Abstract

 Upaya pemerintah dalam memberikan perlindungan kepada pemegang hak merek telahdilakukan dengan memberlakukan dan memperbaharui undang-undang tentang merek,namun pada kenyataannya kejahatan hak atas merek tetap saja terjadi, salah satunya diwilayah hukum Pengadilan Negeri Tanjung Karang. Permasalahan dalam penelitian:bagaimanakah dasar pertimbangan hakim terhadap tindak pidana tanpa hakmenggunakan merek terdaftar dan bagaimanakah analisis tindak pidana tanpa hakmenggunakan merek terdaftar dalam Putusan Nomor: 50/Pid.Sus/2023/PN.Tjk. Jenispenelitian yang digunakan adalah normatif dan empiris, dengan pendekatan perundangundangan dan pendekatan konseptual. Jenis data menggunakan data sekunder melaluistudi kepustakaan. Pengolahan data dilakukan dengan seleksi, klasifikasi danpenyusunan data. Analisis data dilakukan secara deskriptif kualitatif. Hasil penelitian inimenunjukkan bahwa dasar pertimbangan hakim dalam menjatuhkan pidana terhadappelaku tindak pidana tanpa hak menggunakan merek terdaftar dalam Putusan Nomor:50/Pid.Sus/2023/PN.Tjk secara yuridis yaitu perbuatan terdakwa terbukti secara sahmenyakinkan melakukan tindak pidana tanpa hak menggunakan merek terdaftarsebagaimana diatur dalam Pasal 100 ayat (1) Undang-Undang Nomor 20 Tahun 2016tentang merek dan Indikasi Geografis. Secara filosofis hakim mempertimbangkanbahwa pidana yang dijatuhkan sebagai pembinaan dan dapat memberikan efek jerakepada pelaku. Secara sosiologis hakim mempertimbangkan hal-hal yang memberatkandan meringankan pidana. Pertanggungjawaban pidana terhadap pelaku tindak pidanatanpa hak menggunakan merek terdaftar didasarkan pada terpenuhinya kemampuanbertanggung jawab, yaitu terdakwa sudah berusia dewasa (33 tahun), mampumelakukan perbuatan atau tindakan hukum. Unsur kesalahan yaitu terdakwa dengansengaja tanpa hak menggunakan merek terdaftar meskipun mengetahui bahwa  perbuatan tersebut merupakan tindak pidana. Unsur tidak ada alasan pemaaf tepenuhikarena terdakwa pada tindak pidana tanpa hak menggunakan merek terdaftar dalamkeadaan sadar atau sehat dan tidak berada dalam tekanan atau paksaan.Kata Kunci: Tindak Pidana, Tanpa Hak, Menggunakan Merek Terdaftar

Abstract

Child exploitation through forced begging in Bandar Lampung City constitutes a severe violation of fundamental rights, substantially undermining both physical and psychological development. Criminal networks systematically manipulate vulnerable minors for economic gain, representing a grave breach of child labor protection statutes. This research examines law enforcement mechanisms targeting exploitation perpetrators, identifies systemic barriers, and proposes enhanced legal protection frameworks. The investigation employs a sociological-juridical methodology, utilizing documentary analysis, ethnographic observations, and structured interviews with law enforcement personnel, social service practitioners, and child advocacy specialists. Analysis draws upon child protection theory and progressive jurisprudence principles. Findings reveal enforcement mechanisms remain fragmented, reactive, and institutionally unsupported. Primary impediments encompass inter-agency coordination deficits, inadequate street children documentation, and insufficient rehabilitation funding. The research advocates for policy restructuring and systematic strengthening of child protection mechanisms through interdisciplinary collaboration. The study's significance lies in advancing more integrated and effective legal safeguards for exploited children across municipal and national jurisdictions.

Abstract

Many crime cases in Indonesian society are settled in courts, resulting in a buildup that can hinder the justice system. Meanwhile, none of the cases concerning excisable goods or cigarettes in the Free Trade Zone, which are handled by Customs and Excise in several areas, have reached the judicial process. This problem can be resolved using the restorative justice mechanism, which prioritizes the concepts of peace, mediation and reconciliation, where perpetrators, victims, law enforcement officials, and the community participate directly in the settlement of criminal cases. Therefore, the formulation of the problem in this research involved the legal position of restorative justice and its application in excise crimes. Normative juridical legal methods, supported by empirical juridical data, were used in this research. The results showed that customs and excise violations can be resolved using restorative justice without the need for a court process.

Abstract

This study aims to examine the restorative justice paradigm as a means of solving violent crimes against people or goods. Violent crime is an act prohibited by law by a person or group of people using physical force so as to cause physical damage to the victim, helplessness of the victim, damage to the victim's property / property, even lead to death. which is a repressive approach as implemented in the Criminal Justice System. The research method used is a normative research method, using a statute approach and case approach related to the restorative justice paradigm as a means of solving violent crimes against people or goods. The statute approach is to examine matters concerning legal principles, legal views and doctrines, and laws and regulations related to Criminal Acts of Violence Against Persons or Goods and can be held accountable for their truth while the case approach is an approach that is carried out to analyze, analyze and analyze used as a guideline for legal problems to resolve legal cases. This research uses secondary data supported by primary material and will be analyzed with analysis content.

Abstract

Profesi advokat memiliki kedudukan strategis sebagai penegak hukum yang menjunjung tinggi prinsip keadilan dan integritas moral. Penelitian ini bertujuan menelaah akar kelemahan struktural dan kelembagaan dalam mekanisme pengawasan advokat di Indonesia serta merumuskan model reformasi yang akuntabel dan independen. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, kasus, konseptual, dan teoretis, dengan analisis berbasis teori Regulatory Capture. Hasil kajian menunjukkan bahwa kegagalan Dewan Kehormatan Organisasi Advokat dalam menegakkan disiplin, dualisme organisasi yang menimbulkan fragmentasi standar etika, dan keterbatasan kewenangan Mahkamah Agung menjadi faktor utama yang menghambat akuntabilitas profesi. Reformasi yang diusulkan mencakup pembentukan Badan Pengawas Advokat (BPA) yang bersifat independen, penerapan Minimum Continuing Legal Education (MCLE) secara nasional, serta pembatasan rangkap jabatan politik pimpinan organisasi advokat. Temuan ini menegaskan bahwa reformasi sistem pengawasan merupakan langkah mendesak untuk menyeimbangkan independensi profesi dengan tanggung jawab publik, sehingga martabat officium nobile dapat diwujudkan secara substantif

Abstract

Corruption remains a heavy burden for Indonesia in its quality as an extraordinary crime since it has very broad implications for aspects of governance, development, and public trust in state institutions. This study aims to analyze the role of prosecutor's investigators in handling corruption cases related to the illegal deduction of Family Planning Operational Assistance (BOKB) funds in Tanggamus Regency. The research methodology used normative and empirical juridical approaches with primary data collected through interviews with law enforcement officials and secondary data sourced from statutory provisions, case files, and scientific literature. The Tanggamus District Prosecutor's Office carried out the main tasks at the stages of investigation, indictment, and prosecution. In case Number PDS/02/TGMS/07/2022, investigators revealed a systematic scheme where 17.5% was deducted from every fund disbursement causing state financial losses amounting to approximately IDR 1.55 billion. Several barriers were faced during the investigation; witness testimonies were inconsistent, facilities and infrastructure were inadequate, and forensic audits to calculate state losses faced delays. Increasing inter-institutional coordination between prosecutors and related agencies as well as improving infrastructural capacity is necessary to increase both legitimacy and effectiveness in corruption eradication.

Abstract

Presidential Regulation Number 12 of 2021 concerning amendment the Presidential Regulation Number 16 of 2018 (Presidential Regulation 12/2021) was the government efforts for micro small-level enterprises (MSEs) and cooperatives to be involved in the public procurement of goods and services. However, it still needs to be anticipated because there are always irregularities that usually occur, namely corruption. This research aims to determine how the amendment of the public procurement regulation in the Presidential Regulation 12/2021 especially for MSEs and cooperatives, and also how to assess the Presidential Regulation 12/2021 can reduce the potential for corruption in the process of public procurement. This research uses a normative method with a comparative approach and a statutory approach. The results of this research indicate the Presidential Regulation 12/2021 are the elimination of medium-level enterprises, the government's obligation to allocate a minimum budget of 40%, and also increase the budget ceiling for MSEs and cooperatives up to IDR 15 billion. E-Procurement for MSEs and cooperatives still has the potential for corruption, but with the new policy in the form of competency certification, and if there is an increase in regulations from the National Procurement Board (LKPP) in terms of provider qualifications, procurement can produce quality and efficient products. Abstract

Peraturan Menteri Pendayagunaan Aparatur Negara dan Reformasi Birokrasi Republik Indonesia Nomor 10 Tahun 2019 tentang Perubahan Atas Peraturan Menteri Pendayaguna Aparatur Negara dan Reformsi Birokrasi Nomor 52 Tahun 2014 tentang Pedoman Pembangunan Zona Integritas Menuju Wilayah Bebas Dari Korupsi Dan Wilayah Birokrasi Bersih dan Melayani di Lingkungn Instansi Pemerintah. Melihat permasalahan yang ada saat ini KPK mengeluarkan majalah tentang korupsi penggunaan anggaran desa yang makin marak. Oleh sebab itu penelitian pengabdian kepada masyarakat ini berupa Desa Binaan dengan tema Menuju Desa Bebas Korupsi disini diharapkan akan terwujudnya kerja sama antara Universitas Lampung dalam hal ini lembaga Puskamsikham ingin mengajukan program berupa pendampingan dan pengawasan terkait zona integritas di Desa Batang Hari Ogan. Sebab desa ini dinilai masih kurang pemahaman antar masyarakat terkait nilai integritas anti korupsi. Metode penelitian dalam pengabdian masyarakat menggunakan metode penelitian empiris dan didukung dengan pengamatan secara langsung. Berdasarkan hasil pengabdian masyarakat ini adalah terwujudnya Desa Batang Hari Ogan dengan predikat Zona Integritas yang bebas korupsi, dan wilayah birokrasi bersih melayani sesuai konsep yang berkaitan dengan konsistensi dalam tindakan-tindakan, nilai-nilai, metode-metode, ukuran-ukuran, prinsip-prinsip, ekspektasi-ekspektasi yang memiliki pribadi yang jujur dan memiliki karakter yang baik.
