Abstract

Child custody disputes following divorce often become complex legal and emotional battles, especially when religious and customary laws intersect. In many Muslim-majority societies, Islamic law (Sharia) and customary law (adat) both influence custody decisions, sometimes complementing each other but often conflicting in practice. Islamic law prioritizes the child’s welfare while emphasizing maternal custody during early childhood (hadanah) and paternal guardianship (wilayah) in later years. However, customary law, deeply rooted in local traditions, can override or modify these principles based on community norms, family ties, and social status. This study explores the legal and cultural dimensions of child custody disputes in divorce cases, analyzing the extent to which Islamic law and customary law shape judicial decisions and parental rights. While Islamic law prescribes clear guidelines, its application varies across jurisdictions, influenced by local customs and judicial interpretations. In many cases, customary norms challenge Islamic legal principles, leading to inconsistencies and gendered biases that may disadvantage mothers or overlook the best interests of the child. As globalization and legal reforms push for greater adherence to human rights and child protection standards, the tension between religious and customary laws raises critical questions about the future of custody rulings. This paper examines landmark cases, legal frameworks, and the evolving role of Islamic and customary laws in shaping custody outcomes. By comparing these perspectives, it seeks to highlight the need for harmonized legal solutions that prioritize the child’s well-being while respecting cultural and religious traditions.

Abstract

Procurement is not limited to the scope of goods but also extends to services. Therefore, it is essential to both quality goods and services. However, it cannot be denied that universities face various obstacles in terms of procuring goods and services, leading to several challenges. The problems addressed in this research are: (1) What are the issues faced in the procurement of goods and services at universities? (2) What is the problem-solving model for procurement of goods and services at universities? This research utilizes a qualitative approach, with a sociological juridical research method, or non-doctrinal research.

Abstract

Sanitasi lingkungan dan akses air bersih merupakan hak dasar yang dijamin oleh konstitusi dan peraturan perundang-undangan. Masyarakat di wilayah padat seperti Kelurahan Kalibaru, Jakarta Utara belum sepenuhnya menikmati hak tersebut secara nyata. Penelitian ini bertujuan untuk menganalisis implementasi jaminan hukum atas sanitasi dan air bersih serta mengidentifikasi hambatan-hambatan yang terjadi dalam pelaksanaannya. Penelitian menggunakan metode yuridis empiris dengan menggabungkan studi hukum dan pengumpulan data lapangan melalui wawancara serta observasi. Hasil penelitian menunjukkan bahwa pemenuhan hak atas sanitasi bersifat formalistik. Akses terhadap air bersih masih terbatas, kondisi lingkungan tidak sehat, dan kesadaran masyarakat terhadap kebersihan masih rendah. Perubahan regulasi yang berlangsung cepat menyebabkan kesulitan dalam proses sosialisasi serta menghambat pelaksanaan kebijakan di tingkat daerah. Program lingkungan seperti TPS 3R dan bank sampah dari Suku Dinas Lingkungan Hidup Jakarta Utara menunjukkan adanya inisiatif pemerintah untuk membangun kesadaran kolektif. Penelitian ini merekomendasikan penguatan peran pemerintah daerah, stabilisasi kebijakan, serta perluasan pendekatan sanitasi berbasis komunitas secara menyeluruh dan berkelanjutan.

Abstract

Masyarakat Adat Baduy masih menerapkan norma adat dalam kehidupan sehari-hari. Meski terbagi menjadi wilayah Baduy Luar dan Baduy Dalam dengan nilai adat yang berbeda, masyarakat adat Baduy tetap terikat oleh sentralisasi hukum negara, terlebih setelah hak ulayat Masyarakat Adat Baduy sah dan dilindungi secara hukum negara melalui Perda Nomor 32 tahun 2001 tentang perlindungan atas hak ulayat masyarakat Baduy. Penelitian ini bertujuan untuk mengidentifikasi perolehan keadilan hukum tanah adat oleh masyarakat Baduy dan dampak dari dominasi hukum negara terhadap hak-hak tanah adat masyarakat Baduy. Penelitian ini menggunakan metode yuridis empiris. Hasil penelitian menunjukkan bahwa masyarakat adat Baduy memperoleh keadilan atas tanah adatnya melalui nilai-nilai adat dan norma adat yang tidak diabaikan, serta mendapatkan perlindungan hukum atas tanah adat Baduy melalui peraturan daerah tentang hak ulayat, meskipun masyarakat adat Baduy tidak mengakui kepemilikan tanah adatnya, melainkan diwariskan secara turun-temurun.

Abstract

The development of tourism in Batu City has experienced a significant increase, contributing 50% to the Regional Gross Domestic Product (PRDB). However, the construction of illegal settlements in the Bumiaji Ecotourism area threatens environmental sustainability. Land conversion and weak environmental enforcement have led to negative environmental impacts. This study aims to examine the governance of settlements and the legal and non-legal impacts of land utilization management in the Bumiaji Ecotourism area. The research methodology used is normative-empirical, with a legislative approach, case approach, and theoretical approach (design with nature and imageability). The study found violations of the Batu City spatial planning, particularly in the Bumiaji Ecotourism area, and its environmental impacts, highlighting the need for an integrative solution based on spatial data and ecological approaches. Moreover, non-legal impacts show environmental degradation caused by improper land use.

Abstract

The Job Creation Law (Law No. 11 of 2020) as a national strategic policy has sparked controversy, particularly concerning the protection of land rights for indigenous peoples and vulnerable groups. This research is grounded in the concern that the law shifts the orientation of agrarian policy from a social justice paradigm toward investment acceleration, potentially neglecting constitutional community rights. This study aims to critically examine the Job Creation Law and assess the relevance of international legal principles—especially Free, Prior, and Informed Consent (FPIC) under the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP)—in safeguarding land rights in Indonesia. Using a library research method and a critical-juridical approach, this study analyzes national legal provisions, international norms, and comparative agrarian regulations in other countries. The findings indicate that the Job Creation Law does not sufficiently incorporate the FPIC principle, weakening the bargaining power of indigenous and local communities in land acquisition for national projects. Furthermore, the lack of an independent oversight mechanism and an effective agrarian dispute resolution system undermines legal protection. Comparative analysis highlights the need to recognize collective rights and community participation. In conclusion, the law should be revised and harmonized with international legal standards to strengthen community rights through inclusive mechanisms and independent institutions

Abstract

Micro, Small, and Medium Enterprises are business activities that can expand employment and provide extensive economic services to the community. They can also play a role in equalizing and increasing public income, promoting economic growth, and contributing to national stability. In addition, Micro, Small, and Medium Enterprises are one of the main pillars of the national economy that must get the most opportunities, support, protection, and development as a form of firm partiality to the people's economic business groups, without neglecting the role of Large Enterprises and State-Owned Enterprises. In Law No. 11 of 2020 concerning Job Creation, simplification of Business Permissions through Integrated Online Licensing (Online Single Submission). Mergosari Village became the first to produce batik with a typical Wonosobo motif through the Batik Mergosari community named Batik Carica Lestari. The problems partners face include the lack of knowledge and understanding of small- and medium-sized business actors in Mergosari Village regarding the legal aspects of business actors, which still need to be improved. The solution to this problem is to provide education using lectures and seminars with village officials and small and medium enterprises of Mergosari Village, and small and medium enterprises should have a Business Master Number (NIB). The method of service is to provide education through socialization and mentoring practices.

Abstract

Fenomena penolakan Pekerja Migran Indonesia (PMI) untuk bekerja di Malaysia semakin mencuat, terutama akibat dari kontinuitas eksploitasi terhadap kesejahteraan pekerja yang senantiasa terjadi dalam beberapa tahun terakhir. Fenomena ini dipicu oleh perlakuan yang tidak manusiawi terhadap Pekerja Migran Indonesia, termasuk tindak kekerasan, hak-hak pekerja yang diabaikan, dan lingkungan kerja yang tidak aman. Studi ini bertujuan untuk mengidentifikasi bentuk-bentuk eksploitasi kesejahteraan yang dialami oleh PMI di Malaysia dan menjadi faktor utama penolakan PMI bekerja di negara Malaysia, serta untuk menganalisis negara alternatif yang lebih sering dipilih oleh PMI sebagai tujuan bekerja. Pendekatan yang digunakan dalam penelitian ialah kualitatif dengan menganalisis berbagai kasus dan data yang diperoleh dari sumber yang memiliki kredibilitas. Jenis penelitian ini adalah yuridis-empiris, yang diperoleh melalui wawancara dan mengacu pada studi kajian hukum. Hasil penelitian menunjukkan bahwa faktor utama penyebab penolakan PMI untuk bekerja di Malaysia ialah atas pengalaman buruk yang meliputi kekerasan fisik dan psikologis, ketidakpastian atas hak memperoleh gaji, serta perdagangan orang. Pekerja Migran Indonesia lebih memilih negara, seperti Hong Kong dan Taiwan yang menjadi alternatif pilihan dalam mencari kondisi kerja yang lebih manusiawi. Penelitian ini diharapkan dapat membantu dalam upaya mengatasi permasalahan eksploitasi terhadap kesejahteraan PMI secara sistematis, sehingga dapat meningkatkan kesejahteraan PMI di luar negeri.

Abstract

Introduction: The cosmology of the Sedulur Sikep traditional house in Pati Regency is studied in depth in this study as an expression of local wisdom that is crucial for the continuation of a harmonious life. Motivated by.Purposes of the Research: Seeks to determine why this cosmology is necessary in this particular context and to examine how the cosmology of the Sedulur Sikep traditional house is an expression of local wisdom for the harmonious survival of life.Methods of the Research: This study uses a qualitative descriptive approach with a sociological juridical research type. Applying the theory of legal pluralism to examine how customary law (also known as living law) interacts with state law and cultural anthropology theory to understand how cosmology manifests itself in the tangible and intangible elements of customary houses. Interviews and observations were used to collect primary data, which was then supported by secondary and tertiary data. Triangulation is used to ensure the validity of the data.Results Main Findings of the Research: Each component of the Sedulur Sikep traditional house reflects a worldview that encourages the creation of harmony between humans, nature, and spirituality. This cosmology functions as a living law that encourages the creation of ecological harmony, social solidarity (the principle of seduluran), and inner peace. This is important for the urgency of community sustainability as an identity, social control system, and foundation of cultural resilience in the face of legal pluralism and globalization.
