Abstract

The party and election system has an impact on the government system with the phenomenon of difficulty in forming opposition groups. So it is important to review the party and election system by comparing it to the system in the United States to find a more efficient format. By using a descriptive-analytical normative juridical method, the results obtained are First, the implementation of the party system in Indonesia and the United States is different, this is driven by the election system, the proportional system encourages Indonesia to adopt a multiparty system, while the district system urges the United States to adopt a two-party system even though there are not only two parties in the country. Second, the reconstruction of the election system can affect the party system as in Duverger's law theory. Many aspects can affect the election process, such as the time of implementation, the number of candidates, and other variables. So by reconstructing the election system, both the system itself and the variables in it can be a solution to the problems of multiparty and presidential in Indonesia. Abstract

Constitutional Justice Saldi Isra's confusion in expressing a different opinion (dissenting opinion) regarding the ruling of the Constitutional Court Number 90/PUU-XXI/2023, opening up public space to question the material aspects of the decision. According to Saldi Isra, the substance of the petition in Case Number 90/PUU-XXI/2023 is simple and clearly visible.opened legal policyIn fact, it was taken over and used as a "political burden" for the Court to decide. The results of the research explain that first, the mechanism for filling the position of Constitutional Judge greatly determines the statesmanship qualifications of Constitutional Judges, the involvement of state institutions as institutions proposing Constitutional Judges. Second, to create Constitutional Judges who master the constitution and state administration and have integrity and personality that is beyond reproach and are fair, it is necessary to make changes to the mechanism for filling the positions of Constitutional Judges in order to create a mechanism that reflects the independence of their election.

Abstract

Community participation and the legal needs of the community are inherent in the process of forming laws. In fact, these two elements are manifestations and crystallizations of the ideal idea of ​​democracy. In a democracy, public participation is a condition sine qua non. Without public participation in the process of making laws, it will only result in authoritarian regulations and bias against the true meaning of democracy. So that it will result in the formation of laws that are not sourced from the soul and legal needs of the community (volkgeist). The method in this study uses legal research methods with a qualitative approach in the form of normative legal studies and (normative legal studies), where the type of research is descriptive analytical research. In addition, the approach used is a comparative approach (comparison), a historical approach, an institutional approach and a futuristic approach. Community participation in the formation of laws in Indonesia, South Africa and the United States has already started. Although public participation in law-making has some constraints such as slowdown in the legislative process and budgetary requirements, it brings more benefits to the government and society. However, the legitimacy of the process, the issue of justice, also creates better regulations and ultimately creates a stronger quality of democracy so that there is no doubt that public participation is an important part of the legislative process.

Abstract

This paper aims to describe the implications of the legal-political configuration of the Job Creation Law and the implementation of Constitutional Court Decision Number 35/PUU-X/2012. The data used in this study are legal materials in the form of writings published by previous researchers related to the object of this study, and materials in the form of laws and Constitutional Court decisions. These primary and secondary materials will be analyzed and interpreted qualitatively. This study finds that the Job Creation Law is an orthodox legislation formed by an authoritarian political configuration that has undermined the mandate of Constitutional Court Decision Number 35/PUU-X/2012 and has implications for the constitutional rights of customary law communities by revoking their constitutional rights over their customary forests.

Abstract

As a country that maintains a presidential system of government, it is essential to concentrate on creating the framework and structure of government. This is closely tied to the establishment, evolution, and dissolution of such institutions. As a consequence, the President and the DPR will be capable of determining responsive and constitutional legal politics. This legal policy study focuses on how the growth and regulation of state ministries and state institutions were connected to the constitutional system's establishment, modification, and dissolution. Second, how can legal politics address this in a manner that seems to be constitutional? The objective of this study is to assess the arrangements pertaining to the formation, alteration, and dissolution of ministries and state institutions under the constitutional system in order to define the ideal political legislation.This research uses normative legal research methods with descriptive research specifications and is analyzed through library research and data analysis methods using juridical-qualitative. The results of the research and discussion in this study include: First, the arrangements regarding the formation, modification, and dissolution of ministries and state institutions do not yet have a clear legal basis so that the President as the holder of power, is irregular in issuing his policies. Second, the legal politics that was initiated wanted the Government and the DPR to be more synergized in terms of drafting legal considerations and normalizing them based on statutory regulations and principles in a presidential system of government.

Abstract

Corruption has even become a bad habitdamage cornerstones of life in society and pollute the integrity of the nation. The widespread abuse of authority by state parties or officials in government agencies has become a culture aimed at increasing their wealth and even seeking promotion through nepotism. Nepotism is the tendency to prioritize (benefit) one's own relatives, especially in positions and ranks within the government. Nepotism in practice encourages people to do something or not do something as a shortcut to realizing personal benefits in the future through closeness to people who have positions in the agency. The strong influence of nepotism on the buying and selling of positions in the government domain has real detrimental impacts (actual loss). This research is legal research (doctrinal research) with a conceptual approach (conceptual approach), the legal approach (statues approach). The results of this research explain that the practice of nepotism which is part of criminal acts of corruption is very dangerous for the existence of the state, one of which is the integrity of the nation. Cases of nepotism that result in buying and selling positions often occur in government agencies due to greed and weak development supervision and the impact of state losses can be said to be real (actuall loss).

Abstract

After the Amendment of 1945 Constitution, democracy and Rule of Law become two concepts. They are the concept on how to run the power and run the goverment of Indonesia. Both concept, are interconected among each others and can not be separated, because on one side, democracy gives the grounds and mechanisme of power based on the principles of togetherness and equality, while on the other side, rule of law gives guide lines that goverment in the state is not a human but the law of human being. The both of concepts have relation each other. This article are trying to connected and related both concepts in an unseperated function.

Abstract

Pembentukan Peraturan Perundang-undangan, Ayat (1) menyatakan: “Masyarakat berhak memberikan masukan secara lisan dan/atau tertulis dalam pembentukan peraturan perundang-undangan,” dan Ayat (2) menyatakan:“Masukan secara lisan dan/atau tertulis sebagaimana dimaksud pada Ayat (1) dapat dilakukan melalui (a) rapat dengar pendapat umum, (b) kunjungan kerja, (c) sosialisasi, dan (d) seminar, lokakarya, dan/atau diskusi.Mencermati bunyi ketentuan Pasal 96 Ayat (1) dan Ayat (2) UU Nomor 12 Tahun 2011 di atas, pertanyaan kritisnya, apakah hak masyarakat untuk memberikan masukan secara lisan dan/atau tertulis pernah dilakukan oleh lembaga pembentuk hukum (legislatif dan eksekutif) pada saat rapat dengar pendapat umum, kunjungan kerja, sosialisasi, seminar, lokakarya dan/atau diskusi. Hasil penelitian ini menjelaskan bahwa tata cara untuk meningkatkan partisipasi masyarakat dalam pembentukan peraturan daerah adalah melalui Pemerintah daerah menyampaikan informasi tentang penyelenggaraan pemerintahan daerah kepada masyarakat, Pemerintah daerah mendorong kelompok dan organisasi masyarakat untuk berperan aktif dalam penyelenggaraan pemerintahan daerah melalui dukungan pengembangan kapasitas masyarakat, Pemerintah daerah mengembangkan pelembagaan dan mekanisme pegambilan keputusan yang memungkinkan kelompok dan organisasi kemasyarakatan dapat terlibat secara efektif; dan/atau Kegiatan lainnya sesuai dengan ketentuan peraturan perundang-undangan.
