Untuk mengatasi kesulitan di mana kebutuhan dana dapat dipenuhi tanpa kehilangan barang-barang berharga, maka masyarakat dapat menjaminkan barang-barangnya ke lembaga tertentu. Barang yang dijaminkan tersebut pada waktu tertentu dapat ditebus kembali setelah masyarakat melunasi pinjamannya. Kegiatan meminjamkan barang-barang berharga untuk memperoleh sejumlah uang dan dapat ditebus kembali setelah jangka waktu tertentu tersebut disebut dengan nama usaha gadai. Tujuan utama usaha pegadaian adalah untuk mengatasi agar masyarakat yang sedang membutuhkan uang tidak jatuh ke tangan para pelepas uang atau tukang ijon atau tukang rentenir yang bunganya relatif tinggi. Tipe penelitian yang dipergunakan dalam penelitian ini adalah penelitian hukum normatif yang beranjak pada hakikat keilmuan hukum.1 Dalam penelitian ini digunakan pendekatan perundang-undangan (statute approach), dan pendekatan konseptual (conceptual approach). Bahwa perjanjian gadai sebagai perjanjian tambahan keberadaannya ditujukan untuk mendukung perjanjian pokok, yakni perjanjian utang piutang, sehingga manakala pemberi gadai/debitor wanprestasi terhadap penerima gadai/kreditornya, maka berdasarkan parate executie yang dimiliki oleh penerima gadai, penerima gadai berhak melelang objek gadai. Perlindungan hukum bagi pemilik objek gadai yang sesungguhnya atas pelelangan objek gadai diberikan oleh hukum yakni, apabila terbukti bahwa pihak penerima gadai menerima gadainya secara beritikad tidak baik, maka pihak penerima gadai wajib mengembalikan barang yang digadaikan kepada pemilik yang sesungguhnya.Kata Kunci : Pegadaian, Lelang

Minuta Notary deed is a very important state document, so in its storage notary is obliged to maintain and maintain it properly, stipulated in UUJN Article 1 number 13. The storage of documents minuta notary deed using electronic media has not been regulated in UUJN, but in Article 6 of the ITE Law considers the validity of an electronic document, although the proof according to Article 1866 KUHPer and Article 184 kuhap does not explain the existence of electronic evidence, which is a notary deed is an authentic deed in accordance with UUJN Article 1 number 1. The transition of notary protocols from conventional (paper documents) to electronic documents to protection for notary deeds that are prone to damage due to natural disasters, fires and termites. Electronic storage also avoids excess storage space, the protection of electronic documents has been protected by the ITE Law Article 32 Paragraph (1) and (2) although it has not been regulated directly by UUJN as a notary guideline in the manufacture and storage of minuta deeds as a Notary protocol, this makes it possible for Notaries to have special containers to store minuta deeds as electronic documents. This study aims to find out the problems and challenges of determining the honorarium of a notary in making a deed and the solution. This research is normative juridical research using statutory, conceptual, and case approaches. Legal materials were collected through literature study and analyzed using qualitative analysis. The results of this study indicate that there are problems in determining the honorarium for making deeds, namely 1) notaries are faced with a choice between following the organizational provisions of the Indonesian Notary Association or participating in market competition; 2) there are several notaries who end up being dragged into bargaining over the cost of making a deed which has actually been stipulated by the notary professional organization because they are more indulging their egos to get a large number of clients without considering the notary's dignity as a public official; and 3) it is necessary to stipulate rules on the minimum honorarium for Notaries, so that an equal honorarium will be formed between one Notary and another.

This study aims to determine the principles of accountability owned by PT Balai Lelang Serasi. This study uses a normative juridical approach. The data collection technique used is documentation technique (literature study and scientific journal articles). The data analysis technique used is descriptive and critical analysis. The results of this study indicate that the principle of accountability owned by PT Balai Lelang Serasi can be seen from the provision of access to prospective bidders to check the physical condition and completeness of the auction object documents at the open house stage; obliges the prospective bidder to pay a security deposit which will later be returned to the bidder in accordance with what is stated on the registration form (auction participants must deposit a security deposit of Rp 5,000,000 (five million rupiah)/car and auction list as proof of commitment that the prospective bidder guarantees that he or she is willing to participate in the auction); and the auction winner is fully responsible for what he bids, and he wins.

In the implementation of maintaining and protecting the rights of citizens and providing clear legal certainty regarding the registration of a plot of land in order to legalize ownership of land parcels and individual rights in control over land on the basis of PP no. 24 of 1997 concerning Land Registration. PPAT is a public official who is authorized to make a deed of transfer of land rights, deed of assignment of land rights, and deed of power of attorney to impose Mortgage Rights. With this authority, PPAT can take other people's rights by making land deeds for the issuance of other certificates on land owned by other people, so there will be multiple certificates on the same piece of land. In his behavior that violates and abuses his authority and obligations as PPAT, the legal impact of dishonorable dismissal or criminal threats needs to be carried out in order to protect the rights of land owners from crimes committed by PPAT that can harm other parties.

Mafia pertanahan masih tumbuh subur seiring dengan tingginya kebutuhan masyarakat akan ketersediaan lahan pertanahan. Dari sejumlah kasus sengketa tanah yang terjadi, baik di kota besar maupun daerah, diduga kuat selalu melibatkan mafia tanah. Selain itu, permasalahan lain yakni adanya oknum-oknum aparat desa terutama lurah yang mengetahui betul status tanah di lingkungannya yang kemudian tergoda dengan bujuk rayu mafia tanah untuk menerbitkan girik atau perfonding palsu dengan dilengkapi surat-surat pendukung lainnya seperti dari RT/RW sampai ke tingkat kecamatan. Metode penelitian menggunakan metode yuridis normatif. Pendekatan yang digunakan dalam penelitian ini adalah dilakukan dengan metode analisis deskriptif analitis tentang penyelesaian sengketa tanah berkaitan dengan sertifikat ganda yang timbul akibat tindak pidana mafia tanah. Teknik pengumpulan bahan hukum dilakukan melalui studi kepustakaan dan analisis bahan-bahan kepustakaan, serta studi penelusuran bahan-bahan internet meliputi artikel-artikel dan jurnal ilmiah yang berkaitan dengan penelitian ini. Setelah ke semua bahan hukum terkumpul, selanjutnya dianalisis dengan teknik deskriptif analitis dan kritis terhadap objek pembahasan yaitu penyelesaian sengketa tanah berkaitan dengan sertifikat ganda yang timbul akibat tindak pidana mafia tanah. Dalam upaya memberantas sertipikat ganda dari praktik mafia tanah, Kementerian ATR/BPN membuat aturan tertulis yaitu Petunjuk Teknis Pencegahan Pemberantasan Mafia Tanah Nomor: 01/JUKNIS/D.VII/2018. Selain itu, Kementerian ATR/BPN juga membentuk Tim Satgas Mafia Tanah dalam rangka memberantas praktik mafia tanah yang berpotensi menimbulkan sertipikat ganda yang didasarkan pada itikad tidak baik.

Perkembangan dunia teknologi dewasa ini semakin berkembang dengan sangat pesat dimana berimbas kepada perkembangan roda kehidupan maupun dunia usaha. Tanpa disadari semua lini kehidupan tidak bisa dijauhkan dari adanya perangkat teknologi atau masyarakat sering menyebut semuanya serba online. Seiring dengan perkembangan teknologi yang diiringi dengan semakin tingginya mobilitas masyarakat, maka transportasi online hadir untuk memberikan kemudahan bagi masyarakat dalam menunjang aktivitas dan mobilitasnya sehari-hari. Penelitian ditujukan untuk menganalisis dan mendeskripsikan hal yang melatarbelakangi adanya perjanjian kemitraan pada transportasi online dan perlindungan hukum terhadap pengemudi ojek online. Penelitian ini menggunakan metode Yuridis Normatif yang berarti pendekatan yang dilakukan berdasarkan bahan hukum utama dengan cara menelaah teori-teori, konsep-konsep, asas-asas hukum serta peraturan perundang-undangan yang berhubungan dengan penelitian ini. Adapun sumber data yang digunakan adalah pengamatan melalui telaah berbagai peraturan perundang-undangan. Berdasarkan analisa yang dilakukan, diperoleh kesimpulan bahwa pelaksanaan perjanjian kemitraan yang mengandung klausula baku pada transportasi online dilihat dari sudut pandang pengemudi atau calon pengemudi ojek online dimana ketika calon pengemudi tersebut keberatan dengan salah satu syarat, maka perjanjian tersebut tidak terlaksana atau dapat dikatakan bahwa para pengemudi ini dengan terpaksa menerima klausula tersebut serta perlindungan hukum terhadap pengemudi ojek online sebagai mitra dari penyedia aplikasi masih kurang optimal, karena dalam perjanjian antara penyedia aplikasi dengan pengemudi hanya memuat hak-hak yang wajib dimiliki penyedia aplikasi dan belum mengatur mengenai kewajiban-kewajiban pihak perusahaan penyedia aplikasi

Creditors, as mortgage holders, are also entitled to the preeminent status of security in accordance with Droit de Preference as stated in the last sentence of Article 1 number 1 of Mortgage Law (UUHT), which gives priority to certain creditors over others. This mortgage characteristic is also mentioned in the last sentence of Article 20 paragraph (1) letter b, which stated that mortgage holders have privilege rights over other creditors. However, this status is disintegrated, assuming the debtors are involved in a corruption offense because their property becomes confiscated by court order despite being guaranteed to the creditor. Therefore, this condition fails to prioritize the Droit de Preference of the creditors with the implementation of the confiscation state, which needs to take precedence. In Article 19 paragraphs (2) and (3) of Law No. 31 regarding Eradication of Criminal Acts and Corruption, the legal remedy provided for creditors is only by submitting an Objection Letter to the court that imposed the confiscation without suspending the court's ruling. Such regulations tend to injure the goodwill creditors as well as abolish Droit the preference ability to provide legal protection and certainty toward creditors’ rights.

This increasingly rapid development of technology and information affects the acceleration in every field in the rotation of the activities of the wider community. But not only has a positive impact, but also has a negative impact. For example in the case of prostitution that is carried out online. In the news TribunJabar.Id reported the involvement of minors in online prostitution as operators and pimps. The emergence of legal problems related to the position of children involved in online prostitution cases as pimps is the background of this research with the aim of knowing the legal impact of online prostitution crimes committed by minors. The research will use a normative method with a statutory and bibliographical approach. It was concluded that the sanctions that can be imposed on minors who are involved in online prostitution are by taking action in accordance with Law number 11 of 2012 if they are under 15 years old, and a maximum of ½ (half) of the maximum criminal penalty if they are over 15 years old.

This study aims to find out whether the results of mediation can be accepted as a settlement step and what are the legal consequences of the results of this mediation. The research method used is empirical juridical, namely by comparing legal facts with the theoretical basis of law and applicable legislation. Based on the results of the research, the following results were obtained: 1) As a mediator function, based on Permenag Number 11 of 2016 concerning Settlement of Land Cases, ATR/BPN can resolve land ownership disputes through mediation, only for disputes that do not involve ministries, the results of mediation are taken from dispute resolution can be considered final and binding, and to have legal force, a peace deed is better madein front notary official and afterwards the deed is registered with the District Court; and 2) the legal consequences of the mediation results that have been registered with the District Court are the legal basis for the Head of the local ATR/BPN Office to change or repair the disputed land certificate as an effort to provide protection and legal certainty.
