Abstract

This Study Examines The Effectiveness Of The Distribution Of Urgent Financial Assistance For Victims Of Natural Disasters, Humanitarian Disasters, Companions Of Sick People Who Are Referred Out Of Town, Travelers Who Run Out Of Supplies, Or Other Assistance That Is Emergency And Urgent. This Study Is Considered Important Because Every Financial Assistance That Is Disbursed Must Precede The Aceh Revenue And Expenditure Budget (APBA) So That All Activities That Use Zakat Funds Cannot Be Distributed Before The ABPA Is Approved. This Hampers The Distribution Of Urgent Financial Assistance. To Explain This, Two Questions Are Asked: (1) What Is The Description Of The Baitul Mal Aceh Humanist Action Program? (2) What Is The Effectiveness Of The Distribution Of Baitul Mal Aceh Humanist Action Program? The Method Used In This Writing Is Through A Qualitative Study Process Sourced From The Results Of Interviews With Baitul Mal Staff And Data On The Distribution Of Funds That Have Been Distributed By The Baitul Mal Institution Through The Bagah Program Which Has Been Implemented Since The Beginning Of The Bagah Service. The Data Were Analyzed Using The Theory Of Effectiveness And Explained With The Concept Of Baitul Mal And Its Relationship To Zakat, Regulations Related To The Management Of The Aceh Government Budget And The Theory Of Effectiveness. The Results Of The Study Show That Bagah Has Three Classifications In The Distribution Of Funds. First, Isidentil Asnaf (Poor) Namely Sick People And People Who Accompany Sick People. Second, Asnaf (Gharim) Namely Victims Of Natural Disasters Such As Floods. Third, Displaced People Are Included In The Asnaf Ibnu Sabil Namely Migrants From Aceh.

Abstract

In Aceh, the provision of guidance is regulated in Articles 5 and 6 of Gubenur Regulation Number 139 of 2016, which states that the main task and function of the Civil Service Police Unit and Wilayatul Hisbah Aceh is the guidance function. Article 1 point 14 of Qanun Number 7 Year 2013 on Jinayat Procedure Law states that the function of Wilayatul Hisbah (WH) is to socialise, supervise, enforce, and foster the implementation of Islamic Sharia. Therefore, there is a problem of interpreting the authority of coaching carried out by Satpol PP and WH of Lhokseumawe City. This study aims to determine the legal basis for the coaching of suspected jarimah violators by Satpol PP and WH of Lhokseumawe City and the legal consequences of coaching suspected jarimah violators without going through the judicial process carried out by Satpol PP and WH of Lhokseumawe City. The research method used is empirical juridical. Data sources are obtained through interviews with respondents and informants. The results of this study indicate that the coaching carried out by Satpol PP and WH of Lhokseumawe city against suspected jarimah violators does not have a clear legal basis. The coaching carried out is only based on a statement signed by the alleged jarimah violator during the investigation and the legal consequences of coaching against jarimah offenders by Satpol PP and WH of Lhoseumawe City without going through the judicial process is carried out without a legal basis which results in serious legal consequences such as the coaching is not legally valid (can be cancelled), violates human rights, and can be sued civilly or criminally prosecuted and reduces public confidence in Sharia law.

Abstract

The special autonomy granted to Aceh Province allows for the implementation of Islamic criminal law (jinayat), yet challenges remain in law enforcement, particularly against corporations that provide facilities for Jarimah. Despite the enactment of Qanun Number 6 of 2014 on Hukum Jinayat, prosecutions have largely focused on individuals, while companies such as hotels, boarding houses, and cafés frequently escape accountability, even when their facilities are used to commit acts such as khalwat, maisir, and zina. This study aims to examine the enforcement mechanisms targeting such corporate entities within the jurisdiction of Banda Aceh City. Employing empirical legal research methods, the study utilizes qualitative analysis based on field observations, interviews with stakeholders, and a review of legal documents. The findings indicate that law enforcement efforts are hampered by five major factors: vague and incomplete legal provisions; limited knowledge and training among investigators; inadequate human resources and supporting infrastructure; a lack of public support; and deeply rooted cultural practices that often favor informal resolutions over formal prosecution. Despite the legal possibility of corporate liability under the qanun, enforcement remains weak due to unclear definitions, particularly concerning intent and the element of facilitation. The study concludes that the effectiveness of law enforcement in this domain is critically undermined by structural and normative deficiencies. Therefore, reform is urgently needed, including amendments to legal texts, comprehensive investigator training, and public engagement strategies to ensure corporate accountability in supporting the implementation of syari’at Islam in Aceh.

Abstract

Menurut Pasal 46 Qanun Aceh Nomor 11 Tahun 2018 tentang Lembaga Keuangan Syariah (Qanun LKS) menyatakan Dewan Syariah Aceh (DSA) adalah lembaga yang dibentuk untuk melakukan pengawasan, memberi nasehat serta saran kepada manajemen Lembaga Keuangan Syariah agar sesuai dengan prinsip syari’ah. Dalam konteks ini, Dewan Syariah Aceh memegang peran penting dalam mengawasi Lembaga Keuangan Non-Bank seperti koperasi, asuransi, dan Baitul Maal wat Tamwil. Namun, pengawasan tersebut masih mengalami banyak problematika terkait tugas Dewan Syariah Aceh khususnya pada lembaga keuangan non-bank syariah. Penelitian ini bertujuan untuk melihat bagimana problematika yang dihadapi oleh DSA serta menyusun strategi optimalisasi pengawasan DSA. Metode penelitian menggunakan jenis penelitian empiris untuk memahami bagaimana hukum berfungsi dalam masyarakat, pada penelitian ini menggunakan analisis data  kualitatif dengan metode pengumpulan data melalui studi lapangan yaitu data yang diperoleh melalui wawancara langsung bersama anggota DSA, sedangkan data sekunder berupa Qanun LKS dan Peraturan Gubernur Nomor 56 Tahun 2020 tentang Dewan Syariah Aceh, laporan pengawasan oleh DPS, dokumen Strategi Nasional Literasi Keuangan 2024, serta jurnal terkait. Hasil penelitian menunjukkan bahwa, implementasi tugas DSA masih menghadapi kendala utama, seperti belum terbentuknya Dewan Syariah Kabupaten/Kota secara merata, keterbatasan sumber daya manusia dan anggaran, tidak adanya mekanisme sanksi, serta rendahnya literasi keuangan syariah. Untuk mengoptimalkan peran DSA, diperlukan strategi seperti percepatan pembentukan DSK, penguatan regulasi dengan sanksi tegas, peningkatan kapasitas SDM, pengembangan sistem digital, dan edukasi masyarakat. Penelitian ini memberikan rekomendasi kebijakan untuk memperkuat tata kelola keuangan syariah di Aceh.

Abstract

Dalam kehidupan rumah tangga tidak selalu harmonis, suatu ketika bisa saja suami istri berselisih paham dari persoalan yang kecil sampai masalah yang menimbulkan perceraian. Dalam kondisi seperti ini, jika kesalahan fatal datang dari pihak suami, maka istri memiliki hak untuk meminta cerai dari suami (khulu’). Khulu’ adalah berpisahnya suami dari istri dengan memberi ganti yang diambil suami dari istri atau selainnya. ‘iwadh khulu’ merupakan pemberian ganti rugi oleh seorang istri untuk memperoleh talak dari suami. Oleh karena itu permasalahan yang diangkat dalam artikel ini adalah bagaimana penetapan persayaratan hak ‘iwadh khulu’ menurut pendapat Mazhab Maliki, dan bagaimana dalil serta metode istinbath hukum yang digunakan oleh Mazhab Maliki dalam penetapan keabsahan khulu’. Penelitian ini merupakan penelitian kepustakaan (Library Reaserach), dengan metode pengumpulan data dari dokumentasi , dan penelitian ini bersifat deskriptif analisis. Dan sumber data primer yaitu kitab-kitab Imam Malik yang berkenaan dengan ‘iwadh khulu’. Berdasarkan hasil penelitian, menurut Imam Malik khulu’ memiliki dua kemungkinan. Pertama, boleh terjadinya khulu’ tanpa adanya ‘iwadh. Alasan Imam Malik berpendapat seperti ini karena beliau menyamakan khulu’ seperti halnya talak. Kedua, tidak sah khulu’ tanpa adanya ‘iwadh (sesuatu), kecuali si lelaki meniatkan khulu’ istri itu sebagai talak. Serta tidak membolehkan suami mengambil pembayaran khulu’ itu lebih besar dari apa yang diberikan apabila  kesalahan itu datang dari suami,  akan tetapi jika si istri ridha dan tidak merasa berat hati tidak mengapa. Kemudian cara penetapan hukum yang digunakan oleh Imam Malik lebih berfokus pada pola penetapan hukum berdasarkan kepada nash al-Bayan bi al-Qaul yaitu penjelasan melalui sabda Rasulullah SAW atau firman Allah SWT.  Hal ini berdasarkan kepada Hadis yang telah diriwayatkan dari Imam Malik, dan juga Hadis yang diriwayatkan Al-Bukhari dan Al-Nasaiy dan Ibnu Abbas yaitu perihal Habibah binti Sahal yang mana istrinya tidak lagi ingin bersama suaminya karena khawatir tidak akan dapat menjalankan kewajibannya dan merasa takut akan kufur maka dibolehkan khulu’.

Abstract

The Law of the Republic of Indonesia authorizes Aceh to implement shari’a law in various sectors, including jināyāt (Islamic criminal law). This additional authority is different from the authority of the Religious Courts (Pengadilan Agama) in other provinces in Indonesia. This article analyzes the process of handling children in criminal cases in the Aceh’s Shari’a Courts in Aceh using the lex specialis derogate legi generalis and the systematic lex specialis principles. The data in this study comes from legal documents and interviews with Shari’a Court judges. The results show that the handling of Islamic criminal offenses involving children has been carried out by referring to existing laws and regulations according to the principle of specificity. However, some issues arise related to human resources and appropriate facilities. Most of the judges have not obtained special training in handling children’s cases, which influenced their knowledge on the issue. Moreover, children involving in legal cases are still treated using similar facilities as adults. These weaknesses, however, can be appropriately resolved by the Shari’a Courts and the Aceh Government. Abstrak:Undang-Undang Republik Indonesia memberikan kewenangan kepada Aceh untuk menerapkan syariat Islam di berbagai bidang, termasuk jināyāt (hukum pidana Islam). Pemerintah Aceh mengeluarkan qanun (Peraturan Daerah) yang mencakup beberapa jarīmah (perbuatan pidana) dan pelaksanaannya menjadi kewenangan Pengadilan Syariah (Mahkamah Syar’iyyah) di Aceh. Kewenangan tambahan ini berbeda dengan kewenangan Peradilan Agama di provinsi lain di Indonesia. Hakim-hakim di pengadilan-pengadilan tersebut tidak mendapatkan pendidikan khusus dalam hukum pidana, terutama kasus-kasus yang melibatkan anak-anak yang telah diatur dalam undang-undang khusus. Kewenangan tambahan dalam memeriksa dan mengadili perkara pidana di Mahkamah Syariah menimbulkan persoalan Sumber Daya Manusia (SDM) baru. Artikel ini menganalisis proses penanganan anak di Pengadilan Syariah di Aceh dengan menggunakan prinsip lex specialis derogate legi generalis dan systematic lex specialis. Hasil penelitian menunjukkan bahwa penanganan tindak pidana Islam yang melibatkan anak telah dilakukan dengan mengacu pada peraturan perundang-undangan yang ada sesuai dengan asas kekhususan. Beberapa kelemahan sumber daya manusia dan infrastruktur dapat diselesaikan dengan baik oleh Pengadilan Syariah dan Pemerintah Aceh.

This study analyzes risk management in the employment relationship between rafting guides and owners in Central Aceh Regency from the perspective of the ijārāh al-a'māl contract in Islamic jurisprudence (fiqh mu'āmalah). The background stems from a series of rafting accidents in Bengkulu and Central Aceh in 2024, resulting in fatalities due to inadequate risk management, such as extreme fatigue and river collisions. The objectives are to evaluate risk management practices, their alignment with Shariah principles, and propose an ideal model based on ijārāh to ensure justice and safety. The method employed is descriptive qualitative with an empirical juridical approach through a case study at sites like the Peusangan and Lukup Badak Rivers. Data were collected via observation, interviews with owners and guides, and documentation. Data analysis involved reduction, presentation, and verification. Findings reveal that employment is formalized through cooperative contracts, trip-based wages (Rp80,000/trip), and protection via BPJS Employment Insurance, aligning with ijārāh al-a'māl principles such as clear wages (al-ujrah al-ma'lūmah) and risk sharing. Risk management strategies include preventive (routine training), curative (medical handling), and distributive (shared responsibilities). However, challenges include limited Shariah understanding, suboptimal protection for minor risks, and wage dependency on weather and tourist numbers. In conclusion, practices lean toward Shariah compliance but require strengthened preventive risk management based on maqāṣid al-sharī'ah for justice, life preservation (ḥifẓ al-nafs), and business sustainability. Recommendations include Shariah training and stable wage schemes.
