Abstract

A number of cases indicate abuse that received by workers at their workplace inIndonesia. It is certainly ironic because Indonesia has ratified the ILO Conventionnumber 105 and ILO Convention number 182 that provide protection both legally andpsychologically. Legal protection for labor actually invovles national regulationsbecause these conventions oblige the States to take immediate effective action onprotection and prohibition. This paper is a normative legal research that addresses theissue of legal protection for workers in Indonesia from the perspective of theconventions in concern and any kind obstacles for its implementation.

Abstract

Maritime boundaries between Indonesia and Malaysia in Ambalat have not been settled yet. This block is located on a continental shelf that is rich in transboundary reservoirs of hydrocarbons such as oil and gas. Malaysia as a coastal state wants to apply archipelagic state’s boundary, whereas Indonesia as an archipelagic state has applied for an extension of its continental shelf to the United Nations. Therefore, there is still unsettling business to be done in this area to fully utilize transboundary reservoirs in peace. This article aims to seek for way of solving the recurring conflict and utilizing transboundary reservoir in peaceful manner. This article is formulated using normative legal research based on statute, case, and conceptual approaches. This article concludes that differences between states on setting its boundaries is based on interpretation and is driven by economic value of resources, while there is opportunity to peacefully utilize transboundary reservoir by means of joint development based on international practices.

Abstract

The issue of whaling has been extensively debated in various international occasions since it causes a declines in many of the world’s whale population. Presently, Faroe Islands is one of the few regions in Denmark that still adamantly practiced whaling for traditional purposes, even though Denmark itself has prohibit it. This writing aims to analyze the whaling tradition in Faroe Islands from the International Law perspective. Further, to examine whether Denmark has an international obligation to end whaling activities in Faroe Islands. The method that is used in this writing is the normative legal research. The result of this analysis shows that the tradition in Faroe Islands is consistent with International Law, thus Denmark has no international obligation to end the tradition.

Abstract

Abstract The South Cina Sea area is of strategic value because it is a commercially important shipping lane and is rich in resources. Therefore, this marine area becomes an arena for contesting the influence of existing countries regarding common resources. Disputes and conflicts that occur also affect the condition of fishery and the regional environment’s ecosystem so a joint effort is needed that can bridge various aspects of interest. This article discusses the concept of condominiums for optimizing fishery resources in this marine area through normative legal research using legal instruments, conceptual, and case approaches. The results showed that condominiums can 1) fulfill food security and economic development, 2) manage fishery resources and protect the marine environment, and 3) mitigate conflicts and fishing disputes. Abstrak Kawasan Laut Cina Selatan bernilai strategis tidak hanya sebagai jalur pelayaran komersil, namun juga karena kandungan sumber daya yang ada. Oleh karena itu, pemanfaatan kawasan laut ini menjadi ajang kontestasi pengaruh negara-negara yang ada di sekitar kawasan. Perselisihan dan konflik seringkali terjadi sehingga mempengaruhi kondisi lingkungan kawasan dan sumber daya perikanan. Oleh karena itu, diperlukan suatu upaya bersama yang dapat menjembatani berbagai aspek dan kepentingan. Artikel ini membahas tentang konsep Kondominium bagi optimalisasi sumber daya perikanan di kawasan ini melalui penelitian hukum normatif dengan menggunakan pendekatan instrumen hukum, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa Kondominium dapat 1) memenuhi ketahanan pangan dan pembangunan ekonomi, 2) menjadi sarana pengelolaan sumber daya perikanan dan melindungi lingkungan laut, dan 3) menjadi sarana mitigasi konflik dan perselisihan penangkapan ikan.

Abstract

Penelitian ini menjelaskan peristiwa Brexit yang memunculkan problematika perikanan antara Inggris dan Uni Eropa (UE) yang berupa persoalan pilihan metodologi dan mekanisme pengalokasian kuota perikanan. Penelitian hukum normatif ini menggunakan pendekatanperundang-undangan, kasus, dan perbandingan. Hasilnya, persoalan yang menjadi perbedaan atas pemanfaatan sumber daya perikanan antara Inggris dan Uni Eropa terletak pada metodologi penentuan jumlah kuota tangkapan ikan melalui instrumen hukum yang dibentuk oleh para pihak. Uni Eropa ingin menggunakan basis persentase alokasi yang bersifat tetap (relative stability), sedangkan Inggris ingin menggunakan basis tangkapan spesies yang terikat pada zona (zonal attachment). Bentuk solusi diantaranya dapat berupa kombinasi antara mekanisme ‘zonal attachment’ (keterikatan spesies berdasarkan zona), ‘historical attachment’ (keterikatan wilayah penangkapan berdasarkan sejarah), ‘relative stability’ (stabilitas relatif berbasis persentase alokasi tetap), maupun pendekatan lain (Hannesson Model).

Abstract

The development of technology has brought us into a borderless world, which can be a challenge or an opportunity depending on how we approach it. Recent cases have shown that an individual's personal data, which is part of their privacy, can be leaked and misused by irresponsible parties. Examples such as the Facebook data breach during the U.S. presidential election, hacking attacks carried out by Bjorka, and the leakage of data from various government agencies are real examples of this issue. In this context, the protection of privacy has become more crucial than ever. The purpose of this writing is to investigate how Indonesian regulations protect individual privacy. This research uses a normative approach by analyzing the applicable laws and relevant facts. The research findings indicate that Indonesia has regulations that indirectly provide protection for individual privacy. This is in line with Indonesia's constitution and its international responsibility as a party that has ratified the ICCPR. Furthermore, these regulations also include sanctions that can be imposed in cases of privacy violations. However, challenges persist in terms of supervision and the implementation of these regulations, as well as the presence of extraterritorial threats beyond the jurisdiction of the country. Therefore, the challenge of protecting privacy in the digital era needs to be continuously addressed through rigorous supervision and international cooperation. Perkembangan teknologi telah membawa kita ke dalam dunia yang tidak mengenal batas, yang dapat menjadi tantangan atau peluang tergantung pada bagaimana kita menghadapinya. Kasus-kasus terbaru menunjukkan bahwa data pribadi seseorang, yang merupakan bagian dari privasi mereka, dapat bocor dan disalahgunakan oleh pihak yang tidak bertanggung jawab. Contoh-contoh seperti kebocoran data Facebook selama pemilihan presiden Amerika Serikat, serangan peretasan yang dilakukan oleh Bjorka, dan bocornya data dari berbagai lembaga pemerintah menjadi contoh nyata dari masalah ini. Dalam konteks ini, perlindungan privasi menjadi lebih krusial daripada sebelumnya. Penulisan ini bertujuan untuk menyelidiki bagaimana peraturan perundang-undangan di Indonesia melindungi privasi individu. Penelitian ini menggunakan pendekatan normatif dengan menganalisis hukum yang berlaku dan fakta-fakta terkait. Hasil penelitian menunjukkan bahwa Indonesia telah memiliki peraturan-peraturan yang secara tidak langsung memberikan perlindungan terhadap privasi individu. Hal ini sejalan dengan konstitusi Indonesia dan tanggung jawab internasionalnya sebagai pihak yang telah meratifikasi ICCPR. Selain itu, dalam peraturan tersebut juga telah diatur sanksi yang dapat diberlakukan dalam kasus pelanggaran privasi. Namun, kendala tetap muncul dalam hal pengawasan dan penerapan peraturan tersebut, serta adanya ancaman ekstrateritorial yang berada di luar yurisdiksi negara. Oleh karena itu, tantangan perlindungan privasi dalam era digital ini perlu terus diatasi dengan ketatnya pengawasan dan kerja sama lintas negara.

Abstract

The European Union Deforestation Regulation (EUDR) is a regulation introduced by the European Union that aims to address deforestation and forest degradation by preventing the entry of products that contribute to deforestation into the European market. The existence of strict requirements for commodities imported into the EU market has been considered to create green trade barriers that contradict the principle of free trade. This research aims to examine the EUDR policy in the review of the GATT 1994 agreement specifically to understand more deeply the position of green trade barriers and their relation to the EUDR policy. The research method used is normative legal research with a statutory approach (Statue Approach) and conceptual approach (Conceptual Approach). The results of this study state that the explanation of Article XX paragraphs (b) and (g) of the GATT Agreement can be used as a legal basis to justify the application of environmentally motivated barriers in international trade. In other words, environmentally friendly forms of trade barrier protection are legitimate under the GATT Agreement, even though such policies may deviate from the principles of free trade, provided that such policies are not used as a means for unfair discrimination or restriction of trade.

Abstract

The purpose of this study is to examine the legal protection of consumers against the sale of expired foods sold on the Internet as well as to find out what legal action can be taken by consumers for losses incurred by the entrepreneur. The study uses a method of normative law research, with an approach to both primary and secondary law sources. The results of the study show that the legal protection for consumers in sales activities is regulated in the Consumer Protection Act. The legal protection of consumers can be carried out through preventive protection and repressive protection. The legal protection of consumers does not always run as written in the rules, often there is a violation of consumer rights, which ends with the emergence of disputes between the entrepreneurs and consumers. The consumer may take legal action if he or she feels that any of his or her rights have been violated through the court or outside the court.

Abstract

This research was conducted with the aim of analyzing the legal protection applied to online shopping consumers. The research can be carried out by using a normative juridical method that is closer to descriptive qualitative. The source of the data obtained in this study is secondary data with data collection techniques, namely literature review. Various sources of literature both from journals, books and laws and regulations are reviewed and analyzed and analyzed. The analysis was carried out descriptively which was then taken to generalize A statement that summarizes the problem in the research. The results of the study show that consumer protection is governed by Law no. 8 of 1999 on Consumer Protection. In online shopping transactions, the ITE Law also applies, namely Law number. 19 of 2016 on Information and Electronic Transactions. In resolving online shopping disputes, it can be done in 3 ways, namely instant claims (negotiation, mediation, etc.), asking for help from the Consumer Dispute Settlement Agency, and through the courts.

Abstract

As part of fundamental human rights, the right to freedom of expression is neither absolute nor unlimited; however, there are restrictions on exercising the right in the context of the democratic rule of law. Presently, the exercise of the right to freedom of expression in social media has been misused by the emergence of fake news or information (hoaxes). The restrictions to exercising the right, as stipulated under the Indonesian national law, are aimed at respecting and protecting the dignity of individuals or other people, and protecting the public interest and national security. This article aims to discuss the impact of entities outside Indonesian sovereignty (jurisdiction) on implementing legal norms restricting the exercise of the right to freedom of expression in social media and the effectiveness of the norms under Indonesian national law. The method used is normative legal research using statutory, cases, and facts approaches. The analysis shows that restrictions on exercising the right to freedom of expression on social media under Indonesia’s national sovereignty have not been fully effective due to the entities of social media platforms outside the territory of Indonesia, which is not may be entirely located or subject to the scope of national jurisdiction.
