Abstract

Recently, the Government through the Ministry of ATR/BPN launched a plan to adopt digital transformation. In accordance with this goal, there is a new breakthrough in making land certificates, namely electronic land certificates. This study aims to find out the challenges and results achieved in the application of electronic land certificates. The results showed that the transformation from physical certificates to electronic certificates takes time. The land certificate was an implementation of the Regulation of the Minister of ATR/Head of BPN No. 1 of 2021 concerning Electronic Certificates. The issuance of electronic certificates could later be done through land registration for the first time for unregistered land. In addition, the change of physical certificates into electronic certificates for registered land can be done voluntarily by the owner by visiting the land office

Abstract

One of the products of non-codified criminal regulations that adheres to a special minimum system. Article 12 paragraph (2) of the Criminal Code specifies the minimum criminal penalties applicable in Indonesia for one day of imprisonment, while Article 18 paragraph (1) of the Criminal Code also specifies one day of imprisonment as the minimum sentence for imprisonment. This is typically the case. However, the Criminal Code does not regulate the specific minimum criminal hazard level. Article 103 of the Criminal Code states that laws outside the Criminal Code can regulate special rules; in this case, based on the District Court Decision Number: 42 / Pid.Sus / 2019 PN Bpd, the defendant Syamsul Rizal Bin Zainal was sentenced in accordance with the subsidiary charges of the Public Prosecutor article 111 paragraph 1 with a minimum criminal threat of 4 years and a fine of Rp. 800,000,000 (Eight Hundred Million RupeesIn this legal research, a legal approach, a conceptual approach, and a case approach will be utilized, along with specific research requirements. In this investigation, both primary and secondary legal materials were utilized. The analyzed legal material is presented in a methodical, logical, and reasonable manner. On the basis of the study's findings, it is possible to conclude that the criminal conviction below the specified minimum in decision number 42/Pid.Sus/2019/PN Bpd violates the principle of legality (nulla poena sine lege), as the decision lacks legal considerations.

Abstract

Companies don't always make a profit and taking loans from banks or other companies to ensure smooth business operations can put a company's existence in danger. Failure to repay loans can lead to bankruptcy, declared by the competent commercial court upon request of the creditor or debtor. The ease with which bankruptcy requirements are regulated under Indonesian law can lead to economic problems. This study seeks to examine the differences between bankruptcy laws in Indonesia and the United States, the challenges in implementing an insolvency test in Indonesia, and the benefits of such a test. The research method used is normative-juridical, employing a conceptual and statutory approach to assess the benefits and obstacles of implementing insolvency tests in Indonesia. The findings suggest that applying insolvency tests can have a positive impact on economic growth, including reducing the number of bankrupt companies and decreasing unemployment, which contributes to development. As a result, it's necessary to modify Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations to enable the use of insolvency tests in bankruptcy applications in Indonesia.

Abstract

Monopolistic practices and unfair business competition are needed to be regulated to protect both businessmen and consumers. The sovereignty of business competition law can be strengthened if the Indonesia's Business Competition Supervisory Commission/IBCSC (Komisi Pengawasan Persaingan Usaha/KPPU) can carry out its functions optimally, particularly in the era of Industrial Revolution 4.0 (IR 4.0). This research aims to ascertain whether the IBCSC can be perform its functions in enforcing business competition rules and what challenges it faces in performing its duties in the era of IR 4.0. This research applied a normative legal method and analyzed the data by using qualitative approaches. It found the IBSCS has authority to impose administrative sanctions against business actors who violate Law No. 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition (Law No.5 of 1999). Unfortunately, the supervisory function of the IBCSC pertaining electronic systems is not regulated by this Law. Although a Memorandum of Understanding (MoU) and Cooperation Agreement between the Ministry of Communication and Information Technology (Menkominfo) and the IBCSC facilitates the enforcement and supervisory of business competition law in the IR 4.0, it cannot strengthen the IBCSC’s legal position as an institution. Therefore, it is strongly suggested to amend Law No. 5 of 1999 to cover transactions in the digital market to strengthen the functions and authorities of the IBCSC.

Abstract

The enactment of Law Number 30 of 2014 concerning Government Administration, it certainly provides clear directions regarding the implementation of governance, encompassing the acquisition and exercise of authority, as well as prohibitions against the misuse of authority. The distribution of authority, finances, utilization of natural resources, and other resources are conducted fairly and harmoniously between the central government and regional governments. Similarly, the arrangement of authority distribution in the management of marine natural resources stipulates that the management of marine natural resources from the coastline up to a distance of 12 nautical miles beyond oil and natural gas falls under the jurisdiction of provincial regional governments. However, up to this point, the collection of fees for utilization remains under the control of the central government through technical implementation units in the region. This research employs a juridical-empirical method with a legislative approach, analyzing its effectiveness based on its implementation within the province of Riau Islands. The study is conducted using a qualitative method and described in a descriptive manner. The research findings indicate that the regional government does not benefit from the management of marine natural resources in the port sector, particularly concerning the collection aspects of the utilization of marine natural resources within the 0 to 12 nautical miles in the regional government's territory.

Abstract

Industri fashion yang semakin menjamur telah menuntut setiap pelaku usaha untuk memiliki nilai, inovasi, maupun ciri khas dalam menjalankan usahanya agar tetap eksis terutama dalam bentuk, konfigurasi atau komposisi garis atau warna atau gabungan di antaranya dengan tujuan memberikan kesan estetika dalam menghasilkan suatu produk atau barang. Tidak jarang dalam implementasinya terjadi hal plagiarisme terkhusus dalam pola atau desain, sehingga menyebabkan terjadinya kerugian baik materiil maupun immateriil. Penelitian ini bertujuan untuk menganalisa permasalahan terkait plagiarisme mode pakaian dalam ranah hukum Desain Industri di Indonesia. Metode penelitian yang digunakan adalah metode yuridis normatif. Hasil penelitian menunjukkan bahwa perlindungan Desain Industri terkait plagiarisme desain mode di Indonesia telah didasari oleh teori perlindungan hukum melalui dua cara, yakni perlindungan hukum preventif guna mencegah atau menghindari plagiarisme dan perlindungan hukum represif untuk mengadili pelaku plagiarisme dengan pemberian sanksi atau denda, di mana keduanya mengacu pada pemberlakuan Undang-Undang Nomor 31 Tahun 2000 tentang Desain Industri.

Abstract

This study aims to scrutinize the Non-Competition Clauses in employment contracts as a manifestation of trade secrets and understand how these clauses impact an individual’s right to choose employment. This study uses normative legal research with the statute and comparative approaches. The collected legal material is then qualitatively analyzed to describe the problem and answer study purposes. The results show that including Non-Competition Clauses in employment contracts by employers is a strategic measure to protect trade secrets from competitors. However, every contract must fulfill the requirements for the agreement’s validity subjectively and objectively. Non-Competition Clauses can potentially conflict with workers’ rights as regulated in Article 28D section (2) of the 1945 Constitution, Article 38 section (2) of Law Number 39 of 1999, and Article 31 of Law Number 13 of 2003, thereby violating the objective requirements of employment contracts based on Article 52 section (1) point d of Law Number 13 of 2003. Therefore, it recommended that relevant parties review and evaluate the implementation of Non-Competition Clauses in employment contracts in Indonesia. Before incorporating this clause into the employment contract, employers must consider the agreement’s validity requirements and workers’ rights. Furthermore, the employment contract should further explain the definition and scope of the Non-Competition Clause to avoid different interpretations. Meanwhile, the Government is recommended to create clear regulations concerning the legitimacy of Non-Competition Clauses in employment contracts. These regulations must consider the balance between protecting trade secrets and workers’ rights to employment and income. Lastly, Courts should prioritize protecting workers’ rights in resolving disputes related to breaches of the Non-Competition Clause, especially if employers cannot prove the workers have violated the company’s trade secrets.

Abstract

Kegiatan perbankan syariah tidak hanya mengejar profit semata, tetapi juga memiliki fungsi sosial di masyarakat yang direalisasikan dalam bentuk akad qarḍ atau pinjaman kebajikan di mana sumber dananya berasal dari zakat, infaq, sedekah, hibah, dan dana sosial lainnya sesuai Fatwa Dewan Syariah Nasional Majelis Ulama Indonesia Nomor 19/DSN-MUI/IV/2001. Untuk memahami model akad qarḍ dan implementasinya berdasarkan Fatwa Dewan Syariah Nasional Majelis Ulama Indonesia Nomor 19/DSN-MUI/IV/2001 bagi Usaha Mikro Kecil dan Menengah (UMKM) sebagai pemegang fungsi yang sangat strategis bagi pembangunan nasional khususnya dalam hal pertumbuhan ekonomi dan penyerapan tenaga kerja di Indonesia, maka dilakukan penelitian normatif atau doctrinal research. Qarḍ merupakan kegiatan pinjam meminjam dana yang dilakukan tanpa imbalan (tanpa bunga) dengan kewajiban pihak peminjam mengembalikan pokok pinjaman secara sekaligus atau dengan cicilan dalam jangka waktu tertentu. Kesimpulan penelitian ini adalah model akad qarḍ merupakan pinjam meminjam yang sifatnya memberikan pertolongan terhadap nasabah dan wajib dikembalikan 100% (seratus persen) dari besaran jumlah pinjaman tanpa adanya tambahan yang diimplementasikan sesuai dengan Fatwa Dewan Syariah Nasional Majelis Ulama Indonesia Nomor 19/DSN-MUI/IV/2001.

Abstract

Infrastructure development is a benchmark for a country's achievement. Indonesia as developing countries makes various acceleration efforts by increasing the quality and quantity of engineers as the main actor to produce quality development plans. In addition, considering the development of the ASEAN Economic Community (AEC), engineering practice is expected to contribute globally, especially in ASEAN countries. To answer this, the Government of Indonesia issued Act Number 11 of 2014 concerning Engineering and Act Number 2 of 2017 concerning Construction Services. These two Regulation serve as legal protection for the implementation of engineering practice. However, along with the dynamics of political interests, the implementation of these two regulations are actually contradictive and they inherent the ambiguity of the roles of several intersecting institutions related to the engineering profession certification process. Hence this study aims to analyzes the disharmonization of the regulations and to offer solutions. To achieve the aims, the study uses a sociological juridical method that examines the provisions of the two act and examines in depth the realities that exist in society. Beside that, the method use the secondary legal material such as Mutual Recognition Agreement (MRA) on Engineer Service in ASEAN. This article offers a critical approach obtained from the Focus Group Discussion as a public sphere for the gap in engineering practice certification. In this study, it was found that there are gaps in the function and flow mechanism in obtaining competency certificates. This condition has led to a tendency for professional actors to choose an easiest requirement but provide a large access to participate in various government projects. The study concludes that basically the presence of these two acts are beneficial in regulating engineering practices, but they are not supported by massive information and consistency of the government as a regulator and the synergity of the institutions involved in implementing these regulations has not been optimal.

Abstract

Indonesia as a member of the World Trade Organization (WTO) is bound by the General Agreement on Tariffs and Trade (GATT) and WTO regulations. In an effort to increase domestic raw material processing, Indonesia implemented an export ban on nickel ore and other minerals. However, this action sparked protests from the European Union, leading to a lawsuit filed with the WTO. This article analyzes the WTO decision in the context of international trade principles, examining its legal applicability in Indonesia and its impact on other types of minerals. The research method used is a normative legal approach or doctrinal research. The final decision of the WTO dispute settlement panel declared that Indonesia's policy of export bans and mandatory processing of nickel minerals violated Article XI.1 of the GATT 1994. Nevertheless, Indonesia appealed the decision and remains committed to the nickel ore export ban to advance the economy and welfare of its people. Thus, this policy represents a bold step towards downstream the mining industry.
