Abstract

Abstract: Located at the foot of Mount Merbabu, Dukuh Rejosari was bestowed with beautiful scenery, cool weather and fertile land for farming such as coffee, tea, corn and tobacco. Regrettably, these have yet been maximally utilized by the locals because of their busy work as laborers who depend on wages. This is compounded by the very strict working hours that leave workers no time to utilize the blessing as additional income. In dealing with this situation, breeding catfish using tarpaulin method is likely the most appropriate alternative solution for the locals to earn more income without having to leave their main job as factory workers. This is possible as the catfish cultivation using tarpaulin method is effortless and does not consume much time to manage it. Moreover, with the annual increase in demand for catfish consumption in the surrounding regions as well as competitive selling prices (ranging from IDR14,000 to IDR17,000 per kilogram) making tarpaulin cultivation of catfish solution for the locals in Dukuh Rejosari. The method used in this service was socialization by providing outreach and training from the catfish cultivation expert. The result shows that villagers are enlightened to have a new source of income in the midst of busyness working as laborers.

Abstract

Privacy should become a key component in the IT system. It is not something to be considered at last but from the very early stages. Almost no nation has a greater sense of personal data security which could be equivalent to the European level. Since 9/11, the United States has declared to utilize PNR as a method for combating terrorism by associating PNR data with criminal records. Nevertheless, in fact, the majority of data found in the PNR is immense and most of this data is of a confidential nature. The paper used doctrinal legal research methodology utilizing the case and comparative law approach. It elaborates particular cases in relation to data protection issues. It also explores the differences between EU and US law which hinder the idea of data protection in particular on PNR. The study revealed that security is one of the most critical issues which hinder the agreement between the EU and the US on PNR data protection. As the EU promotes the highest standard to the data protection referring to the European community history and GDPR provisions, while the US places national security as a main priority beyond the privacy issues.

Abstract

The fall of President Al-Bashir in 2019 was a turning point in the Darfur conflict that happened for more than 17 years in Sudan. The conflict has forced 2.5 million people away from homes and killed at least 500,000 people. The humanitarian conflict and crisis are motivated by the inter-ethnic conflict in Sudan. With orders from the U.N. Security Council, on March 4, 2009, at The Hague, the International Criminal Court (ICC) issued an arrest warrant for President of Sudan, Omar Hassan Al-Bashir, on charges of war crimes and crimes against humanity in Darfur. The purposes of the study are to understand the factors behind the Darfur conflict, to understand how effective the Sudanese national judicial system is, and the jurisdiction of ICC in resolving Darfur conflict. The study is normative legal research through literature review with the existing books and journals. Two approaches of normative legal research were used, namely statutory approach and case approach. The result shows that Sudan National Court is ineffective in resolving the conflict and has no willingness to settle the conflict. Furthermore, ICC has jurisdiction to settle the Darfur conflict by order of United Nation Security.

Abstract

In 2014, the Republic of the Marshall Islands (RMI) filed lawsuits against several major Nuclear Weapons States (NWS) to the International Court of Justice (ICJ). In connection with the conclusion of the nuclear arms race and disarmament, RMI filed a lawsuit alleging a breach of negotiating duties. However, the ICJ concluded that such a complaint should be dismissed since there was no urgency in the case. There is a concern that this judgment does not follow the pattern and practice of the ICJ’s rulings. Some scholars conclude that there is a potential of power or political link in the ICJ judgment that cannot be explained by law. The United Kingdom has nuclear weapons and dominates the nuclear arms race. The purpose of this study is to examine the hegemony NWS, which leads the ICJ to reject the Marshal Islands case in the context of negotiating duties related to the cessation of the race and nuclear disarmament. The research method applied in this study is a normative legal research method. Secondary data derived from the statutory approach, analytical approach, legal conceptual approach, and factual approach were used in the study. The result of the study showed that the ICJ has jurisdiction over the case to give advisory opinions and to settle this case in order to give additional provision in Article VI of The Non-Proliferation Treaty of 1968 (NPT).

The study is normative legal research with Statute Approach. Using the qualitative descriptive method, the study describe right of water as one of the human rights which explicitly stated in Indonesian Constitution, especially Article 28 (H), Article 33, and also many other instruments of human rights. Furthermore, the article also explore that constitutionally, the responsibility of state is enacting the pros and fair policies that support and enhance the quality for the people to access the water itself. States also have to fulfill and protect those rights from privatization, which will reduce the right of the people. The result shows that after the Decision of Indonesian Constitutional Court No. 85/PUU-XI/2013, that nulling the Law No. 7 Year 2004 on Water Resource and reenacted the Law No. 11 Year 1974 on Irrigation is the most proper way to return backs the access for public to access water which for a long time was occupied by private sector. However, the Irrigation Law Year 1974 did not provide the regulation on how to respect, to fulfill and to protect the right and access to water and it will be homework for the Government to realize it.Keywords: Human Rights, Right to Water, Constitutional Court Decision, Privatization

Abstract

This action took place in Potorono Village. The biggest issue that the residents of Potorono face are the large population, although there are still many people who do not work. Essentially, the potential for employment prospects in Potorono Village for the local community is rather considerable, but it is not appealing enough to work for the local people. Meanwhile, the Covid 19 pandemic, which began in March 2020, has caused many village community companies to halt and fail to flourish correctly. Furthermore, Potorono Village residents' knowledge of the value of Village Owned Enterprises (BUMDES) has not been optimal for the development of village residents' companies. Furthermore, the village community has not properly harnessed the natural potential and its supporting job sectors to boost welfare. This service's efforts are in the form of dissemination and support with the proper technology, as well as comprehending BUMDES's duty as a legal body. Furthermore, the utilization of waste processing into finished commodities that can be sold is communicated to the community in order to strengthen the village economy. The Potorono community's approach technique is built on active and interactive involvement, as well as dissemination and support with the deployment of relevant technologies to the community. As a result of this service, the community will understand the benefits of having BUMDES as a legal body in their area, as well as how to use technology to assist rural communities in growing their local economies.

Abstract

This writing examines the International Court of Justice's authority over cases of airspace breaches. Airspace is the space above the land area and waters of a country. Air space is one of the most critical parts of a region in realizing the welfare of a country. ICJ, as the Supreme Court of the United Nations, is capable of resolving conflicts between countries and disputes involving United Nations member states. As a result, this writing aims to analyse further the authority of the International Court of Justice regarding airspace violations. The research was normative and qualitative. The result showed that, in theory, ICJ had clear jurisdiction in resolving violation of airspace cases, but in practice, only a few cases had been resolved by ICJ. However, most of those cases submitted to ICJ produce no judgment from ICJ since the Court found that it lacks jurisdiction

Abstract

The Yemen war is a continuous conflict that first occurred in 2015. The war, known as the Yemen Civil War, involves two factions: Abdrabbuh Mansur Hadi leading the Yemen government, and the armed Houthi movement, along with their supporters and allies. Both claim to be the official government of Yemen. Iran-aligned Houthi rebels, who have controlled large parts of northern Yemen since 2014, have continued to carry out cross-border incursions into Saudi Arabia and are pressing for an offensive to seize Yemen's gas-rich Marib region. Already more than 100,000 people have died in Yemen's civil war, most of them civilians, because too many people have died in the civil war, so there is a need for legal protection. The purpose of this study is to find out how the protection of the people who are in conflict countries, especially the civil war in Yemen, is according to the perspective of international law. This study used a normative legal research method with a statute approach and a case approach to be easier to examine what is being studied, namely how to protect people living in conflicted countries from the perspective of international law. The results of this study indicate whether there is already legal protection for people who are in a conflicted country and how it is protected according to the perspective of international law.
