Abstract

Indonesia, especially Binjai City, uses an agroforestry system by utilizing the land of the residents of Binjai City by planting several cultivated plants, especially horticultural annuals and forest trees. The goal is to reduce the use of chemical pesticides and get the yield of land planted with horticultural crops in a relatively fast time, compared to forest crops whose productivity is relatively long. The sad thing is that the land will cause soil damage and will not become one of the providers of oxygen sources (O2) on Earth due to the reduced number of trees planted. There are also several other disadvantages, namely the competition between trees and horticultural crops in terms of fighting for nutrients and sunlight and the last weakness is the increasing labor costs, especially the role of women. The problem raised in this study is the role of women in environmental conservation using the Agroforestry system. The method carried out in this study is an observation method using a qualitative descriptive method that analyzes the problem under study. The result of her research is that the Government must conduct counseling or presentation of material about the Agroforestry system to women directly so that it is easier to understand

Abstract

Penelitian ini terkait dengan adanya kasus perusakan lingkungan hidup oleh PT. Gorga Duma Sari (PT. GDS) yang terbukti secara sah dan meyakinkan bersalah telah melakukan tindak pidana perusakan lingkungan hidup berdasarkan Pasal 98 ayat (1) UU Pengelolaan dan Perlindungan Lingkungan Hidup berdasarkan Putusan Mahkamah Agung RI No. 1203K/Pid.Sus/2016. Putusan tersebut mengadili Terdakwa “JH” selaku Direktur Utama PT GDS atas perbuatannya yang mengakibatkan dilampauinya baku mutu udara ambien, buku mutu air, baku mutu air laut atau baku mutu kerusakan lingkungan hidup yang diatur dalam Pasal 98 ayat (1) jo. Pasal 116 ayat (1) UU PPLH. Dalam amar putusan tersebut ada hal yang menarik terkait pidana tambahan perbaikan kerusakan lingkungan yang dilakukan dengan cara menanam tanaman keras di lokasi bekas tebangan pohon dari membangun dinding penahan tebing terhadap tebing yang telah dipotong oleh PT GDS. Penjatuhan pidana tambahan dalam putusan ini terdapat makna “tanaman keras” yang tidak dijelaskan oleh majelis hakim. Istilah tanaman keras ini tidak diatur sama sekali mengenai definisi tanaman keras yang sesungguhnya. Permasalahan penelitian ini, yaitu: pengaturan pelaksanaan putusan pengadilan (eksekusi) pidana tambahan terhadap putusan tindak pidana lingkungan hidup; kekuatan eksekutorial jaksa dalam pelaksanaan eksekusi pidana tambahan dalam Putusan Mahkamah Agung RI No. 1203K/Pid.Sus.LH/2016. Penelitian ini adalah penelitian hukum normatif, dengan sifat penelitian deskriptif analisis. Pendekatan yang digunakan adalah pendekatan perundang-undangan (statute approach). Putusan pengadilan sebagai data sekunder didapat dari Kepaniteraan Pengadilan Negeri Balige. Dengan menggunakan analisis kualitatif, maka hasil penelitian, bahwasanya masih terdapat kekosongan hukum dalam eksekusi putusan tindak pidana lingkungan hidup; dan tidak adanya upaya paksa dari Kejaksaan Negeri Pangururan dalam melaksanakan eksekusi Putusan MA.RI No. 1203K/Pid.Sus.LH/2016. Sebab, tidak ada sanksi tindakan tata tertib yang dikenakan kepada PT. GDS apabila tidak melaksanakan pidana tambahan tersebut.

Abstract

For two-wheeled vehicles, it is expressly required by Law Number 22 of 2009 Concerning Road Traffic and Transportation to switch on the primary lights during the day. A requirement for vehicle eligibility on the road is the regulation of this obligation. The provisions in the UULLAJ do not yet control the ATPM's accountability for vehicle requirements that ensure the headlights stay on and the availability of an automatic device as a warning when the headlights are damaged. This has ramifications for traffic-related duties performed by the National Police in the area of law enforcement. Only drivers who fail to fulfil their requirements to ensure the specifications of their primary lights throughout the day without touching the ATPM are the targets of law enforcement. Because there was no legal framework for the Police to take action against the ATPM, this law enforcement was not carried out. In reality, considerations of legal certainty, justice, and advantages must be given while establishing a legal norm. Data were collected using interviews as main sources and library research as secondary sources. This study employs a qualitative research methodology and is a descriptive analysis.

Abstract

The Indonesian Notary Law (UUJN) stipulates that notaries may be held accountable administratively, civilly, and criminally. In District Court Decision Number: 209l/Pid.B/2023/PN.Sby, Notary DC was sentenced to imprisonment of nihil. The research method employed is normative legal research based on literature review, with qualitative analysis of legal principles The findings of this study indicate that Decision Number: 2091/Pid.B/2023/PN.Sby may serve as the basis for dishonorable dismissal of Notary DC, as the criminal acts committed constitute concursus realis in relation to previous court rulings. In sentencing, by applying the rule of the highest penalty plus one-third, namely 7 (seven) years + (A x 7) years = 9 (nine) years and 4 (four) months of imprisonment, the decision fulfills the elements stipulated in Article 13 of the UUJN. This study suggests the need for harmonization between the UUJN and the new Criminal Code regarding sanctions for notaries who commit criminal offenses, greater judicial prudence in sentencing, and clearer provisions within the UUJN on sanctions against notaries.

Abstract

This study examines the criminal provisions applied to corruption cases involving the former Head of the National Land Agency (BPN) of Toba Regency in issuing a Land Ownership Certificate (SHM) No. 221. Corruption is categorised as an extraordinary crime due to its violation of social and economic rights. However, based on Articles 2 and 3 of Law No. 31 of 1999 on the Eradication of Corruption Crimes, as amended by Law No. 20 of 2001, the defendant was not proven to have committed any unlawful act, and no state financial loss was found. The judicial analysis also confirms that Ministerial Regulation No. 28 of 2015 and Ministerial Decree No. 1695 of 2022 only regulate sectoral technical criteria and do not classify the land as state property. The Supreme Court's cassation ruling on October 4, 2023, rejected the Public Prosecutor's appeal and upheld the acquittal. This study highlights the importance of precise legal interpretations in corruption cases to avoid judicial errors.

Abstract

The sovereignty over natural resources in Indonesia faces challenges due to foreign corporate ownership, which can undermine national control over these resources (Cotula, 2016). Article 33 of the 1945 Constitution, however, asserts that the management of these resources must prioritize the welfare of the people and be under state control (Miranda, 2012). Illegal mining activities, particularly in Mandailing Natal Regency, have become a serious concern, as they are carried out without proper government permits and contribute to significant environmental degradation (Jacob & Gunadi, 2023). This study aims to examine the factors contributing to illegal mining in the region and the effectiveness of current policies aimed at curbing these activities. Using qualitative methods, including interviews with local miners, this research explores the economic, social, and legal aspects influencing illegal mining. The findings indicate that economic factors, lack of socialization about legal mining regulations, and weak law enforcement are the primary drivers behind illegal mining. The study suggests that raising public awareness and strengthening legal frameworks could significantly mitigate illegal mining activities. Ultimately, this research contributes to improving policy formulations that address illegal mining and its associated impacts on the environment and local economie

Abstract

The tabulation of case data collected by the Indonesian Child Protection Commission (KPAI), the Directorate General of Corrections of the Ministry of Law and Human Rights, and the National Police's National Police Center (Pusiknas Polri) explicitly shows the high number of cases of children in conflict with the law and the high number of children in conflict with the law as perpetrators with very serious crimes. The data is also still collected data, which means that data in the field can be much larger than the data that has been recorded, so it requires special and serious attention. Several problem formulations were drawn for the research study, namely how the regulation of criminal sanctions for children and the urgency of formulating a model of criminal sanctions for children aged 15-18 years as perpetrators of crimes in Indonesia, how the concept of updating the model of criminal sanctions for children aged 15-18 years in Indonesia, and how the formulation of the model of criminal sanctions for children aged 15-18 years is appropriate to the ethics of national legal development in Indonesia. This research uses a normative juridical method with a conceptual approach and qualitative analysis of primary and secondary legal materials. The research results show that the provisions on criminal sanctions for children in the Child Protection and Child Protection Law are still rehabilitative and not fully proportional for children aged 15–18 who commit serious crimes. Therefore, it is necessary to formulate a new sanction model that is fairer, more educational, and has a deterrent effect. The proposed reform concept includes optimizing the principal penalty to two-thirds of the adult penalty, accompanied by additional community service and out-of-institutional guidance, and increasing the maximum sentence to 12 years for crimes punishable by death or life imprisonment.

Abstract

Environmental arrangements are regulated in Law No. 32 of 2009 concerning Protection and Management of the Environment. Corporation is a body created by law. The body that is created consists of "corpus" which is its physical structure and in it the law includes an element of "animus" that makes the body and the law is a legal creation then except the creator, his death is also determined by law. The regulation of criminal responsibility and individual responsibility for corporations and corporate administrators as perpetrators of criminal acts is regulated in Law No. 32 of 2009 concerning the protection and management of living environments. To find out who the criminal offender in the environment can be used as proof theory so that directing information can be found in the company. The research used in this legal research is normative law. Normative legal research or also called library legal research is legal research conducted by examining library materials or mere secondary data.

Abstract

Efforts to eradicate smuggling of imported goods have long been an interesting study material among law enforcers, because they are related to several agencies that have the authority and supervision over the implementers of the import and export. This issue should be quickly addressed because this problem has become one of the main targets in the implementation of the duties of law enforcers and several related agencies that have authority and supervision over the implementation of import and export of goods. One of the efforts to eradicate the transportation of imported goods unlawfully is with the judge's decision in combating criminal acts in the customs field. Judge's decision is the product of a court which is included in the judicial power section based on Article 24 of the third amendment to the 1945 Constitution which confirms that the judicial power is an independent power in carrying out judiciary to enforce law and justice carried out by the Supreme Court and judicial bodies which there are below such as general justice and so on.The research method used in this study is normative legal research, namely research carried out based on the main legal material by examining theories, concepts, legal principles and legislation relating to this research.Research Results and Discussion are: 1) The crime of smuggling is regulated in the provisions of Article 102, Article 102 A, and Article 102 B of customs laws. 2) Parties that can be held accountable according to the customs law are Individuals; Acting Director General of Customs and Excise; Carrier of Goods; Employers of Customs and Legal Services Management (Companies, Companies, Collections, Foundations, and Cooperatives). 3) Judges in Decision Number 77 / Pid.B / 2017 / PN-Tjb see factors affecting the skipper transporting imported goods unlawfully. These factors are personal character, mental pressure, the motives of the perpetrators and the state of the environment around the place of residence. However, judges at the Tanjung Balai District Court as in some of their decisions tend to forget and leave the effects of smuggling imported goods

Abstract

Manusia dan korporasi merupakan subjek hukum sebagai pembawa hak dan kewajiban, di mana manusia bersifat kodrati sedangkan badan hukum dibentuk untuk kepentingan manusia. Pertanggungjawaban pidana timbul jika terdapat perbuatan melawan hukum yang disertai kesalahan, baik sengaja maupun lalai. Dalam perseroan terbatas, direksi berwenang mengurus dan mewakili perseroan sesuai UU No. 40 Tahun 2007, namun dalam praktik dibantu manajer melalui pendelegasian tugas. Penelitian normatif ini menunjukkan bahwa tindakan manajer merupakan perpanjangan tangan direksi, sehingga apabila terjadi tindak pidana lingkungan hidup, direksi sebagai pengurus korporasi dapat dimintai pertanggungjawaban pidana atas perbuatan bawahannya serta termasuk pertanggungjawaban korporasi berdasarkan doktrin vicarious liability yang berkembang
