Abstract

The rapid expansion of digital technology has transformed the circulation of literary works, particularly electronic books, while simultaneously intensifying copyright infringement through unauthorized digital reproduction and distribution across online platforms, electronic marketplaces, and decentralized cyber networks. This study examines the legal construction, enforcement mechanisms, and structural obstacles concerning the circulation of pirated digital books under Law Number 28 of 2014 concerning Copyright within Indonesia’s contemporary digital ecosystem. Employing normative-juridical legal research, the study applies statutory, conceptual, and doctrinal approaches through qualitative analysis of legislation, legal doctrines, scholarly literature, and relevant regulatory frameworks governing copyright and electronic systems. The analysis demonstrates that Indonesian copyright law formally provides comprehensive protection for digital books through civil, criminal, and administrative enforcement mechanisms, yet operational effectiveness remains constrained by complaint-based criminal procedures, fragmented intermediary liability standards, technological enforcement limitations, and the normalization of digital piracy within online culture. The study further argues that effective copyright protection in cyberspace requires an integrated cyber-regulatory framework emphasizing preventive governance, intermediary accountability, technological supervision, and strengthened legal consciousness to ensure sustainable protection of intellectual property rights within digitally mediated environments.

Abstract

This study analyzes the legal protection of digital content copyright on social media under Law Number 28 of 2014 concerning Copyright. The rapid expansion of social media platforms has accelerated the creation, dissemination, and commercialization of digital content, including videos, photographs, music, graphic designs, and live-streaming content, while simultaneously increasing the prevalence of copyright infringement. Common violations include unauthorized re-uploading, removal of attribution, unauthorized modification, and commercial exploitation without the consent of copyright holders. This normative legal research employs statutory, conceptual, and analytical approaches using primary legal materials, including Law Number 28 of 2014, as well as secondary materials derived from legal doctrines and scholarly publications. The findings indicate that the Copyright Law provides comprehensive protection through the declarative principle, moral rights, economic rights, technological protection measures, rights management information, and notice-and-takedown mechanisms within electronic systems. The study also finds that copyright enforcement is supported through administrative, civil, and criminal remedies designed to address various forms of infringement. Despite the adequacy of the normative framework, enforcement remains constrained by challenges related to digital evidence, cross-border jurisdiction, technological developments, and limited public awareness. The study concludes that strengthening institutional coordination, digital copyright literacy, and platform cooperation is essential for improving the effectiveness of copyright protection in social media environments.

Abstract

This study examines the systematic vulnerabilities embedded within the Indonesian first to file trademark registration framework under Law Number 20 of 2016 concerning Trademarks and Geographical Indications. Utilizing a qualitative normative juridical research design, the investigation evaluates the persistent misalignment between statutory mandates, administrative examinations, and judicial outcomes. The analysis shows that the absence of standardized testing metrics for the triple identity test generates severe subjectivity during the evaluation of dominant visual, phonetic, and conceptual elements. Furthermore, comparative case studies of landmark litigations expose deep inconsistencies in how commercial courts interpret bad faith intentions and cosmetic brand modifications. These institutional challenges are exacerbated by the rapid growth of the digital marketplace, which enables sophisticated lookalike storefronts to exploit existing legal voids and dilute corporate goodwill. The study concludes that building a secure and innovative domestic market ecosystem requires urgent structural reforms, including automated phonetic mapping technologies, standardized judicial evaluation guidelines, and inclusive registration pathways.

Abstract

This study aims to analyze the urgency of intellectual property rights protection in the context of the digital economy and to formulate effective legal strategies for protecting business ideas. The background of this study stems from the increasing vulnerability of business ideas to imitation and infringement due to advances in digital technology, which have accelerated the distribution and reproduction of intellectual works. The method used is non-empirical legal research employing a normative, doctrinal, and conceptual approach through an analysis of relevant legislation, legal doctrines, and academic literature. The research findings indicate that although Indonesia’s legal system possesses a comprehensive regulatory framework, there remain normative gaps and inconsistencies in accommodating the protection of business ideas in the digital era. The analysis also highlights the need for an integrative legal strategy through a combination of intellectual property registration, trade secret protection, strengthening of business contracts, and the utilization of digital technology. The study’s conclusion emphasizes that effective protection requires a multidimensional approach that is adaptive to technological developments and supported by responsive legal policies.

Abstract

This study aims to conduct a legal analysis of the practice of unauthorized content reuploading as a form of copyright infringement on social media in Indonesia, as well as to evaluate the effectiveness of its enforcement in the digital context. The method used is normative legal research employing a legislative, conceptual, and comparative approach to international legal instruments. The results of the study indicate that the practice of reuploading constitutes a copyright infringement because it involves acts of reproduction, distribution, and public communication without the creator’s consent, thereby directly violating the economic rights and moral rights guaranteed under Law No. 28 of 2014 on Copyright. Furthermore, the open, fast, and cross-border nature of digital media amplifies the intensity and impact of such infringements compared to conventional forms. Law enforcement against this practice still faces significant challenges, including low public legal awareness, limited capacity of law enforcement agencies, and the suboptimal role of digital platforms in prevention. This study underscores the importance of strengthening adaptive regulations, enhancing the effectiveness of law enforcement, and integrating the role of digital platforms to create a copyright protection system that is more responsive to technological developments.

Abstract

Perkembangan Generative artificial intelligence (AI) telah menimbulkan persoalan hukum baru terkait status perlindungan hak cipta atas karya yang dihasilkannya. Sistem hukum Indonesia belum memberikan kepastian hukum mengenai posisi karya AI, karena peraturan yang berlaku masih mengasumsikan manusia sebagai satu-satunya subjek hukum hak cipta. Rumusan masalah dalam penelitian ini diarahkan untuk menjawab pertanyaan mengenai apakah karya yang dihasilkan oleh sistem Generative AI dapat dikualifikasikan sebagai ciptaan yang dilindungi oleh hak cipta menurut peraturan perundang-undangan di Indonesia, serta bagaimana posisi hukum pengguna (user) terhadap karya tersebut, khususnya dalam kaitannya dengan klaim kepemilikan dan hak pemanfaatan karya hasil teknologi Generative AI. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan studi kepustakaan. Hasil analisis menunjukkan bahwa karya yang sepenuhnya dihasilkan AI belum memenuhi syarat perlindungan hak cipta, kecuali terdapat kontribusi kreatif manusia. Oleh karena itu, diperlukan reformasi regulasi untuk memberikan kepastian hukum yang adaptif terhadap perkembangan teknologi.

Abstract

This article examines the challenges of regulating intellectual property rights (IPR) in Indonesia for digital works produced by artificial intelligence (AI). Although Law No. 28 of 2014 on Copyright establishes the creator as the legal subject, works produced automatically by AI create ambiguity in copyright ownership. This uncertainty creates a legal loophole that could lead to disputes. This study employs a normative juridical approach to analyse the legal protection of AI works and finds that, absent specific regulations, these works lack adequate legal protection. Concrete steps are needed, either through revisions to laws or through the establishment of new rules, to accommodate the development of AI technology and provide legal certainty for the owners of works.

Abstract

The rapid expansion of social media has transformed the creation, distribution, and commercialization of digital content, generating new challenges for copyright protection in Indonesia. This study examines the adequacy of Indonesian copyright law in addressing the evolving dynamics of digital content circulation within platform based environments. Employing a non empirical normative legal research design, the study integrates statutory, conceptual, and case approaches to analyze legal materials, regulatory frameworks, judicial reasoning, and contemporary scholarly discourse. The findings indicate that Indonesian copyright law provides a substantial normative foundation for recognizing ownership, economic rights, and moral rights of digital creators. Nevertheless, significant enforcement obstacles persist due to technological acceleration, platform mediated dissemination, digital anonymity, cross border activities, and limited public awareness. The analysis further reveals a regulatory gap between formal legal protection and practical enforcement effectiveness. To address these challenges, the study proposes an adaptive copyright protection model that combines Digital Rights Management, automated detection technologies, strengthened platform accountability, digital literacy initiatives, coordinated institutional enforcement, and international legal cooperation. This integrated framework offers a forward looking strategy for enhancing copyright governance and ensuring sustainable protection of digital creativity in Indonesia.

Abstract

The rapid advancement of Artificial Intelligence (AI) has transformed technological innovation, making AI algorithms central to developments across healthcare, finance, manufacturing, and autonomous systems. Despite their growing economic and technological significance, the patentability of AI algorithms remains legally uncertain in Indonesia. Existing studies have predominantly examined software patent protection or AI-related intellectual property from a general perspective, while limited attention has been given to establishing normative parameters for determining the patentability of AI algorithms under the Indonesian Patent Law. This research addresses that gap by analyzing the juridical challenges arising from Article 4 letter (d) of Law Number 13 of 2016 concerning Patents and formulating an adaptive legal framework for AI algorithm patentability. This study employs normative juridical research using statutory, conceptual, and comparative approaches by examining Indonesian patent regulations alongside the practices of the European Patent Office (EPO) and the United States Patent and Trademark Office (USPTO). The findings reveal that the categorical exclusion of computer programs has created a protection vacuum, as copyright protection safeguards only the expression of source code rather than the technical functions and computational logic embodied in AI algorithms. Comparative analysis demonstrates that both the EPO and USPTO have adopted functional approaches through the doctrines of technical character, technical effect, and inventive concept, enabling AI-related inventions that produce concrete technical solutions to qualify for patent protection. This study contributes by proposing a normative reconstruction of Indonesia's patent system through the adoption of substantive examination parameters based on technical contribution, technical integration, and inventive step, thereby providing a conceptual framework for future patent examination guidelines. The proposed model is expected to strengthen legal certainty, promote technological innovation, and support the development of a more adaptive national patent system in response to the digital economy
