Abstract

Pembentukan Peraturan Perundang-undangan, Ayat (1) menyatakan: “Masyarakat berhak memberikan masukan secara lisan dan/atau tertulis dalam pembentukan peraturan perundang-undangan,” dan Ayat (2) menyatakan:“Masukan secara lisan dan/atau tertulis sebagaimana dimaksud pada Ayat (1) dapat dilakukan melalui (a) rapat dengar pendapat umum, (b) kunjungan kerja, (c) sosialisasi, dan (d) seminar, lokakarya, dan/atau diskusi.Mencermati bunyi ketentuan Pasal 96 Ayat (1) dan Ayat (2) UU Nomor 12 Tahun 2011 di atas, pertanyaan kritisnya, apakah hak masyarakat untuk memberikan masukan secara lisan dan/atau tertulis pernah dilakukan oleh lembaga pembentuk hukum (legislatif dan eksekutif) pada saat rapat dengar pendapat umum, kunjungan kerja, sosialisasi, seminar, lokakarya dan/atau diskusi. Hasil penelitian ini menjelaskan bahwa tata cara untuk meningkatkan partisipasi masyarakat dalam pembentukan peraturan daerah adalah melalui Pemerintah daerah menyampaikan informasi tentang penyelenggaraan pemerintahan daerah kepada masyarakat, Pemerintah daerah mendorong kelompok dan organisasi masyarakat untuk berperan aktif dalam penyelenggaraan pemerintahan daerah melalui dukungan pengembangan kapasitas masyarakat, Pemerintah daerah mengembangkan pelembagaan dan mekanisme pegambilan keputusan yang memungkinkan kelompok dan organisasi kemasyarakatan dapat terlibat secara efektif; dan/atau Kegiatan lainnya sesuai dengan ketentuan peraturan perundang-undangan.

Abstract

The Sharia Court is a judicial institution within the scope of the Unitary State of the Republic of Indonesia which has important position in the Indonesian judicial system. The authority of the Syar'iyah Court is regulated through the Qanun of the Province of Nanggroe Aceh Darussalam (Article 1 point 15 of Law Number 11 of 2006 concerning the Government of Aceh). The limitations of the qanun that regulate the authority of the Sharia Court raises its own problems for judges to decide cases. Therefore, it is necessary to formulate and identify the characteristics of the decisions of the Sharia Court in the Province of Nanggroe Aceh Darussalam. This research is a normative legal research with a descriptive-analytic. The results show that the characteristics of the decisions of the Syar'iyah Court in the Unitary State of the Republic of Indonesia are in the form of the decisions of the Syar'iyah courts, the types of cases that are decided at the Syar'iyah courts, and on the basis of legal considerations in the decisions of the Sharia Courts. The characteristics of the decisions of the Sharia Court in these three aspects are not found in other court decisions in the Unitary State of the Republic of Indonesia. Jinayat cases are characteristic of the types of cases that are decided at the Sharia court. This type of Jinayat case shows the development of the concept of the Unitary State in the implementation of regional autonomy. The basis for legal considerations in the decision of the Sharia Court are facts (events and law), trial facts, sources of law and statutory regulations.

Abstract

Alasan pemberhentian (impeachment) Presiden dan/atau Wakil Presiden dalam masa jabatannya tidak hanya berdasarkan atas alasan pelanggaran hukum tetapi juga dapat didasarkan atas pelanggaran etik. Pelanggaran etik dan penegakannya terkait Presiden dan/atau Wakil Presiden secara tersirat dapat dikonstruksikan melalui analisa terhadap Pasal 9 ayat (1), Pasal 7A, Pasal 7B UUD Negara Republik Indonesia Tahun 1945 dan Undang-Undang Nomor 7 Tahun 2017 Tentang Pemilihan Umum.

Abstract

The Nagari Government is the lowest government and the implementation of the Nagari government is based on the traditions and socio-culture of the people of West Sumatra. The form of the Nagari Government has been regulated through the West Sumatra Provincial Regulation Number 7 of 2018 concerning Nagari. The development that occurs from a homogeneous society to a heterogeneous society has the potential for social change both internally and externally. This social change is influenced by various factors, including population transmigration, marriage, and the economy that forces people to settle in the area. The increase in heterogeneous society certainly gives rise to heterogeneous villages in West Sumatra. The results of the first study, the form of legal construction of the village administration policy can be done in an argumentum a contrario. This legal construction is the right model where in order to achieve all the interests of the community in the local nagari, legal discovery can be made by agreement (buek arek) with due regard to local wisdom. Second, the policies in the Nagari Government are special and different from the general village regulations and are based on the values ​​that have been integrated into the Nagari environment..

Abstract

Putusan Mahkamah Konstitusi  Nomor 91/PUU-XVIII/2020 memerintahkan kepada pembentuk undang-undang, (dalam hal ini, konstitusionalitas lembaga yang memiliki kewenangan membentuk undang-undang adalah  Dewan Perwakilan Rakyat ) untuk melakukan perbaikan pembentukan Undang-Undang Nomor 11 Tahun 2022  Tentang Cipta Kerja , artinya, untuk ‘mengulang kembali’ proses pembentukan undang-undang mulai dari tahap tahapan perencanaan, penyusunan, pembahasan, pengesahan, dan pengundangan, atau sebahagian dari tahapan tersebut. Tetapi Presiden telah melakukan ‘manuver’ terlebih dahulu dengan menafsirkan”  tindak lanjut atau pelaksanaan Putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 ditujukan kepada Presiden,  maka diterbitkan Peraturan Pemerintah Pengganti Undang-Undang (PERPPU) Nomor 2 Tahun 2022 Tentang Cipta Kerja. Secara konstitusional, Presiden bukanlah lembaga yang memiliki kewenangan membentuk undang-undang, tetapi sebagai lembaga yang terlibat dalam proses pembentukan undang-undang.

Abstract

Clinic is a health service facility that organizes individual health services that provide basic and/or specialist medical services. Primary Clinic (Klinik Pratama) is a Clinic that organizes basic medical services both general and specific. To establish a Klinik Pratama so that it can operate through a series of licensing processes namely Nuisance/Hinder Ordonnantie Permit (HO), Establishment Permit Clinic (IMK) and Clinical Operating Permit (IOK). The results of this process are overlapping or repetitive requirements, making the process ineffective and inefficient. This research is intended to analyze the dispute on health facility licensing in Padang City, West Sumatra. This paper analyzes overlapping of clinical licensing. The main problems that analyzed in this paper concerning to analyze and review clinical licensing, analyze licensing regulations at the Padang City level as a basis for recommendations on simplification, deletion and merging of licenses by the Padang City Government.

Abstract

General elections are a means of democracy to elect leaders who will carry out the wheels of government for a certain period of time, through legitimate power transfer procedures by involving public participation. Elections are the crystallization of popular sovereignty in procedural mechanisms. But often in the implementation of procedural democracy this is followed by fraudulent actions that tarnish the true nature of democracy (substantial democracy). Therefore, we need a law enforcement agency for every action that can damage the essential meaning of democracy and elections in Indonesia. The idea of a special court emerged as an alternative to electoral dispute resolution in the study of Indonesian constitutional law, however this idea needs to be discussed in more depth from various aspects to see its relevance to the Indonesian constitutional system, given that long before there was the idea of a special election court, Indonesia already had a number of institutions that given a mandate and authority to resolve disputes related to elections. This paper uses normative juridical methods in its study and is supported by secondary data in the form of primary, secondary and tertiary legal materials. The analysis used is qualitative analysis. The results of the study revealed that the idea of establishing an electoral special court was the idea of state administration which emerged amidst the struggle to substantially improve the quality of democracy. However, in its formation, it does not only require clear legal politics, but also requires a holistic study of the mechanism and flow of resolution and models of electoral dispute resolution. The parameter that needs to be used in examining the idea of a special electoral court is to measure the extent and importance of elections for Indonesian democracy. because the more important the meaning of the election is the presence of special election court more worthy of consideration

Abstract

Fulfilling the legal needs of the community is one of the legal materials regulated in Article 10 paragraph 1 of law number 12 of 2011 concerning the formation of statutory regulations. However, there are unclear parameters or characteristics of community law compliance. This has resulted in the emergence of laws that do not meet the legal needs of the community. For example, The Law Of Cipta Kerja. There are many legal problems in this law, both in the process of formation and in substance. When linked with the principles of morality, several articles in this law violate these principles. One of them is moral principle that serve as an ethical foundation in the formation of law, especially the value of justice for all people.

Abstract

The constitution gives citizens freedom to engage in commercial activities not only to increase their economic income. But rather to encourage the quality of each individual to continue productivity. Currently, a variety of jobs have developed which can increase individual income, where the global economic cycle is better than in the past. Recently, there have been plans for every profession in the Indonesian National Army (TNI) to be able to do business. This plan is due to the Draft Law or what is called Bill Number 34 of 2002 concerning the TNI.  Polemic about eradicating norms"prohibition of the TNI in doing business” has become a matter of public concern at the moment, there are concerns that the TNI's role as a national defense soldier will be disrupted. This research is legal research (doctrinal research) with a legal approach (statues approach), analytical approach (analytical approach), and conceptual approaches (conceptual approach). The research results explain that First The National Army is not only to uphold, protect and safeguard the nation's sovereignty from Indonesian military and non-military attacks/threats, but can also participate in civil society activities such as helping victims of natural and non-natural disasters or joining the government as long as the orders of their superiors has been regulated in law.  Second, the rights to life of a TNI soldier are no different from civil rights, especially the rights to improve their daily welfare. Third, the urgency of eliminating the norm regarding "TNI is prohibited from doing business" is a legal effort to look at the situation progressively. Therefore, the abolition of the norm "TNI is prohibited from doing business" is a legal effort to protect their economic rights in improving the standard of living for those of their families.
