Abstract

Law Number 16 of 2019 Amendments to Law Number 1 of 1974 concerning Marriage raise the minimum age for marriage for both men and women to be 19 years old. This was not just an equalization of the minimum age for men and women, but there were government legal politics to improve the quality of Indonesian marriages. The focus of this research was a review of the problems of the legal politics of the minimum age limit for marriage in Law Number 16 of 2019? This study concludes that the legal politics of determining the minimum age for marriage in Indonesia in the Law of the Republic of Indonesia Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage with the principles of equality and justice; non-discrimination; the state's obligation to actively protect and ensure the fulfillment of human rights and freedoms; the best interests of the child; the right to life which guarantees that every child has the right to live, develop and carry on their lives and the state was obliged to guarantee it and fulfill the rights of the child, respect for the opinion of the child; orderly and legally certainty; in line with maslahah which was the goal of Islamic law related to maintaining offspring (hifz an-nasl).

Abstract

This community service project was carried out by students of KKN MBKM Group 1, Batch IV 2025, from Fatmawati Sukarno State Islamic University of Bengkulu. The focus was on protecting the inheritance rights of parents and the elderly as a means to promote social justice in the community. The aim of this activity was to evaluate the effectiveness of legal education and assistance in improving public understanding of inheritance rights for parents and elderly individuals, while also preventing inheritance disputes among family members in RT 19 Karang Indah, Sumur Dewa Village, Bengkulu City. The method used was a participatory approach involving legal counseling sessions, group discussions, and direct consultations with residents and community leaders. The results showed that most people lacked adequate knowledge of inheritance law, both in Islamic and civil legal systems. However, after receiving the education, there was a notable increase in legal awareness and active participation in ensuring the inheritance rights of parents and the elderly were respected. This initiative also strengthened intergenerational relationships and received a highly positive response from the community.

Abstract

This study was conducted by students of KKN MBKM Group 1, Batch IV 2025, at Fatmawati Sukarno State Islamic University of Bengkulu, focusing on the impact of early marriage on adolescents in building greater community awareness. The purpose of this activity is to assess the effectiveness of education and mentoring in reducing the incidence of early marriage and enhancing teenagers' understanding of the social, educational, health, and economic risks associated with marrying at a young age in RT 19 Karang Indah, Sumur Dewa Subdistrict, Bengkulu City. The method used is a participatory approach through counseling sessions, interviews, and group discussions with residents and community leaders. The results show that education about early marriage significantly increases adolescents’ awareness of the importance of education and emotional readiness before entering marriage. Furthermore, this activity also strengthens the role of families and communities in preventing early marriage practices.

Abstract

This article examines the mechanisms of inheritance resolution in cases of different religions in several regions of Indonesia, namely North Sumatera, Central Java, Bengkulu, and East Java, focusing on integrating customary law, religious law, and state law in inheritance distribution. This research employs a descriptive qualitative approach with a case study method, where data is gathered through interviews, observations, and literature reviews on the practice of inheritance among families with different religions. The findings reveal that family deliberation remains the primary principle in resolving inheritance disputes despite the religious differences among heirs. Social and cultural values such as kinship, mutual assistance, and interfaith tolerance play a significant role in the inheritance process, with each region having its own ways of accommodating religious differences within families. The legal pluralism approach, which combines customary law, religious law, and state law, forms the foundation for developing a fair and inclusive national inheritance law. This article suggests strengthening the principle of deliberation, creating an adaptive legal unification, and formulating inclusive regulations for interfaith inheritance rights to create a harmonious and just inheritance system that aligns with the spirit of Indonesia's cultural diversity. AbstrakArtikel ini mengkaji mekanisme penyelesaian waris beda agama di beberapa wilayah di Indonesia, yaitu Sumatera Utara, Jawa Tengah, Bengkulu, dan Jawa Timur, dengan fokus pada integrasi hukum adat, agama, dan negara dalam pembagian warisan. Penelitian ini menggunakan pendekatan kualitatif deskriptif dengan metode studi kasus, di mana data diperoleh melalui wawancara, observasi, dan kajian literatur mengenai praktik waris beda agama dalam masyarakat. Hasil penelitian menunjukkan bahwa meskipun terdapat perbedaan agama di antara ahli waris, musyawarah keluarga menjadi prinsip utama dalam penyelesaian sengketa waris. Nilai sosial dan budaya seperti kekeluargaan, gotong royong, dan toleransi antaragama berperan penting dalam proses pembagian warisan, dengan setiap daerah memiliki cara-cara tersendiri dalam mengakomodasi perbedaan agama dalam keluarga. Pendekatan pluralisme hukum yang memadukan hukum adat, agama, dan negara menjadi landasan dalam pengembangan hukum waris nasional yang adil dan inklusif. Artikel ini menyarankan penguatan prinsip musyawarah, unifikasi hukum yang adaptif, serta penyusunan aturan inklusif untuk hak waris lintas agama, guna menciptakan sistem kewarisan yang harmonis dan adil sesuai dengan semangat keragaman budaya Indonesia.

Abstract

This study critically examines the concept of nationhood and nationalism as understood by the Salafi group and analyzes the implementation of hadiths related to nationalism within the framework of contemporary Islamic law. Using a qualitative field research approach, the study focuses on approximately 200 Salafi adherents spread across Java and Sumatra. Informants were selected through purposive sampling, and data collection methods included interviews, surveys, and documentation. The research uncovers diverse interpretations of nationhood and nationalism within the Salafi community. A minority of Salafi adherents view nationalism as lacking a strong foundation in Islamic law, considering it a secular concept incompatible with Shari'ah. However, the majority, influenced by contextualist approaches in contemporary Islamic jurisprudence, argue that nationalism aligns with Islamic principles, particularly when understood as a form of maslahah and ukhuwwah wathaniyyah. This perspective is supported by contemporary Islamic scholars who emphasize protecting societal harmony and national unity as part of maqasid al-shari'ah. In practice, Salafi adherents demonstrate their acceptance of nationalism through various socio-religious activities. For instance, Salafi educational institutions integrate the study of Indonesia's independence history into their curriculum, emphasizing the moral responsibility of contributing to national welfare. This study makes academic contributions by providing a deep understanding of how contemporary Salafi groups connect Islamic teachings with modern concepts of nationhood, enriching the discourse on the adaptability of Islamic law in addressing contemporary socio-political challenges, and offering a practical framework for integrating religious values with national identity. It also contributes to discussions on pluralism and nation-building within an Islamic context.

Abstract

The purpose of this research is to describe the Tabot festival, a legacy of the Shia tradition but still exists and held continuously in the Sunni community of Bengkulu City. This festival is a manifestation of love for Sayidina Husen bin Ali from people of Bengkulu. However, even though the purpose of this Tabot is useful, there are still some people who are questioning the legality of Tabot’s law because it is strongly suspected that Shiites brought this festival to the Bengkulu. This research was held to answer the legality of Tabot’s law, which is still being disputed by the Sunni community. Through this study, the researcher explained in detail the Tabot legal issues through the sociology of  Islamic law Perspective. This research is categorized as field research, and the approach used in this research is the sociology of Islamic law. Data collection techniques used were interview and documentation techniques. After an in-depth study, it was concluded that the Tabot Festival was accepted by the Sunni community, but there are a few sets of events that need to be improved, because it was considered to violate Shari'ah. The allowed event series are Duduk Penja, Meradai, Menjara/Mengandun, Arak Penja, Mengarak Penja Bersurban, Gam, and Arak Gendang. There are two series of Tabot programs that need to be improved, namely Menggambik Tanah and Tabot Tebuang.

Abstract

This paper discusses the implementation of the Ngarah gawe marriage tradition in Bukit Harapan Village, Air Rami District, Mukomuko Regency, Bengkulu province, and how it is reviewed from the perspective of Islamic law. The research method used in this research is using the field research method (field research). The location of the research is in Buki Harapan Village, Air Rami District, Mukomuko Regency, and the data collection techniques are interview, observation and documentation methods. The results of the research are: (1) the implementation of the ngarah gawe marriage tradition is as follows; narosan, seserahan, ngaras, ngeuyeuk seureuh, and marriage contracts, with the aim of preparing to create a harmonious, peaceful and peaceful family through the assessment of the in-laws. (2) as for the process of implementing the ngarah gawe tradition, it does not conflict with Islamic Shari'a because in the process of implementation, the values or Islamic Shari'a are not forgotten in the slightest.

Abstract

Masyarakat Suku Rejang hingga saat ini masih banyak yang terikat hubungan perkawinan bleket. Bahwasannya dengan terjadinya kawin bleket, si perempuan dilepaskan dari golongan sanak saudaranya dan dimasukkan bersama-sama anak-anaknya ke golongan sanak saudara dari si suami, dengan ketentuan wajib si perempuan tinggal di tempat suaminya. Jika suami meninggal dunia, perempuan bleket tetap tinggal di rumah suami untuk mengurus rumah tangga dan harta peninggalan suaminya. Seterusnya jika kedua mertuanya meninggal maka perempuan bleket mewarisi bersama-sama dengan iparnya dalam menerima harto pusako. Namun perempuan bleket harus melepaskan hak warisnya dikeluarga asalnya. Sedangkan sistem kewarisan dalam perkawinan bleket adat rejang yang dilakukan secara tidak murni yaitu tidak menyalahi hukum syara’ karena hal tersebut tidak terputusnya hak waris perempuan yang berada dalam perkawinan bleket dengan keluarga asalnya. Oleh sebab itu boleh dilakukan dengan syarat tidak terjadi konflik diantara ahli waris dan demi kemaslahatan.
