Abstract

Artikel ini mengkaji falsafah hukum Islam dengan menitikberatkan pada konsep Asrār al-Ahkām dan relevansinya dalam kerangka maqāṣid al-syarī‘ah pada konteks kehidupan modern. Kajian ini bertujuan untuk menunjukkan bahwa hukum Islam tidak semata-mata berfungsi sebagai seperangkat aturan normatif, tetapi juga mengandung tujuan, hikmah, dan nilai kemaslahatan yang mendalam. Melalui pendekatan kualitatif-deskriptif berbasis kajian pustaka, artikel ini menganalisis bagaimana setiap ketentuan syariat memiliki rasionalitas moral dan sosial yang berorientasi pada perlindungan kepentingan dasar manusia. Konsep Asrār al-Ahkām dipahami sebagai upaya menyingkap dimensi filosofis di balik hukum-hukum syariat, seperti shalat yang membentuk kedisiplinan spiritual, zakat yang memperkuat solidaritas sosial, serta larangan riba yang bertujuan mencegah ketimpangan dan ketidakadilan ekonomi. Temuan kajian menunjukkan bahwa integrasi Asrār al-Ahkām dengan teori maqāṣid al-syarī‘ah yang mencakup perlindungan agama, jiwa, akal, keturunan, dan harta menjadikan hukum Islam bersifat dinamis dan kontekstual. Dalam menghadapi tantangan modern seperti isu hak asasi manusia, kesetaraan sosial, kesehatan publik, dan kelestarian lingkungan, pendekatan ini menegaskan fleksibilitas hukum Islam serta orientasinya pada kemaslahatan umat secara universal.

Abstract

This study discusses the practice of eyebrow and lip embroidery micropigmentation from the perspective of Islamic Jurisprudence on the principle of hajiz (water barrier) in thaharah and the concept of taghyir khalqillah (change of Allah's Creation). The phenomenon of the increasing use of semi-permanent beauty procedures among Muslim women has raised legal debates because it is often equated with the practice of permanent tattoos which are prohibited in the hadith. This study aims to discuss the legal status of eyebrow and lip embroidery by considering the normative fiqh aspects and dermatological scientific explanations regarding the micropigmentation technique. The research method used is qualitative research with a juridical-normative approach through a literature study of classical and contemporary fiqh literature, fatwas of religious institutions, and related medical studies. The results of the study show that micropigmentation differs substantially from permanent tattoos because the pigment is implanted superficially and is semi-permanent, so it does not always meet the criteria for hajiz which invalidates wudu. From the aspect of taghyir khalqillah, this practice cannot be considered absolutely haram, but depends on the purpose, level of change and the impact it causes. This study concludes that the law on eyebrow and lip embroidery is ijtihadi and contextual, depending on the purpose, level of change and impact caused and requires caution by considering sharia principles and developments in modern beauty technology. Abstract

This field research provides an overview and factual and explains the various relationships of all the data obtained. This research was conducted in Majene and precisely in the working area of the Majene Religious Court. The study is based on an application for marriage dispensation. Instruments used are researchers, observation, interview, and documentation data. The judge's consideration in granting or rejecting the application for marriage dispensation at the Majene Religious Court is the completeness of the administration at the time of applying for marriage dispensation following Perma No. 5 of 2019, and there is no pro; there on marriage as in Article 8 of Law No. 1 of 1974 concerning Marriage, while still taking into account the aspects of benefit and mudharatan arising from the granting of the application for marriage dispensation.

Abstract

Human welfare encompasses personal well-being, social and communal interests, as well as national benefit. When a government aspires to build a strong nation and ensure a safe, peaceful, and orderly society, it must prioritize public interest over individual benefit. Likewise, individuals and communities seeking a harmonious and tranquil life should emphasize actions that generate greater collective benefit. Sharia, as a divinely ordered system of law, functions as a comprehensive guide for human life, aiming to realize welfare at both personal and social levels. In relation to the values ​​of maslahah embedded in the commands of worship, Islamic law affirms that all divine prescriptions are inherently beneficial and free from harm, even when they may appear unfavorable from a human perspective. Furthermore, the pursuit of benefit in safeguarding religion, life, intellect, lineage, and property constitutes a fundamental obligation within Islamic legal thought. These essentials, classified by Islamic scholars as indispensable necessities (darūriyyāt), if neglected, would result in severe harm to worldly and spiritual life, ultimately undermining human happiness, peace, and social stability.

Abstract

The spirit of anti-usury in various Muslim communities in the country is getting more intense and active. one of which is that it can be seen from the increasing number of customers at Islamic banks with a significant number of developments from time to time. However, the reality that occurs in conventional banking is still the choice of customers as Muslims, including to borrow money or funds. Of course, conventional banking applies an interest system (Conventional Banking Applies), both loan interest and deposit interest. In Indonesia, the fatwa regarding the halal interest of banks  is not very popular. Most Islamic scholars and organizations in Indonesia have issued a fatwa that bank interest is usury which is forbidden. The concept in the past was that transactions occurred individually, where someone borrowed money and the person who gave the loan charged interest. While transactions that include borrowing money from banks are more complex or more complete. In the matter of usury in bank interest, various opinions of scholars, there are scholars who argue that bank interest is lawful on the grounds that the practice of usury in the past was not the same as the phenomenon of bank interest that occurred at the moment now. The main problem is: is bank interest included in the usury category or not included in the usury category, Bank interest law in the perspective of contemporary Islamic law is permissible if there is a need or benefit by adhering to the principle "Mȃ hurrima lisadd al-dzarî'at ubîha li alhȃjat aw al-mashlahat.

Abstract

The perspective of contemporary Islamic law is a perspective that tries to see further how understand acte versus sirri marriage exists in the midst of modern human life as a phenomenon. An approach based on the responsive fiqh paradigm is a necessity in the development of contemporary Islamic law, including addressing sirri marriage versus understand acte marriage. In this process, a marriage that is carried out must be carried out through an understand acte marriage because with the registration of marriages at an official state institution, this will guarantee state protection with its normative juridical authority for the parties involve. Phenomenon of modern human life today which shows that marriage with sirri marriage raises various problems implies the need for contemporary Islamic law to emphasize that registration of marriage in an official state institution or understand act marriage is an aspect that needs to be considered to become a legal requirement of a marriage.
