Abstract

Intellectual Property Rights for Batik Semarang still not as expected. Though the existence of Batik Semarang has existed since the Dutch colonial era around the 19th century and the motive is not inferior to other batik. Supposedly IPR can be applied to protect Batik Semarang, especially is The Copyright. The issue is What is the Copyright can be used to protect and preserve Batik Semarang? If ok what is the problem of it that can not apply its IPR, especially for Copyright. The conclusions is: Copyright can be applied to art / motive. The obstacles are the traditional motif is already a Public Domain, shall have the novelty of novation, Batik Semarang is not widely known and less desirable both from employers and community batik Semarang. Suggested communities often use Batik Semarang by requiring students to use Batik Semarang.

Abstract

Pasal 33 ayat 3 UUD 1945 ini mendasari adanya TAPMPR NO IX TAHUN 2001 pasal 5 huruf J mengakui dan menghormati hak masyarakat hukum adat dan keragaman budaya bangsa atas sumberdaya agraria dan sumber daya alam, sesuai dengan prinsip-prinsip Pembaruan agrarian dan pengelolaan sumber daya alam. Keberadaan tanah timbul ini juga mengacu pada PP Nomor 16 tahun 2004 tentang penggunaan tanah. Melalui hasil penelitian ini dapat diketahui bahwa Aspek hukum Hak Penguasaan dan Pendaftaran Tanah Timbul sesuai dengan Pasal 33 ayat 3Undang-Undang Dasar Negara Republik Indonesia tahun 1945 mendasari Peraturan Pemerintah (PP) Nomor 16 Tahun 2004 Tentang Penggunaan Tanah, pada penjelasan Pasal 12, memberikan definisi Tanah timbul sebagai daratan yang terbentuk secara alami dan buatan karena proses sedimentasi sungai, danau, pantai dan atau pulau timbul, serta penguasaan tanahnya dikuasai Negara sebagai aturan yang terbaru maka hal ini pun berakibat pada kejelasan status tanah dan pendaftaran tanah timbul di BPN Kabupaten Tegal. Penguasaan Tanah timbul oleh masyarakat pesisir pada RW I RT 05 secara adat diakui oleh seluruh masyarakat desa Kramat yang lain. Disamping itu juga Pemerintah Desa mengakui tanah timbul tersebut dikuasai oleh masyarakat pesisir RW I RT 05 sesuai dengan letaknya.Penguasaan tanah timbul oleh masyarakat pesisir yang digunakan untuk pertanian melati melalui proses truka ( olah lahan ) belum optimal hal ini disebabkan keragu-raguan kejelasan status lahan, walaupun secara hukum adat diakui, akan tetapi secara aspek hukum yang lain belum diakui baik yuridis maupun kebijakan pemerintah daerah. Maka dalam penguasaan Tanah Timbul oleh masyarakat pesisir perlu adanya pengakuan Hak penguasaan Tanah Timbul baik oleh Pemerintah desa, Pemerintah daerah maupun BPN. Faktor yang mendorong dilkukannya Pendaftaran tanah timbul oleh masyarakat pesisir yaitu dari aspek hukumnyaagar memperoleh kejelasan status lahan sehingga dalam pemanfaatannya masyarakat tidak ragu, ari aspek ekonomi untuk meningkatkan taraf hidup dan dari aspek budayaagar tetap mempertahankan budaya culture cognitive (hukum adat). Agar keberadaan Tanah Timbul yang dikuasai masyarakat pesisir sesuai dengan yang diharapkan, yakni kejelasan status Tanah timbul sampai adanya Sertikat Hak Milik, maka perlu adanya kebijakan lokal dari pemerintah desa tentang penguasaan Tanah Timbul oleh masyarakat RW I RT 05 untuk pertanian melati sebagai potensi lokal dan keunggulaan komparatif kepada Pemerintah Daerah, dalam hal ini Komisi I DPRD terkait dengan bidang Hukum dan Pertanahan. Selanjutnya Pemerintah Daerah mengevaluasi tentang RTRW Pantura sebagai Kawasan Industri, terkait letak Tanah Timbul yang digunakan untuk potensi lokal sebagai keunggulan komparatif berada di wilayah Pantura. Pemerintah Daerah dalam hal ini DPRD Komisi I perlu memberikan ruang hijau dan kejelasan status lahan dengan prinsip -prinsip Reforma Agraria sesuai TAP MPR NO IX TAHUN 2001 sehingga ada keberlanjutan proses regulasi Pemerintah Daerah kepada Badan Pertanahan Nasional. Badan Pertanahan Nasional dalam menindaklanjuti kebijakan Pemerintah Daerah terkait dengan RTRW dan Sertifikasi Tanah Timbul juga berpedoman pada PMA NO 14 TH 1961 Tentang Permintaan dan Pemberian Izin Pemindahan Hak atas Tanah dan PP NO. 24 TH 1997 tentangPendaftaran Tanah. Sehingga Aspek Hukum Penguasaan Tanah Timbul oleh Masyarakat pesisir untuk pertanian melati menjadi jelas sampai adanya Sertikat Hak Milik untuk pertanian bagi Masyarakat pesisir.

Abstract

Menggunakan deposito sebagai agunan, atau jaminan kredit bank (Cash Collateral), masih jarang dilakukan. Umumnya, orang menggunakan aset berwujud sebagai barang jaminan, dan belum mengetahui bahwa deposito dan tabungan dapat dipakai sebagai jaminan kredit di Bank. Dalam perkembangannya, debitur dapat mengajukan pinjaman kredit pada bank dengan agunan deposito, namun bukan miliknya. Jadi yang diagunkan adalah deposito milik pihak ketiga apakah itu suami atau istri sendiri, maupun tidak menutup pihak ketiga lain seperti milik orang tua atau pihak lain. Dasar hukum yang digunakan terkait gadai deposito oleh pihak ketiga adalah Pasal terkait perikatan terutama Pasal 1320 KUHPer, Pasal terkait Gadai yaitu Pasal 1150 s/d 1160 KUHPer, Pasal penanggungan Utang Pasal 1820 s/d/ 1832 KUHPer, UU No 10 Tahun 1998 Tentang Perubahan UU No 7 Tahun 1992 Tentang Perbankan dan UU No 8 Tahun 1999 Tentang Perlindungan Konsumen serta UU No 21 Tahun 2011 Tentang Otoritas Jsa Keuangan. Secara teori Undang – Undang Perbankan, UU OJK, Undang – Undang Perlindungan Konsumen dan Kitab Undang – Undang Hukum Perdata memberikan perlindungan bagi deposan yang depositonya dijadikan agunan oleh pihak lain. Perlindungan Hukum yang diberikan menjadi tidak efektif karena pihak ketiga selaku pemilik deposito secara sadar dan tanpa paksaan bersedia untuk dilakukan pemblokiran dan pencairan deposito miliknya, apabila debitur wanprestasi, dengan membuat kuasa tidak dapat dicabut dan penandatanganan pada bagian belakang bilyet deposito miliknya. Dengan demikian deposan secara sadar telah melepaskan hak istimewanya, sebagaimana dimaksud dalam Pasal 1832 KUHPer. Agar perjanjian (pokok dan tambahan) tidak Batal Demi Hukum karena melanggar ketentuan tentang Klausula Baku, maka pihak bank harus dapat memberikan penjelasan kepada konsumen (debitur maupun deposan) terkait resiko – resiko kredit yang dimaksud.

Abstract

Kepailitan adalah sita umum atas semua kekayaan debitur pailit yang pengurusan dan pemberesannya dilakukan oleh kurator di bawah pengawasan Hakim Pengawas sebagaimana diatur dalam UU No.37 Tahun 2004.Salah satu kasus dipailitkannya Koperasi Persada Madani(KPM) yaitu berdasarkan Putusan Nomor 35/Pdt.Sus-PKPU/2015/PN Niaga Jkt.Pst, bahwa Koperasi Persada Madani (KPM) mengalami kasus gagal bayar dan sedikitnya Rp.1,35 triliun dana nasabah menyangkut di koperasi simpan pinjam ini. Dari putusan PKPU Nomor 35/Pdt.Sus-PKPU/2015/P.Niaga Jkt-Pst, tidak serta merta diketahui Koperasi Persada Mandiri (KPM) bubar demi hukum. . Akibat hukum keputusan kepailitan terhadap koperasi Persada Mandiri memang tidak bertentangan dengan Keputusan Menteri Koperasi Pengusaha Kecil dan Menengah Nomor: 351/Kep/M/XII/1998 tentang Petunjuk Pelaksanaan Kegiatan Usaha Simpan Pinjam Oleh Koperasi. Sebab keputusan kepailitan hanya mengadili masalah utang piutang antara debitor dan kreditor. Sedangkan keputusan Menteri Koperasi, Pengusaha Kecil Dan Menengah tersebut mengatur tentang pembubaran koperasi karena koperasi dinyatakan pailit.

Abstract

Sistem jaminan sosial nasional bidang jaminan kesehatan di Indonesia baru mulai serius diurusi pemerintah setelah disahkannya Undang-Undang No. 40 Tahun 2004 tentang sistem jaminan sosial nasional dan Undang-Undang tentang Badan Penyelenggara Jaminan Sosial (BPJS).Berdasarkan uraian tersebut maka penulis tertarik untuk melakukan penelitian dengan mengambil judul : “Tinjauan Hukum Perjanjian Kerjasama Terhadap Pelaksanaan Pelayanan Kesehatan Peserta Badan Penyelenggara Jaminan Sosial dengan Laboratorium Kesehatan Sarana Medika”. Perumusan masalah yang akan diteliti adalah 1) bagaimana tinjauan hukum perjanjian kerjasama pelayanan kesehatan antara Badan Penyelenggara Jaminan Sosial dengan Laboratorium Kesehatan Sarana Medika ?2) Bagaimana Prosedur yang harus dilaksanakan peserta BPJS dalam mengajukan klaim agar mendapatkan pelayanan kesehatan dari fasilitas kesehatan BPJS ? 3) Hambatanyang dihadapi oleh peserta BPJS dalam mendapatkan pelayanan kesehatan, dalam memberikan pelayanan kesehatan bagi BPJS dan Fasilitas Kesehatan dan bagaimana upaya penyelesaiannya ? Hasil penelitian dan pembahasan menunjukan bahwa (1) Tinjauan hukum perjanjiankerjasama pelayanan kesehatan antara Badan Penyelenggara Jaminan Sosial dengan Laboratorium Kesehatan Sarana Medika diselenggarakan berdasarkan Permenkes Nomor 71 Tahun 2013 Pasal 4 ayat (1), (2) dan berdasarkan Undang-Undang Nomor 24 Tahun 2011. yang menyatakan bahwa: ayat (1) “Fasilitas Kesehatan sebagaimana dimaksud dalam Pasal 2 mengadakan kerja sama dengan BPJS Kesehatan.” Dan ayat (2) “Kerja sama Fasilitas Kesehatan dengan BPJS Kesehatan sebagaimana dimaksud pada ayat (1) dilakukan melalui perjanjian kerja sama.” (2) Prosedur yang harus dilaksanakan peserta BPJS dalam mengajukan klaim agar mendapatkan pelayanan kesehatan dari fasilitas kesehatan BPJS, yaitu: a) Pesertamengajukan klaim disertai dokumen pendukung sebagai syarat klaim yang telah ditetapkan oleh BPJS, (3) Hambatanyang dihadapi oleh peserta BPJS dalam mendapatkan pelayanan kesehatan, dalam memberikan pelayanan kesehatan bagi BPJS dan Fasilitas Kesehatan yaitu berupa kurangnya sosialisasi dari BPJS.

Abstract

Lending often occurs in a loan agreement (credit), which is a State party to the debtor's inability to pay an obligation that has been mutually agreed by the lender so that losses on the part of creditors as occur at the KSP Artha True Semarang. As for the purpose of this research is to know and understand what factors being the cause of the occurrence of loans (bad credit) as well as settling the loan (bad credit) happens on the KSP Artha True Semarang. The methods used in the writing of this is empirical method that uses an approach from the aspect arising in field, which has the nature of a real legal who live in thecommunity. Formulation of the problem examined in this thesis is how writing reviews of juridical agreement loan (credit) in cooperative Artha True Semarang, what are the factors that led to the loan (kreditmacet) on Cooperative Artha True Semarang, and how the process of rescue and settlement of loans (kerdit jam) of the true Artha padaKoperasi Semarang Formulation of the problem examined in this thesis is how writing reviews of juridical agreement loan (credit) in cooperative Artha True Semarang, what are the factors that led to the loan (kreditmacet) on Cooperative Artha True Semarang, and how the process of rescue and settlement of loans (kerdit jam) of the true Artha on Cooperative Semarang From this research can generate external factors which are the cause of loan (kerdit jam) is the debtor experienced barriers/difficulties in economic needs due to an accident causing late payment in pay off in installments. While the internal factor is the weak information and oversight in causing the credit turnaround supervision be not maximum. And the efforts made in the settlement of bad debts in the KSP Artha Semarang is True through the settlement outside the Court/non litigation and settlement in court, as well as save existing assets.

Abstract

PT TASPEN (PERSERO) is an Indonesian State-Owned Enterprise engaged in pension fund insurance and taboo PT TASPEN (PERSERO) is an Indonesian State-Owned Enterprise engaged in insurance for pension funds and old age savings which refers to Government Regulation Number 20 of 2013 About Amendments to Government Regulation Number 25 of 1981 concerning Civil Servants' Social Insurance. PT TASPEN (PERSERO) in carrying out its role is not always able to fulfill the rights of Civil Servants on pension rights and old age savings because of the things that are needed in the fulfillment of pension rights and old age savings. These matters are concerning the role of PT TASPEN (PERSERO) in organizing pension and old-age savings programs that will later be entitled to receive severance pay and receive other pension rights based on applicable regulations. The problem in this study is about the risk of social insurance juridical for employees of PT TASPEN (PERSERO) Semarang Main Branch Office who apply for early retirement before the specified retirement age limit. This research is a type of normative juridical research that focuses on studying the application of positive legal norms or norms. From the results of this study indicate that, the juridical risk when applying for an early retirement is not legal unless the person concerned is in trouble, at the time of retirement will get administrative sanctions in the form of postponement of retirement or severance pay. With old age referring to Government Regulation Number 20 of 2013 concerning Amendments to Government Regulation Number 25 of 1981 concerning Civil Servants' Social Insurance. Abstract

The issue of legal protection for consumers is one that is championed in order to provide protection for the community as consumers. BPOM Semarang City has the duty to provide services for the community to supervise the circulating products to ensure their safety, however, there are still products that contain hazardous substances in circulation. Therefore this thesis is entitled "The Function and Role of BPOM in Consumer Protection Against Foods Containing Hazardous Ingredients in Semarang City". The problem under study is to find out how the function and role of BPOM in dealing with food containing hazardous ingredients, what efforts have been made by BPOM on foods containing hazardous ingredients and the rights obtained by consumers in order to be safer against substances that contain hazardous ingredients. The research method used is the type of normative juridical legal research. Specific research is descriptive analysis of primary and secondary data sources. Data collection methods used are interviews and literature study with research locations at BPOM Semarang City. Based on the research obtained shows that the position of consumers is weak compared to producers, so consumers need the existence of UUPK and POM agencies as supervisors on the feasibility and safety of drugs and food to avoid losses suffered by consumers considering that there are still dangerous substances in the circulating products. The role of the government needs to be maximized in controlling, supervising and coaching and counseling to consumers and businesses.

Abstract

Freight of goods and passengers in Indonesia With the availability of goods and transportation needed by transportation, there are many entrepreneurs or transportation service companies in the three transportation routes. PT. Pandu Logistik is a company engaged in the transportation of goods which is a legal entity in the Commercial Postal Service as stipulated in article 18 paragraph (1) of Law Number 38 of 2009 concerning Postal. During the process of shipping goods sometimes it does not need to be done with problems, for example regarding expenditures, both originating from nature, human actions or from the nature of the goods themselves. In answering this law, the approach method is carried out using the sociological juridical method with descriptive analytical specifications and the analysis is done qualitatively. The results of this study indicate that the standard agreement in the transportation agreement determined by the carrier according to the position of the parties is not balanced and there is no freedom of transfer to determine the contents of the agreement. Factors that cause ownership change, damage or loss of goods in PT. Pandu Logistics is 2 factors, the first factor which is a factor of PT. Pandu Logistik itself and the second is external factors such as circumstances and accidents that cannot be done in the transportation of goods. The responsibility of PT. Pandu Logistics Semarang for lost or damaged goods that is by way of compensation of 10 times the shipping fee or a maximum of Rp. 1,000,000 (one million rupiah), except if PT. Pandu Logistik Semarang can prove right and wrong that PT. Pandu Logistik Semarang, apart from the negligence and mistakes of the sender of the goods or because there is something about the cargo that does not reach the recipient of the goods, this is what frees PT. Pandu Logistik from Semarang sent by the goods sender. Abstract

The need for land continues to increase so that it often causes very complex problems. To deal with these land issues, the government issued Law no. 5 of 1960 concerning Basic Agrarian Principles which later became known as the UUPA, the birth of the UUPA was a new milestone for this nation in land law. In line with that, the government then issued government regulation No. 24 of 1997 concerning land registration which reaffirmed the importance of the community registering their land, land registration functions to find out the status of the land parcels, who owns it, what rights are it, how much area, what is it used for. The importance of systematic, good and correct land registration through adjudication aims to reduce problems that arise with regard to land. The research method used by the writer is a juridical empirical approach with the intention of proving or testing to ensure the truth and rationalizing it through the results of research and experiences that have been found in everyday life. The results of the research found that more people register their land in a sporadic manner, because the community considers that systematic land registration does not necessarily occur every year, even though it is expensive for the community to register their land in order to obtain the rights to the land they own.
