Abstract

Childfree is a life choice not to have children after or before marriage, whether biological children, stepchildren, or adopted children. This article discusses how childfree is influenced by the digital era and what the perspective of Islamic law is according to the views of ulama and gender activists in Malang, East Java. This empirical legal study used legal sociology and maqāṣid al-sharī’ah approaches. Data were collected by means of in-depth interviews and a literature review. Findings showed that child-free development in Indonesia has been influenced by the digital era through online media, which quickly spread and made it easier for people from various countries to interact and share information. One of the objectives of Islamic law (maqāṣid al-sharī'ah) is to maintain offspring (hifz al-nasl) through marriage. According to the ulama, being childfree is contrary to Islamic law and the nature of humanity. According to the Nahdlatul Ulama, Muhammadiyah, and gender activists, the laws on childfree can be summed up in two ways: haram and mubah. Childfree is haram (unlawful) because it is contrary to maqāṣid al-sharī’ah, i.e., preserving offspring, as it is also the goal of marriage. Childfree is mubah (allowed) if there are reasons that are condoned by the sharia, e.g., health problems, physical limitations, and psychological conditions that prevent the wife from having children. Sociologically, the government and all related parties need to provide education to the public so that the meaning of childfree can be understood properly and correctly.

Abstract

The distribution of joint property regulated under the Compilation of Islamic Law is considered very effective due to the legal certainty guaranteeing that ex-husbands and wives receive a half share. However, these provisions cannot be fully applied to estranged husbands and wives because family background conditions vary. There are certain conditions where husbands and wives have multiple roles, and this occurrence needs to be more profoundly studied. Therefore, this study is presented to analyze the distribution of joint assets according to the roles assigned in the household. This research employed a normative-legal method and statutory and conceptual approaches. The primary data in this study is the Compilation of Islamic Law (KHI). The researcher analyzed activity profiles, access and control between husband and wife as specified in KHI norms by using a gender equity analysis tool. The results show that the fair value of the distribution of joint assets which refers to the division of roles between husband and wife contained in the KHI has set different roles between the two, in which the husband works outside the house while the wife serves as a housewife. Meanwhile, currently, all roles performed by husbands can also be performed by wives and the other way around, while unchangeable roles remain in the biological or reproductive role. So the division of roles cannot be interpreted literally because the husband or wife has flexible and fair access and control. Keywords: joint property; gender equality; spouses rights.

Abstract

This study explores  Fatima Menissi's perspective on the position and leadership of women in Islam based on existensialist feminism theory. A descriptive-qualitative approach draws on the finding from the literature Study (library research). This study uses data collection techniques based on the documentary method. The result suggest that Fatimah argues about the hadith narrated by Abu Bakrah was used to corner women in political activities. This hadith cannot be used as a reference to reject women's leadership in the public sphere. According to existentialist feminist theory, women have their own freedom and autonomy. This theory is  accordance with Fatima's opinion that women have the right to fight for their rights and freedom to make decisions in marriage, education, and employment. As long as women cannot be separated from their nature as a woman and wife. This is based on that every human being has the right to herself. Therefore, women have the right to be themselves without any pressure and become second class society. In occupying a leadership position is not based on gender (sex).

Abstract

Abstract Cases of sexual violence have recently occurred frequently in the public sector, such as workplaces, public services, educational institutions, and even places of worship like mosques. The Indonesian Mosque Council (DMI), as an authoritative institution, aims to create mosques that are friendly to women and children to address this issue. This hope is carried out by the leadership of the Indonesian Mosque Council from the central level to the regions. This research aims to examine the responses and prevention models of sexual violence that will be implemented by the Regional Leadership of the Indonesian Mosque Council (PD DMI) in Malang Regency in realizing mosques that are friendly to women and children. This research is a field study with a phenomenological qualitative approach. Primary data sources include the PD DMI of Malang Regency, the Expert Council of PD DMI of Malang Regency, the management of the Great Mosque and the Grand Mosque, as well as the Department of Empowerment of Muslimah, Children, and Families (PPMAK) at PD DMI of Malang Regency. Meanwhile, the secondary data consists of literature books, journals, laws, and related regulations obtained from interviews and documentation. The results obtained indicate that realizing a mosque that is friendly to women and children is not only achieved through the provision of information and education on the prevention of sexual violence but also includes the establishment of regulations, integration of themes in Friday sermons, education through study circles, infrastructure improvements, the establishment of family corners, and collaboration with relevant institutions Keywords: Indonesian Mosque Council; Sexual Violence; Women and Children Friendly MosqueAbstrak Kasus kekerasan seksual belakangan sering terjadi di sektor publik seperti tempat kerja, layanan publik, lembaga pendidikan, bahkan terpat peribadatan seperti masjid. Dewan Masjid Indonesia (DMI) sebagai lembaga berwenang ingin mewujudkan masjid ramah perempuan dan anak untuk mengatasi kasus tersebut. Harapan ini dilakukan oleh pimpinan Dewan Masjid Indonesia di tingkat pusat sampi daerah. Penelitian ini bertujuan untuk melihat respons dan model pencegahan kekerasan seksual yang dilakukan oleh Pimpinan Daerah Dewan Masjid Indonesia (PD DMI) Kabupaten Malang dalam mewujudkan masjid ramah perempuan dan anak. Penelitian ini termasuk penelitian lapangan dengan pendekatan kualitatif fenomenologis. Sumber data primer meliputi PD DMI Kabupaten Malang, Dewan Pakar PD DMI Kabupaten Malang, Takmir Masjid Besar dan Masjid Agung, serta Departemen Pemberdayaan Potensi Muslimah, Anak dan Keluarga (PPMAK) pada PD DMI Kab. Malang. Sedangkan data skunder berupa buku literatur, jurnal, undang-undang, dan peraturan terkait yang diperoleh dari wawancara dan dokumentasi. Hasil yang diperoleh yaitu dalam mewujudkan masjid ramah perempuan dan anak tidak hanya dilakukan melalui pemberian informasi dan edukasi mengenai pencegahan kekerasan seksual, tetapi juga mencakup pembentukan regulasi, integrasi tema dalam khutbah Jum'at, pendidikan melalui pengajian, perbaikan infrastruktur, pendirian family corner, serta kolaborasi dengan lembaga-lembaga terkait. Abstract

Sejumlah karya sastra seringkali masih menghadirkan narasi bias gender yang merugikan perempuan. Hal ini disebabkan penulis kurang memiliki kepekaan gender dan pemahaman konsep gender, sehingga tidak mampu mengintegrasikannya ke dalam tulisannya. Kertas kerja ini bertujuan untuk menganalisis novel karya Ihsan Qudus yang berjudul “Saya Lupa Bahwa Saya Adalah Seorang Perempuan”. Judul novel tersebut terkesan provokatif dan diskriminatif terhadap perempuan. Namun jika dilihat dengan analisis kritis, ditemukan hasil yang berbeda dan menarik. Sosok perempuan sebagai tokoh utama dalam novel tersebut menggambarkan bentuk perlawanan perempuan di tengah latar belakang sosial budaya masyarakat Mesir yang masih meninggalkan bias gender dan diskriminasi terhadap perempuan. Melalui novel ini, novelis ingin mengungkap fakta bahwa perempuan di Mesir juga memiliki kepekaan gender, meniti karir, menempati posisi strategis, mendominasi ruang publik dan berkontribusi bagi kemajuan bangsanya. Dengan pendekatan deskriptif kualitatif, analisis gender dan cara pandang Qasim Amin tentang emansipasi perempuan, hasilnya ditemukan nilai-nilai kesetaraan gender dalam novel “Saya lupa bahwa saya perempuan”, yaitu keberhasilan Suad dalam mewujudkan semua mimpinya. Sedangkan permasalahan gender yang ditemukan dalam novel ini adalah konstruksi budaya Mesir yang membatasi peran perempuan dalam masyarakat, baik dari aspek akses, partisipasi, penguasaan sumber daya dan manfaat bagi laki-laki maupun perempuan dalam kehidupan. Terdapat pula diskriminasi gender berupa stereotipe gender, subordinasi, marginalisasi, beban ganda dan kekerasan berbasis gender.

Abstract

Cases of religious intolerance in the education sector in Indonesia are still common. Tosari District has a diverse religious population, but it is known that religious conflicts rarely occur, especially in the field of education, where massive social interaction can foster harmony between religious communities. This study aims to explain and compare religious tolerance values based on social interaction at State Junior High Schools (SMPN) 1 and 3 in Tosari District, Pasuruan Regency. The researcher selected these two educational institutions due to their differing religious compositions. SMPN 1 Tosari has the highest number of Hindu students, while SMPN 3 Tosari is predominantly Muslim. This study employs a qualitative approach with a multiple case study design. The findings reveal three religious tolerance values in both institutions: mutual respect, social concern, and solidarity. These values emerge based on different patterns of social interaction. The study recommends strengthening religious tolerance values in junior high schools in general.

Abstract

This study discusses the balance of family roles in Sandwich Generation adolescents in realizing optimal mental health. The background of this study is the increasing pressure faced by adolescents who have to take care of parents and children simultaneously, which often has a negative impact on their mental health. The purpose of this study is to examine how Sandwich Generation adolescents balance their roles in the family and its impact on their mental health. The method used was desk research with a phenomenological qualitative approach to understand adolescents' subjective experiences. The results showed that balanced family support can reduce stress and improve mental health, while role imbalance can lead to emotional problems, such as anxiety and depression. The conclusion of this study emphasizes the importance of the family's role in creating a supportive environment for Sandwich Generation adolescents to effectively manage their responsibilities and maintain optimal mental health.

Abstract

HIV/AIDS is currently spreading more widely in society. The government and society have responded to this issue by establishing the National Commission for AIDS Prevention (KPAN). Malang Regency issued Local Regulation Number 14 of 2008 on AIDS Prevention, forming KPAN facilitated by the local government budget and building international cooperation. Ironically, the number of infected individuals continues to rise. This research aims to describe the implementation of HIV/AIDS prevention based on Local Regulation Number 14 of 2008. The results highlight supporting factors and obstacles in the implementation through institutional networks in Malang. By applying qualitative methods through interviews, observation, and documentation, this research reveals that the AIDS prevention process through networking is relatively effective. As a result, through this program, services have improved, qualified facilities are provided, KPA's network performance has enhanced, and society's understanding of HIV/AIDS issues has gradually grown, supported by social capital and stakeholder solidarity, although challenges remain. HIV/AIDS saat ini semakin meluas penyebarannya di masyarakat. Pemerintah dan masyarakat telah merespons isu ini dengan membentuk Komisi Penanggulangan AIDS Nasional (KPAN). Kabupaten Malang menerbitkan Peraturan Daerah Nomor 14 Tahun 2008 tentang Penanggulangan AIDS, mendirikan KPAN yang difasilitasi oleh anggaran pemerintah daerah dan membangun kerja sama internasional. Namun ironisnya, jumlah orang yang terinfeksi terus meningkat. Penelitian ini bertujuan untuk mendeskripsikan implementasi penanggulangan HIV/AIDS berdasarkan Perda Nomor 14 Tahun 2008. Hasil penelitian menunjukkan faktor pendukung dan hambatan dalam implementasi melalui jejaring kelembagaan di Malang. Dengan menggunakan metode kualitatif melalui wawancara, observasi, dan dokumentasi, penelitian ini mengungkapkan bahwa proses penanggulangan AIDS melalui jejaring cukup efektif. Hasilnya, melalui program ini, layanan semakin baik, fasilitas yang memadai tersedia, kinerja jejaring KPA meningkat, serta pemahaman masyarakat tentang isu HIV/AIDS berkembang secara bertahap dengan dukungan modal sosial dan solidaritas stakeholder, meskipun masih ditemui hambatan.

Abstract

Families who have economically vulnerable conditions sometimes need strengthened resilience because there are various problems that come to them. Lazis Sabilillah Malang city has a program called family assistance with the aim of helping families and underprivileged people who live in Malang City in the form of education, economy, health, and spirituality. Therefore, Walsh's theory regarding the importance of belief systems, organizational patterns, and communication processes is important to study for families facing various challenges in order to maintain family resilience and develop. This research is a type of empirical research with a legal sociology approach. The data source consists of primary data through Lazis Sabilillah assisted family informants and secondary data obtained from books, journals, related legislation. data collection through interviews and documentation. The results showed that the program provided by Lazis Sabilillah was very helpful and effective for the assisted families, besides that the program that had a lot of influence and benefits for the assisted families was spiritual, educational, economic, and finally the health program. Regarding family assistance carried out by Lazis Sabilillah is a reflection of the Walsh family resilience principle. In building meaning during crisis situations, it can mobilize the economy, and strengthen communication in family members. However, most of the assisted family informants have not fulfilled the three Walsh family resilience indicators due to various factors behind them. Abstract

Background. Marriage is a lawful and main way to realize and maintain human honor, because by marrying people can avoid behaviors that are forbidden by Allah SWT. As normal human beings in their human instincts, persons with disabilities are also gifted with sexual desire and the desire to continue their offspring in a grand procession called marriage. However, with the various shortcomings that exist in them, they are worried that they will have difficulty in carrying out the life of the ark of their household life.Aim. For this reason, it is necessary to know how marriages carried out by persons with disabilities are in the eyes of legislation and Islamic law, and this requires legal certainty.Methods. This literatur study purpose to determine and analyze: Marriage Law for Persons with Mental Disabilities according to Law No. 1 of 1974 and Law no. 8 of 2016. This research method uses library research methods, namely research that collects data and information with the help of various materials contained in the literature.Results. The results of this study are that legally, marriages for people with mental disabilities are still legal in terms of harmony and there is no damage or there must be an annulment in terms of the terms of marriage. Because for people with mental disabilities, whether prospective brides or grooms, there are no criteria, they must be healthy and respond to the needs of contemporary life such as human rights, gender, environment, democracy and others.
