Abstract

Introduction to The Problem: The execution without notification of Tuti Tursilawati’s at the end of 2018 becomes one of the most important diplomatic and consular relations issues between Indonesia and Saudi Arabia. Indonesia was unable to seek Saudi Arabia clarification because of the absence of bilateral agreement regarding consular notification between Indonesia and Saudi Arabia. Having regard to the Vienna Convention on Diplomatic Relations 1961 and the Vienna Convention on Consular Relations 1963, both provides the protection and assistance from the Consulate to all their citizens abroad.Purpose/Objective Study: This research aims to outline the importance of bilateral agreement on the mandatory consular notification in dealing with a case of Tuti Tursilawati who executed by Saudi Arabia government without any notification to the Republic of Indonesia.Design/Methodology/Approach: Data was collected from primary and secondary data sources in the form of literature legal research and statute approach.Findings: The result shows that based on Article 36 of the VCCR 1963, Mandatory Consular Notification should be delivered by Saudi Arabia before the execution. Making a bilateral agreement on Mandatory Consular Notification (MCN) with Saudi Arabia is very urgent to become a legal basis in helping and giving proper protection to the Indonesian who lives in Saudi Arabia in the future. Without that agreement, Indonesia will be not easy to access the information and assisting to protect the rights of the nationals from any cases that happened abroad, especially related to criminal issues.Paper Type: Research Article

Abstract

The dispute in Jammu and Kashmir has been tensed by the revocation of Article 370 of the Indian Constitution by the Indian government in the end of 2019. The existence of Kashmir has become one of matters as the main focus between India-Pakistan conflicts. People are under diverse senses of de facto and de jure martial law. Estimated from 1990, thereabouts 70,000 people have been killed, 8,000 people have been subjected to enforced disappearances, thousand of them also victims of repressive laws and Indian security forces humiliate the protestors and detainees frequently. The research is normative legal research by using statute approach and case approach through literature review. The research aims to discuss and analyze the implementation of the rights of self-determination pursuant to Kashmir dispute between India and Pakistan. The results of the study indicate all the disputes should be ended by giving the right to self-determination, which should be given to the people of Kashmir, thus the disputes between the two countries can be resolved properly and making a clarity of Kashmir status.

Abstract

The recent Russian-Ukrainian dispute over Crimea has been attracted wide international attention. The crisis in the territory of Crimea has been criticize by the other states and international organizations as wrongful annexation by Russia of part of the territory of Ukraine. A referendum held in Crimea and the majority of the population choose to join the Russian Federation. Nevertheless, on March 2014, according to the Ukraine Constitutional Court, only parliament of Ukraine has the authority to make a referendum. The United Nations General Assembly adopted a resolution A/RES/68/262 on Ukraine’s territorial integrity that the annexation of Crimea, declared the referendum was invalid, and appealed to the international community not to recognize changes the status of Crimea. The research aim is to analyze whether Crimea belongs to Russia or Ukraine. The study is a normative legal research with Statute Approach and Case Approach. By using qualitative descriptive method, the research uses law as a foundation of norm and done through a library research with existing journal sources, internet, and books. The result shows that the annexation by Russia was invalid under international law perspective and Crimea should belong to Ukraine.

Abstract

The purpose of this article is to find out how international law plays a role in the Israeli-Palestinian war during the Covid-19 pandemic. The method in writing this article was a literature study by collecting literature from journals and books relevant to the topic, then analyzing it, and then making conclusions. The emergence of the Covid-19 pandemic that spreads rapidly raises concerns about the socio-economic conditions of Palestinian citizens. The challenge is getting bigger in tackling these two problems simultaneously. The condition of Palestinian citizens is increasing concerning with the destruction of WASH facilities (water, sanitation, and hygiene), the inhibition of the supply of necessities that will enter the Palestinian state, as well as the destruction of the natural environment since these aspects can be used to prevent the spread of the Covid-19 virus. International humanitarian law actually exists to limit the occurrence of such incidents, but these regulations are violated by the military and the Israeli government. This article is helpful to find out how the actions of the state of Israel against Palestine during the Covid-19 pandemic are based on the perspective of international law. This article was compiled with references to various literary sources from national and international journals and books. In addition, it also uses the latest news from the topics discussed. The result of this literature study is that the conflict that is being experienced by Israel and Palestine is not getting better with the increasing number of attacks on Palestinian civilians.

Abstract

This research aims to understand and clarify the international legal perspec-tive relating to the current dispute and how they are resolved according to international law between Vietnam and China over fishing rights in the South China Sea. This paper has adopted a normative legal research with a statutory and historical approaches. The data will be analysed by using de-scriptive-analytical analysis. This paper reveals that there are two legal is-sues in the fishing rights conflict between Vietnam and China. First is the legality of the Nine-dashed Line by China to claim the disputed water. Sec-ond, the legality of unilateral fishing ban policy by China over the disputed water, which both has no legality under international law. Although China claims over SCS using Nine-dashed Line and unilateral fishing ban policy under international law has no legal basis, the dispute over SCS including fishing rights continued until today. The solutions offered to solve these problems include a resolution on SCS dispute must be made legally and di-plomacy to build confidence-building measures. Ideally, both states should honour the accepted negotiation steps to agree upon compensation for the effects of the disputes and be sincere and earnest in their attempts and com-mitment to resolving their dispute.

Abstract

Nowadays, many human rights violations related to religion, race or culture exist. In 2018, The Council on Foreign Relations (CFR) estimated around two million Uyghur were arrested by the Chinese government without due process of law and forced to accept the political doctrine of the Chinese Communist Party. These actions include physical torture and restrictions on religious freedom. Article 2 of 1948 UDHR stipulates the prohibition of discrimination against race, colour, sex, language, religion, political or other opinions, national or social origin, property, birth, or another status. The paper aims to analyse human rights violations against the Uyghur and legal efforts to protect freedom of human rights for Uyghur in China. Human Rights have been fully regulated by the 1948 Universal Declaration of Human Rights (UDHR). By using statutory and case approach, the result shows that the actions taken by the Chinese government have violated legal provisions including the Declaration and the International Convention on the Elimination of All Forms of Racial Discrimination (ICERD) and the International Covenant on Economic, Social and Cultural Rights (ICESCR). The government of China is also failing to uphold its responsibility to protect.

Abstract

Abstract. The Kalakijo Community has recently established a Tourism Centre, which functions as a traditional culinary center for Javanese Chicken Culinary "Ingkung Kuali." Based on the participatory mapping and inquiries with the Kalakijo Community, some main issues needed to be addressed for the development of the Kalakijo Tourism Village. The issues are namely: 1. the need to develop foreign language skills for local youth community henceforth shall be referred to "Karang Taruna" and 2. to increase the marketing of Ingkung Kuali outbound package. The intended target and outcomes of the above are 1. English language skill training for the Karang Taruna as many as 6-8 youths for three days from 24 - 26 September 2016 at night located in the Karang Taruna office, Dusun Kalakijo. 2. Based on the discussion with the Ingkung Kuali Outbound tourism package marketing unit, it is found that there are a networking problem or the lack thereof, the problems currently facing the marketing unit. Therefore, with the Universitas Muhammadiyah Yogyakarta vast network, we are doing a promotion excursion to 23 Muhammadiyah Elementary throughout Sleman Regency, Yogyakarta, and Bantul Regency in August 2016. The implementation method for the Ibm Sustainable Tourism Development of Kuali Ingkung Outbound Tourism is the English language skills training for Kalakijo Karang Taruna and the expansion of the promotion of Ingkung's Outbound activities to 23 Muhammadiyah Elementary Schools throughout Sleman Regency, Yogyakarta, and Bantul Regency. The result shows that the Kalakijo Karang Taruna has gotten a basic understanding of Basic-English skills, such as the understanding of making active and passive sentences from the present tense, future tense, past tense, and present perfect tense in the form of writing and speaking. The marketing and promotion expansions of outbound tourism packages through the establishment of a network to various Muhammadiyah Elementary Schools throughout Sleman Regency, Yogyakarta, and Bantul Regency.Keywords: Sustainable tourism, tourism package, outbound Abstrak. Saat ini masyarakat Kalakijo telah mendirikan Pusat Wisata (Tourism Centre) yang sekaligus berfungsi sebagai pusat kuliner Ingkung Kwali. Berdasarkan pemetaan secara partisipatif dengan masyarakat, beberapa permasalahan yang dihadapi dalam rangka Kampung Wisata Kalakijo adalah sebagai berikut: 1.Pemberdayaan ketrampilan bahasa bagi Karang Taruna, 2.Peningkatan pemasaran paket outbond  Ingkung Kuali. Target dan luaran sebagai berikut : 1.Pelatihan ketrampilan berbahasa Inggris bagi pemuda karang taruna berjumlah 6-8 orang berlangsung selama 3 hari mulai tanggal 24 sampai dengan 26 September 2016 bertempat di Kantor Karang Taruna Dusun Kalakijo di malam hari. 2.Berdasarkan diskusi dengan unit pemasaran paket outbond  Ingkung Kuali, ada persoalan pemasaran sehingga dengan jaringan yang dimiliki oleh UMY, kami melakukan promosi kegiatan outbond Ingkung Kuali ke 23 SD Muhammadiyah dilingkungan DIY yaitu sekitar Kabupaten Sleman, Kota Yogyakarta dan Kabupaten Bantul pada bulan Agustus 2016. Metode pelaksanaan pengabdian Ibm Pembangunan Pariwisata Berkelanjutan Paket Wisata Outbond Ingkung Kwali di Dusun Kalakijo ini meliputi 1) pelatihan bahasa Inggris bagi pemuda Karang Taruna Dusun Kalakijo, 2) Perluasan Jasa Promosi Kegiatan Outbond Dusun Kalakijo ke 23 SD Muhammadiyah dilingkungan DIY yaitu sekitar Kabupaten Sleman, Kota Yogyakarta, dan Kabupaten Bantul. Hasil Kegiatan Pengabdianini adalah 1) Pemuda Karang Taruna Dusun Kalakijo memperoleh pemahaman membuat kalimat aktif dan pasif dari tenses Present Tense, Future Tense, Past Tense, Present Perfect Tense dalam writing dan speaking 2) Memperluas pemasaran dan promosi paket Outbond melalui jaringan SD Muhammadiyah se Kabupaten Sleman, Kabupaten Bantul dan Kota Yogyakarta.Kata Kunci: Parawisata berkelanjutan, paket wisata, outbound

Abstract

Program pengabdian ini berjudul “Penguatan Advokasi Hukum Penyelesaian Konflik Tanah di Desa Glagah dan Desa Palihan sebagai Masyarakat Terdampak Pembangunan Bandara NYIA-Kulonprogo, Daerah Istimewa Yogyakarta”. Program ini bertolak dari fakta empiris bahwa meskipun Bandara NYIA telah mulai beroperasi pada April 2018, tetapi penyelesaian hukum terkait konflik tanah bagi warga terdampak belum terselesaikan secara baik. Tujuan dari program ini adalah meningkatkan pengetahuan, kapasitas, dan kemampuan mengorganisasikan diri dalam membangun posisi tawar, memperjuangkan, dan menuntut secara hukum hak-hak yang terlanggar akibat proses pelepasan tanah/ganti rugi untuk pembangunan Bandara NYIA oleh warga terdampak, khususnya di Desa Glagah dan Desa Palihan-Kecamatan Temon. Warga terdampak di kedua Desa ini masih minim sosialisasi dan pengetahuan terkait (a) hak-hak apa saja patut diperjuangkan jika terjadi pelepasan tanah atau pencabutan tanah untuk pembanguna bandara; (b) apakah masyarakat dapat menggugatnya proses ganti rugi sepihak ke pengadilan atau cukup diselesaikan secara nonlitigasi (mediasi atau rekonsiliasi); (c) apa makna “fungsi sosial tanah” dan “kepentingan umum” dalam pengadaan tanah bagi pembangunan bandara sesuai UUPA dan UU No.2/2012. Masyarakat terdampak juga tidak tahu mekanisme pengaduan dan penyelesaian sejumlah persoalan hukum yang timbul. Untuk itu, digunakan metode kegiataan berupa (a) penyuluhan hukum dan HAM; (b) pelatihan nonlitigasi-penyelesaian sengketa di luar pengadilan/ADR dan litigasi/jalur pengadilan; (d) pembuatan buku saku/guideline penyelesaian konflik tanah; dan (e)public hearing/dengar pendapat dengan DPRD Kulonprogo dan pihak eksekutif. Dengan suasanan kegiatan yang dikemas sedemikian nonformal, dialogis, dan interaktif, diharapkan tingkat partisipasi warga di kedua Desa terdampak menjadi signifikan. Warga yang menjadi kelompk sasaran penerima manfaat diharapkan juga terlibat dalam memberikan feedback atau masukan terkait monitoring-eveluasi dan keberlanjutan dari program ini di masa mendatang.

Abstract

Pada dasarnya setiap orang memiliki hak asasi manusia (HAM) yang melekat sejak dilahirkan dalam kehidupannya. HAM melekat pada manusia sebagai makhluk ciptaan Tuhan. Dari itulah HAM wajib dihormati, dijunjung tinggi, dan dilindungi negara, hukum, serta pemerintah, demi kehormatan dan perlindungan harkat dan martabat manusia. Diseminasi nilai-nilai HAM di usia sekolah merupakan salah satu bentuk penanaman nilai-nilai HAM sejak dini, terutama dengan maraknya kasus kekerasan antar siswa, bullying, sampai dengan kejahatan yang mengakibatkan korban jiwa di kalangan siswa sekolah. Upaya ini dilakukan karena anak yang akan menjadi generasi penerus bangsa di masa akan datang. Program Pengabdian masyarakat berupa inisiasi Sekolah Ramah HAM adalah salah satu cara yang diharapkan mampu mengurangi dan mencegah kekerasan di kalangan siswa terus meningkat. Lokasi Pengabdian ini adalah Madrasah Muallimin dan Madrasah Muallimat yang berlokasi di Kota Yogyakarta. Program ini tidak hanya melibatkan antara peserta didik dengan guru tapi juga seluruh warga sekolah dan masyarakat sekitar sekolah serta orang tua murid. Setelah terbentuknya Sekolah ramah HAM ini diharapkan siswa dapat memahami serta menjunjung tinggi HAM itu sendiri, serta berkurangnya tindak kekerasan, terutama bullying di kalangan siswa di Kota Yogyakarta.

Abstract

Pendidikan bagi anak-anak, pemuda, dan masyarakat di sebagian daerah merupakan hal yang kerap kali luput dari perhatian pemerintah. Dengan kesadaran yang penuh, tim pengabdian serta kepedulian dari pemuda dan masyarakat Indragiri Hilir, provinsi Riau, maka tim pengabdian dan Indragiri Hilir Connect (Inhil-Connect) berusaha menyediakan akses pendidikan kepada masyarakat yang tidak mampu dengan cara memberikan pembelajaran dan pelatihan-pelatihan kepada seluruh anak-anak, remaja, serta para pemuda dan masyarakat Indragiri Hilir. Hal tersebut dilakukan tentunya dalam rangka untuk memperbaiki kualitas pendidikan dan pengetahuan serta meningkatkan taraf hidup masyarakat Indragiri Hilir kedepannya. Bentuk pelatihan dan pembelajaran yang dilakukan adalah sistem belajar, baik secara online maupun offline mengenai materi-materi yang telah disusun oleh tim pengabdian dan Inhil Connect di Rumah Belajar Bersama (RBB). Tenaga pengajar dalam program ini terdiri dari tim pengabdi, para pemuda dan para mahasiswa serta alumni perguruan tinggi di seluruh Indonesia yang berasal dari kabupaten Indragiri Hilir. Pendekatan yang digunakan adalah berbasis partisipasi aktif dan interaktif menggunakan model participatory learning atau role play yang memudahkan seluruh peserta untuk memahami dan menyenangi pembelajaran bersama ini. Luaran dari pengabdian masyarakat ini adalah para peserta mampu mengoperasikan komputer dan alat teknologi yang berkaitan dengan aktifitas belajar mengajar, yaitu Microsoft Office, utamanya PowerPoint, serta memiliki rasa percaya diri mempraktikkan public speaking dengan menggunakan bahasa Inggris.
