Abstract

Many crime cases in Indonesian society are settled in courts, resulting in a buildup that can hinder the justice system. Meanwhile, none of the cases concerning excisable goods or cigarettes in the Free Trade Zone, which are handled by Customs and Excise in several areas, have reached the judicial process. This problem can be resolved using the restorative justice mechanism, which prioritizes the concepts of peace, mediation and reconciliation, where perpetrators, victims, law enforcement officials, and the community participate directly in the settlement of criminal cases. Therefore, the formulation of the problem in this research involved the legal position of restorative justice and its application in excise crimes. Normative juridical legal methods, supported by empirical juridical data, were used in this research. The results showed that customs and excise violations can be resolved using restorative justice without the need for a court process.

Abstract

Trading in influence is a form of corruption that has gained increasing attention in Indonesia's legal system. This practice involves leveraging social relationships and access to public officials to gain certain advantages, either directly or indirectly. However, Indonesian law has yet to explicitly criminalize trading in influence as a distinct corruption offense, leading many cases that should fall under this category to be prosecuted under bribery or gratification laws instead. Amid these legal limitations, the concept of restorative justice emerges as an alternative resolution mechanism that focuses more on restitution and reconciliation rather than mere punishment. This study employs a normative juridical approach by analyzing relevant legal regulations and case studies at both national and international levels. From a criminal procedure law perspective, implementing restorative justice in trading in influence cases faces significant challenges, particularly in terms of evidence and victim identification. Nevertheless, this mechanism has the potential to enhance law enforcement effectiveness by promoting transparency, accountability, and the restitution of unlawfully obtained benefits. In the context of implementing Target 16 of the SDGs, the application of restorative justice can strengthen the rule of law and foster more transparent and inclusive institutions. Therefore, clearer regulatory reforms are necessary to accommodate restorative justice as a viable approach to addressing trading in influence as part of Indonesia's broader anti-corruption efforts.

Abstract

The eradication of narcotics crime is a national priority due to its impact on public health, social stability, the economy, and national security. This study aims to examine state sovereignty through the harmonization between the National Narcotics Agency and the State Intelligence Agency in combating narcotics crimes. The research uses a normative juridical method with the theory of the rule of law and law enforcement theory. The results show that cooperation between the two institutions is not yet optimal due to overlapping authorities and lack of integrated intelligence data, requiring regulatory strengthening and systematic inter-agency coordination.

Abstract

Badan Usaha Milik Desa (BUMDes) di Pekon Puralaksana Kelurahan Waytenong Kabupaten Lampung Barat merupakan badan usaha milik desa yang bergerak dalam beberapa sector, BUMDes ini memiliki beberapa cabang usaha, seperti terdapat kolam renang beserta pedagang makanan dan minuman didalamnya, lalu juga ada tempat hiburan lain berupa karaoke, terdapat juga wahana rekreasi dan belajar berupa kebun stroberi, dan juga mereka menyewakan mobil mobilan listrik. Oleh karena banyaknya cabang usaha yang mereka lakukan ini diperlukan system pembukuan yang efektif dan efisien, selain itu juga memanfaatkan kemajuan teknologi yang ada untuk melakukan penulisan laporan keuangan atau pembukuan. Tujuan dari kegiatan ini adalah Pelatihan Pembukuan Kepada Pegawai BUMDes dengan Menggunakan Media Ms Excel yang dapat memudahkan proses pembukuan. Adapun hasil dari pelatihan pembukuan dengan media Ms Excel ini adalah dapat memudahkan tugas para pegawai BUMDes, terutama bendahara BUMDes untuk membuat laporan keuangan, mengurangi kesalahan atau kekeliruan dalam laporan keuangan, dan juga memanfaatkan kemajuan teknologi yang ada secara optimal, efektif, dan efisien.

Abstract

Konsep tata kelola pemerintahan dari good governance merupakan sebuah konsep rujukan yang dianggap dapat mengelola aktivitas pemerintahan dengan baik. Konsep tata kelola pemerintah apa pun yang diadopsi menyiratkan untuk menolak berbagai bentuk aktivitas pemerintah yang didasari dari kegiatan otoritarian, korupsi, kolusi, dan nepotisme yang akan membuka peluang tindakan-tindakan jahat lainnya dalam melaksanakan aktivitas pemerintah. Tujuan diadakannya kegiatan sosialisasi ini yaitu untuk meningkatkan pengetahuan masyarakat Desa Sukaraja dalam hal Tata Kelola Pemerintahan yang Baik. Kegiatan ini dilakukan oleh Mahasiswa Kuliah Kerja Nyata (KKN) Universitas Lampung dan bekerjasama dengan Pemerintah Desa Sukaraja, Kecamatan Way Tenong, Kabupaten Lampung Barat. Hasil penelitian mengungkapkan, tata kelola pemerintah diadopsi karena kebutuhan untuk merespon berbagai masalah aktivitas pemerintah. Berbagai model tata kelola pemerintah itu muncul akibat adanya pemikiran baru untuk mengisi kekurangan dari konsep yang telah ada sebelumnya dengan pendekatan dan fokus yang berbeda. Dengan dilaksanakannya kegiatan ini dapat terbentuknya pemahaman bagi elemen kelembagaan desa terhadap keterlibatan setiap kegiatan pembangunan, penyelenggaraan pemerintahan desa, pembinaan dan pemberdayaan masyaraat. Sehingga hubungan dan koordinasi menyangkut tugas dan fungsi yang baikpun tercipta antara pemerintah desa dengan masyarakat Desa Sukaraja.

Abstract

The armed conflict between the Indonesian National Army and separatist groups in Papua shows the characteristics of a non-international armed conflict (NIAC) based on international humanitarian law (IHL). However, the legal status of Indonesian National Army soldiers in this conflict has not been clearly defined in the national legal system, thus creating ambiguity regarding their protection and accountability. This study aims to analyze the combatant status of Indonesian National Army soldiers in NIAC based on international legal instruments and national regulations. Through a normative legal approach comparisons with other countries such as Colombia, Philippines, and Hungary are examined to assess legal gaps and best practices. The research findings indicate that, although combatant status is not formally recognized in NIAC, the fundamental principles of IHL remain applicable to all parties. The study concludes that Indonesia must reform its legal framework to ensure both the protection of soldiers acting lawfully and accountability for IHL violations. The research contribution i the development of an understanding of international humanitarian law (IHL) and the formation of national policies related to the legal status of military members in non-international armed conflicts (NIAC).

Abstract

Legal protection for victims of wrongful arrest is regulated in Articles 95 to 97 of the Indonesian Criminal Procedure Code (KUHAP) and further detailed in Government Regulation No. 92 of 2015 concerning compensation and rehabilitation mechanisms. This study aims to examine the forms of legal protection available to victims of wrongful arrest and to analyze the legal remedies they can pursue to claim their rights. The research employs a normative and empirical legal approach. The normative approach is based on statutory regulations, literature, and academic references, while the empirical data is collected through interviews with relevant informants. The findings indicate that victims of wrongful arrest are entitled to compensation and rehabilitation through legal mechanisms such as pretrial motions. These efforts are intended to restore the dignity, rights, and legal status of the victims. However, in practice, challenges remain in the enforcement of such rights due to procedural complexity and the lack of legal assistance. The study recommends that legal protection should be ensured from the earliest stages of investigation to prevent arbitrary treatment by law enforcement. Furthermore, access to legal remedies must be simplified, and legal aid should be provided to ensure justice for victims.

Abstract

Animal quarantine plays a crucial role in preventing the smuggling of wildlife, particularly protected bird species. Although this is regulated under Law Number 21 of 2019 concerning Animal, Fish, and Plant Quarantine, smuggling practices remain prevalent. This study employs a normative and empirical juridical approach to examine the role of the Agricultural Quarantine Agency Class 1A Bandar Lampung in combating bird smuggling, as well as the factors hindering the enforcement of criminal law. The findings indicate that the quarantine agency carries out three main roles: normative (based on regulations), factual (preventive and repressive actions), and ideal (emphasizing prevention). Obstacles faced include a shortage of field personnel, limited equipment and funding, and low public awareness of the law. It is recommended that the quarantine agency improve community welfare and collaborate with relevant institutions to optimize public outreach and law enforcement efforts.

Abstract

Document forgery is a serious issue that affects various sectors of life in Indonesia, including social, economic, and political systems. Document forgery involves the act of creating or altering documents to make them appear valid and genuine with the intent to deceive or gain unlawful benefits. This practice has become more complex with the advancement of information technology, enabling the forgery of electronic documents that are difficult to detect. This study examines the role of law in addressing document forgery in Indonesia, the challenges faced in law enforcement, and solutions that can be implemented to enhance the effectiveness of law enforcement. This research uses a qualitative approach by reviewing various legal regulations, case studies, and previous research to understand the root causes of document forgery. The findings show that although regulations are in place to address document forgery in the Criminal Code (KUHP) and the new Law No. 1 of 2023, the biggest challenge in law enforcement is the difficulty in proving forgery, particularly in relation to electronic documents. Additionally, the lack of capacity among law enforcement in digital forensic technology and the general public's lack of awareness are significant barriers. Therefore, improving the capacity of law enforcement, updating regulations, and raising public awareness are necessary to make law enforcement against document forgery more effective and efficient. This study provides recommendations for strengthening Indonesia's legal system in dealing with document forgery in a more comprehensive manner.Keywords: Document Forgery, Criminal Law, Electronic Documents, Law Enforcement, Digital Forensics
