Abstract

The objective of this study is to investigate the act of postponing the execution of inheritance distribution in the Seunuddon village, located in North Aceh. This study employs sociological legal approaches, which are examined through the lenses of al-'urf and the notion of legal pluralism. Data was gathered through extensive interviews conducted with religious leaders, community leaders, and successors. This study determined that delays in the distribution of inheritance in Seunuddon had persisted for an extended period, with some cases resulting in patah titi and subsequent complications. The delay arises due to entrenched customs, the survival of one parent, inadequate economic conditions, lack of family discussions regarding inheritance division, reluctance to distribute the inheritance immediately due to feelings of embarrassment, and the incapacity of young children to handle the inheritance. Secondly, while examining customary Islamic law, the act of delaying the allocation of inheritance is encompassed within the concepts of 'urf sahih (valid custom) and 'urf fasid (invalid custom). Out of the four cases examined, three cases did not present any issues related to inheritance, as each party got and obtained the legacy funds. Nevertheless, there are instances in which the designated successor has deceased (patah titi), leading to complications in the process of inheriting assets. Within the framework of 'urf theory, the initial three instances can be classified as 'urf sahih, however, the final instance is deemed 'urf fasid due to its propensity for generating injustice, albeit preserving the bond of brotherhood. According to the doctrine of legal pluralism, there exists a dialectic and accommodation between Islamic law and societal customs to provide social harmonization and integration.

Abstract

Di antara sebab perbedaan pendapat ulama dalam masalah hukum adalah penempatan posisi sunah Nabi: setingkat dengan al-Qur'an atau berada di bawahnya. Hal ini diperkuat oleh wacana bahwa sunah adalah bagian dari wahyu melalui teori ḥikmah yang dikemukakan oleh para ulama fikih.  Konsekuensi dari teori ḥikmah ini, ketentuan yang dimuat di dalam sunah memiliki otoritas setingkat dengan al-Qur'an. Kata “ḥikmah” sendiri memang disebutkan beberapa kali di dalam al-Qur'an dan menjadi argumentasi utama para ulama.  Penelusuran terhadap penggunaan kata tersebut dalam al-Qur'an menunjukkan bahwa kata ḥikmah memiliki banyak arti; al-Qur'an menggunakannya tidak hanya seputar Nabi Muhammad, tetapi juga di lingkungan Nabi lain dan manusia biasa. Karena itu, mewacanakan sunah sebagai bagian dari wahyu dengan teori ḥikmah memiliki kelemahan. Selain itu, praktik para Sahabat yang memisahkan berbagai peran Muhammad: Nabi, pemimpin/kepala negara, dan manusia biasa menunjukkan bahwa ḥikmah yang otoritasnya setingkat dengan wahyu hanya dalam masalah tasyrī’ (hukum). Hal ini dikuatkan oleh unsur kemanusiaan Muhammad yang disebut dengan jelas dalam al-Qur'an.

Abstract

Sharia online financing is guaranteed by the Financial Services Authority by referring to the DSN MUI Fatwa on Financing Services Based on Financial Information Technology Based on Sharia Principles, which avoids usury, gharar, maysir and tadlis. The purpose of this research is to find out how the mechanism of sharia online financing services and to find out how the analysis of the elements of usury in sharia online financing on its suitability with the DSN-MUI Fatwa on Financing Services. This research method is empirical juridical, where primary data is obtained from interviews. While secondary data is obtained from reference sources related to this research. The results showed that the additional element at the time of returning the financing on the Alami and Investree applications was not categorised as usury (interest). In the transaction, this addition is an ujrah / fee that will be received by the parties for their services, as implemented by Alami Sharia and Investree Syariah online financing where there are funding providers and funding recipients who authorise these online financing platforms to transfer receivables settlement. On the basis of marketplace services that have brought the two parties together, the Alami and Investree platforms are entitled to an ujrah of 1% - 5% for fees for their services, the lender/funder is also entitled to a profit / ujrah from the funds provided to be managed by the borrower, the margin / ujrah that can be obtained is 12% - 20% effective p.a. according to the level of risk and the term chosen at the time of financing

Abstract

Mahkamah Syar’iyah Banda Aceh memutuskan verstek dalam 38 putusan pada 2022-2023. Fenomena ini memang diizinkan oleh SEMA No. 9/1964 Pasal 125 HIR/149 RBg ayat (1), tetapi putusan verstek pada sidang pertama dapat menunjukkan ada hal yang penting menjadi pertimbangan hakim. Dikatakan demikian karena hakim sepatutnya menunggu hasil panggilan kedua dan ketiga sesuai SEMA No. 4/2019 Pasal 13. Penelitian ini bertujuan untuk pertama, mengetahui pertimbangan hakim. Kedua, pelindungan terhadap perempuan dalam pertimbangan hakim. Penelitian ini termasuk jenis penelitian yuridis normatif. Sebagai sampel diambil 16 putusan verstek pada Juni 2022. Dari ke 16 putusan dianalisis lebih lanjut 3 putusan yang dinilai dapat mendekati putusan lain. Adapun pendekatan yang digunakan adalah pendekatan perundang-undangan. Hasil penelitian dalam tesis ini adalah pertama, pertimbangan hakim dalam 16 putusan menggunakan pertimbangan legal dan ekstra legal. Legal hakim berdasarkan pembuktian dan asas kepastian hukum yang telah memenuhi Pasal 39 ayat (2) UU Perkawinan jo Pasal 116 KHI jo Pasal 19 PP No. 9/1975, dan SEMA, sedangkan ekstra legal hakim berdasarkan keadaan penggugat dan tergugat yang disebabkan karena faktor penganiayaan, narkoba, tidak ada keturunan, suami di penjara, pisah tempat tinggal, ekonomi, dan suami menjatuhkan talak. Kedua, pelindungan terhadap perempuan dalam pertimbangan hakim pada 3 (tiga) putusan menunjukkan bahwa hakim memutuskan verstek pada sidang pertama karena upaya melindungi perempuan dari kekerasan dalam lingkup rumah tangga berdasarkan alasan/dalil gugatan yaitu kekerasan fisik, kekerasan psikis, dan penelantaran rumah tangga, seperti faktor narkoba, tidak ada keturunan, suami di penjara, kekerasan dalam rumah tangga, pisah tempat tinggal, ekonomi, dan suami menjatuhkan talak.

Abstract

This research aims to explain judges' legal considerations from the perspective of procedural and substantive justice. This is because the decision 124/Pdt.G/2023/MS.Bna, which was a case where the application for a marriage registration was rejected and caused problems with the purpose of the marriage ceremony, thus affecting the position of the parties before and after the decision. In this research the author used qualitative research methods and a normative juridical approach, namely by examining the judge's decisions (content analysis). The judge's legal considerations are analyzed using the theory of justice (procedural and substantive) and compared with several other decisions. The results of the research show that the decision of the Banda Aceh Syar'iyah Court which was based on the provisions of the Compilation of Islamic Law resulted in everyone having the right to become heirs except the applicant, whereas if it was based on the provisions of fiqh the applicant had the right to become an heir because the applicant's marriage was valid in harmony and according to the requirements of Islamic law. . In considering decision 124/Pdt.G/2023/MS.Bna the judge sided with the nature of procedural justice only and ignored substantive justice, resulting in formal justice which was only guided by the law. If the judge uses extra-legal considerations and substantive justice, the itsbat application is very worthy of being accepted.

Abstract

The Law of the Republic of Indonesia authorizes Aceh to implement shari’a law in various sectors, including jināyāt (Islamic criminal law). This additional authority is different from the authority of the Religious Courts (Pengadilan Agama) in other provinces in Indonesia. This article analyzes the process of handling children in criminal cases in the Aceh’s Shari’a Courts in Aceh using the lex specialis derogate legi generalis and the systematic lex specialis principles. The data in this study comes from legal documents and interviews with Shari’a Court judges. The results show that the handling of Islamic criminal offenses involving children has been carried out by referring to existing laws and regulations according to the principle of specificity. However, some issues arise related to human resources and appropriate facilities. Most of the judges have not obtained special training in handling children’s cases, which influenced their knowledge on the issue. Moreover, children involving in legal cases are still treated using similar facilities as adults. These weaknesses, however, can be appropriately resolved by the Shari’a Courts and the Aceh Government. Abstrak:Undang-Undang Republik Indonesia memberikan kewenangan kepada Aceh untuk menerapkan syariat Islam di berbagai bidang, termasuk jināyāt (hukum pidana Islam). Pemerintah Aceh mengeluarkan qanun (Peraturan Daerah) yang mencakup beberapa jarīmah (perbuatan pidana) dan pelaksanaannya menjadi kewenangan Pengadilan Syariah (Mahkamah Syar’iyyah) di Aceh. Kewenangan tambahan ini berbeda dengan kewenangan Peradilan Agama di provinsi lain di Indonesia. Hakim-hakim di pengadilan-pengadilan tersebut tidak mendapatkan pendidikan khusus dalam hukum pidana, terutama kasus-kasus yang melibatkan anak-anak yang telah diatur dalam undang-undang khusus. Kewenangan tambahan dalam memeriksa dan mengadili perkara pidana di Mahkamah Syariah menimbulkan persoalan Sumber Daya Manusia (SDM) baru. Artikel ini menganalisis proses penanganan anak di Pengadilan Syariah di Aceh dengan menggunakan prinsip lex specialis derogate legi generalis dan systematic lex specialis. Hasil penelitian menunjukkan bahwa penanganan tindak pidana Islam yang melibatkan anak telah dilakukan dengan mengacu pada peraturan perundang-undangan yang ada sesuai dengan asas kekhususan. Beberapa kelemahan sumber daya manusia dan infrastruktur dapat diselesaikan dengan baik oleh Pengadilan Syariah dan Pemerintah Aceh.

Abstract

This article aims to analyze the protection of life (ḥifẓ al-nafs) as the law reason (`illat) of the rights of children outside of legal marriage (ALPS) of biological fathers. Ḥifẓ al-nafs is assumed to be `illat emerging from many neglected ALPS phenomena and resulting in negative stigma and discrimination. This research is a study of Islamic law using the theory of `illat in analyzing the problem of children's rights outside of legal marriage. The research concludes that the presence of the 2010 Constitutional Court decision regarding the civil rights of ALPS with biological fathers reveals new spaces in seeing the nature of ALPS rights. This is different from the fatwa of the Indonesian Ulema Council and classical fiqh (Islamic jurisprudence) arguments, which tend to only link the child to the mother. Based on the Constitutional Court decision, the essence of ALPS rights from biological fathers is limited to civil rights. The responsibility of the biological father to ALPS is in the form of physical and mental support, while denying other rights such as guardianship of marriage; ALPS rights today have been largely abandoned. Thus, the protection/care is necessary. `Illat (the reason of law) in ḥifẓ al-nafs (protection of the life) is real and can be juxtaposed with `illat ḥifẓ al-nasl (protection of heredity). Ḥifẓ al-nasl does not completely fulfill the real requirements of an `illat which can abolish the abandonment of ALPS.

Abstract

The focus of this research discusses the transformation of maqāṣid shari'āh in mediation practices in divorce cases, and the revitalization of adat in mediation practices in Bugis and Mandar communities. This study is a field legal research using historical and socio-anthropological approaches, while the data is analyzed using maqāṣid shari'ah theory and social change theory. Data collection techniques are based on literature studies on legal sources related to the discussion.This study concludes that divorce is an extraordinary case in the religious courts, dynamics of mediation practice in Religious Courts have successful mediation for a written peace agreement in peace deed, other mediation products are partially successful mediation and partially unsuccessful mediation, mediation products are not successful is that husband and wife are committed to divorce; maqāṣid shari‘āh transformation can be a major consideration by judges in mediation practice to save households on the verge of collapse, so that maqāṣid shari‘āh is very urgent to place in Perma No.1 of 2016, and revitalization of Bugis-Mandar customary is an effort to revive the value of life sirondo-rondoi, siamasei, sianuang pa'mai, and sibaliparri, also animate shara’ which is performed petta kalie (Bugis) or puang kali’ (Mandar).

Abstract

Today, the family experiences dysfunction because their functions are taken over by the state and the market. Before the Industrial Revolution, most people still relied on their families and communities for food, shelter, education, and employment. New communication and transformation technologies enable markets and governments to pull people out of family security and enter the market as individuals. During the Covid-19 pandemic, the authors saw a tendency for the return of family functions that had been taken away by the state and the market. People are getting closer to their families, especially because of the effects of physical distancing rules by the state. So far there have been no studies that show in detail how a pandemic really influences family functioning. The authors tries to investigate the functions of families returning to work using the daily data of UGM Cultural Anthropology students collected in the Rural Studies class in Indonesia from 30 March 2020 to 29 April 2020. Findings show that family refunction occurred during the pandemic.

Abstract

The removal of fuel subsidies led to a rise in the price of fuel. These rapid changes hurt the activities of many Nigerians as nearly all homes and businesses use subsidised petrol to power their generators due to the problems with the nation's electrical supply. This paper looks into the impact of fuel subsidy removal on trading/marketing activities in Takum LGA. The study used a descriptive, cross-sectional survey research design. A sample size of 400 respondents was selected from the total population of 211,700 using the Tare Yamane formula. Questionnaires were distributed to 400 respondents who were randomly selected across the wards in Takum LGA. Responses from the questionnaire were analysed using the descriptive statistics of frequency counts and percentages, and Pearson Correlation. The Pearson Correlation was used to test the stated hypotheses at a 0.05 level of significance with the use of SPSS (Statistical Package for Social Sciences). The study revealed that the removal of petroleum subsidies had its most severe impact on trading and marketing activities during May–August 2023, as businesses were unprepared for the sudden fuel price spike, leading to disrupted supply chains and reduced profits. Although the impact slightly moderated in September–December 2023, it persisted into January–March 2024, indicating prolonged economic stress. The study recommended that a targeted measure, like financial assistance for small firms, transportation subsidies for necessities, and infrastructure investments to stabilise supply chains, should be implemented with subsidy removal policies.
