaminkan tersebut pada waktu tertentu dapat ditebus kembali setelah masyarakat melunasi pinjamannya. Kegiatan meminjamkan barang-barang berharga untuk memperoleh sejumlah uang dan dapat ditebus kembali setelah jangka waktu tertentu tersebut disebut dengan nama usaha gadai. Tujuan utama usaha pegadaian adalah untuk mengatasi agar masyarakat yang sedang membutuhkan uang tidak jatuh ke tangan para pelepas uang atau tukang ijon atau tukang rentenir yang bunganya relatif tinggi. Tipe penelitian yang dipergunakan dalam penelitian ini adalah penelitian hukum normatif yang beranjak pada hakikat keilmuan hukum.1 Dalam penelitian ini digunakan pendekatan perundang-undangan (statute approach), dan pendekatan konseptual (conceptual approach). Bahwa perjanjian gadai sebagai perjanjian tambahan keberadaannya ditujukan untuk mendukung perjanjian pokok, yakni perjanjian utang piutang, sehingga manakala pemberi gadai/debitor wanprestasi terhadap penerima gadai/kreditornya, maka berdasarkan parate executie yang dimiliki oleh penerima gadai, penerima gadai berhak melelang objek gadai. Perlindungan hukum bagi pemilik objek gadai yang sesungguhnya atas pelelangan objek gadai diberikan oleh hukum yakni, apabila terbukti bahwa pihak penerima gadai menerima gadainya secara beritikad tidak baik, maka pihak penerima gadai wajib mengembalikan barang yang digadaikan kepada pemilik yang sesungguhnya.Kata Kunci : Pegadaian, Lelang

Abstract

Minuta Notary deed is a very important state document, so in its storage notary is obliged to maintain and maintain it properly, stipulated in UUJN Article 1 number 13. The storage of documents minuta notary deed using electronic media has not been regulated in UUJN, but in Article 6 of the ITE Law considers the validity of an electronic document, although the proof according to Article 1866 KUHPer and Article 184 kuhap does not explain the existence of electronic evidence, which is a notary deed is an authentic deed in accordance with UUJN Article 1 number 1. The transition of notary protocols from conventional (paper documents) to electronic documents to protection for notary deeds that are prone to damage due to natural disasters, fires and termites. Electronic storage also avoids excess storage space, the protection of electronic documents has been protected by the ITE Law Article 32 Paragraph (1) and (2) although it has not been regulated directly by UUJN as a notary guideline in the manufacture and storage of minuta deeds as a Notary protocol, this makes it possible for Notaries to have special containers to store minuta deeds as electronic documents. Abstract

This study aims to find out the problems and challenges of determining the honorarium of a notary in making a deed and the solution. This research is normative juridical research using statutory, conceptual, and case approaches. Legal materials were collected through literature study and analyzed using qualitative analysis. The results of this study indicate that there are problems in determining the honorarium for making deeds, namely 1) notaries are faced with a choice between following the organizational provisions of the Indonesian Notary Association or participating in market competition; 2) there are several notaries who end up being dragged into bargaining over the cost of making a deed which has actually been stipulated by the notary professional organization because they are more indulging their egos to get a large number of clients without considering the notary's dignity as a public official; and 3) it is necessary to stipulate rules on the minimum honorarium for Notaries, so that an equal honorarium will be formed between one Notary and another.
