Abstract

Di dalam keserentakan pesta demokrasi, Pemilihan Umum (Pemilu) secara serentak hanya dilakukan bagi pemilihan anggota Dewan Perwakilan Rakyat, Dewan Perwakilan Daerah, Presiden dan Wakil Presiden dan Dewan Perwakilan Rakyat Daerah. Namun, Pemilihan Kepala Daerah (Pilkada) akan dilakukan secara serentak pada tahun 2024. Keserentakan Pilkada 2024 sebagai amanat dari Pasal 22E ayat (1) UUD 1945 bahwa “Pemilihan umum dilaksanakan secara langsung, umum, bebas, rahasia, jujur, dan adil setiap lima tahun sekali. Inisiatif dari pilkada dilakukan secara serentak berawal dari Putusan Mahkamah Konstitusi Nomor 14/PUU-XI/2013 untuk memperkuat sistem presidensial dan penyelenggaraan lebih efisien. Pilkada serentak 2024 telah diatur melalui Pasal 201 ayat (8) UU Nomor 10 Tahun 2016 bahwa Pemungutan serentak nasional dalam pemilihan kepala daerah akan diselenggarakan pada bulan November 2024. Dalam persiapan pilkada serentak 2024 menimbulkan pemotongan masa jabatan kepala daerah yang tidak selesai hingga 5 (lima) tahun. Salah satu dari kepala daerah yang dilantik tahun 2020 tidak secara penuh masa jabatannya selama 5 (lima) tahun. Hal ini, tentu akan merugikan hak konstitusional bagi kepala daerah yang sedang menjabat secara tidak penuh bahkan tidak dapatnya melaksanakan seluruh agenda politik yang telah dijanjikan kepada Masyarakat pada saat kampanye. Baru-baru ini, Mahkamah Konstitusi mengeluarkan Putusan MK Nomor 27/PUU-XXII/2024 terkait pengujian Pasal 201 ayat (7), (8), dan (9) UU Nomor 10 Tahun 2016. Hasil Penelitian ini menjelaskan bahwa Pertama, Mahkamah menegaskan terhadap norma Pasal 201 ayat (7) UU Pilkada memungkinkan bagi kepala daerah dan wakil kepala daerah hasil pemilihan tahun 2020 untuk tetap terus menjalankan tugas dan jabatannya sampai pelantikan kepala daerah dan wakil kepala daerah hasil pemilihan serentak secara nasional tahun 2024 sepanjang tidak melebihi masa jabatan 5 (lima) tahun. Kedua, Putusan MK Nomor 27/PUU-XXII/2024 telah memperbaiki kerugian hak konstitusional kepala daerah yang menjabat sejak 2020 dimana akan terpotong masa jabatannya karena adanya pilkada serentak. Akibat hukum positif ini mengakhiri sengketa hukum bagi Kepala Daerah yang menjabat sejak tahun 2020 dan tidak terpotong masa jabatannya akibat Pilkada serentak 2024.

Abstract

Inevitably, the same problem, namely the infertility of the judicial institution, is also one of the problems that occurs in Indonesia. One of the processes in changing the 1945 Constitution of the Republic of Indonesia is to reconstruct the judicial power institution. As one of the judicial authorities, the Constitutional Court has the independent authority to administer justice to uphold law and justice. In carrying out its adjudicating function, the Constitutional Court has nine constitutional judges appointed by the President, with three nominated by the Supreme Court, three by the House of Representatives, and three by the President. The Constitutional Court is not immune to controversial issues that intersect with its independence. The regression of democracy in Indonesia is increasingly apparent when institutions, such as the Constitutional Court, are caught up in practical politics. Issues arise regarding the weakness of the Constitutional Court system regulated in the 1945 Constitution of the Republic of Indonesia, particularly the system for filling constitutional judge positions, which impacts the Constitutional Court's independence.Are controversial cases in the Constitutional Court that overlap with independence caused by the weakness of the system related to the Constitutional Court as regulated in the 1945 Constitution of the Republic of Indonesia? The research method used is normative juridical. The results of the research, filling the position of constitutional judge through the House of Representatives, the Supreme Court and the President as mandated by Article 24C paragraph (3) of the 1945 Constitution of the Republic of Indonesia, is a form of mechanism.check and balanceswhich is not functional but issupreme. To maximize objectivity regarding the quality of constitutional judges, tiered selection through a mechanismcheck and balancesBased on the function of the institution that carries out the functions of state power, this is an option. This option is one of the efforts to strengthen the independence of the Constitutional Court. To realize this idea, it is necessary to make a fifth amendment to the 1945 Constitution of the Republic of Indonesia, specifically by reconstructing Article 24C paragraph (3) of the 1945 Constitution of the Republic of Indonesia.

Abstract

The constitution gives citizens freedom to engage in commercial activities not only to increase their economic income. But rather to encourage the quality of each individual to continue productivity. Currently, a variety of jobs have developed which can increase individual income, where the global economic cycle is better than in the past. Recently, there have been plans for every profession in the Indonesian National Army (TNI) to be able to do business. This plan is due to the Draft Law or what is called Bill Number 34 of 2002 concerning the TNI.  Polemic about eradicating norms"prohibition of the TNI in doing business” has become a matter of public concern at the moment, there are concerns that the TNI's role as a national defense soldier will be disrupted. This research is legal research (doctrinal research) with a legal approach (statues approach), analytical approach (analytical approach), and conceptual approaches (conceptual approach). The research results explain that First The National Army is not only to uphold, protect and safeguard the nation's sovereignty from Indonesian military and non-military attacks/threats, but can also participate in civil society activities such as helping victims of natural and non-natural disasters or joining the government as long as the orders of their superiors has been regulated in law.  Second, the rights to life of a TNI soldier are no different from civil rights, especially the rights to improve their daily welfare. Third, the urgency of eliminating the norm regarding "TNI is prohibited from doing business" is a legal effort to look at the situation progressively. Therefore, the abolition of the norm "TNI is prohibited from doing business" is a legal effort to protect their economic rights in improving the standard of living for those of their families.

Abstract

Indonesia cannot close eyes that cooperation with other countries is needed .Different interests and the source of the power possessed make the state independent of one another .Cooperation between countries can occurred in agreed to an international agreement .The national interest and public interest broad should be included in International Agreement to other countries , do not get international treaties approved by the government torment the people. Hence , legal basis international treaties in Indonesia must be clear and firmly , to avoid possible in the practice of especially with regard to the ratification of a treaty. Do not get obscurity legal basis cause financial losses for the state especially the people

Abstract

The Regional Offices of the Ministry of Law and Human Rights in each region have an important role in the harmonization of regional regulations in accordance with the legal hierarchy. Harmonization of law is an effort to create a harmony, suitability and compatibility to balance the legal norms. One of the agencies that has this role is the Ministry of Law and Human Rights to each region. The results of the study show that in relation to the duties and functions of the Regional Office, basically the duties and functions of the Regional Office in preparing regional regulations are in line with the provisions of Law Number 12 of 2011 concerning the Establishment of Legislation. the invitation, but the involvement of the Regional Office of the Ministry of Law and Human Rights is limited and passive waiting for the local government and DPRD to participate. In an effort to increase the role of the Regional Office of the Ministry of Law and Human Rights in the process of drafting regional regulations, it is necessary to formulate a rule for implementation that regulates in detail the mechanism for the preparation of regional regulations involving the Regional Government, DPRD and Regional Office of the Ministry of Law and Human Rights. optimizing the preparation of quality regional regulations.

Abstract

Article 15 Number 61 of 2024 is the legality for the President in determining the number of state ministries. On the other hand, Article 17 paragraph (4) of the 1945 Constitution of the Republic of Indonesia delegates that the establishment, amendment, and dissolution of state ministries is regulated in the law, the delegation has implications for the regulation or determination of the number of state ministries stated in the content of the law The results of the research are First, the power of the President in the 1945 Constitution of the Republic of Indonesia in this study is divided into two types, namely:  first, the President's power is based on the check and balance mechanism. second, the power of the President is singular, the power of the President is the power of the President regulated in the 1945 Constitution of the Republic of Indonesia, where the power does not 'intersect' with other functions of state power, both in the capacity of the President as the head of government and as the head of state. The President's power is sole within the scope of state ministries in the 1945 Constitution of the Republic of Indonesia only related to the power to appoint and dismiss ministers, it does not include in determining the number of state ministries as mandated by Article 15 Number 61 of 2024. According to the lawmakers, the President's power to determine the number of state ministries is the prerogative of the President.

Abstract

Constitutional Court Decision Number 62/PUU-XXII/2024 which granted the request for judicial review of the 1945 Constitution of the Republic of Indonesia regarding the presidential threshold (threshold for nominating President and Vice President) stated in the provisions of Article 222 of Law Number 7 of 2017 "Candidate pairs are proposed by political parties or coalitions of political parties participating in the election that meet the requirements of obtaining seats of at least 20% (twenty percent) of the total number of seats in the DPR or obtaining 25% (twenty five percent) of valid votes nationally in the previous DPR member election". In its decision, it was stated that the norm of Article 222 of Law Number 7 of 2017 is contrary to the 1945 Constitution of the Republic of Indonesia (unconstitutional) and has no binding legal force. The decision contradicts several previous Constitutional Court decisions regarding the same object, where the norm of Article 222 of Law Number 7 of 2017 was declared constitutional on the grounds that the norm was categorized as an open legal policy of lawmakers, one of which can be found in Constitutional Court Decision Number 73/PUU-XX/2022. . The formulation of the problem in this study is: 1) What is the concept of open legal policy of lawmakers before and after Constitutional Court Decision Number 62/PUU-XXII/2024? 2) What is the ideal conception in interpreting open legal policy of lawmakers based on the principle of limiting the power of lawmakers contained in the 1945 Constitution of the Republic of Indonesia? This research is a legal research, through a statute approach, a comparative approach, and a conceptual approach.

Abstract

Clinic is a health service facility that organizes individual health services that provide basic and/or specialist medical services. Primary Clinic (Klinik Pratama) is a Clinic that organizes basic medical services both general and specific. To establish a Klinik Pratama so that it can operate through a series of licensing processes namely Nuisance/Hinder Ordonnantie Permit (HO), Establishment Permit Clinic (IMK) and Clinical Operating Permit (IOK). The results of this process are overlapping or repetitive requirements, making the process ineffective and inefficient. This research is intended to analyze the dispute on health facility licensing in Padang City, West Sumatra. This paper analyzes overlapping of clinical licensing. The main problems that analyzed in this paper concerning to analyze and review clinical licensing, analyze licensing regulations at the Padang City level as a basis for recommendations on simplification, deletion and merging of licenses by the Padang City Government.

Abstract

The constitutional right to vote or be elected is a realization of a democratic government system. Freedom exists for every citizen or government to be able to participate in the advancement of a nation. Nominating the head of state in Indonesia is a big part of political participation for every citizen nominated by their political party to be able to run for president. However, in Indonesia, certain conditions must be met for citizens running for President, one of which is a minimum age limit. This age restriction became an academic debate until the Petitioner was tested at the Constitutional Court, where he had potential disadvantages, namely not being able to run for president even though he had experience or expertise in the world of government. This research is legal research with towards statutory case analysis. The results of this research explain that the age restrictions for presidential nomination requirements in Indonesia are not only bound by formal provisions, but the Court provides an alternative consideration regardless of the age of a presidential candidate who can nominate if they have experience or are currently serving as regional heads. The implications of the Constitutional Court's Decision Number 90/PUU-XXI/2023 regarding the alternative in the form of age quality for Presidential candidacy wishes of the Community in performing their  political rights
