Abstract

This study examines the concept of Dalalah al-Alfazh within the framework of Hanafi usul al-fiqh, focusing on the four principal forms of textual indication: al-‘Ibarat al-Nash, al-Isyarat al-Nash, Dalalah al-Nash, and al-Iqtida’ al-Nash. The study aims to analyze the conceptual foundations, methodological characteristics, and legal implications of these categories in the process of Islamic legal derivation (istinbat al-ahkam). Employing a qualitative approach through descriptive-analytical library research, the study explores classical and contemporary works of Islamic legal theory to examine how Hanafi jurists interpret scriptural texts through linguistic and rational methodologies. The findings reveal that al-‘Ibarat al-Nash represents explicit textual meaning, while al-Isyarat al-Nash reflects implicit meanings derived from linguistic structure and logical implication. Dalalah al-Nash extends legal rulings to analogous cases based on shared legal causes (‘illah), whereas al-Iqtida’ al-Nash identifies implied meanings required for the coherence and operability of legal texts. These categories demonstrate the methodological sophistication of the Hanafi school in integrating textual interpretation, rational analysis, and the objectives of Islamic law (maqasid al-shari‘ah). The study further argues that the theory of Dalalah al-Alfazh remains highly relevant in addressing contemporary legal issues, particularly in contexts requiring adaptive and contextual Islamic legal reasoning. Therefore, understanding the various forms of textual indication is essential for developing a comprehensive, dynamic, and methodologically accountable approach to contemporary Islamic jurisprudence.

Abstract

Background. In the global context, understanding the holy texts of the Qur'an and the application of Islamic law face increasingly complex challenges, especially related to language qaedah, tafsir qaedah, and ushul fiqh. Purpose. This research aims to explore the relationship between linguistic qaedah, tafsir qaedah, and ushul fiqh, as well as identifying effective strategies for applying these three aspects in the context of modern life. Method. This study uses a qualitative method with a literature study approach through analysis of relevant literature related to interpretation and ushul fiqh. Results. The results of the study show that language rules play an important role in determining the meaning and context of the verses of the Qur'an, which then influences the process of interpretation and legal decision-making in ushul fiqh. Conclusion. the application of the principles of maqashid al-syari'ah and qawaid fiqhiyyah in interpretation can enrich understanding and increase the relevance of Islamic law in the modern era.

Abstract

Background. Understanding the meaning of legal verses in the Qur’an requires a rigorous linguistic approach, as Qur’anic law is articulated through highly nuanced Arabic structures, vocabulary, and rhetorical devices. Many misinterpretations of Islamic legal texts stem from insufficient mastery of Arabic language rules, including morphology, syntax, semantics, and contextual pragmatics. Purpose. This study aims to examine how Arabic language rules function as a foundational framework for accurately interpreting the meaning of law in the Qur’an and for deriving sound legal understanding. Method. The research employs a qualitative library-based methodology, utilizing textual analysis of selected Qur’anic legal verses alongside classical works of Arabic grammar (na?w and ?arf), semantics, and Qur’anic exegesis. Data are analyzed through comparative and contextual analysis to identify the relationship between linguistic rules and legal interpretation. Results. The findings demonstrate that Arabic grammatical structures, semantic precision, and rhetorical patterns play a decisive role in determining legal meaning, scope, and implication within Qur’anic texts. Variations in case endings, verb forms, and syntactic constructions significantly influence legal interpretation and normative conclusions. Conclusion. The study concludes that mastery of Arabic language rules is not supplementary but essential for understanding Qur’anic law, as linguistic competence safeguards legal interpretation from reductionism and textual misreading, thereby ensuring methodological accuracy in Islamic legal studies.

Abstract

The rise of online gambling in the digital era has created new challenges to household stability, particularly when it causes the neglect of alimony obligations within marriage. This study aims to analyze the divorce decision in Case Number 304/Pdt.G/2025/PA.SJJ by examining the relationship between alimony neglect, online gambling, and marital breakdown from normative legal and maqasid al-shariah perspectives. This research employs a qualitative case study approach using primary data obtained through interviews with the plaintiff, defendant, presiding judge, and an Islamic law scholar. Secondary data were collected from court decisions, statutory regulations, and relevant literature. Data were analyzed using the Miles and Huberman interactive model combined with case interpretation. The findings show that online gambling became a catalyst for the misuse of household financial resources, resulting in neglected alimony obligations and prolonged domestic conflict. Normatively, these conditions fulfill the legal grounds for divorce under Law Number 1 of 1974 and Kompilasi Hukum Islam (KHI). From the maqasid al-shariah perspective, such behavior violates the protection of life (hifz al-nafs), property (hifz al-mal), intellect (hifz al-aql), and offspring (hifz al-nasl). Therefore, the court's decision reflects the principle of preventing greater harm within the household. Consequently, the study contributes to the development of maqasid-based legal interpretation in contemporary divorce cases, particularly those arising from emerging digital social problems such as online gambling.

Abstract

This article analyzes the dynamics of the Muhammadiyah movement in Java and West Sumatra by highlighting the historical, cultural, and structural differences that shape the character of the movement in both regions. Although Muhammadiyah promotes a normatively uniform ideology of Islamic modernism, its practices and expressions at the local level exhibit significant variation. This study employs a qualitative approach with a comparative-historical design based on library research. Data are drawn from official Muhammadiyah documents, works of key figures and scholars, and relevant academic literature, and are analyzed qualitatively using the theoretical framework of Islamic modernism, structuration theory, and the concept of cultural negotiation.The findings indicate that Muhammadiyah in Java developed within a cultural context that emphasizes harmony and a hierarchical social structure, resulting in a movement characterized by moderation, persuasive strategies, and gradual change, with institutional strengthening as its primary approach. In contrast, Muhammadiyah in West Sumatra evolved within an egalitarian culture and a critical surau-based intellectual tradition, producing a movement that is more rational, assertive, and argumentative. These differences are not dichotomous; rather, they represent a spectrum of complementary expressions of Muhammadiyah’s Islamic modernism.This study demonstrates that the strength of Muhammadiyah as a national Islamic movement lies in its ability to manage local diversity without losing its ideological identity. The article contributes to the study of modern Islam in Indonesia by emphasizing the importance of contextual approaches in understanding the dynamics of religious movements.Keywords: Muhammadiyah, Islamic modernism, Java, West Sumatra, cultural dynamics.
