Abstract

The definition of land acquisition is essentially a legal act in the form of releasing land rights from the entitled party before the competent authority by receiving compensation. In the issue of land supply by the state is very necessary in the implementation of national development and it can be ascertained that the availability of land for development activities becomes its own problem related to land prices, land status and acquisition mechanisms as well as criminal problems arising from land acquisition. However, in its implementation, we often find irregularities that occur, both in the collection of physical data and juridical data, there can also be elements of inaccuracy and abuse of authority which leads to the imposition of elements of criminal acts. The arrangement of laws and regulations has been such that in its implementation it does not cause legal problems starting from the planning stage, as well as in its implementation, for this reason, socialization of land acquisition legal arrangements to land acquisition implementers, entitled parties and all parties involved is the key to success in land acquisition activities.

Abstract

Study This aim For analyze base laws, procedures and implications juridical obligation recording diversion receivables on certificates right liability as form protection law for creditors new, and study consequence law if recording the No done before debtor default. The research method used is study juridical normative with approach legislation, approach conceptual approach​ analytical and approach case. Abstract

Pembuat Akta Tanah (PPAT) merupakan Pejabat Umum yang bertugas untuk membuat Akta Autentik sebagai bukti telah dilakukannya perbuatan hukum tertentu mengenai Hak Atas Tanah atau Hak Milik Satuan Rumah Susun, salah satunya adalah Akta Jual Beli (AJB). Ketika pembuatan Akta Jual Beli tidak memenuhi prosedur dan persyaratan yang diatur dalam peraturan perundang-undangan, maka Akta tersebut menjadi cacat hukum, sehingga harus dibatalkan/batal demi hukum. Adapun rumusan masalah dalam penelitian ini yaitu bagaimana akibat hukum Akta Jual Beli Tanah yang dibuat di hadapan PPAT terkait adanya utang piutang? Serta bagaimana tanggung jawab PPAT yang membuat Akta Jual Beli Tanah terkait adanya utang piutang? Teori yang digunakan dalam penelitian ini yaitu Teori Akibat Hukum menurut Soeroso dan Teori Tanggung Jawab Hukum menurut Hans Kelsen. Metode yang digunakan dalam penelitian ini dengan jenis penelitian Yuridis Normatif, yaitu penelitian hukum kepustakaan atau data sekunder dengan sumber bahan-bahan hukum primer, sekunder dan tersier. Adapun pendekatan penelitian yang dipergunakan Pendekatan Perundang-Undangan, Pendekatan Konseptual, Pendekatan Analitis, Pendekatan Kasus dan teknik pengumpulan bahan hukum dilakukan dengan cara mengidentifikasi dan menginventarisasi aturan hukum positif, literatur buku, jurnal dan sumber bahan hukum lainnya. Untuk teknik Analisa bahan hukum dilakukan dengan penafsiran gramatikal, penafsiran sistematis, dan metode konstruksi hukum. Hasil penelitian menunjukkan bahwa akibat hukum dari pembuatan AJB dihadapan PPAT terkait adanya utang piutang yaitu mengandung cacat hukum dan tidak dapat dibenarkan karena melanggar syarat materil (sebab yang halal) yang merupakan batal demi hukum. Serta PPAT dapat bertangung jawab secara etik atas sanksi Administratif, atas sanksi Perdata, dan atas sanksi Pidana.

Abstract

Peralihan hak milik atas tanah dapat dilakukan melalui jual beli, yang melibatkan subyek penjual dan pembeli. Proses ini lebih aman jika tanah tersebut memiliki sertifikat yang terdaftar, mengurangi risiko sengketa dibandingkan dengan tanah yang belum terdaftar. Namun, jika penjual tidak berwenang atau pembeli tidak memiliki hak untuk membeli, transaksi dapat dibatalkan oleh pihak yang berkepentingan. Penelitian ini fokus pada akibat hukum jual beli tanah tanpa persetujuan pasangan dan perlindungan hukum bagi pembeli dalam situasi tersebut Metode yang digunakan dalam penelitian ini dengan jenis penelitian yuridis normatif, yaitu penelitian hukum kepustakaan atau data sekunder dengan sumber bahan-bahan hukum primer, sekunder, dan tersier. Adapun pendekatan penelitian yang dipergunakan Pendekatan Perundang-Undangan, Pendekatan Konseptual, Pendekatan Analitis, Pendekatan Kasus dan teknik pengumpulan bahan hukum dilakukan dengan cara mengidentifikasi dan menginventarisasikan aturan hukum positif, literatur buku, jurnal, dan sumber bahan hukum lainnya. Untuk teknik analisa bahan hukum yang dilakukan dengan penafsiran gramatikal, penafsiran Sistematis, dan metode konstruksi hukum. Hasil penelitian menunjukkan bahwa pengalihan harta bersama tanpa persetujuan pasangan melanggar syarat sah perjanjian sesuai Pasal 1320 Kitab Undang-Undang Hukum Perdata, sehingga dapat dibatalkan secara hukum.Perlindungan hukum bagi suami atau istri yang dirugikan dalam jual beli tanpa persetujuan pasangan penting untuk mencegah kerugian akibat pengalihan harta bersama. Pembeli yang beritikad baik juga perlu mendapatkan kepastian hukum untuk melindungi hak atas tanah yang dibeli. Dalam kasus sengketa, akta di bawah tangan hanya memiliki kekuatan bukti jika diakui oleh kedua belah pihak atau didukung bukti lain. Penyelesaian masalah dapat dilakukan melalui jalur non-litigasi atau litigasi di pengadilan untuk mendapatkan kepastian hukum atas kepemilikan tanah

Abstract

Grants to social organizations that are Indonesian legal entities as intended in Article 3 paragraph (1) letter d are given to social organizations or foundation that legitimately have legal entities or social organizations that are association legal entities that have received legal entity approval from science in the field of law and human rights following legislation. However, a phenomenon that occurs in society is that grants received by foundations are not used for activities or foundation interests, but are used by foundations for personal interests. What are the legal consequences of foundation grants being diverted by foundation administrators for personal interests? And what is the legal certainty about foundation grant funds being diverted by foundation administrators for personal interests? The theories used are Soeroso’s Law Consequences Theory and Jan Michiel Otto’s Legal Certainty.

Abstract

The position of electronic certificates in agrarian law in Indonesia is a means of proof of ownership of land rights, ownership rights to apartment units, management rights, and mortgage rights, The Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 5 of 2017 concerning Electronic Land Information Services (hereinafter referred to as Ministerial regulations ATR/Head of BPN 5/2017) which was later replaced by Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 19 of 2020 concerning Electronic Land Information Services (hereinafter referred to as Ministerial regulations ATR/Head of BPN 19/2020). Ministerial regulations ATR / Head of BPN 5/2017 is the forerunner or embryo of the start of electronic land law politics in Indonesia. For this reason, in order to further realise the certificate, the Indonesian Government should regulate the position of electronic certificates in law and need to support changes in the registration system in Indonesia to a positive system with the issuance of electronic certificates, in addition to conducting comprehensive socialisation to the Indonesian people who think that they do not hold physical evidence of certificates with the assumption that everything is electronically based.

Abstract

Legal certainty in the context of the deed of agreement on debts and guarantees that are the basis for the purchase and sale of land. so that the parties involved in the transaction can obtain legal clarity and security regarding debt-receivable obligations and rights and responsibilities related to guarantees, creating a solid foundation for the implementation of land sale and purchase transactions. This study raises two problems, namely the legal consequences of the cancellation of the debt and accounts receivable agreement accompanied by a guarantee in the sale and purchase of land and legal certainty deed of debt and Accounts Receivable Agreement and guarantee as the basis for sale and purchase by using the theory of legal consequences and The Theory of legal certainty. The method used in this study with the type of normative research is legal research with secondary data using primary, secondary and tertiary sources of legal materials. The research approach used is the approach of legislation, conceptual, case, and analytical and legal material collection techniques carried out by identifying and inventorying positive legal rules, researching library materials and other sources of legal materials relevant to the legal issues under study. Legal material analysis technique is done by legal interpretation (interpretation) grammatical, historical and systematic The results of this study that the legal certainty in the deed of agreement payable receivable for the sale and purchase of land form a solid foundation for the parties involved. Clarity regarding debt-receivable obligations and collateral-related responsibilities creates a stable legal environment, not only minimizing the potential for conflict, but also allowing transactionists to operate with confidence within a reliable legal framework. The role of the guarantee in the deed is the foundation that provides protection and trust in the land sale and purchase transaction, creating security for the creditor and confidence for the loan recipient. With clear guarantees, transaction actors can face the process of buying and selling land with more confidence, reducing financial risks that may arise.

Abstract

Pembahasan mengenai tanggungjawab hukum  PPAT  dalam  pembuatan  akta pemberian hak tanggungan yang diketahui kemudian tidak terpenuhi syarat formil. Penelitian yang dilakukan dengan menggunakan metode yuridis normatif. Tanggung jawab Hukum PPAT dalam pembuatan Akta Hak Tanggungan yang tidak terpenuhi syarat formilnya bahwa sesuai dengan Pasal 55 PERKABAN No. 1 Tahun 2006, dalam pelaksanaan tugas dan jabatannya untuk pembuatan akta, PPAT bertanggung jawab secara pribadi terhadap setiap akta yang dibuatnya, dikaitkan dengan Pasal 23 UUHT, apabila PPAT melanggar atau lalai dapat dikenakan sanksi administratif. Apabila terdapat gugatan dari para pihak, dapat dimintakan pertanggungjawaban dalam bentuk perdata, pidana maupun administratif.

Abstract

Pembahasan mengenai tanggung jawab hukum pejabat pembuat akta tanah (ppat) yang  tidak melakukan pengecekan kesesuaian  data fisik  dan yuridis dalam  pembuatan akta jual beli. Penelitian yang dilakukan dengan menggunakan metode yuridis normatif. Peraturan Pemerintah tentang Pendaftaran Tanah bahwa jual beli harus dilakukan para pihak di hadapan PPAT yang bertugas membuat akta. Dengan dilakukannya jual beli dihadapan PPAT, dipenuhi syarat terang. PPAT  dalam pelaksanaan pembuatan atas pemindahan hak atas tanah haru menerapkan prinsip kehati-hatian dengan memastikan  kesesuaian data fisik dan data yuridis pada sertipikat dimana PPAT diberikewenangan atas kebenaraan data pemohon. Permasalahan dalam penelitian bagaimana  akibat hukum pembuatan akta jual beli tanpa pengecekan keseuaian  data fisik dan yuridis oleh PPAT serta bagaimana  tanggungjawab hukum PPAT dalam membuat akta jual beli tanpa melaksanakan penyesuaian  data fisik dan yuridis.

Abstract

Legal certainty related to transactions using Dinar and Dirham currencies in the criminal law approach in Indonesia. Based on Law No. 7 of 2011 on currency, Rupiah is the only legal tender in Indonesia. The use of currencies other than Rupiah, including dinars and dirhams, is not legally recognized and has the potential to violate criminal provisions, such as those related to fraud or forgery. However, this phenomenon also involves social and cultural dimensions, especially in communities based on sharia economics, where dinars and dirhams are considered as means of transaction that are more in line with Islamic principles of justice and ethics. Overly repressive law enforcement can generate resistance in society, so more inclusive legal reforms and adjustments are needed. By promoting dialogue and collaboration between policy makers, business actors, and the community, it is expected to create a legal system that is fair and responsive to social needs and is able to maintain legal stability in Indonesia . From the research results, the transfer of receivables by Cessie by the creditor in the event that the debtor fails to pay the third party mortgage guarantee does not comply with the applicable provisions as regulated in Article 613 of the Civil Code and Law of the Republic of Indonesia Number 4 of 1996 concerning Mortgage Rights. Form legal protection for third parties by filing a lawsuit before or during the execution process. The government, stakeholders and related parties are expected to make changes to Law of the Republic of Indonesia Number 4 of 1996 concerning Mortgage Rights over Land and Objects related to Land, by accommodating third party protection which is explicitly regulated in guaranteeing rights to land, these regulations do not clearly regulate the rights and obligations of third parties so they cannot provide legal protection for collateral owners. The results of this study that legal certainty related to transactions using dinars and dirhams, as done by Zaim Saidi, in the approach of Indonesian criminal law is a violation of Article 9 of Law No. 1 of 1946 on Criminal Law regulations in conjunction with Law No. 7 of 2011 on currency. Enforcement of these transactions can be carried out through the application of criminal sanctions, since the use of currencies other than Rupiah for payment purposes is not justified by law. In addition, the low legal awareness of the public in using the Rupiah as a legal tender also became an important factor in this case.
