Introduction: This study aimed to examine the legal dialectic over the age limit for marriage and political rights in Indonesia. It was promoted by a new marriage regulation stipulating the minimum age of nineteen years for men and women. This regulation correlates with the rules containing the minimum age limit, necessitating a further discussion.Objective: Previous studies on the minimum age limit did not focus on the law dialectic.Methodology: There are contradictions between the normative method of law and the idea of legal dialectics. The conclusions were drawn inductively.Findings: There are inequalities in several laws and regulations over the minimum age. The legal products, including a minimum age, are specific to certain laws and actions. The marriage dispensation has broken through higher laws, significantly impacting political rights. Mekanisme pengawalan demokrasi, bidang pengawasan memiliki Bawaslu yang kewenangan dan tugasnya melekat pada UU No. 7/2017 tentang Pemilu. Bawaslu sendiri tidak diberikan melakukan mengawasan atas mekanisme Pemilihan Kepala Desa (Pilkades) yang dapat mengarah pada politisasi desa. Penelitian mendiskusikan kemungkinan dilema hukum perluasan pengawasan dilakukan atas mekanisme demokrasi desa terutama dalam Pilkades. Metode penelitian pada diskusi dilema hukum Bawaslu atas mekanisme demokrasi desa dilakukan dengan cara pendekatan yuridis normatif, dengan menitikberatkan data penelitian kepustakaan. Metode analisis yang digunakan dalam analisis data dalam penelitian adalah analisis yuridis kualitatif dengan melihat pada permasalahan yang ada dihubungkan dengan peraturan-peraturan sebagai hukum postif, untuk kemudian dianalisis secara kualitatif. Perjalanan perubahan nama dari Panwaslu jadi Bawaslu sebagai langkah mau dalam bidang pengawasan Pemilu belum diimbangi dengan sentuhan pada pengawasan Pilkades. Ironis kemajuan Bawaslu kurang terlibat dalam pengawasan Pilkdesa meningat desa sebagai laboratorium demokrasi sangat besar terjadinya money politic jika dibandingkan dengan Pemilu ataupun Pilkada. Namun kenyataannya peran Pemerintah Daerah terkesan membiarkan dan kemungkinan besar arena Pilkades banyak dimanfaatkan untuk kepentingan Kepala Daerah. Maka untuk menghidari keadaan tersebut, sudah selayaknya Bawaslu dilibatkan langsung dalam pengawasan Pilkades tersebut. Namun peran Bawaslu sendiri telah mengalami dilema secara hukum untuk melakukan pengawasan Pilkades.

The mindset of the elite class in the formulation of legislation. In the context of the formation of the Act, freedom of expression is a condition for listening to popular opinions. Listening aims to know the opinions of all the people, not a few people. Such knowledge will be the basis of legislative consideration in approving a bill. However, the mindset of the elite class is sometimes confusing even still see the formation of legislation should impose its will. At the level of application the community becomes a victim due to the mindset of an elite class that is not yet mature enough in thinking related to its task. Utilization is the utilization of State/Regional Property that is not used for carrying out the duties and functions of ministries/institutions/regional work units and/or optimizing State/Regional Property by not changing the ownership status of Regional Property (BMD). The results of the discussion show that the use of BMD for regions to increase their PAD is not carried out according to the applicable mechanism because it is widely misused, especially in the Cirebon City Government with the motive of illegal acts which are indicated as criminal acts with the problem of the State Property Grant (BMN) of former Pertamina assets as as stated in the Decree of the Minister of Finance Number KMK-247/MK.6/2019 dated 24 September 2019 cannot be transferred from the Cirebon City Government to other parties. There are types of utilization of borrow-to-use, BGS/BSG, Lease, Cooperation in Utilization that can be carried out in the form of non-infrastructure utilization, while in the form of infrastructure, the forms of utilization that can be selected are lease, cooperation in utilization and cooperation in providing infrastructure. Each method of asset utilization (except borrow-to-use) has its own form of contribution that can increase regional income. Based on the facts that the Cirebon City Government and other parties (Gunung Jati Self-Help Education Foundation) deliberately ignore the rules and provisions of the laws and regulations that apply to date and do not carry out the option of using/utilizing BMD related to the lease on the establishment of the campus used by the community. The Faculty of Medicine, Universitas Swadaya Gunung Jati which has been occupied for lectures, on the use of part of the land in the Bima Stadium area is part of the Regional Property belonging to the Regional Government of Cirebon City in the form of land with an area of ??+/- 10,300 m2 which is currently problematic. Cooperatives occupy a very respectable position in the Indonesian economy. Etymologically, a cooperative is an association or economic organization consisting of people or entities that provide freedom of entry and exit as members. With the existence of an institution in the form of a cooperative such as the example of the Mekar Mandiri cooperative which collects funds from its members then distributes the funds back to the cooperative members and the general public and creates problems, namely what are the factors that cause bad credit in the Mekar Mandiri Cooperative. And how are the efforts to resolve bad loans at the Mekar Mandiri Cooperative. In the research to compile this journal using the type of empirical legal research, law is conceptualized as an empirical phenomenon that can be observed in everyday life, the type of approach used for writing this journal uses a fact approach and a statutory approach. Penelitian ini bertujuan mengkaji karang taruna sebagai organisasi sosial berbasis kepemudaan yang memiliki peranan penting dalam mewujudkan tanggung jawab sosial pemuda di Desa Manis Kidul Jalaksana Kuningan. Seseorang bertanggung jawab secara hukum atas suatu perbuatan tertentu atau bahwa dia memikul tanggung jawab hukum, subyek berarti bahwa dia bertanggung jawab atas suatu sanksi dalam hal perbuatan yang bertentangan. Jenis penelitian yang digunakan adalah penelitian kualitatif, penelitian ini dilaksanakan di desa Manis Kidul Kecamatan Jalaksana Kabupaten Kuningan. Sumber data yang digunakan berupa data primer dan sekunder. Teknik pengumpulan data dengan wawancara, observasi dan dokumentasi. Hasil penelitian menunjukkan bahwa peran karang taruna dalam mewujudkan tanggung jawab sosial pemuda mengajak masyarakat aktif dalam keterlibatan program kerja yang berjalan atas dasar program kerja yang berlandaskan Peraturan Menteri Sosial N0 25 Tahun 2019 sehingga dapat mewujudkan Tanggung Jawab Sosial Pemuda terhadap peduli lingkungan masyarakatnya. The phenomenon of money politics that occurs in the community is very difficult to stop and it has become a habit that certain political candidates or contestants do to the public ahead of the election to gain support and gain the most votes from the community without considering the quality of the political candidates or contestants they choose. This study was conducted to determine the factors that cause money politics, how the process occurs, the impact of money politics and suggestions to overcome the occurrence of money politics. This research uses descriptive qualitative method by analyzing the paradigm of social behavior. The research location is in Ciamis Regency. Sources of information in this study consisted of the community, the success team of political candidates or contestants and other important figures. The results of the study show that (1) the factors that influence the occurrence of money politics are the poverty factor, the habit factor, and the community knowledge factor. (2) The process of the occurrence of money politics is carried out directly with the term dawn attack or by mobilizing the masses in the form of money directly or in other goods such as building facilities for prayer rooms, roads and others. (3) The impact arising from the practice of money politics can damage the democratic order and can cause other new problems in society to the government, so that it has a long-term negative impact. (4) Suggestions to anticipate the occurrence of money politics, there must be strategic steps taken by the government and all parties for the realization of good democracy in the future, namely, political education for the community must be increased, punishment must have a deterrent effect for money politics actors, and need regulatory changes. This study aims to find out how the obligations of the Cirebon Regency Education Office on the decision of the Cirebon Regency Regional Information Commission Number 002/VI/KIKC-PS-A/2018 on the completeness of public documents in Cirebon Regency. The form of the completeness of the requested public documents in the form of a request for a hardcopy / official copy of the 2017 Budget Implementation Document at the Cirebon Regency Education Office is open information based on the KIP Law. The obligation of the Cirebon Regency Education Office in accordance with its duties and functions as a Public Agency does not carry out the mandate of the KIP Law. The methodology used is a type of normative juridical research, namely legal research that places the law as a building system of norms. The system of norms in question is to recognize the principles, norms, rules of laws and regulations, court decisions, agreements and doctrines (teachings). Meanwhile, from the nature of the core research, it is included in the type of descriptive research in the form of diagnostic and evaluative by using qualitative exposure. The findings in this study, First; the weak response and no guarantees as well as the existence of deliberate institutional actions by the Cirebon Regency Education Office, so that the rights of applicants for public information are ignored so that they must take the public information dispute resolution route at the Cirebon Regency Regional Information Commission. Second; that the obligation of the Cirebon Regency Education Office is not to provide, not to provide and/or not to publish public information under its authority to applicants for public information until an unspecified time limit, so that unclear public information will appear and cause a problem. Theorists struggle to determine the nature of the separation of power. There are many objections to the tripartite separation (three powers) of the state in the form of the legislature, executive and judiciary by referring to Montesquieu in his Spirit of the Laws for the history of political theory originating in the French state. The separation of powers is a vital feature of western democracies, enshrined in various federal and state constitutions. As a broad principle, theorists struggle to determine its precise nature, and many argue that the tripartite separation of state power into legislative, executive and judicial branches has proved simple and impossible. I think we should understand the separation of powers as a strategy used to structure the relationship between separate institutions. This structuring process empowers the creation of new relationships between institutions, with the aim of enhancing their institutional integrity. In short, we split up just to reconnect. These strategies direct attention to inter-agency relationships highlighting the contribution of these relationships to keeping institutional integrity together. The election of the President and Vice President of Indonesia has experienced many dynamics from time to time. The beginning of independence, precisely on August 18, 1945, was carried out by the Preparatory Committee for Indonesian Independence (PPKI). the second replaces Sukarno. The minimum threshold (presidential threshold) became known in Indonesia in 2004, along with the issuance of Law no. 23/2003 concerning General Elections (Pemilu). The stipulation is that Political Parties (Parpol) must reach a minimum of 15% of the DPR seats and 20% of the national valid votes to be able to carry the president and vice president. Efforts to restore democracy to prevent the arbitrariness of the rulers through the presidential threshold have their own obstacles. The function of research is to seek the truth, truth is intended with regard to the nature, source, and scope of knowledge. Setting the Presidential Threshold in the presidential and vice presidential elections in Indonesia has had many impacts. So with the high Presidential Threshold, the public and political parties then submitted a judicial review to the Constitutional Court and in the Constitutional Court's decision Number 53/PUU-XV/2017 regarding the judicial review of Law No. 7/2017 article 222 which discusses the Presidential Threshold, the Constitutional Court refused. The refusal of judicial review of Article 222 of Law No. 7/2017 of the Constitutional Court resulted in setting the threshold for regional head elections still referring to Law No. 10/2016 on regional government.
