Abstract

Pengabdian masyarakat ini bertujuan untuk meningkatkan akses keadilan bagi warga Desa Pasiran, Kecamatan Sei Dadap, Kabupaten Asahan, melalui penyediaan layanan bantuan hukum dan edukasi hukum yang berbasis partisipatif. Rendahnya pemahaman masyarakat terhadap hak-hak hukum serta terbatasnya akses terhadap lembaga bantuan hukum menjadi tantangan serius dalam penyelesaian permasalahan hukum di tingkat desa. Kegiatan ini dilakukan melalui penyuluhan hukum, konsultasi hukum gratis, dan pembentukan forum pengaduan masyarakat. Metode yang digunakan adalah pendekatan edukatif dan advokatif dengan melibatkan unsur perangkat desa, tokoh masyarakat, dan mahasiswa hukum. Hasil kegiatan menunjukkan peningkatan pemahaman masyarakat terhadap isu-isu hukum seperti Sengketa tanah, permasahan izin pertambangan galian C dan lainnya. Selain itu, masyarakat mulai menunjukkan keberanian untuk menyampaikan pengaduan dan berkonsultasi tentang permasalahan hukum yang dihadapi. Kegiatan ini diharapkan menjadi model replikasi dalam meningkatkan kesadaran dan akses hukum di wilayah pedesaan lainnya.

Abstract

Perlindungan hukum yang di berikan bagi konsumen tidak dapat di jalankan dengan sempurna apabila hanya di ajukan ke BPSK tetap dapat dibatalkan melalui pengadilan negeri. Penyelesaian melalui jalur non litigasi dilakukan oleh Badan Penyelesaian Sengketa Konsumen (BPSK) dengan cara Mediasi, Konsiliasi, dan Arbitrase. BPSK tidak dapat berperan aktif dalam penyelesaian sengketa konsumen, hal ini disebabkan substansi pengaturan, prosedur dan mekanisme penyelesaian sengketa banyak mengandung kelemahan dan saling bertentangan sehingga BPSK tidak dapat berperan banyak dalam penyelesaian sengketa konsumen, terutama yang menyangkut keberatan mengenai putusan konsiliasi atau mediasi, serta penetapan eksekusi sama sekali belum ada pengaturannya. Permasalahan yang diangkat dalam tulisan ini adalah Bagaimana penerapan hukum terhadap perlindungan konsumen atas kewenangan Badan Penyelesaian Sengketa Konsumen (BPSK) dan Pengadilan Negeri terhadap Putusan BPSK Nomor: 038/Arbitrase/2023 / BPSK. Mdn Jo. Putusan Pengadilan Negeri Medan Nomor : 727/ Pdt.Sus-BPSK/2023 Pn. Mdn. Jo. Putusan Kasasi No. 275 K/Pdt.Sus-Bpsk/2024?.Metode penelitian yang digunakan dalam penelitian ini adalah penelitian yuridis normatif. Penelitian hukum normatif merupakan  terdapat data sekunder. Sifat penelitian ini adalah deskritif analisis. Teknik pengumpulan data penelitian ini dilakukan dengan metode penelitian kepustakaan (library research). Hasil penelitian menunjukkan bahwa penerapan hukum yang dilakukan terhadap pengaturan mengenai BPSK dapat dikatakan masih kurang, sehingga mengakibatkan kurang efektifnya peranan BPSK di dalam menyelesaikan sengketa konsumen di Indonesia.

Abstract

Tulisan ini menganalisis Putusan Praperadilan No. 22/Pid.Pra/2025/PN Mdn terkait dengan dugaan tindak pidana pemalsuan surat dan pemalsuan akta autentik yang terjadi di Kota Medan. Permohonan praperadilan ini diajukan untuk menguji keabsahan penetapan tersangka oleh penyidik terhadap pemohon. Penelitian menggunakan metode yuridis-normatif dengan pendekatan kasus. Hasil analisis menunjukkan bahwa dalam perkara ini, hakim menilai penetapan tersangka tidak memenuhi standar minimal pembuktian awal sebagaimana disyaratkan dalam putusan Mahkamah Konstitusi No. 21/PUU-XII/2014. Putusan ini menegaskan kembali pentingnya prinsip due process of law dan perlindungan hak-hak tersangka dalam proses peradilan pidana

Abstract

Money laundering with Cryptocurrency in Indonesia in the use of digital currencies provides a loophole for criminals to hide the results of criminal acts through money laundering practices. This article reviews various strategies used in money laundering using crypto assets, with the aim of providing a deeper understanding of this issue. This research applies the normative study method by analyzing legal aspects based on literature as well as the latest developments related to money laundering and cryptocurrencies. Money laundering through crypto assets is carried out in order to disguise the source of illegal funds. Some of the commonly used methods include transactions over the dark network as well as the use of unlicensed mixing services. This crime has been regulated in various laws and regulations that aim to prevent and eradicate the practice of money laundering through cryptocurrencies.

Abstract

This study discusses legal aspects, forms of sanctions, as well as efforts to recover and prevent violations in mining activities of non-metallic minerals and rocks (MBLB) in North Sumatra province. Based On The North Sumatra Regional Regulation No. 2 year 2013, businesses must have a license to carry out mining activities to ensure sustainable governance. Non-compliance with this regulation resulted in negative impacts including environmental damage, social conflicts, and loss of local revenue potential. In law enforcement, the sanctions applied include criminal penalties in the form of imprisonment and fines, along with the obligation to restore the environment by business actors. Enforcement proceedings also involve investigation, seizure of evidence, as well as supervision of the execution of court decisions.The research method used is normative juridical approach with qualitative analysis.The results showed that the success of mine governance depends on the synergy between adaptive regulation, consistent law enforcement, and active participation of all stakeholders. The use of modern technology and regular regulatory evaluation are also key to improving the effectiveness of surveillance and Prevention of violations. With an integrated approach, the mining sector of non-metallic minerals and rocks is expected to provide sustainable economic benefits without compromising environmental sustainability and community welfare. This study recommends strengthening the capacity of law enforcement officials, increasing transparency, and regulatory education to business actors as strategic steps to prevent violations in the future.

Abstract

Forced defense (noodweer) is one of the justifications in criminal law that can eliminate criminal liability for an act that is basically unlawful, but is carried out to defend oneself from an unlawful attack. The regulation regarding noodweer still often causes debate in judicial practice, especially in cases of abuse. This study aims to examine the regulation of forced defense in Indonesian criminal law and analyze its application in cases of criminal abuse. This study uses a normative legal method with a statutory approach and a conceptual approach, through analysis of secondary legal materials. The case study in case No. 101/Pid.B/2024/PN.Snj shows that the judge acquitted the defendant because he was proven to have committed a forced defense. The elements of defense that can eliminate criminal liability include an unlawful attack, actions carried out proportionally and subsidiary, not accompanied by malicious intent, and carried out at the place and time of the incident. These results show the importance of a proper understanding of the concept of noodweer in the criminal justice process.

Abstract

This study aims to analyze the legal regulations, forms of violations, and enforcement mechanisms of electoral criminal offenses committed by election organizers during the election of members of the Medan City Regional House of Representatives for the 2024–2029 period. The research employs a normative legal method with statutory, conceptual, and case-based approaches. The findings indicate that the legal framework for electoral crimes is comprehensively regulated under Law Number 7 of 2017 concerning General Elections, which stipulates criminal sanctions such as imprisonment, fines, and administrative penalties for election officials proven to have committed violations. The types of violations identified include manipulation of voter lists, abuse of authority, vote buying, and vote inflation or reduction. The enforcement mechanism involves several key institutions including the Election Supervisory Body (Bawaslu), the Integrated Law Enforcement Center (Gakkumdu), the police, the public prosecutor’s office, and the Election Organizer Honorary Council (DKPP), all of which are mandated to act independently, transparently, and professionally. Legal enforcement in this context serves not only as a repressive tool to punish violations but also as a preventive measure by promoting legal awareness and strengthening the integrity and accountability of election organizers. Therefore, firm and consistent law enforcement is a crucial prerequisite to ensure elections are conducted fairly, honestly, democratically, and with high integrity, thereby maintaining public trust in the electoral process.

Abstract

This study aims to evaluate the implementation of legal protection for husbands who become victims of Domestic Violence (DV) committed by their wives, with a case study in Medan City. The research focuses on the application of Law Number 23 of 2004 concerning the Elimination of Domestic Violence, the motives of wives as perpetrators, and the legal protection provided to husbands as victims. Using a normative approach, this study relies on secondary data from legislation, legal doctrines, and relevant case analyses. The findings show that Law Number 23 of 2004 explicitly provides legal protection for all DV victims, regardless of gender, including husbands. The law guarantees victims’ rights to physical protection, legal assistance, healthcare, and social rehabilitation. The motives of wives committing DV against their husbands may include dominance, frustration, revenge, or economic stress. In some cases, such acts arise from attempts to control the partner or express unresolved emotional distress. The analysis of household dynamics reveals that power imbalance, unresolved conflicts, and past trauma are common triggers of violent behavior. Legal frameworks ensure husbands’ rights to report violence and access protection and rehabilitation services. Law enforcement agencies and relevant institutions such as the Witness and Victim Protection Agency (LPSK) and the Integrated Service Center for the Empowerment of Women and Children (P2TP2A) play an essential role in guaranteeing that male victims receive appropriate and equitable protection under the law.

Abstract

The research aimed to analyze the alignment between the judge's decision in cases of domestic violence against children and the provisions of Law Number 23 of 2004 on the Elimination of Domestic Violence and Qonun Number 9 of 2019 on the Implementation of Handling Violence Against Women and Children. The study also considered moral considerations and the overall benefits. The research methodology employs a case law study, which involves examining court decisions to get insight into the application of the law in specific circumstances. Specifically, the study focuses on the Decision of the Tapak Tuan District Court Judge Number 37/Pid.Sus/2020/PN. Case law is utilized to examine court rulings to comprehend how the law is implemented in specific instances. The library research method is employed in conjunction with a sociological juridical perspective. The data for the research is sourced from the Law and various pertinent articles addressing the research difficulties. Furthermore, to bolster the ideas of the study, the paper also incorporates the findings of several empirical studies. According to the findings, it appears that the judge primarily focuses on formal factors and gives little weight to material considerations in their decision-making process. This aligns with the viewpoint expressed by Member Judge II and the concurring opinion within the panel of judges. However, the author acknowledges and values the decision made by the panel of judges. The author recognizes the challenging nature of the judges' task, as they must not only consider the legal interests involved in the case, but also consider the community's sense of justice in order to achieve legal certainty.

Abstract

AbstractJudicial procedures in Indonesia in resolving criminal cases have not been in accordance with the wishes society to feel fair in law. People who feel less Justice issued opinion or criticism of judicial procedures in indonesia. The problem of traffic accidents refers to the act No. 22/2009 on LLAJ and Criminal Procedure Code. The second legal basis for the settlement of traffic accident cases it is not yet possible to solve problems based on restorative justice. This research aims to find out and analyze procedures to solve the problems of past accidents traffic that can cause casualties both serious injuries and fatalities using the approach of Justice restorative justice according to police Regulation Number 8 of 2021 on handling criminal acts based on Justice Restorative, a form of settlement of accident cases and then with a restorative justice approach according to the police Perarturan Number 8 of 2021 on handling criminal acts based on restorative justice and legal certainty to resolve the issue of laka and then with a restorative justice approach. Methods used in this research using empirical approach and normative juridical approach to the paradigm of analysis qualitative data. Research and Discussion: 1. Legal arrangement for settlement of traffic accident cases it is not based on restorative justice. 2. Legal weaknesses in the settlement of traffic accident cases using a restorative justice approach. 3. Reconstruction of last accident settlement law cross with restorative justice approach, namely by revising the provisions of Article 230 and Article 235 U.S. No. 22/2009 on LLAJ, so that the case of traffic accidents light, medium and heavy can based on restorative justice.
