Abstract

The basic right to life is a human right protected in the Indonesian constitution. In this case, residents of the assisted communities still have the right to life as part of their human rights so that the state is obliged to try to protect them from the dangers of the Covid-19 pandemic which threatens the location of prisons where assisted residents live. The implementation of the policy of the Decree of the Minister of Law and Human Rights of the Republic of Indonesia Number M.Hh-19.Pk.01.04.04/2020 has not been very effective because there are still prisoners and children who are returned to prisons or detention centers for returning to commit crimes. In the field of supervision, there are still shortcomings, namely that supervision only involves elements of the Bapas and the Prosecutor's Office which are limited.

Abstract

Paper ini berisi analisis tentang pentingnya keterlibatan Mahkamah Konstitusi mengawasi proses amandemen UUD 1945 oleh MPR agar hasilnya senantiasa selaras dengan ketentuan Pasal 37 UUD 1945. Sebab, sekalipun hukum sudah memberikan pedoman bahwa MPR hanya dapat melakukan perubahan atas pasal- pasal konstitusi sebagaimana yang telah diusulkan sebelumnya, namun ada potensi MPR mengabaikan ketentuan tersebut sehingga membuka peluang terjadinya penyalahgunaan kekuasaan yang dapat merugikan kepentingan rakyat. Adapun jalan keluar yang diusulkan untuk mengoreksi pelanggaran oleh MPR saat melakukan amandemen konstitusi atas ketentuan Pasal 37 UUD 1945 yaitu Mahkamah Konstitusi harus membatalkan keputusan MPR tersebut melalui mekanisme judicial review.

Abstract

Pembangunan infrastruktur pemerintahan Provinsi Papua Pegunungan di Distrik Walesi memicu dinamika hukum terkait eksistensi hak ulayat masyarakat adat setempat. Penelitian ini bertujuan untuk menganalisis kedudukan hukum hak ulayat tanah adat di Walesi dalam konstalasi hukum nasional serta mengidentifikasi resolusi konflik yang berkeadilan bagi masyarakat adat dan pemerintah. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan kepustakaan dan perundang-undangan. Hasil penelitian menunjukkan bahwa secara de jure, hak ulayat diakui kuat oleh UUD 1945, UU Peraturan Dasar Pokok-Pokok Agraria (UUPA), dan UU Otonomi Khusus Papua. Namun, secara de facto, dalam proses pengadaan tanah bagi pembangunan demi kepentingan umum di Walesi, seringkali terjadi benturan komunikasi dan mekanisme ganti kerugian yang belum sepenuhnya memenuhi asas keadilan distributif. Diperlukan pendekatan hukum progresif yang mengedepankan musyawarah (pacta sunt servanda) serta penghormatan terhadap struktur adat setempat guna meminimalisir konflik horizontal maupun vertikal.

Abstract

Sexual violence remains a persistent structural problem in Indonesian society, and rural communities in particular suffer from low legal literacy and limited access to formal complaint mechanisms. The enactment of Law Number 12 of 2022 on the Crime of Sexual Violence (UU TPKS) marked a paradigm shift by placing prevention, victim protection, and community participation at the center of the national legal framework. Yet the effectiveness of this law depends on how far its norms are translated into practice at the village level, where legal education is often sporadic and complaint channels remain distant from ordinary citizens. This article examines the urgency of continuous legal education on the TPKS Act and explores the establishment of village-based community complaint centers as an institutional bridge between normative protection and practical accessibility. Employing normative juridical research with statutory and conceptual approaches, the study analyzes the TPKS Act, the Village Law, and their implementing regulations alongside recent socio-legal literature. The findings show that community complaint centers, when embedded in sustained legal education and linked to formal referral pathways such as UPTD PPA, can strengthen early detection, reporting, and victim assistance. The article recommends a collaborative model integrating village government, community-based service providers, and law enforcement to operationalize the participatory mandate of the TPKS Act.
