Abstract

Difficulties as well as challenges for Cirebon education in developing local traditions are faced with the development of religious understanding and globalization. Examples of earth charity and Cirebon nadran as a manifestation of gratitude for the gifts that have been given to humans on earth. The alms tradition of the earth and the Cirebon nadran are in line with the commemoration of international earth day which is commemorated every April 22nd. Religious ideology is often expressed in the practice of seemingly squandering costs which the community considers bid'ah and some are not bid'ah by reason of guarding the ancestral heritage of Cirebon. The problem that arises is how to maintain the local tradition of Cirebon amid religious understanding and globalization in order to be maintained and in line with the mandate of national education. The goal to be achieved in writing is to maintain, maintain and preserve the local traditions of Cirebon through school education. The benefits of giving enlightenment regarding religious understanding in Cirebon in seeing local traditions in Cirebon and providing solutions to the challenges faced by the world of national education in general. The method used is by describing words in the form of sentences regarding local traditions and challenges, team experience is used to explore information relating to the problem. Using Ghoethe's thinking about the search for novelty lies in ancient truth as a knife of analysis in terms of problem solving. As a result, the Cirebon local tradition has increasingly lost its identity due to the growing religious understanding in Cirebon and unstoppable globalization. Then we need support and synchronization between the goals of education, religious understanding and the challenges of globalization Kesulitan sekaligus tantangan bagi pendidikan Cirebon dalam mengembangkan tradisi lokal dihadapkan pada perkembangan paham keagamaan dan globalisasi. Contoh sedekah bumi dan nadran Cirebon sebagai perwujudan bentuk syukur atas karunia yang telah diberikan pada manusia di muka bumi. Tradisi sedekah bumi dan nadran Cirebon sejalan dengan subtansi peringatan hari bumi internasional yang diperingati setiap tanggal 22 April. Faham keagamaan sering dilontarkan pada praktik yang terkesan menghambur-hamburkan biaya yang kemudian masyarakat menganggapnya bid’ah dan sebagian lagi bukan bid’ah dengan alasan menjaga warisan leluhur Cirebon. Permasalahan yang timbul adalah bagaimana menjaga tradisi lokal Cirebon ditengah pemahaman keagamaan dan globalisasi agar tetap terjaga dan sejalan dengan amanah pendidikan nasional. Adapun tujuan yang hendak dicapai dalam penulisan adalah menjaga, mempertahankan, dan melestarikan tradisi lokal Cirebon melalui pendidikan sekolah. Manfaatnya memberikan pencerahan berkenaan dengan paham keagamaan di Cirebon dalam melihat tradisi-tradisi lokal di Cirebon dan memberikan solusi terhadap tantangan-tantangan yang dihadapi dunia pendidikan nasional pada umumnya. Cara yang digunakan yakni dengan mendeskripsikan kata dalam bentuk kalimat berkenaan dengan tradisi lokal dan tantangannya, pengalaman tim digunakan untuk menggali informasi yang berkenaan dengan permasalahan. Menggunakan pemikiran Ghoethe tentang pencarian akan kebaruan terbetik pada kebenaran kuno sebagai pisau analisis dalam kerangka pemecahan permasalahan. Hasilnya tradisi lokal Cirebon semakin kehilangan jatidirinya yang disebabkan oleh pemahaman keagamaan yang berkembang di Cirebon dan globalisasi yang tidak terbendung. Maka diperlukan dukungan dan sinkronisasi antara tujuan pendidikan, paham keagamaan dan tantangan globalisasi

Abstract

The sovereignty of God in the state administration of the Kingdom of Indonesia can be seen from the words of Ken Arok attacking the kingdom of Kediri, "O Pastors who adhere to Shiva and Buddhism. Please bless me to have the title Bhatara Guru ”. The study of God's sovereignty can be clearly seen from the history of Ken Arok, who was the king of Tumapel, who succeeded in using God's sovereignty to gain power over Kediri. So the question is the extent to which the existence of the struggle for God's sovereignty in Indonesia which underlies divine values. Ken Arok as the ruler of Tumapel who is a subordinate of Kediri has committed an offense of royal state order. What was done by Ken Arok in terms of International Law as "belligerent". Ken Arok's movement to gain power by committing offenses on the state administration of the kingdom, legalized by the laws of the royal state at that time, as well as international law today. In addition to evidence of the theory of God's sovereignty which was applied by Ken Arok to strengthen his power, in modern times too, the theory of God's sovereignty was practiced by Soekarno during the Old Order. As proof of the theory of God's Sovereignty during the Soekarno era came from the minister of religion of the Republic of Indonesia who at that time was held by Wahid Hasyim, who considered it important to build a magnificent mosque as gratitude for Indonesia's independence in the struggle against the invaders.Keywords: sovereignty, God, struggle, kingdom

Abstract

Strategi yang diusulkan oleh Mohammad Yamin menghendaki agar Balai Agung tidak hanya melaksanakan kekuasaan yudikatif. Politik hukum ketatanegaraan dapat merubah tatanan negara. Para pemikir negara Indonesia bersikeras untuk menambah kewenangan menguji materi undang-undang terhadap UUD 1945. Negara berdasarkan hukum, keberadaan norma-norma hukum yang mengatur tatanan kehidupan masyarakat untuk mencapai ketertiban adalah karakter umum dari sebuah negara hukum. Penelitian yang dilakukan yaitu penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Proses sejarah pembentukan dual rudiction lembaga yudikatif direalisasikan kedalam dua  lembaga yudikatif yakni Supreme Court (MA) dan Contitutional Court (MK). Kedua lembaga yudikatif memiliki peran berbeda dan mempunyai tujuan yang sama yakni menegakkan hukum nasional.

Abstract

ABSTRAK Penelitian tentang politik hukum dan politisasi desa dalam sistem ketatanegaraan Indonesia, dilatarbelakangi pada tulisan buku judul buku Regulasi Baru, Desa Baru Ide dan Misi Semangat Undang-Undang Desa. UU Desa hendak membuat desa bertenaga secara sosial, berdaulat secara politik, berdaya secara ekonomi, dan bermartabat secara budaya (Catur Sakti Desa). Praktik banyak sekali kebijakan-kebijakan desa yang diatur oleh negara, menjadikan desa sebagai bentuk pemerintahan yang mengarah pada local administrative bukan sebagai local genius atau local government. Titik permasalahan yakni apa yang menjadi pembeda antara politik hukum dan politisasi hukum desa, dan bagaimana cara membangun politik hukum desa dalam rangka menghindari politisasi hukum desa dalam ketatanegaraan Indonesia. Untuk memudahkan pengerjaan penelitian ini maka diperlukan suatu metode penelitian, teknik pengumpulan data dan metode pendekatan yang relevan. Dalam hal ini digunakan metode penelitian deskriptif analitis dengan pendekatan yuridis normatif. UU yang mendistorsi desa dari kesatuan organik-sosiologis menjadi sebatas pemerintahan desa itu tidak hanya merusak adat di Luar Jawa, tetapi juga merusak bangunan sosial dan otonomi desa di Jawa. LKD dan LAD merupakan bukti nyata bahwa selesainya UU No.6 Tahun 2014 tidak menyelesaikan politik hukum dan politisasi hukum itu sendiri. Maka, pengawalan-pengawalan terhadap aturan-aturan turunannya harus senantiasa dikawal secara politik hukum maupun politisasi hukum. Kata kunci: desa; hukum; politik; politisasi. ABSTRACT Research on legal politics and the politicization of villages in the Indonesian constitutional system is based on the writing of the book entitled the New Regulations, the New Village Ideas and the Spirit Mission of the Village Law. The Village Law wants to make the village socially empowered, politically sovereign, economically empowered, and culturally dignified (Catur Sakti Desa). The practice of many village policies is governed by the state, making the village a form of government that leads to local administrative not as local genius or local government. The point of the problem is what is the difference between legal politics and politicization of village law, and how to build village law politics in order to avoid politicizing village law in Indonesian constitution. To facilitate the execution of this research, a research method, data collection techniques and relevant approach methods are needed. In this case used descriptive analytical research method with a normative juridical approach. The law which distorted the village from the organic-sociological unit became limited to the village administration which not only damaged adat outside Java, but also damaged the social structure and village autonomy on Java. LKD and LAD are proof that the completion of Law No. 6 of 2014 does not resolve legal politics and the politicization of the law itself. So, escorting the derivative rules must always be escorted by legal politics and politicization of the law. Keywords: law; politics; politicization; village.

Abstract

ABSTRAK Penelitian dilatarbelakangi adanya surat pernyataan di larang menikah bagi siswa-siswi Sekolah Menengah Pertama di kota Surakarta-Solo, kemudian di cabut kembali oleh pihak sekolah. Aturan sudah berlaku selama lima tahun, pencabutan dilatarbelakangi oleh keinginan dari orang tua murid. Faktanya tidak sedikit usia anak Sekolah Menengah Pertama saat sekarang sudah banyak yang menikah. Melalui metode penelitian hukum yang normatif mengkaji permasalahan berkenaan surat larangan menikah dan kemudian melihat alur kebijakan politik hukum yang melahirkan kebijakan terhadap batas usia perkawinan. Pembahasan memfokuskan pada politik hukum nasional tentang batas usia perkawinan untuk laki-laki dan perempuan dengan melihat fenomena di dunia Pendidikan. Dilihat dari usia minimal, kemudian seperti kegelisahan pemerintah melihat dunia pendidikan, lahirnya putusan Mahkamah Konstitusi disambut oleh lahirnya undang-undang untuk membatasi usia pernikahan menjadi sembilan belas tahun. Peraturan dalam bentuk undang-undang berkenaan dengan pembatasan usia minimal pernikahan pada dasarnya bukan merupakan undang-undang Apabila ada yang kelihatanya tidak setuju dengan aturan dilarang menikah di tingkatan Sekolah Menengah Pertama juga pada dasarnya memiliki tujuan yang sama yakni untuk mengantisipasi pernikahan dini. Kata kunci: kebijakan; perkawinan; politik hukum. ABSTRACT This research is based on the existence of a forbidden marriage for junior high school students in Surakarta-Solo City which was later withdrawn by the school. This rule has been in effect for five years, its repeal is motivated by the wishes of the parents of students. Facts in the field, many junior high school children are now married. Through the normative legal research method, it examines these problems and then looks at the flow of legal political policies that give rise to policies regarding the age limit of marriage. The discussion focused on legal policy that develops in society regarding the rules of marriage as seen from the minimum age, then like the government's anxiety in seeing the world of education, the birth of the Constitutional Court decision was greeted by the birth of a law to limit the age of marriage to nineteen years. Regulations in the form of laws regarding the minimum age limit for marriage are not laws that are coercive, pervasive as a form of anti-education and child protection in Indonesia. If someone seems to disagree with the prohibition rules for marriage at the junior high school level, they have the same goal, namely to anticipate early marriage. Abstract

The term delik is still identified with criminal law, the offense itself comes from delict in various legal literatures. That according to the positive law a strafbaar feit is actually nothing other than an action which according to a formulation of the law has been declared a punitive action. The thought that was considered wrong in learning stated that the term delict was criminal. The wrong terminology eventually spread among the students who always named delict as a criminal. Research on interpreting delicts and state administration offenses is a study carried out using old literature. Old literature has been chosen to strengthen the argument in finding a bright spot about the meaning of the offense itself. Writing defines offenses and constitutional offenses including in normative legal research carried out through various efforts to thoroughly examine and analyze legal provisions relating to research problems (study of law in the book). Through the meaning in the discussion it was found that the meaning of offense is basically not limited to criminal matters but can also be used in the meaning of state administration. So in constitutional offenses, an offense is used to gain power or maintain power. In addition, state administration offenses cannot be separated from the sovereignty theory itself. Then it can be concluded that the meaning of offense at this time is only trapped in a criminal that actually has a neutral meaning that is not limited to criminal matters.

Abstract

This study aims to investigate Self-Seeking towards Self-Knowledge which plays an essential role for the life moment of the famous and distinguished Christian mystic namely Saint Augustine. He seeks and asks about himself as a human being, both horizontally [his relationship with another man], and vertically [his relationship with God the Creator]. He also reveals the answers toward his questions and searching. It can be explored in his masterpiece entitled ‘The Confession’. This study also relies on this book, as the primary reference, to explore and analyze Self-Seeking and Self-Knowledge in Western Mysticism. Therefore, the present study addresses research questions as follow: What is the definition of true Self-Seeking in general? What kind of Self-Knowledge offered by Saint Augustine inside the circumstance of the Western Mysticism Treasury? What is the significance of the Self-Seeking and the Self-Knowledge which is relevant with the current context?

Abstract

This article is intended to examine the movement of political parties towards the castration of village democracy. Based on two studies conducted before and after the birth of Law Number 6 of 2014 concerning Villages. Marking the economy and the domination of the village elite are clearly illustrated in winning Pilkades. The dominance of clients who are concerned with the services of their parents or siblings who have been approved as village heads. Issues that will be the subject of discussion concern the role of party wings in the process of castration of village democracy. The selection of political parties is not seen in the castration of village democracy. It turns out that the people who control the candidates are those who are involved in political wing organizations. Political organizations have no restrictions as long as they do not prioritize political parties. This situation basically depicts my organization as indirect politics which has castrated village democracy. The organizational movement of the political wing in the village is a problem that is determined by the political parties which include its regulation. The election of village heads in the political process related to the political interests of the people, local politics regulates more influences on the daily life of national politics. The political wing organizations have unwittingly castrated democracy at the village level. Ideally, the village as a laboratory for national democracy should serve as a model and limit the excessive role of politics in achieving democracy nationally.

Abstract

The Republic Indonesia has continually changed since reformation particularly regarding the institution that uphold national law. The historical process resulted in the formation of dual jurisdiction of the judiciary, namely the supreme court (MA) and the contitutional court (MK). Dual jurisdiction is interesting fact to be noticed. This model is used to analyze the problems of state administration. This article shows that the history of Indonesian governance has played significant role in Indonesian politics. Indonesian state administration is inseparable from the influence of A Model Islamic Contitution on the amendment. Hence, Indonesia is basically not an Islamic state but a country that adopts several Islamic constitutional provisions which are then adjusted to the Indonesian domain. This role has now been realized in a judicial institution namely the Constitutional Court of the Republic of Indonesia as the mandate of the 1945 amendment.

Abstract

This article aims to explore the relationship between the Ministry of Home Affairs (Kemendagri) and the Ministry of Villages (Kemendes) from theconstitutional law and state administrative law point of view.The second concerns of this research is the disharmony and problem between the two ministries.From the constitutional law point of view, it turns out that what the Ministry of Home Affairs is doing, is closer to the object of its discussion. The method used in this research is normative legal research bycomparingthe constitutional law and state administrative law to obtain clarity regarding the Ministry of Home Affairs and Ministry of Village. The result shows that the Ministry of Village approached the science of state administrative law, namely to revive or give spirits to the village. Disharmonization began to exist since the inception of the Ministry of Village. The root of disharmony itself was the improper application of constitutional foundations in the formation of the Village Law. It would be better if the government reassess the constitutional foundation for the village.
