Abstract

Terbitnya PP Nomor 24 Tahun 2022 membuka ruang akan adanya skema pembiayaan berbasis Kekayaan Intelektual. Namun, terbitnya PP tersebut masih menimbulkan kesenjangan antara hukum yang dicita-citakan dengan keadaan hukum dalam kenyataannya, yang lazim disebut dengan kesenjangan antara das sollen dan das sein. Peraturan Pemerintah Nomor 24 tahun 2022 yang membuka ruang fasilitasi pembiayaan berbasis Kekayaan Intelektual pada kenyataannya belum dapat sampai pada titik yang ideal, karena terdapat hal-hal yang bersifat yuridis dan teknis belum mendapat pengaturan yang komprehensif, termasuk kesiapan lembaga/institusi yang mengelilingi pembiayaan berbasis Kekayaan Intelektual. Dari hasil penelitian diperoleh bahwa pelaksanaan jaminan Kekayaan Intelektual atas penjaminan Hak Cipta pasca berlakunya PP Nomor 24 Tahun 2022 mengenai nilai penjaminan belum dapat diimplementasikan karena lembaga Penilai KI belum berdiri dan kepastian hukum atas penjaminan Hak Cipta menimbulkan ketidakpastian hukum karena tidak adanya ketentuan tentang tata cara eksekusi Hak Cipta yang menjadi agunan, PP Nomor 24 tahun 2022 belum selaras dengan Undang-Undang Hak Cipta dan belum adanya Peraturan OJK yang mengakomodir Hak Cipta atau KI secara umum sebagai agunan pada sektor jasa keuangan. Penelitian ini merekomendasikan kepada Pemerintah untuk menginisiasi pendirian dan penerbitan regulasi lembaga Penilai KI, membentuk hukum positif pada level undang-undang ataupun berupa revisi terhadap Undang-Undang Hak Cipta yang berlaku saat ini dengan yang di dalamnya memuat ketentuan khusus mengenai penjaminan Hak Cipta terutama perihal teknis tata cara eksekusi Hak Ekonomi pada Hak Cipta dan menerbitkan Peraturan OJK yang menambahkan Hak Cipta atau KI secara umum sebagai aset yang dapat menjadi agunan pada sektor jasa keuangan.

Abstract

The aim of the research is to describe apartment units associated with investment in the property sector for ownership of apartment units for foreign citizens in Indonesia by paying attention to land rights in Indonesia, so that there is no disharmony with positive law in Indonesia. The research method uses a normative juridical legal research type. The approaches used include the statutory approach, conceptual approach, analytical approach. An analytical approach is carried out by analyzing legal material to find out what is contained in the terms used in a legal regulation conceptually, as well as understanding the regulation in practice. The results of the research are that in the UUPA there are several types of land rights, namely: (1) Ownership rights; (2) Cultivation rights; (3) Building use rights; (4) Use rights; (5) Rental rights; (6) The right to open land; (7) The right to collect forest products; (8) Other rights which are not included in the rights mentioned above will be determined by law as well as temporary rights as stated in Article 53 of the UUPA. After the enactment of Law 11/2020, the regulation of ownership of condominium units for foreigners is specifically regulated in Part Four of Land Paragraph 3 Condominium Units for Foreigners, as intended in the provisions of Articles 143 to 145. In its development to implement Constitutional Court Decision Number 91/PUU-XVIIl2020, improvements need to be made by replacing Law Number 11 of 2020 concerning Job Creation (Letter f, Considering section, Law Number 6 of 2023), as promulgated in Law Number 6 of 2023 concerning Determination of Regulations The Government Substitutes Law Number 2 of 2022 concerning Job Creation into Law (hereinafter referred to as Law 6/2023)

Abstract

In a limited liability company, which is a limited legal organization with liability limited to paid-up capital, shares are defined as proof of a legal subject's participation in capital ownership. Shares can be bequeathed, pledged, transferred, gifted, and kept in trust. A limited liability business can be invested in, for example, by buying and selling shares. Therefore, by taking into consideration joint assets, inherited assets, or marriage agreements, it is required to include the spouse's permission in the transfer of rights in order to offer legal certainty regarding the presence of assets' separation in a limited liability business

Abstract

The study purpose was This study aims to analyze the legal responsibility of notaries involved in price mark-up practices in land acquisition compensation, examining both juridical and practical aspects. This research employs a normative juridical approach, using statutory and doctrinal legal materials, combined with a case study analysis of land acquisition disputes involving notarial participation. Data were collected from laws, regulations, academic literature, and legal cases, then analyzed qualitatively to identify patterns of legal liability and compliance issues. Findings indicate that notaries who participate in price mark-up practices may be held civilly and administratively liable under the Notary Law, particularly when failing to act in accordance with their duties of accuracy, transparency, and legality. Case studies demonstrate that such practices often involve misrepresentation of land values, causing financial harm to landowners and potential conflicts with government acquisition standards. The research also highlights gaps in enforcement, emphasizing the need for stronger oversight and clearer procedural guidelines. Notaries bear significant legal responsibility in land acquisition compensation, and their involvement in price mark-up practices constitutes a breach of professional and legal duties. Ensuring strict adherence to notarial obligations is essential to protect public trust, prevent exploitation, and uphold the integrity of land acquisition processes in Indonesia.
