Abstract

Medical disputes continue to grow in complexity as public expectations for high-quality healthcare and legal awareness increase. Within this context, the Medical Committee holds a crucial role as an internal hospital mechanism responsible for providing professional and objective assessments of medical actions before disputes escalate to external forums. This study aims to examine the normative position, authority, and effectiveness of the Medical Committee in the resolution of medical disputes within the framework of existing legislation. The research employs a normative juridical method by analyzing the provisions of the Health Law No. 17 of 2023, Hospital Law No. 44 of 2009, Medical Practice Law No. 29 of 2004, and Minister of Health Regulation No. 755/MENKES/PER/IV/2011. The findings indicate that the Medical Committee possesses strong legal legitimacy to conduct medical audits, maintain professional standards, and provide technical recommendations in dispute resolution. However, its effectiveness varies due to inconsistent implementation, overlapping authority with other internal bodies, and the absence of uniform operational guidelines. This study highlights the need for strengthened regulation and standardized procedures to enhance the role of the Medical Committee as an effective early-stage dispute filter and a provider of legal certainty within hospital-based medical dispute mechanisms..

Abstract

Surgical procedures in children with tumors constitute high-risk medical services that have the potential to give rise to medical disputes. Within the framework of health law, hospitals function not only as healthcare providers but also as legal entities responsible for service quality, patient safety, and the resolution of medical disputes. This study aims to analyze the legal responsibilities and roles of hospitals in resolving medical disputes arising from pediatric surgical procedures in children with tumors, based on Minister of Health Regulation Number 24 of 2022, Law Number 17 of 2023 on Health, and Government Regulation Number 28 of 2024. The research employs normative and empirical juridical approaches, supported by field studies conducted at H. Adam Malik General Hospital, Medan. The findings indicate that hospital legal responsibility is comprehensive, encompassing the actions of medical personnel, healthcare service systems, compliance with patient safety standards, and medical record documentation. Hospitals also play a strategic role in resolving medical disputes through non-litigation mechanisms, particularly internal mediation and patient complaint systems, in order to provide legal protection and prevent the escalation of disputes.

Abstract

Peningkatan pemahaman hukum kesehatan menjadi salah satu kebutuhan penting bagi profesional medis, mengingat kompleksitas dan dinamika dunia kesehatan yang melibatkan berbagai aspek hukum. Profesional medis, khususnya yang tergabung dalam Ikatan Dokter Indonesia (IDI) Pekanbaru, perlu memahami regulasi yang mengatur praktik kedokteran dan hak serta kewajiban mereka dalam memberikan pelayanan kepada masyarakat. Oleh karena itu, pengabdian masyarakat ini bertujuan untuk meningkatkan kesadaran hukum kesehatan melalui forum diskusi interaktif yang melibatkan dokter dan tenaga medis lainnya di Pekanbaru. Forum diskusi ini diselenggarakan untuk memberikan pemahaman yang lebih mendalam terkait dengan hukum kesehatan yang berlaku di Indonesia, dengan mengedepankan materi yang relevan dan aplikatif. Peserta diskusi diberikan kesempatan untuk berdialog dan bertanya langsung kepada narasumber yang ahli di bidang hukum kesehatan. Diskusi ini juga berfokus pada isu-isu aktual dalam dunia medis, seperti hak pasien, etika kedokteran, serta regulasi terkait tanggung jawab medis dan kewajiban profesional medis dalam menghadapi tuntutan hukum. Metode yang digunakan dalam kegiatan ini adalah pendekatan interaktif, di mana peserta tidak hanya mendengarkan paparan materi, tetapi juga aktif berpartisipasi dalam diskusi yang membahas kasus-kasus nyata yang sering dihadapi dalam praktik kedokteran. Kegiatan ini diharapkan dapat menumbuhkan kesadaran hukum yang lebih baik, meningkatkan rasa tanggung jawab para profesional medis, serta memperkaya wawasan mereka dalam menghadapi berbagai situasi hukum yang mungkin timbul dalam pekerjaan sehari-hari. Melalui forum ini, diharapkan tercipta lingkungan yang lebih kondusif untuk meningkatkan kompetensi dan profesionalisme tenaga medis di Pekanbaru, serta memperkuat kesadaran mereka terhadap pentingnya hukum dalam setiap aspek praktik kedokteran. Abstract

Health service activities at Community Health Centers (Puskesmas) are increasingly dependent on electronic systems, so system failures can cause service delays and potentially violate patients’ rights. This condition requires legal protection and clear accountability of health service providers. This study aims to analyze electronic system failures at Puskesmas, their impact on services, the forms of legal protection available to patients, and the legal liability that may be applied. The research uses a normative juridical method based on the Health Law, the Electronic Information and Transactions Law, and the Personal Data Protection Law. The results show that system failures lead to service delays and access barriers, with providers’ liability potentially taking administrative, civil, or criminal forms. This study emphasizes the importance of strengthening digital infrastructure and technical regulations to ensure the reliability of electronic health services at Puskesmas.

Abstract

This study examines the legal role of informed consent in high-risk dental medical procedures under Law Number 17 of 2023 on Health. Informed consent represents not only an ethical obligation but also a legal mechanism ensuring patient autonomy and professional accountability. Using a normative juridical method with statutory, conceptual, and case approaches, this research analyzes how the new legal framework strengthens patient protection and defines the professional responsibilities of dental practitioners. The findings indicate that despite the law’s explicit provisions particularly Articles 293 and 294 implementation remains constrained by limited legal literacy, ineffective communication, and insufficient documentation among practitioners. From the ethical perspective, informed consent reflects respect for autonomy, while legally it serves as preventive protection against malpractice claims. Therefore, enhancing professional understanding, integrating bioethics and health law in education, and ensuring standardized consent documentation are essential to achieving transparent, fair, and patient-centered dental services in Indonesia.

Abstract

Penelitian ini membahas pertanggungjawaban pidana terhadap anak yang melakukan tindak pidana pembunuhan berencana sebagaimana diatur dalam Pasal 340 Kitab Undang-Undang Hukum Pidana. Permasalahan muncul karena anak memiliki kedudukan khusus dalam hukum yang memerlukan perlindungan serta perlakuan berbeda dibandingkan pelaku dewasa. Penelitian ini bertujuan untuk menganalisis dasar hukum pertanggungjawaban pidana anak serta mengkaji penerapannya dalam Putusan Nomor 3/Pid.Sus-Anak/2022/PN Bnt. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Bahan hukum terdiri dari bahan hukum primer berupa KUHP, Undang-Undang Sistem Peradilan Pidana Anak, Undang-Undang Perlindungan Anak, serta putusan pengadilan, dan bahan hukum sekunder berupa literatur dan pendapat ahli. Hasil penelitian menunjukkan bahwa anak dapat dimintai pertanggungjawaban pidana apabila memenuhi unsur tindak pidana dan memiliki kemampuan bertanggung jawab. Namun, pemidanaan terhadap anak harus memperhatikan prinsip perlindungan anak, kepentingan terbaik bagi anak, serta tujuan rehabilitasi. Putusan pengadilan telah mencerminkan keseimbangan antara kepastian hukum, keadilan, dan perlindungan hak anak.

Abstract

Abstract: Professional ethics of doctors are an important foundation in the practice of quality health services. The application of professional ethics of doctors in health services for patients greatly determines the quality of services provided, both in terms of professionalism, safety, and patient comfort. This study aims to examine the application of medical professional ethics in providing health services to patients, focusing on aspects of honesty, medical confidentiality, and professional responsibility. The research method used was a literature study and interviews with medical personnel in several hospitals and clinics in Indonesia. The results show that although many doctors have implemented professional ethics well, there are still challenges in terms of effective communication between doctors and patients and adherence to the principle of medical confidentiality. In addition, the application of professional ethics is also influenced by cultural factors and the work environment in each health institution. Most doctors understand the importance of professional ethics, but their application is not yet fully optimal, especially in situations that require difficult decisions or conflicts of interest. This study provides recommendations to improve professional ethics training for doctors and create a work environment that supports the application of professional ethics in health services. It is hoped that with the implementation of better professional ethics, the quality of health services for patients can be further improved, create a more harmonious doctor-patient relationship, and reduce the risk of malpractice and patient complaints. Keywords: professional ethics, health services, medical confidentiality. Abstrak: Etika profesi dokter merupakan landasan penting dalam praktik pelayanan kesehatan yang berkualitas. Penerapan etika profesi dokter dalam pelayanan kesehatan bagi pasien sangat menentukan kualitas pelayanan yang diberikan, baik dari sisi profesionalisme, keamanan, maupun kenyamanan pasien. Penelitian ini bertujuan untuk mengkaji penerapan etika profesi dokter dalam memberikan pelayanan kesehatan kepada pasien, dengan fokus pada aspek-aspek kejujuran, kerahasiaan medis, dan tanggung jawab profesional. Metode penelitian yang digunakan adalah studi literatur dan wawancara dengan tenaga medis di beberapa rumah sakit dan klinik di Indonesia. Hasil penelitian menunjukkan bahwa meskipun banyak dokter yang sudah menerapkan etika profesi dengan baik, masih ada tantangan dalam hal komunikasi efektif antara dokter dan pasien serta kepatuhan terhadap prinsip kerahasiaan medis. Selain itu, penerapan etika profesi juga dipengaruhi oleh faktor budaya dan lingkungan kerja yang ada di setiap institusi kesehatan. Sebagian besar dokter memahami pentingnya etika profesi, tetapi penerapannya belum sepenuhnya optimal, khususnya dalam situasi-situasi yang memerlukan keputusan sulit atau konflik kepentingan. Penelitian ini memberikan rekomendasi untuk meningkatkan pelatihan etika profesi dokter serta menciptakan lingkungan kerja yang mendukung penerapan etika profesi dalam pelayanan kesehatan. Diharapkan dengan penerapan etika profesi yang lebih baik, kualitas pelayanan kesehatan bagi pasien dapat lebih ditingkatkan, menciptakan hubungan dokter-pasien yang lebih harmonis, dan mengurangi risiko malpraktik serta keluhan pasien. Kata kunci: etika profesi, pelayanan kesehatan, kerahasiaan medis.

Abstract

Health insurance provides financial protection against health risks, yet disputes over claim denial remain frequent in Indonesia. This study analyzes the legal basis of health insurance claim rejection, identifies the principal causes of disputes, and examines legal protection available to policyholders. A normative juridical method was applied through statutory and conceptual approaches using legislation, legal doctrine, scientific literature, and relevant regulatory materials. The analysis shows that claim denials commonly arise from incomplete medical documentation, pre-existing-condition clauses, waiting periods, policy exclusions, and differences in the interpretation of medical necessity between hospitals and insurers. The contractual imbalance between insurers and policyholders, combined with limited transparency of policy terms, can intensify disputes. Existing protection is grounded in contract law, consumer protection law, insurance regulation, and Financial Services Authority rules, but implementation requires greater consistency. Stronger disclosure standards, standardized medical-necessity criteria, digitalized claim verification, and effective complaint and dispute-resolution mechanisms are required to improve fairness, transparency, and legal certainty in Indonesian health insurance services.
