Abstract

This study aims to analyze the implementation of Sapta Pesona at the Kalipasang Nature Tourism site in Mount Merbabu National Park and its relationship with tourism management policies and human rights principles. The focus of the study is on the extent to which the elements of safety, order, cleanliness, coolness, beauty, friendliness, and memorable experiences are actually applied in the management of conservation-based tourist destinations. The research method used is descriptive qualitative with data collection techniques through field observations, interviews with managers and tourists, documentation, and literature studies. The results show that the implementation of Sapta Pesona at Kalipasang Nature Tourism has been going quite well. The element of safety is realized through routine patrols, the provision of insurance, and warning signs, although the trekking trails still need improvement. Order and cleanliness are supported by a digital ticketing system, parking management, the provision of sanitation facilities, and cooperation with BUMDes. The cool and beautiful environment, friendly service, and positive tourist experience contribute to the sustainability of the destination. Overall, the implementation of Sapta Pesona reflects the synergy between tourism policy and the fulfillment of visitors' basic rights, particularly the right to safety, comfort, and a decent living environment. However, improvements in the quality of facilities and strengthening of safety aspects are still needed so that tourism management can be sustainable and oriented towards respect for human dignity.

Abstract

The rapid growth of the Indonesian Islamic capital market is constrained by institutional challenges and authority overlaps between the Financial Services Authority (OJK) as the state financial regulator and the Islamic Supervisory Board (DPS) as the Sharia authority. This study aims to analyze the scope, authority, and institutional coordination between OJK and DPS in supervising Islamic capital market activities and financial products. This study employs an empirical legal research method. The results demonstrate that while both institutions share the objective of market oversight, existing regulatory frameworks lack integrated coordination, resulting in ambiguous boundaries regarding enforcement and Sharia compliance verification. Field findings reveal that the separation of state financial supervision and religious compliance assessment frequently leads to legal uncertainty for market practitioners, creates operational inefficiencies, and causes significant delays in financial product approvals. Furthermore, the supervision of Sharia compliance remains suboptimal due to the limited executive and investigative power of the DPS compared to the binding regulatory and sanctioning authority of OJK. This structural disparity prevents proactive monitoring of ongoing market transactions, leaving Sharia enforcement vulnerable to administrative gaps. Consequently, inconsistent regulatory interpretations between state law and religious fatwas continue to emerge, weakening the overall oversight framework. This study concludes that establishing a synchronized regulatory framework, integrating Sharia oversight protocols directly into OJK digital systems, and formalizing a joint-coordination mechanism are imperative to eliminate institutional overlapping, strengthen legal certainty, enhance public trust, and foster the sustainable development of the Indonesian Islamic capital market.

Abstract

The ambiguous transformation of National Sharia Council–Indonesian Ulema Council (DSN-MUI) fatwas into positive law creates a critical legal loophole and compliance vulnerability in the operational governance of Indonesian Islamic financial institutions. This study aims to analyze the legal binding authority of DSN-MUI fatwas and evaluate their practical enforcement within Islamic financial institution operations. This study employs a normative legal research method. The results demonstrate that while DSN-MUI fatwas hold strong moral and religious legitimacy, they lack direct state-enforceable executive power unless explicitly codified into binding banking or financial services regulations. This structural gap leads to inconsistent implementation across different institutions, where fatwa compliance varies significantly depending on internal corporate willingness and local Sharia supervisory board oversight. Furthermore, the absence of standardized statutory sanctions for fatwa non-compliance weakens institutional accountability and leaves consumers exposed to financial-sharia risks. The findings indicate that the current self-regulatory approach fails to guarantee uniform Sharia compliance, as institutions frequently prioritize commercial viability over strict fatwa adherence due to weak external regulatory pressure. Consequently, the operational binding force of these fatwas remains highly pragmatic rather than legally absolute. This study concludes that formalizing fatwas directly into state-backed financial regulations and establishing rigorous statutory enforcement mechanisms are imperative to eliminate legal uncertainty, strengthen institutional accountability, and guarantee robust consumer protection within the national Islamic financial system.

Abstract

Tujuan penelitian ini adalah menganalisis tingkat kepatuhan regulasi perdagangan internasional pada tahap pra-kontrak dalam industri ekspor dan merumuskan model persiapan kontrak yang efektif. Metodologi yang digunakan adalah pendekatan hukum normatif-empiris (socio-legal) dengan jenis deskriptif-analitis. Data primer dikumpulkan melalui in-depth interview dengan Manajer Legal dan Ekspor-Impor, sementara data sekunder mencakup peraturan domestik dan konvensi internasional. Hasil dan pembahasan menunjukkan bahwa meskipun perusahaan ekspor telah melaksanakan due diligence, masih terdapat kesenjangan hukum (legal gap) terutama dalam adaptasi cepat terhadap perubahan regulasi standar produk dan aturan kepabeanan di negara tujuan. Kesenjangan ini sering berujung pada risiko penahanan barang atau penalti, yang menunjukkan compliance pada tahap awal belum optimal. Simpulan utama adalah bahwa kerangka kerja persiapan pra-kontrak yang ada saat ini belum cukup komprehensif dan adaptif. Oleh karena itu, penelitian merekomendasikan model compliance checklist terintegrasi yang mencakup Incoterms, standar sertifikasi internasional, dan pembaruan regulasi sanksi, sebagai panduan mitigasi risiko hukum proaktif bagi industri ekspor.

Abstract

ABSTRACT Purpose of the study: This paper aims to provide an in-depth analysis of the judges' considerations in case number HC-42KB-7-04/2014 at the High Court of Kota Bharu, Malaysia. This paper specifically aims to explore the philosophical, historical, psychological, and sociological aspects that influenced the decision to release an Indonesian migrant worker from a death penalty charge. The considerations of Malaysian judges were guided by the applicable law, facts of the case, principles of justice, legal precedents; social considerations and due process of law. Methodology: This was socio-legal research with a comparative legal approach that examined how the law functions and is applied in society, taking into account the social, cultural and economic contexts that influence it. Results: The analysis of the judges' reasoning in Wilfrida Soik's case (HC-42KB-7-04/2014) by the Kota Bharu High Court highlights the importance of a holistic approach to law enforcement. The court emphasized substantive justice by integrating written law with the human condition, particularly the mental state of the accused. This decision reflects the influence of the diplomatic relations between Indonesia and Malaysia, respect for sovereignty, and international conventions. Psychologically, the defendant's mental state was disturbed, showcasing the justice system's attention to individual well-being. Sociologically, the judgment underscored the interplay of social and cultural factors, promoting rehabilitation alongside punishment. This multidimensional approach reinforces fairness and social justice in legal decisions. Applications of this study: The results of this research may inspire judicial institutions to make decisions based on considerations of inconsistency of evidence; lack of murderous intent; humanitarian consideration; criminal policy; and parole consideration. This is because many factors must be considered when making a decision, especially in the case of a death row. Novelty/Originality of this study: The analysis of Wilfrida Soik's case underscores a holistic approach to law enforcement, emphasizing substantive justice, mental health, and sociocultural factors. This novel research reveals how these considerations led to the decision to spare the accused from the death penalty, highlighting fairness and social justice. Keywords: Judicial considerations, Indonesian migrant workers, death penalty.   ABSTRAK  Tujuan penelitian: Makalah ini bertujuan untuk memberikan analisis mendalam tentang pertimbangan hakim dalam perkara nomor HC-42KB-7-04/2014 di Pengadilan Tinggi Kota Bharu, Malaysia. Makalah ini secara khusus bertujuan untuk mengeksplorasi aspek filosofis, historis, psikologis, dan sosiologis yang memengaruhi keputusan untuk membebaskan seorang pekerja migran Indonesia dari dakwaan hukuman mati. Pertimbangan hakim Malaysia dipandu oleh hukum yang berlaku, fakta-fakta kasus, prinsip-prinsip keadilan, preseden hukum; pertimbangan sosial dan proses hukum yang wajar. Metodologi: Penelitian ini merupakan penelitian sosio-hukum dengan pendekatan hukum komparatif yang mengkaji bagaimana hukum berfungsi dan diterapkan dalam masyarakat, dengan mempertimbangkan konteks sosial, budaya, dan ekonomi yang memengaruhinya. Hasil: Analisis penalaran hakim dalam perkara Wilfrida Soik (HC-42KB-7-04/2014) oleh Pengadilan Tinggi Kota Bharu menyoroti pentingnya pendekatan holistik terhadap penegakan hukum. Pengadilan menekankan keadilan substantif dengan memadukan hukum tertulis dengan kondisi manusia, khususnya kondisi mental terdakwa. Putusan ini mencerminkan pengaruh hubungan diplomatik antara Indonesia dan Malaysia, penghormatan terhadap kedaulatan, dan konvensi internasional. Secara psikologis, kondisi mental terdakwa terganggu, yang menunjukkan perhatian sistem peradilan terhadap kesejahteraan individu. Secara sosiologis, putusan tersebut menggarisbawahi interaksi faktor sosial dan budaya, yang mendorong rehabilitasi di samping hukuman. Pendekatan multidimensi ini memperkuat keadilan dan keadilan sosial dalam keputusan hukum.   Aplikasi penelitian ini: Hasil penelitian ini dapat menginspirasi lembaga peradilan untuk membuat keputusan berdasarkan pertimbangan ketidakkonsistenan bukti; kurangnya niat membunuh; pertimbangan kemanusiaan; kebijakan kriminal; dan pertimbangan pembebasan bersyarat. Hal ini karena banyak faktor yang harus dipertimbangkan saat membuat keputusan, terutama dalam kasus hukuman mati.   Kebaruan/Keaslian penelitian ini: Analisis kasus Wilfrida Soik menggarisbawahi pendekatan holistik terhadap penegakan hukum, yang menekankan keadilan substantif, kesehatan mental, dan faktor sosial budaya. Penelitian baru ini mengungkap bagaimana pertimbangan-pertimbangan tersebut berujung pada keputusan untuk membebaskan terdakwa dari hukuman mati, dengan menonjolkan keadilan dan keadilan sosial.  Kata kunci: Pertimbangan hukum, pekerja migran Indonesia, hukuman mati.

Abstract

ABSTRACT Purpose of the Study: This research aims to analyze the legal responsibility of insurers in rejecting life insurance claims based on policyholders’ non-material information. This study analyzes the Decision of the Medan High Court No. 47/PDT/2025/PT MDN and compares it with legal practices in Malaysia. Methodology: This research applied the normative juridical method with an analysis of legal regulations, legal doctrines, and court decisions. It also employed the legal comparison method between the legal systems in Indonesia and Malaysia. Results: Results of this research found that the rejection of claims by insurance companies due to non-material or administrative information is invalid according to the law. The judicial assembly emphasizes the principle of contractual justice and the protection towards the insured. Thus, they declare that only information with material characteristics can be used as a valid basis to reject claims. Applications of this Study: Results of this research can be used to strengthen the legal protection for policyholders in the life insurance practice. Apart from that, this study may be used as a reference for formulating policies and reforming the insurance industry both at the national and regional levels. Novelty/Originality of this Study: The novelty of this research lies in its comparative approach to the materiality principle in life insurance contracts. This research shows a difference between the normative approach in Indonesia and the factual evidence-based approach in Malaysia, enriching insight into legal protection in the life insurance industry as well as the urgency of renewing practical norms to make them more just and transparent. Keywords: Life Insurance, Claims, Substantial Justice, Insurers’ Responsibility.   ABSTRAK Tujuan Penelitian:Penelitian ini bertujuan untuk menganalisis tanggung jawab hukum perusahaan asuransi dalam menolak klaim asuransi jiwa berdasarkan informasi non-material pemegang polis. Penelitian ini menganalisis Putusan Pengadilan Tinggi Medan No. 47/PDT/2025/PT MDN dan membandingkannya dengan praktik hukum di Malaysia. Metodologi:Penelitian ini menggunakan metode yuridis normatif dengan analisis peraturan perundang-undangan, doktrin hukum, dan putusan pengadilan. Penelitian ini juga menggunakan metode perbandingan hukum antara sistem hukum di Indonesia dan Malaysia. Hasil: Hasil penelitian ini menemukan bahwa penolakan klaim oleh perusahaan asuransi karena informasi non-material atau administratif tidak sah menurut hukum. Majelis Hakim menekankan prinsip keadilan kontraktual dan perlindungan terhadap tertanggung. Oleh karena itu, mereka menyatakan bahwa hanya informasi yang bersifat material yang dapat digunakan sebagai dasar yang sah untuk menolak klaim. Aplikasi Penelitian Ini: Hasil penelitian ini dapat digunakan untuk memperkuat perlindungan hukum bagi pemegang polis dalam praktik asuransi jiwa. Selain itu, studi ini dapat digunakan sebagai referensi untuk merumuskan kebijakan dan mereformasi industri asuransi, baik di tingkat nasional maupun regional. Kebaruan/Keaslian Studi Ini: Kebaruan penelitian ini terletak pada pendekatan komparatifnya terhadap prinsip materialitas dalam kontrak asuransi jiwa. Penelitian ini menunjukkan perbedaan antara pendekatan normatif di Indonesia dan pendekatan berbasis bukti faktual di Malaysia, yang memperkaya wawasan tentang perlindungan hukum dalam industri asuransi jiwa serta urgensi pembaruan norma-norma praktis agar lebih adil dan transparan.
