Abstract

The government has issued Bogor City Regional Regulation Number 11 of 2019 concerning the Arrangement and Empowerment of Street Vendors.   As we know, the sidewalks on Jalan Merdeka are still filled with street vendors ranging from drink and food sellers and clock repair workers lining the sidewalks along Jalan Merdeka which leads to Red Bridge. As a result of all this, many pedestrians who were walking on the sidewalk had to move to the side of the road, because many street vendors' carts were blocking them. from this research to determine the role, supporting and inhibiting factors as well as the efforts made by the Civil Service Police Unit in controlling street vendors on the sidewalk of Jalan Merdek which leads to Red Bridge. The research used was descriptive qualitative with an inductive approach. Data collection was carried out through interviews, observation and documentation. What is obtained from this research is that the Bogor City Civil Service Police Unit has carried out its role well. The supporting factors for the Bogor City Civil Service Police Unit in controlling street vendors on Jalan Merdeka are having a clear legal basis and good relationships with other agencies. The inhibiting factors include a lack of awareness of street vendors and the community, the absence of clear legal sanctions, limited operational budgets, poor conditions of facilities and infrastructure. The efforts made by the Bogor City Civil Service Police Unit include carrying out additional outreach, maximizing members in every activity, and improving existing facilities and infrastructure.

Abstract

Legal protection for home buyers is very important when developers default, one of which is by guaranteeing the house certificate that has been purchased to a third party, such as banks or other financial institutions. This practice is detrimental to buyers because it can cause the house certificate that should be the buyer's right to become collateral for the developer's debt. As a result, buyers risk losing the rights to the house they have purchased if the developer fails to pay off their debts. According to Consumer Protection Law No. 8 of 1999, these practices run counter to the idea of good faith in the agreement and infringe upon the rights of consumers. Buyers who suffer losses due to the developer's failure have the right to demand that their rights be fulfilled, that they be compensated, or that the agreement be cancelled, according to the Civil Code (KUHPer), particularly Articles 1320 and 1267. The goal of the guarantee cannot disregard the rights of other parties, such as homebuyers, as stated in Law No. 4 of 1996, which deals with Dependent Rights. Strict government oversight and openness in property purchasing and selling activities are necessary for more effective legal protection. Furthermore, in order to prevent any losses caused by developer default, purchasers are urged to exercise greater caution in verifying the certificate's legitimacy before to finalizing a deal.

Abstract

The purpose of this research is to analyze the position of the authentic deed in the evidence in the trial of civil cases and to find out and analyze the legal force of the sale and purchase deed before the official who made the land deed made based on the power of attorney stated in the deed of the notary sale and purchase binding agreement. This research method uses a normative juridical approach that emphasizes literature studies with the addition of literature, namely decision studies to strengthen the analysis and produce accurate conclusions. The results of the study show that first, the power of attorney listed in the PPJB deed is a unit that is not separate from the PPJB deed as an authentic deed and becomes full proof for judges in civil trials. Second, that the AJB made before PPAT based on the power of attorney stated in the PPJB Notarial deed has perfect legal force and is legally binding and the power of attorney listed in the notary deed is valid as authentic evidence.

Abstract

Many motorcyclists are aware of the safety riding program that is often published by various parties, especially the traffic police. However, it seems that the introduction and campaign of the safety riding concept alone is not enough to explain to motor vehicle drivers about road safety. Minor to major violations are still often found. Research methods are needed to collect a number of materials used to answer the legal analysis. Starting from the problem, the research method used is the normative legal research method, namely the law is conceptualized as norms, rules, principles or dogmas. The Traffic Police (Polantas) is responsible for traffic regulations on the highway, this unit assists other elements in the police to handle violations of the law on the highway. For this reason, there are four steps that are the main characteristics of the Polantas task, namely traffic law enforcement (both preventive and repressive), public education about traffic, traffic engineering, and registration and identification of drivers and motor vehicles. In addition, Polantas serves the community in managing STNK, SIM, and helping with traffic accidents.
