Abstract

Independensi kekuasaan kehakiman (judicial independence) merupakan elemen kunci dalam mewujudkan good governance di dalam sistem demokrasi konstitusional. Artikel ini bertujuan untuk menganalisis bagaimana judicial independence berkontribusi terhadap indikator utama good governance, serta mengevaluasi tantangan struktural dan kelembagaan yang dihadapi oleh sistem peradilan Indonesia. Penelitian ini menggunakan pendekatan yuridis-normatif yang diperkuat dengan data sekunder dari putusan pengadilan, laporan lembaga internasional, serta studi komparatif terhadap praktik negara lain. Temuan penelitian menunjukkan bahwa meskipun secara normatif Indonesia telah menjamin kemandirian kekuasaan kehakiman, dalam praktiknya masih terdapat berbagai hambatan, antara lain kesenjangan antara norma dan praktik, ketergantungan administratif terhadap eksekutif, intervensi politik dalam rekrutmen hakim, dan lemahnya pengawasan etik. Ketiadaan judicial independence berdampak langsung pada menurunnya akuntabilitas, transparansi, serta efektivitas pemerintahan. Oleh karena itu, dibutuhkan reformasi menyeluruh yang meliputi aspek regulatif, institusional, dan kultural agar peradilan dapat berfungsi secara optimal sebagai pilar demokrasi dan pengawal tata kelola pemerintahan yang baik.

Abstract

This study examines the legal legitimacy of the delegation of authority for managing Public Street Lighting (PJU) from the provincial government to district/city governments. This delegation often occurs without the support of clear legal norms, thus giving rise to issues of legality, accountability, and clarity of the authority structure between levels of government. This study uses a socio-legal approach with normative analysis techniques based on the legitimacy theory of French and Raven and the systemic legal theory of H.L.A. Hart. The research location focused on Pasuruan Regency. The results of the study indicate that the district government's authority in handling PJU is still functional without adequate legal legitimacy, and is not supported by a strong system of coordination and institutional recognition. This condition reflects the weak integration between the legal structure and administrative implementation, which impacts the effectiveness of services and legal certainty in PJU governance.

Abstract

Pesantren or Islamic traditional boarding school is one the unique institution within Indonesian Islam. Serving a comprehensive education with emphasis on the internalization of Islamic values is the main purpose of pesantren. Additionally, since they also serve the society safeguarding and leadership, Pesantren promote the emergence of new leadership. This study explores how pesantren cultivates leadership by integrating spiritual depth with intellectual rigor highlighting 5 pesantrens across East Java. Using a Systematic Literature Review (SLR) from Scopus, WoS, and Semantic Scholar, the findings identify five leadership development categories in pesantren: moral and character-based, entrepreneurial, humanist and inclusive, spiritual and religious, and transformational and innovative leadership. As a result, Pesantren provides a strong foundation for leadership education, grounded in moral, spiritual, and local wisdom. This model has been proven effective in shaping character, integrity, and responsibility, making it a relevant framework for fostering the nation's moral and leadership development. Their alumni show strong leadership skills that beneficial for their role in society.

Abstract

The rule of law sets as an important principle entrenched in the Constitution of Malaysia and Indonesia. This principle stand as a guardian against abuse of power by the government as nobody shall be above the law. This paper examines the practices of the executive power relating to decision-making policy, execution of power and enforcement activities in Malaysia and Indonesia. It also analyses how the executive branch perfoms the powers in accordance to the rule of law. It mainly focuses on the institutional framework of the head of the government and head of state. The analysis allows for identifications of issues and proposals on the enhancement of the executive branch in both countries that would increase the quality of state administration as well as promoting the rule of law. The study adopts a normative method where the fundamental discussions are based on normative approach with content analysis approach on the constitutional and legal provisions, legal cases, circular and directive. The data acquired through doctrinal study is supported by semi-structured interviews with respondents that have been selected through purposive approach. This article concludes that the executive branch plays important roles in promoting the rule of law in both countries. The Constitution, in this case, provides constitutional limitation for the institutional branch of the executive to perform its powers. In the age of rule of law, the executive powers has to be limited. There is no power without limits. The laws has to provide a clear legal direction and reliable mechanism of checks and balances to govern the exercise of the executive powers.

Abstract

Desa Wisata Taro memiliki daya tarik wisata alam yang asri berupa hutan bambu yang terkonservasi oleh desa, sungai yang bersih serta peternakan lembu putih yang dikelola secara adat dan diternak dengan baik oleh warga desa. Dari hasil observasi, ditemukan beberapa permasalahan yaitu: pengelolaan desa wisata belum optimal, pengurus desa wisata belum mengetahui dasar hukum yang tepat dalam pengelolaan desa wisata, dan permasalahan yang tidak kalah penting adalah kurangnya wawasan pengurus Desa Wisata Taro mengenai metode yang tepat dalam pengelolaan wisata alam berkelanjutan. Solusi yang ditawarkan untuk permasalahan pertama adalah melakukan kegiatan loka karya. Kemudian untuk permasalahan kedua diberikan penyuluhan terkait dasar hukum pengelolaan desa wisata. Solusi permasalahan ketiga adalah benchmarking metode pengelolaan wisata alam berkelanjutan yang diterapkan di Swiss. Secara garis besar metode pelaksanaan kegiatan ini terdiri atas identifikasi masalah, observasi, analisis situasi, seminar/penyuluhan/benchmarking. Keberhasilan kegiatan diukur menggunakan indikator: tercapainya tujuan kegiatan, tercapainya target yang telah direncanakan, dan keberlanjutan program. Tingkat ketercapaian ketiga indikator ini menunjukkan nilai di atas 75% sehingga kegiatan pengabdian ini telah berjalan baik. Sebagai bentuk keberlangsungan proram, promosi Desa Wisata Taro perlu terus dilakukan dan diperbaharui agar meningkatkan daya tariknya, masyarakat Desa Taro perlu mengimplementasikan materi dari penyuluhan dasar hukum pengelolaan desa wisata, dan hasil benchmarking metode pengelolaan sustainable tourism perlu dijadikan referensi oleh pengelola Desa Wisata Taro dalam mengelola dampak pariwisata terhadap lingkungan, sosial, budaya, serta ekonomi untuk masa kini dan masa depan, baik bagi masyarakat lokal maupun wisatawan

Abstract

Cultural heritage is a fundamental asset in promoting cultural diversity and facilitating access to education, social values, science, technology, and tourism. Museums play a pivotal role in preserving cultural heritage and fulfilling constitutional obligations, as enshrined in the Indonesian Constitution. Protecting cultural heritage is essential for maintaining national identity and upholding citizens' constitutional rights, particularly in education and cultural participation. This study analyses the constitutional framework and government policies related to cultural heritage protection, with a specific focus on museums in Indonesia. Employing a statute-based and comparative approach, the research examines constitutional provisions such as Article 18B(1) of the Indonesian Constitution, which mandates the state’s responsibility to preserve cultural heritage and safeguard indigenous communities' rights. Despite this constitutional obligation, challenges such as limited financial resources, inadequate maintenance, and institutional constraints hinder the effective operation of museums. The findings emphasize that strengthening museums is not only necessary for heritage conservation but also for fostering national and local values that define Indonesia’s constitutional identity. The study argues that the government must implement more comprehensive policies and allocate sufficient resources to enhance museums’ role in cultural preservation, ensuring their sustained contribution to public welfare and national development.

Abstract

The use of Artificial Intelligence (AI) in notarial services is becoming increasingly important in the era of digital transformation. However, previous studies have mainly focused on the opportunities offered by digitalization and have not sufficiently addressed the legal conflicts arising from the use of AI in Indonesian notarial practice. This study aims to analyze the legal challenges of AI implementation in notarial services and to propose a regulatory model that supports legal certainty, accountability, and personal data protection. This research uses a normative juridical approach through statutory, conceptual, and comparative analyses. The study examines the Law on Notarial Office, the Electronic Information and Transactions Law, and the Personal Data Protection Law, supported by relevant legal literature and international developments regarding AI governance. The results show that Indonesian notarial regulations have not fully adapted to technological developments. While the Electronic Information and Transactions Law recognizes electronic documents and digital signatures, the Law on Notarial Office still requires conventional notarial procedures, creating regulatory inconsistency and legal uncertainty. The study also finds that the use of AI in notarial practice raises challenges related to legal responsibility, transparency, cybersecurity, and personal data protection. This study proposes an AI-assisted notarial regulatory model based on three principles: recognition of electronic notarial services, human supervision over AI systems, and stronger personal data protection mechanisms. The study contributes to the development of cyber notary regulation in Indonesia by positioning AI as a supporting tool under the responsibility and control of the notary.
