Abstract

Peraturan Daerah (PERDA) Kabupaten Sukoharjo Nomor 18 Tahun 2017 tentang Perlindungan dan Pemenuhan Hak-Hak Penyandang Disabilitas merupakan salah satu regulasi yang penting dalam pemenuhan hak-hak bagi penyandang disabilitas khususnya di Kabupaten Sukoharjo. PERDA ini bertujuan untuk menjamin bahwa penyandang disabilitas di Kabupaten Sukoharjo mendapatkan perlindungan dan pemenuhan hak-hak mereka, termasuk dalam bidang pendidikan. Pengabdian ini bertujuan untuk mengetahui pemenuhan hak pada siswa MIS Muhammadiyah Siwal sebagai implementasi Perda Nomor 18 Tahun 2017 tentang Penyandang Disabilitas. Melalui pengabdian kepada masyarakat ini, diharapkan dapat diperoleh gambaran yang jelas mengenai sejauh mana PERDA ini telah diimplementasikan secara efektif serta hambatan-hambatan yang dihadapi dalam prosesnya. Metode pengabdian yang digunakan adalah sosialisasi. Sosialisasi dilakukan untuk memberikan informasi kepada siswa tentang hak-hak penyandang disabilitas. Dengan demikian, hasil pengabdian kepada masyarakat ini dapat memberikan rekomendasi yang konstruktif bagi pemerintah daerah, pendidik, serta pemangku kepentingan lainnya dalam upaya memperbaiki dan mengoptimalkan pendidikan bagi penyandang disabilitas di Kabupaten Sukoharjo.

Abstract

ABSTRACT This study examines the legal framework governing corporate social responsibility (CSR) in Indonesia and explores how CSR can be repositioned as a strategic instrument for advancing environmental health. The purposes of this research are to identify the legal foundations of CSR relevant to environmental protection, to assess the contribution of corporate CSR initiatives to environmental health outcomes, and to formulate a regulatory framework that transforms CSR from symbolic compliance into a measurable public health strategy. This research employs a normative juridical method with statutory, conceptual, and comparative approaches, supported by qualitative content analysis of CSR reports and sustainability disclosures published by companies operating in environmentally sensitive sectors between 2021 and 2025. The findings reveal that although Article 74 of Law No. 40 of 2007 makes CSR mandatory, the framework operates as lex imperfecta: it lacks enforceable standards, health-oriented performance indicators, and integration with environmental health regulation, so corporate practice remains dominated by visibility-driven programs whose health impacts cannot be verified. The results provide policymakers with a four-pillar reform framework covering normative standards, health impact assessment, state supervision, and incentives, and offer corporations practical guidance for aligning CSR with national health priorities. The novelty of this study lies in bridging corporate law and environmental health law within a single analytical framework and in drawing comparative lessons from India and the European Union, dimensions that previous Indonesian CSR scholarship has largely examined separately. Keywords: corporate social responsibility; environmental health; legal reform; corporate accountability; environmental justice ABSTRAK Penelitian ini menganalisis kerangka hukum yang mengatur tanggung jawab sosial dan lingkungan perusahaan (Corporate Social Responsibility atau CSR) di Indonesia serta mengkaji reposisi CSR sebagai instrumen strategis dalam mendukung peningkatan kesehatan lingkungan. Penelitian ini bertujuan untuk mengidentifikasi landasan hukum CSR yang berkaitan dengan perlindungan lingkungan, menganalisis kontribusi implementasi CSR perusahaan terhadap peningkatan kualitas kesehatan lingkungan, serta merumuskan model regulasi yang mampu mentransformasikan CSR dari sekadar pemenuhan kewajiban normatif menjadi instrumen kebijakan kesehatan masyarakat yang terukur. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan, pendekatan konseptual, dan pendekatan komparatif. Analisis didukung oleh analisis isi (content analysis) secara kualitatif terhadap laporan CSR dan laporan keberlanjutan (sustainability reports) yang diterbitkan oleh perusahaan-perusahaan yang beroperasi pada sektor-sektor yang memiliki dampak signifikan terhadap lingkungan selama periode 2021–2025. Hasil penelitian menunjukkan bahwa meskipun Pasal 74 Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas mewajibkan pelaksanaan CSR, pengaturannya masih bersifat lex imperfecta karena belum dilengkapi dengan standar pelaksanaan yang dapat ditegakkan, indikator kinerja yang berorientasi pada kesehatan lingkungan, maupun integrasi dengan regulasi di bidang kesehatan lingkungan. Kondisi tersebut menyebabkan implementasi CSR masih didominasi oleh program-program yang berorientasi pada pencitraan (visibility-driven programs), sementara dampaknya terhadap kesehatan lingkungan belum dapat diukur maupun diverifikasi secara objektif. Penelitian ini menawarkan model reformasi regulasi yang bertumpu pada empat pilar utama, yaitu penguatan standar normatif, penerapan mekanisme penilaian dampak kesehatan (Health Impact Assessment), penguatan fungsi pengawasan oleh negara, serta penyediaan skema insentif bagi perusahaan yang menunjukkan kinerja CSR yang efektif. Selain memberikan kontribusi bagi pembentukan kebijakan publik, penelitian ini juga menawarkan pedoman praktis bagi dunia usaha untuk menyelaraskan implementasi CSR dengan prioritas pembangunan kesehatan nasional. Kebaruan penelitian ini terletak pada integrasi perspektif hukum perusahaan dan hukum kesehatan lingkungan dalam satu kerangka analisis yang komprehensif, serta penyajian pembelajaran komparatif dari India dan Uni Eropa sebagai rujukan bagi reformasi regulasi CSR di Indonesia. Abstract

Determining the illegalization of marijuana in Indonesia always reaps many pros and cons in society. Law Number 35 of 2009 concerning Narcotics is the main basis for prohibiting marijuana plants for medical purposes, even though some treatments require the Thetrahydrocannabinol or THC-9 content of marijuana plants. Various attempts to release marijuana from Category I narcotics have occurred many times, both through literature from the marijuana research community, and even PUU before the Constitutional Court. The Ministry of Health has repeatedly issued regulations regarding the classification of Narcotics, but Marijuana is still in Class I Narcotics. In Islamic law, Marijuana is legal in jurisprudence in qiyas by several fiqh scholars with Khamr because it has similarities in the consequences of its use, namely loss of mind, even though The origin and substances contained are different. But there are several scholars who do not agree with this qiyas, this is based on Khamr which has no benefits at all while Ganja still has benefits in it, moreover, no Nash clearly mentions the prohibition of Marijuana in Islam. This research was conducted using the Normative Juridical research method, so this research will focus on the legislative approach, conceptual approach, approach to Islamic law and analysis of the rules of Usul Fiqh. The final aim is to state whether marijuana is worthy of being legalized in Indonesia in the study of the fiqh proposals of Fathu Dzariah and Saddu Dzariah's rules.

Abstract

Rape Rape is a form of sexual violence that is rampant in Indonesia. Rape is also an act that often occurs repeatedly so it is called ongoing rape. This crime is a concrete problem to be handled in the existing justice system. Punishment for rape often causes inequality for its victims because the existing punishment is considered disproportionate to the losses experienced by the victim. This paper qualitatively analyzes the judge's considerations and the application of punishment in the crime of ongoing rape based on the decision of the Surakarta District Court Number 8/Pid.B/2024/Pn.Skt. This paper applies the normative legal method with a case approach from the decision of the Surakarta District Court which shows that the judge's considerations are based on legal, philosophical, and sociological aspects. In the decision, the application of Article 285 and Article 64 paragraph (1) of the Criminal Code is relevant but the application of the threat of punishment is not optimal.

Abstract

This study discusses the phenomenon of illegal racing in the road area towards the interchange Pekalongan Toll Road, Pekalongan City. This activity violates traffic laws and endangers the safety of road users. This study aims to analyze law enforcement against illegal racing perpetrators and assess the effectiveness of prevention efforts by law enforcement officers. This study uses an empirical juridical approach with a qualitative descriptive method to analyze law enforcement against illegal street racing in Pekalongan City. Data were gathered through interviews at the Pekalongan City District Police, direct observation at the research location, and literature studies, then analyzed qualitatively. The results of the study indicate that police efforts through patrols, enforcement, and socialization still face obstacles, such as limited personnel, low legal awareness, environmental influences, and minimal family supervision, so that synergy between various parties is needed.
