Abstract

This article analyses the understanding of legal modernization in the sociology of Islamic law in Muslim countries regarding Islamic family law in Indonesia. The theory of legal modernization arises from the long history of Islamic legal theory since the Dutch era related to the enactment of Islamic law, both in terms of the struggle between customary law, Islamic law, and state law. The work for the emergence of legal theories such as Receptie theory becomes a filter for Islamic law in its application to Muslim communities in Indonesia. The results of this study indicate that the modernization of law in the form of KHI applies to the Indonesian Muslim community and requires the nation to be more mature in responding to modernity. However, there is an intersection between modernization and legal secularisation in the Islamic world, such as in Turkey, Egypt, Sudan, and Syria. Legal modernization from fiqh towards positivisation has given birth to formulations in Islamic family law in the form of sociological dynamics in contemporary Indonesian Islamic society.

Abstract

This article aims to reveal the learning of patterns and cultural influences of perceptive mental processes in Angkola language with a Systemic Functional Linguistics (SFL) approach. This is because learning research tends to offer research related to language learning models and language learning media from various perspectives. Meanwhile, the content of the learning is still limited to be analyzed in certain grammar. This research offers perceptive mental process learning based on one of the regional languages in Indonesia, namely Angkola language which needs to be raised considering that this language still includes native speakers. Thus, the Angkola language must be included in the list of documentation of languages and oral traditions that should be preserved in order to maintain the wealth of the archipelago. The method used is descriptive qualitative with transitivity analysis. The results of the analysis show that the Angkola community in expressing perceptive mental processes produces two patterns, one sequential pattern and one non-sequential pattern. However, for non-sequential patterns, after the process is not followed by sensing but is followed by a phenomenon then sensing afterwards. The uniqueness and symptoms of this strangeness are found in the study of perceptive mental processes in the Angkola language. Therefore, according to the presentation of the analysis, it can be proven the consistency, prevalence and acceptance of this pattern in transitivity in the Angkola language. Abstract

This research discusses the influence of the Sufi interpretation of the Qur'an in shaping cultural narratives and political discourses in Muslim society. This study addresses the under-explored influence of Sufism beyond its spiritual domain, specifically in cultural and political spheres. This study aims to fill this void by exploring how the Sufi interpretation of the Qur'an influences contemporary cultural identity and political dynamics. The methods used in this study are multidisciplinary approaches, including analysis of Sufi literature, art, and social practices. The study's findings suggest that Sufism has a significant role in shaping cultural narratives, promoting tolerance and social justice, and providing a framework of thought that influences political discourse in Muslim communities. This study recommends that future studies focus more on Sufism's contribution to Islamic political thought and its relevance in the modern context. This research also emphasizes the importance of considering the spiritual dimension in analyzing cultural and political phenomena to understand the role of religion in shaping the social and political landscape more comprehensively.

Abstract

Recently, the Indonesian Muslim community has been shocked by the government's policy to use the AstraZeneca Vaccine to minimize the negative impact of Corona Virus Disease 10 (Covid-19). This policy is permitted by the Fatwa of the Indonesian Ulema Council (MUI), although it uses trypsin from pigs to make the vaccine. This article explains the legal problems of using the vaccine from a hermeneutic perspective. This research is a literature review using the MUI Fatwa Number 14 of 2021 concerning the Law on the Use of the Covid-19 Vaccine for AstraZeneca Products as primary data and analyzing it descriptively with a hermeneutic approach. The authors found that the MUI Fatwa Number 14 of 2021 was a direct request from the government and was used as a guideline for implementing the AstraZeneca Vaccine for Muslim communities in Indonesia. In determining the fatwa on the permissibility of using the AstraZeneca Vaccine in an emergency to create herd immunity against Covid-19, the MUI Fatwa Commission uses the qiyās and maqāsid al-syarī’ah methods. The use of these two methods can be seen from the citation of several fiqh rules and opinions of previous scholars. Even though there are contradictory responses to the MUI Fatwa, the only difference lies in the concept of istihālah (change of unclean objects to become holy) used by the fatwa institution.
