Abstract

AbstrakPenelitian ini bertujuan untuk menganalisis regulasi yang ada mengenai energi baru terbarukan di Indonesia berdasarkan analisis ekonomi. Indonesia memiliki potensi untuk memproduksi listrik tenaga surya dalam jumlah yang sangat besar. Hal ini sejatinya telah disadari oleh pemerintah sebagai badan struktural yang telah menyusun strategi lewat regulasi untuk mengembangkan PLTS. Namun masih terdapat banyak celah substansial yang menyebabkan investor, IPP, dan masyarakat luas pada umumnya enggan melirik PLTS. Dengan menggunakan metode hukum normatif yang mendekatkan pada peraturan perundang-undangan yang berlaku ditambah dengan metode komparatif-deskriptif untuk melihat cerminan perbandingan regulasi di negara lain, penulis mendapati bahwa celah substansial tersebut di antaranya meliputi belum tersedia kemudahan serta penetapan harga yang masuk akal dengan kewajiban membeli tanah untuk pengadaan proyek, syarat TKDN yang tinggi padahal eksternalitas yang tinggi juga dibutuhkan untuk mengembangkan PLTS di Indonesia, serta adanya kekosongan hukum secara umum mengenai EBT dan insentif fiskal khusus. Untuk itu, perlu adanya rekonstruksi yang menyeluruh dan gamblang, yang menyiasati ketiga komponen utama sistem hukum yakni struktur, substansi, dan budaya.Kata kunci: energi terbarukan; PLTS; investasi. AbstractThis study aims to analyze the existing regulations regarding renewable energy in Indonesia based on economic analysis. However, there are still many substantial gaps that cause investors, IPPs, and the general public to be reluctant to look at PLTS. By using other normative legal methods in the applicable laws and regulations plus a comparative-descriptive method to reflect regulatory regulations in the country, the authors find that these substantial gaps include the unavailability of facilities and reasonable pricing by purchasing land for project procurement, high local content requirements despite high externalities are also needed to develop PV mini-grid in Indonesia, as well as the availability of general laws regarding NRE and special fiscal incentives. For this reason, there is a need for a thorough and clear reconstruction, which takes into account the three main components of the legal system, namely structure, substance, and culture.Keywords: renewable energy; solar power plant; investment.

Abstract

This writing is written to find out the fraudulent acts committed by business actors during the pandemic and how the legal consequences arise from these fraudulent acts. This research is a juridical normative type with a statutory approach using secondary data collected through literature study. From this writing, it can be concluded that dominant position, Price fixing, and hoarding are a form of fraudulent and interrelated acts committed by business actors in the current pandemic era. Administrative sanctions, fines, imprisonment or additional penalties are given to comply with the applicable provisions for parties who commit several forms of fraud during the pandemic period.

Abstract

The development of the Indonesian economy is aimed at improving the lives of people who are just and prosperous. This is an ideal that has been mandated in the 1945 Constitution and Pancasila. One of the obstacles in the Indonesian economy is the existence of monopolistic practices and unfair business competition in business or business in Indonesia. Tender conspiracy is one of the forms of action prohibited in the Anti-Monopoly Law because tender conspiracy is fraudulent and detrimental, especially to other tender participants who do not conspire, because automatically in the tender, the winner cannot be regulated, but rather who does it. the best bid is the winner and apart from that bid rigging is an anti-competitive act. Regarding the conspiracy, there is a KPPU Decision relating to this matter, namely the KPPU Decision Case Number 6 / KPPU-L / 2015 regarding the construction of the Barito Kuala Regency DPRD building and its Land Development, in its decision the KPPU Commission Council stated that Reported Party I (PT. Citra Kharisma Persada), reported II (PT. Cempaka Mulia Perkasa), reported III (PT Sumber Nor Abadi), reported IV (Pokja I in the Human Settlements Division of the Public Works Office of Barito Kuala Regency Fiscal Year 2013) was proven legally and convincingly violating Article 22 of the Law Number 5 of 1999. This research will discuss legal protections for business actors participating in tenders who suffer losses due to conspiracy in the KPPU's decision.

Abstract

Latar Belakang: Pelimpahan wewenang oleh dokter kepada perawat dapat dilakukan secara delegasi ataupun mandat. Pelimpahan wewenang dengan cara delegasi atau mandat seharusnya dilakukan dengan cara tertulis karena hal ini berkaitan dengan hubungan hukum yang terkait dengan hak dan kewajiban ners dan dokter dalam menjalani kewenangannya. Tujuan:  Menelaah secara yuridis pelimpahan wewenang dan tanggung jawab hukum pelimpahan wewenang dokter ke perawat Metode: Pendekatan penelitian ini merupakan yuridis normatif, dengan waktu penelitian dari Mei 2021 – Agustus 2021. Sampel penelitian ini berupa sumber hukum primer (regulasi dan hukum positif), sumber hukum sekunder (buku), serta sumber hukum tersier (website). Seluruh materi daring diambil dari berbagai literatur terindeks Google Scholar Hasil: Permenkes Nomor 2052/Menkes/Per/X/2011 tentang Izin Praktik dan Pelaksanaan Praktik Kedokteran, dalam Pasal 23 Ayat (1) menyatakan: segala pelimpahan wewenang wajib tertulis, bilamana hal ini tidak dilakukan maka terdapat konsekuensi hukum Kesimpulan: Dokter dapat mendelegasikan wewenang kepada perawat melalui pendelegasian atau mandat. Pendelegasian wewenang seringkali diikuti dengan pendelegasian kewajiban, sedangkan mandat tidak.

Abstract

The source of the State Budget is Taxes. Tax is a mandatory contribution that is coercive because it is regulated by law. One of the tax collection systems is self-assessment, where taxpayers are given the freedom to pay and report their taxes independently, the fiscal officer supervises and checks the tax returns reported by taxpayers every year. This difference in opinion on the results of the examination between taxpayers and tax officers is what raises the problem of tax disputes. The problem of tax disputes has existed from the Dutch colonial era to the present. The Tax Court is the body that decides tax dispute cases, the name and duties of the tax court have changed from time to time and with the decision number 26/PUU-XXI/2023 concerning the Tax Court. The authority of the tax court changed to the full authority of the Supreme Court. This article concludes that the Tax Court developed over time, and along with tax reform the Tax Court also underwent reform with the transfer of organizational, administrative, and financial coaching authority to the Supreme Court (MA). With this transfer of authority, it is hoped that the Tax Court can decide tax dispute cases fairly and have legal certainty for the parties to the dispute.

Abstract

The purpose of this paper is to examine the barriers to registering geographic indications of Sumedang as potential regional assets. The research method used in the research is normative juridical research which means that it is carried out by examining library materials or secondary materials, then analyzing issues concerning Geographical Indications and their benefits to the area of ​​origin. The results of the analysis raise 2 themes discussed here, barriers to registering geographical indications of Sumedang tofu, as well as the impact on product listing as geographic indications. A study of these two themes is very useful in understanding the importance of registering geographic indications as well as the benefits generated by protecting Geographical Indications. Abstract

Penelitian ini mengkaji peran tanggung jawab sosial perusahaan (CSR) PT. Telkom Indonesia dalam meningkatkan kesejahteraan masyarakat, dengan fokus pada implementasi dan dampaknya tentang pedoman umum pembangunan dan pemberdayaan masyarakat desa sesuai yang diatur dalam Peraturan Menteri Desa. PT. Telkom Indonesia, sebagai perusahaan BUMN, telah mengembangkan berbagai program CSR yang ditujukan pada pemberdayaan masyarakat melalui pendidikan, pengembangan sumber daya manusia, dan pengembangan wilayah terpencil. Program-program ini mencakup kemitraan dengan UMKM, digitalisasi pendidikan, serta pengembangan infrastruktur dan teknologi di desa-desa. Hasil penelitian menunjukkan bahwa PT. Telkom Indonesia tidak hanya berhasil meningkatkan kualitas hidup masyarakat tetapi juga memperkuat hubungan dengan komunitas lokal melalui program-program CSR yang inklusif dan partisipatif. Melalui pendekatan yang holistik dan kolaboratif, CSR PT. Telkom Indonesia mendukung pencapaian tujuan Sustainable Development Goals (SDGs) desa, mempromosikan prinsip-prinsip keadilan, keberlanjutan, dan keterbukaan, serta berkontribusi pada pembangunan ekonomi yang intensif serta berkelanjutan di Indonesia.

Abstract

In digital banking, customers who are served digitally can be done starting from the business connection between the bank and the customer starting from opening an account, executing account transactions, to closing a deposit account which is carried out through the use of Information Technology. This of course makes it easier for customers because these activities can be done anywhere. Behind the convenience obtained from using digital banking services, there are also risks involved. Thus, the need for legal protection for customers who use digital banks is necessary to protect consumers from customers in banking services, because the law integrates and serves society. However, unfortunately the regulations regarding Digital Banks in Indonesia have not yet stood alone and are still being reviewed by the OJK. Therefore, so that the special regulations for digital banks in Indonesia can be of good use and not harm any party, references are needed from other countries that have issued legal regulations regarding digital banking to see the legal regulations for digital banks that have been previously implemented in that country so that they can become a reference for the process of making special regulations regarding banking in Indonesia. One country that has implemented special regulations regarding digital banking is Singapore. Based on these problems, in this journal the author will discuss the General and Systematic Overview of Legal Protection for Digital Bank Customers in Indonesia and the Comparison of Digital Bank Regulations in Indonesia and Digital Banks in Singapore for Customers.

Abstract

This study was conducted to analyze the Business Competition Supervisory Commission's consideration of re-tendering as a vertical conspiracy, as well as to examine arrangements for the application of re-tendering that provide legal certainty for project owners and tender participants. This research uses qualitative normative methods involving steps such as statutory studies, case studies, and conceptual approaches. This research uses a statutory approach to examine related regulations, a case approach to analyze decisions related to tender conspiracy, and a conceptual approach to understand relevant legal ideas and concepts. The results showed that the Business Competition Supervisory Commission (KPPU) concluded that there was a tender conspiracy in the process of canceling and re-running the tender by PT Jakarta Propertindo (Perseroda). Where PT Jakarta Propertindo (Perseroda) is a company officially assigned by the Provincial Government of DKI Jakarta to plan, build, manage, and maintain the Jakarta Arts Center Taman Ismail Marzuki. The Commission Panel found that the Reported Party I, which canceled the tender without a valid reason and could not be accounted for, deliberately did so to facilitate the Reported Party II and the Reported Party III to win the tender. Changes in the assessment procedures, especially in the experience aspect of the technical assessment, proved the intent of the Procurement Team to increase the technical scores of the Reported Party II and the Reported Party III. Thus, it confirms the role of KPPU in prohibiting vertical conspiracy and re-tendering in the practice of goods and services procurement, which provides legal certainty for project owners and tender participants
