Abstract

In the use of energy in Indonesia, is still completely dependent on non-renewable energy such as petroleum, coal and natural gas as the source of its energy needs. After being implemented by the government to realize the renewable energy mix it still experiences various obstacles including technical, non-technical and price competition with fossil energy which tends to be cheaper, causing development of renewable energy is hampered and the energy mix achieved is only around 6.2% overall with growth of 0.39 per year. This research will discuss the effectiveness of regulations issued by the Indonesian government relating to foreign investment in the renewable energy sector. The purpose of this research, will contribute in the form of ideas to relevant agencies, such as the Ministry of Energy and Mineral Resources of the Republic of Indonesia because it is directly related to renewable energy in Indonesia. The method that will be used in this research is empirical normative juridical, which uses facts in the field and is analyzed based on applicable laws and regulations.Keywords: Renewable Energy, Investment, Foreign

Abstract

The system of exchanging information on taxpayer data between countries called as AEoI  is follow up action on tax amesty which  provides many benefits for the country but has risks for taxpayers data. Law 9/2017 concerning the AEoI merely governs technical issues and does not regulate regarding taxpayer data protection even if taxpayer data protection is guaranteed in article 28G paragraph (1) of the 1945 Constitution. Personal data in Indonesia is currently not regulated in a specific law. The need for personal data protection arrangements is an urgent matter because personal data stores human dignity, especially in the AEoI system that has data permissions. This paper compares the personal data protection arrangements in the European Union and the regulatory principles applied in Indonesia because it is important for Indonesia to meet European Union standards regarding personal data protection.

Abstract

Distributors and retailers have a relationship in running their business. Their relationship creates business competition. Business competition is legitimated as long as it does not break the existing regulations. Distributors retail goods to consumers, it has a detrimental impact on retail traders. It requires a more in-depth study related to business competition law reviews about this case, especially on analyzing the existence of unfair business competition and seeking legal certainty for law enforcement. Relates to distributors who direct retail their goods to consumers. This research method use in this research was juridical normative, which uses a statutory approach with secondary data sources. There are indications of abuse of dominant position related to monopolize the market. It is regulated in Law Number 5 of 1999 concerning Monopolistic Practices and Unfair Business Competition against the distributor's actions. That action is regulated on Number 22 of 2016 concerning General Provisions of trade minister for the Distribution of Goods which prohibits the distributor who retails their product to consumers clearly and the sanctions. Therefore, law enforcement is carried out based on the provisions of these regulations.

Abstract

The ratification of Law Number 11 of 2020 concerning Employment Creation (Omnibus Law Employment Creation) massively amends, deletes, or sets new rules against several previous laws, such as Law Number 39 of 2014 concerning Plantations (Plantation Law) and other regulations. Some of the contradictions that have arisen between the Plantation Law and the Omnibus Law Employment Creation, of course, have an influence on the palm oil industry sector in Indonesia, causing legal uncertainty. The problem raised in this study is about how the plantation regulation in the palm oil industry sector is in the Omnibus Law Employment Creation. The research objective is to analyze the legal certainty of plantation regulations in the palm oil industry sector in the Omnibus Law Employment Creation. The research method used is juridical normative, that is, research is carried out through literature study with secondary data. The results show that the plantation regulations in the palm oil industry sector in the Omnibus Law Employment Creation contain legal uncertainty, where in the Omnibus Law Employment Creation there are several contradictions with the provisions of the previous Plantation Law, such as the culture of prioritizing foreign investors, and not in accordance with protection and management of environment. It is necessary to review laws and regulations, especially for the sustainability of the palm oil industry sector, by harmonizing all the rules contained in the Omnibus Law Employment Creation.

Abstract

The world is being shocked by the COVID-19 disease, which has quickly evolved into a pandemic. rRT-PCR is used to examine this disease. This attracts a large number of Start-Up companies to the health industry, resulting in a significant increase in medical waste. As an outcome, medical waste that is not appropriately managed in accordance with SOP accumulates. There are quite a few people who carelessly discard medical waste. This journal is a juridical-normative study. If not correctly managed, the outcomes of this investigation in the form of medical waste can pollute the environment and endanger surrounding populations. The study's conclusion is that medical waste must be carefully managed in compliance with SOP. Individuals who fail to properly handle medical waste will face criminal consequences under the criminal code of law.

Abstract

Penelitian ini bertujuan untuk mengkaji terkait akibat hukum bagi perusahaan yang memberikan upah lebih rendah dari upah minimum yang berlaku. Upah ialah imbalan yang berbentuk uang yang diberikan atas kesepakatan atau melalui perjanjian kerja antara buruh atau pekerja dengan pengusaha atau pemberi kerja maupun berdasarkan peraturan perundang-undangan dan merupakan hak buruh atau pekerja termasuk di dalamnya tunjangan untuk buruh atau pekerja serta keluarganya yang diberikan karena hasil kerjanya oleh pengusaha atau pemberi kerja. Artinya pekerja yang sudah melaksanakan perintah atau pekerjaan yang diberikan maka berhak mendapatkan upah dari hasil kerjanya. Sedangkan upah minimum merupakan upah bulanan terendah. Maka dari itu pemberian upah tersebut tidak boleh lebih rendah dari upah minimum yang telah diatur dalam peraturan perundang-undangan. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan statute approach dan case approach. Hasil yang didapat dari penelitian ini bahwa perusahaan atau pemberi kerja akan mendapatkan sanksi atau hukuman apabila tidak memberikan upah sesuai dengan aturan yang berlaku.

Abstract

Jurnal ini ingin mengkaji tentang bagaimana pengaturan perencana keuangan dan pengelolaan dana investasi di Indonesia dibandingkan dengan Singapura. Dengan adanya kasus yang melibatkan perencana keuangan, saat ini muncul permasalahan yang menimbulkan persoalan hukum baru, yaitu belum adanya pengaturan tentang perencana keuangan di Indonesia. Sejumlah negara seperti Australia, Singapura dan Hongkong telah memiliki aturan yang tegas berkenaan dengan perencana keuangan. Akan tetapi sampai saat ini Indonesia belum memiliki undang-undang khusus yang mengatur tentang perencana keuangan. Tujuan jurnal ini adalah mengetahui bagaimana pengaturan perencana keuangan di Singapura  serta bagaimana pengelolaan dana investasi di Indonesia dibandingkan dengan Singapura.

Abstract

Penelitian ini bertujuan meneliti mengenai fungsi bea materai dalam surat perjanjian jual beli online (e-commerce) dan kepastian hukum yang diberikan bea materai kepada surat perjanjian jual beli online (e-commerce). Metode penelitian yang digunakan dalam penelitian ini adalah metode pendekatan normatif (yuridis). Hasil penelitian yang didapatkan adalah fungsi bea materai dalam surat perjanjian jual beli online (e-commerce) sebagaimana disebutkan dalam Undang-Undang Bea Materai terbaru yaitu Undang-Undang Nomor 10 Tahun 2020 Tentang Bea Materai. Kesimpulan yang didapatkan adalah fungsi bea materai dalam surat perjanjian jual beli online (e-commerce) memiliki fungsi sebagai dasar pemberian pajak atas dokumen dan kepastian hukum atas surat perjanjian jual beli online (e-commerce) merupakan bentuk dari isi surat perjanjian tersebut.

Abstract

The purpose of this paper is to examine the barriers to registering geographic indications of Sumedang as potential regional assets. The research method used in the research is normative juridical research which means that it is carried out by examining library materials or secondary materials, then analyzing issues concerning Geographical Indications and their benefits to the area of ​​origin. The results of the analysis raise 2 themes discussed here, barriers to registering geographical indications of Sumedang tofu, as well as the impact on product listing as geographic indications. A study of these two themes is very useful in understanding the importance of registering geographic indications as well as the benefits generated by protecting Geographical Indications. Abstract

Banyak sebab siswa melakukan perilaku bullying. Beberapa konsep perilaku sosal digunakan untuk menganalisis bagaimana praktik bullying itu terjadi, apa saja motif dan bagaimana praktik bullying itu dimaknai oleh pelaku. Dalam dunia pendidikan kasus bullying sering terjadi. Hal tersebut disebabkan oleh berbagai faktor, seperti orang tua terlalu memanjakan anaknya, keadaan keluarga yang berantakan sehingga diri anak tersisihkan, atau hanya karena anak tersebut meniru perilaku bullying dari kelompok pergaulannya serta tayangan yang bernuansa kekerasan di internet atau televisi. Tingkatan ringan kasus bullying bisa menjadi berat ketika pelaku bullying merasa sakit hati berkepanjangan dan memendam rasa dendam terhadap seseorang yang berujung kematian. Melalui sosialisasi mengenai school bullying kepada siswa-siswi serta guru, tindakan ini cukup membantu untuk mengurangi terjadinya hal tersebut, tidak hanya kepada pelaku bullying, tetapi juga kepada korban bullying.
