Abstract

Pertunjukan Wayang Kulit Cirebon merupakan salah satu bentuk tradisi lisan yang termasuk dalam drama rakyat. Sebelum tahun 2000-an, pertunjukan wayang kulit Cirebon memasuki masa keemasan, mengalami penurunan pada tahun 2000-an yang disebabkan oleh budaya baru yang masuk ke daerah Cirebon. Melihat dan menanggapi penurunan tersebut, penulis bertujuan untuk mengkaji peran katalisator dalam pertunjukan wayang kulit terhadap katalis sosial budaya di Cirebon. menggunakan metode penelitian dengan pendekatan kualitatif. Untuk itu, penelitian ini akan mencoba mengkonstruksi realitas peran katalisator dalam pertunjukan wayang kulit dan memahami maknanya dalam membawa katalis sosial budaya di Cirebon. Jadi memperhatikan proses, peristiwa dan keaslian. Hasil dari penelitian ini adalah katalisator yang mendorong katalisasi sosial budaya melalui pertunjukan Wayang Kulit Cirebon yang tercermin di desa-desa atau daerah di Cirebon. Merupakan model katalis untuk mempertahankan nilai-nilai sosial budaya yang memiliki ciri khas tersendiri, artinya menjadi katalisator identitas masyarakat Cirebon dalam menjaga nilai sosial budaya.

Abstract

The present study aims to scrutinize the Indonesian Civil Service Police Unit (henceforth: Satuan Polisi Pamong Praja/CSPU) in enforcing local regulations. In enforcing the local regulations, the principle of “no punishment without representation” is applied to the formulation of criminal sanctions, while the principle of “no taxation without representation” is conducted to regional development funding. This study employs normative qualitative approach to obtain legal facts encountered by CSPU. The findings indicated that CSPU merely works as administrative officers with their insignificant roles. Furthermore, the contents of the criminal sanctions for regional development funding position it as an instrument to influence the perception of the regional communitydue to their lack of coordination in implementing the two principles. Furthermore, the CSPU is deemed to be restricted due to the absence of regulations that strengthen their duties to enforce the local regulations. Therefore, it can be inferred that the lack of support for legal products in enforcing local regulations is considered an obstacle for those CSPU to truly play their main role as investigators towards the violation of local regulations. Furthermore, the local government does not place more emphasis on the principles of criminal sanctions as well as the escorting of financial capital in regions.

Abstract

Pemikiran the king can do not wrong dapat dikatakan sebagai alat kekuasaan penguasa untuk merekayasa warga negara. Produk hukum Indonesia saat ini telah terkontaminasi oleh pemikiran tersebut. Tidak heran warga menginginkan keseimbangan politik hukum untuk menuntuk keadilan hukum penguasa. Pertanyaan yang timbul tentang pemikiran the king can not do wrong terhadap system ketatanegaraan Indonesia menjadi satu topik kajian. Melalui metode pengkajian terhadap beberapa telaah pustaka dan sejarah di belahan dunia, dapat membudahkan pembahasan yang disajikan melalui penggambaran dalam bentuk kalimat. Hasil dalam pembahasan didapatkan perlawanan terhadap produk hukum bukan hanya terjadi di Indonesia saja, malainkan jauh sebelumnya terjadi di beberapa negara. Di Indonesia sendiri berkenaan perlawanan terhadap produk hukum berusaha dilakukan terutama terhadap produk hukum positif yang dinilai kurang memberikan keadilan. Sebagai bentuk negara kesatuan kesalahan produk hukum sering dilakukan oleh eksekutif. Namun, hal yang rumit berkenaan pengguasa yang tidak dapat dihukum atas pembuatan produk hukum. Maka dapat ditarik kesimpulan bahwa produk hukum pada dasarnya dibuat penuh dengan kepentingan terutama kepentingan penguasa yang bernaung di bawah legitimasi. Theory of the King Can Do Not Wrong on Legal Politics Under Indonesian Constitutional System The thought of the king can do not wrong can be said as an instrument of power of the authorities to engineer citizens. Indonesia's legal products are now contaminated by such thoughts. No wonder citizens want a political balance of law to seek justice of the ruling law. Questions that arise about the thinking of the king can not do wrong to the Indonesian state administration system into a single topic of study. With the method of studying some of the literature review and history in the world, can facilitate the discussion presented through the description in the form of a sentence. Results in handling not only occur in Indonesia alone, but far earlier in several countries. In Indonesia itself is against the legal products. How the country works. However, the very thing concerning the unreliable. Then it can be recalled the above products are made full of interests above the interests of the rulers who take shelter under legitimacy.

Abstract

This research is motivated by the local media in Cirebon since May 2016-2018 cannot be separated from the discussion and data that Cirebon is categorized as an emergency of child violence. The category of emergencies can be known from data on the increase in child violence in 2016 with 30 cases recorded, in 2017 there were 126 cases, and in early 2018 it increased to 147 cases. What is the ideal policy for realizing child protection? What steps should be taken by the regional government in Cirebon in responding to areas that are included in the emergency situation of child victims of sexual crimes? The method used in this study uses a normative juridical method approach, starting from the provisions of the legislation and examined in the field to obtain supporting factors and obstacles. In Cirebon itself sexual violence as reported by the media is still high and requires government policies that favor children. Government policies in Cirebon are very confusing for the people in Cirebon itself, especially regarding violence against children.

Abstract

This article aims to examine Law Number 6 of 2014 concerning Villages relating to the castration of villages through legal products issued by the state. Refuse of Article 18B Paragraph (2) The 1945 Constitution of the state recognizes and respects customary law community units and their constitutional rights insofar as they are still alive and in accordance with the development of society and the principle of the Unitary State of the Republic of Indonesia, which is regulated in law. The castration of the village is basically a means that cannot be fully blamed or justified. These considerations are of concern to those who understand the importance of the integrity of the country. The implementation is very contradictory where villages must submit to the commands that have been determined by legal products

Abstract

This article delves into the crucial aspects of the Constitutional Court of the Republic of Indonesia's decision, focusing on the emergency state of administrative law concerning open legal policy decisions referred back to legislators, particularly regarding the tenure of village heads. The study employs a conceptual and legal approach, centering on the Constitutional Court Decision No.15/PUU-XI/2023 concerning the village head's position. This represents an open legal policy for law framers, paving the way for the political prevention of Pilkades (village head elections) money politics. Law No. 6 of 2014, which is under consideration for revision, lacks explicit measures against money politics. The methodology adopted is normative legal research that integrates legal theory with legislation. The findings indicate that open legal policy rulings necessitate immediate action by law framers, signaling administrative law urgency. The rationale is that law framers must react to that decision, and revising the law does not necessarily require inclusion in the National Legislation Program (Prolegnas). Decision on open legal policies must be administratively executed by law framers, including the issuance of Government Regulation in Lieu of Law (Perpu), which subsequently require legislative approval to become law. In essence, the decision of the Constitutional Court carries a moral and ethical coercive force, achieved by transforming ius constitutum into ius constituendum.

Abstract

Embedded gray and white writing for High School students or equivalent, it is categorized as a beginner voter in Indonesia. In September 2019 there was a ban on demonstrations involving white and gray voices. The aim and study focuses on the discussion of white and gray voices in demonstrations seen from the substance of electoral law seen from the principle of lex specialis derogat legi generali. Its usefulness, it gives enlightenment to the minimum age limit to vote and can be legally accounted for and election justice. The arguments of politicians, bureaucracy, and education in the assessment of white and gray are still children and unstable. The gray-white voice opposes ordinary use to crank up the voice and anticipate abstentions. The substance of democratic elections, white and gray votes have the same rights and obligations, unstable age is politicized substance to prevent abstentions, making it a stepdaughter of democracy. Countries that want elections that are more mature than they exist revitalize elections on demonstrations.

Abstract

The village as the basis of national development in upholding new constitutionalism found a bright spot as the birth of the Village Customary Institution (LAD) which had a noble task. Village customary life is determined, mobilized, and controlled by institutions in the village. Village life loses its identity as a village, individuals, communities and villages move in conditions of individualism. Customary law is a term that is given legal knowledge, as guidelines, reality that governs groups, and disciplines people's lives in Indonesia. Indonesian people living in remote areas need order and guidance as rules they make themselves. Thus the existence of customary law to date still has an important role, especially in the formation of future national laws, especially in the field of family law. Customary law will be one of the main sources in the formation of written law, so that written rules are automatically a reflection of community law. And of course with the expectation that when the written law is enacted, there is no gap in practice in the community.

Abstract

This legal study investigates the implications of the proposed renaming of West Java Province to Tatar Sunda Province, employing the approach of intuitive semantic dualism to address issues of language, territory, ethnicity, and national identity. The research draws on data from academic journals, books, media reports, and interviews, comparing secondary data with field opinions on the languages and bordering regions of the Sundanese dialect. The findings reveal that, although the Sundanese linguistic system was expected to play a crucial role in the renaming process and promote territorial unity, it falls short due to the inclusion of regions such as Banten, pre-independence Batavia, and bilingual border areas in the east and north. This geographic and linguistic complexity means that the name "Tatar Sunda" does not accurately reflect the distinct linguistic, cultural, and territorial identities of the Sundanese people as described by J. van Baal. Legally, while there are no barriers to the renaming policy, the proposed name fails to adequately represent the region's diverse identities. Consequently, the study recommends further exploration of more representative alternatives that align with the existing legal framework, ensuring that the name change is not only legally valid but also appropriately reflects the region's identity.

Abstract

Copying and commercial use of copyright (especially songs) is an act that is detrimental to copyright holders. Article 9 of the Copyright Law has emphasized this action and problems in the field of intellectual property protection become a fundamental problem when research shows that there are weaknesses in aspects of copyright protection. A copyrighted work will receive legal protection if it covers the fields of science, art and literature. Legal protection is obtained if a creation has been realized in a tangible form. The method used in this research is normative research. The author uses the library research method (library search) which is done by reading and studying written sources. According to Article 4 UUHC, the exclusive rights of protected music creators consist of moral rights and economic rights. Moral rights are inherent in the creator or actor that cannot be removed or deleted without any reason, even though the copyright or copyright has been transferred. However, not all countries provide the same legal protection for moral rights in copyright. Some countries may not have strong moral rights laws, or may provide less protection for those rights. Legal arrangements regarding the economic rights of creators or copyright holders show that economic rights are the exclusive rights of creators or copyright holders to obtain economic benefits from creations, so that everyone who exercises economic rights must obtain permission from the creator or copyright holder and is prohibited from duplicating and/or commercial use of works without the permission of the creator or copyright holder.
