Abstract

Industri perbankan memainkan peran kunci dalam ekonomi Indonesia dengan fokus pada stabilitas dan keamanan sistem keuangan nasional, untuk mewujudkan sektor perbankan yang sehat. Terbagi menjadi bank konvensional dan bank syariah,definisi bank syariah berdasarkan Undang-Undang Perbankan Syariah adalah bank yang beroperasi berdasarkan prinsip syariah. Saat ini, bank syariah juga menyediakan berbagai pilihan distribusi dana, termasuk melalui pembiayaan istiṣnâ`. Istiṣnâ` adalah kontrak pembiayaan objek dalam bentuk pemesanan dan pembuatan, sesuai dengan syarat dan ketentuan yang disepakati antara pembeli (mustaṣni`) dan penjual (ṣâni`). Penelitian ini bertujuan untuk menganalisis konsep kontrak istiṣnâ` di Indonesia dan menganalisis risiko bank syariah dalam implementasi kontrak istiṣnâ` paralel dalam industri perbankan syariah Indonesia. Metode penelitian yang digunakan adalah normatif yuridis dengan studi literatur untuk menganalisis doktrin dan nilai yang berlaku. Hasil penelitian menunjukkan bahwa konsep kontrak istiṣnâ` dalam industri Perbankan Syariah di Indonesia sesuai dengan prinsip Hukum Islam. Namun, implementasi kontrak istiṣnâ` paralel dalam industri perbankan syariah memiliki risiko pembiayaan yang signifikan. Oleh karena itu, Indonesia melalui otoritas keuangan dan lembaga yudisial perlu konsisten menerapkan dan mengawasi implementasi kontrak istiṣnâ` dalam industri perbankan syariah, untuk mendukung pertumbuhan ekonomi nasional yang sejahtera dan berkelanjutan.

Abstract

One form of democracy's embodiment is through general elections. The Philippines and Indonesia are two countries in the Southeast Asian region that are currently still developing their democratic practices through general elections. This study aims to compare how the general elections have been enforced in the two countries to obtain input on the implementation of democracy in Indonesia. The normative legal research design was used in this study, and data collection was carried out through a literature study. The functional comparative approach compares the implementation of general elections in the two countries. The data collected by literature searches were analyzed using a qualitative juridical analysis method. The analysis shows that although the two countries have declared themselves democracies and the general election is the form of their implementation in the constitution, general elections have been used to perpetuate power in both countries. The two countries have differences in implementing general elections due to historical differences and national problems. The most distinguishing matter that can be learned is how the Philippines implemented the general election through the existence of a plebiscite that makes the people more involved in the state process. In addition, information technology in the Philippines' general election has also made the process of conducting the general elections effective and efficient. This study is still limited to analyzing general elections at the national level, especially the presidential and vice-presidential elections. Further research on the general elections of legislature members and regional heads can add to our understanding of the comparative implementation of the two countries.

Abstract

The Occupational Safety and Health Management System (SMK3) is imperative as a preventive measure to mitigate workplace accidents within a company's environment. Indonesia has enacted legal regulations regarding SMK3, specifically Government Regulation Number 50 of 2012 concerning the Implementation of the Occupational Safety and Health Management System. Nevertheless, the existence of these regulations does not consistently enhance workers' awareness of their safety while at work. This research employs an empirical research method, gathering data through literature studies as secondary data and interviews with the safety officer of PT. GPI as primary data. The research findings conclude that PT. GPI has implemented SMK3 in Indonesia. However, the implementation of SMK3 at PT. GPI in Batam cannot be deemed effective due to the presence of workers unwilling to comply with the applied regulations, ultimately leading to workplace accidents. In addressing this situation, the company needs to enhance strictness and supervision of each worker to ensure compliance with every applicable occupational safety and health regulation.

Abstract

This study aims to evaluate the effectiveness of anti-discrimination policies in the workforce in Batam City, a center of industry with a high diversity of backgrounds. Although international and national regulations have been implemented to reduce discrimination, the practice of discrimination in the workplace is still a significant issue, as evidenced by the high rate of discrimination that occurs, including in Batam City. This study aims to analyze the application of international and national laws in Batam City because the industries in Batam City are comprised of local/national and foreign industries. This research uses a statutory approach and an empirical approach. The research was conducted through in-depth interviews with companies and agencies related to labor policies. The findings show that most companies in Batam City have adopted anti-discrimination policies to realize the international and national legal approaches. However, implementing these policies is often hampered by a lack of understanding and awareness of workers' rights, as well as weak monitoring mechanisms and sanctions for violations. This study recommends increased training on diversity and equality in the workplace, strengthened reporting mechanisms, and stricter law enforcement against perpetrators of discrimination. Thus, it is expected that a more inclusive and fair work environment can be created in Batam City.
