Abstract

Penelitian didasarkan usia pendewasaan antara hukum dan praktik pengawalan demokrasi Indonesia. Pendewasaan hukum jadi patokan melakukan perbuatan hukum, secara khusus berlaku bagi subjek hukum sesuai ketentuan hukum positif. Lex specialis, merupakan upaya khusus memberi kepastian dan keadilan selama memenuhi lex specialis. Bila tidak terpenuhi sifat khusus, legi generali menjadi rujukan atas produk hukum sejajar. Pendekatan perundang-undangan sebagai pilihan penelitian dengan bertumpu pada asas lex specialis derogat legi generali atas pendewasaan hukum pemilih pemula. Temuan dalam penegakan pendewasaan hukum terkesan memanfaatan pemilih pemula sebatas eksistensi kekuasaan. Ketidakonsistenan terlihat pada larangan keterlibatan pelajar SMA atau sederajat dalam setiap demonstrasi, termasuk demonstrasi bulan September 2019. Aturan Pemilu tegas memberi ruang bagi pelajar sebagai pemilih pemula, tentunya memiliki kedudukan hukum sama seperti yang lain. Praktik melahirkan pengingkaran atas lex specialis maupun legi generali berkenaan pendewasaan hukum Pemilu. Anggapan pemilih pemula masih anak-anak dan labil semakin melemahkan pemilih pemula sebagai subjek hukum dalam mengawal demokrasi dan menunjukan dilema pendewasaan hukum di Indonesia.

Abstract

The Republic of Indonesia is based on Pancasila as an agreement between all elements of the nation with various ethnic groups, languages ​​and various religions. The birth of Pancasila is considered by some Muslims to be an agreement between the founding fathers of the nation. Pancasila is considered very appropriate and appropriate to accommodate all races, ethnicities and religions in Indonesia. This is what then attracts researchers to examine more deeply Muhammadiyah's thinking about the relationship between Islam and Pancasila and what the relationship between Islam and Pancasila as a legal system is from Muhammadiyah's perspective. According to Muhammadiyah, the Pancasila state can be realized as "Baldatun thayyibatun wa rabbun ghafur," which signifies an advanced, just, prosperous, honorable and autonomous existence under the blessing of God. In Muhammadiyah's perspective, the relationship between Islam and Pancasila as a legal system in Indonesia is considered harmonious and complementary in a deep and substantial way. Abstract

The position of the Fatwa of the MUI is not in the order of laws and regulations as Indonesian formal law. The fatwas decided by the MUI sometimes cause controversy in the midst of society, some see it as the mouthpiece of the authorities, and there are also people who judge it as inconsistence. Indonesian legislation in the development of national law politics prioritizes formal instruments as stipulated in national law when compared with jurisprudence and living law. Using a descriptive method and a legislative approach regarding the subject matter. The fatwa of the MUI as a legal doctrine is a legal research that has the substance of Fatwa, which is a process to find legal doctrines in response to legal issues faced. The law cannot be separated from the community, so the living law that dominates life even though it has not been included in the state law. Legal doctrine is said to be one source of law, even though it is not listed in Indonesian formal legislation. The Fatwa MUI is a means of placing in order to know the status of the state of the MUI Fatwa as a legal doctrine. The word occupation can also be interpreted as placing the MUI Fatwa as one of the sources of law in the sense of methyl in the form of legal doctrine and its power in influencing the policy of the formation of legislation in Indonesia. Not all Fatwa MUI can be regarded as doctrines if the MUI Fatwa does not consider the philosophical, sociological, and juridical reasons or the MUI Fatwa is made arbitrarily. Keywords: Occupy, Fatwa, MUI, Doctrine, law

Abstract

Media sosial adalah sebuah media online, dengan cara penggunanya bisa dengan mudah berpartisipasi, berbagi dan menciptakan isi. Perkembangan media sosial akhir-akhir ini sangat pesat. Sehingga menjadi topik hangat untuk dibahas karena banyaknya masyarakat yang menggunakan media sosial namun kurang memahami makna medianya itu sendiri. Perkembangan media sosial secara langsung berdampak terhadap tatanan dari perilaku manusia, baik sebagai sarana informasi maupun sebagai sarana sosialisasi dan interaksi antar manusia. Media sosial seakan menjadi tempat menumpahkan segala aktivitas yang tidak jarang mengesampingkan beragam etika yang ada. Hal ini dilihat dari penggunaan bahasa non baku dan tidak resmi dalam berkomunikasi. Komunikasi adalah suatu proses penyampaian informasi (pesan, ide, gagasan) dari satu pihak kepada pihak lainnya. Komunikasi akan lebih efektif apabila pesan yang disampaikan dapat ditafsirkan sama oleh penerima pesan. Adapun Etika komunikasi yang baik dalam media sosial adalah jangan menggunakan kata kasar, provokatif, porno ataupun SARA; jangan memposting artikel atau status yang bohong; jangan mencopy paste artikel atau gambar yang mempunyai hak cipta, serta memberikan komentar yang relevan. Kata kunci: Media Sosial, Etika, dan Komunikasi

Abstract

This study aims to examine the legal review of Sundanese local wisdom, specifically the concept of Sandekala traditionally practiced by West Java community. The analysis evaluated the effect of government policies on the implementation of local wisdom values in the context of education, technology, and restrictions during the COVID-19 pandemic, with particular attention to the role in fostering environmental awareness post-pandemic. Moreover, this study examined how these policies complement or deviate from the legal principles underlying local wisdom and environmental sustainability. An analytical method was used to review legal journals and online discussions, investigating how shifts in the understanding and application of local wisdom values have occurred in response to government measures. Furthermore, there are also big myths about these values that cause problems for keeping local wisdom true and useful. The results showed the importance of matching government policies with local values, including Sandekala, as a form of customary law that remains relevant, and ensuring the continuity of inclusive cultural and legal practices while protecting the environment in the post-pandemic context. This study provides valuable insights into how policies can enhance local wisdom and ensure compliance with relevant legal frameworks. In conclusion, keeping local wisdom is not just culture but also part of sustainable and inclusive law in Indonesia. Local wisdom should be kept and studied using science and technology.

Abstract

This research explores the state's emergency policy during the COVID-19 pandemic, particularly its moral dilemma in confronting the cultural tradition of handshakes and the symbolic implementation of the “Totem Handshake.” The state’s approach, limited to non-binding recommendations and symbolic language such as “physical distancing” and “social distancing,” raises critical questions about legal effectiveness. The study finds that symbolic appeals, though lacking coercive force, have a psychological and cultural impact resembling a form of “state magic” that influences public behavior. While such appeals were widely accepted, their legal standing remains weak, and the success of compliance is ambiguous—did people obey state messaging, or were they simply afraid of the virus? The research argues that the state faces greater social and legal risks if it enforces coercive regulations to restrict cultural practices. The public response varied, reflecting differing interpretations of state authority. Ultimately, this study highlights the state's reliance on symbolic language as a soft-law mechanism during moments of moral crisis. It suggests that in future emergencies, legal obedience may require not only formal authority but also cultural sensitivity and moral legitimacy, especially when asking citizens to temporarily abandon deeply rooted social traditions like handshakes.

Abstract

Ketatanegaraan Indonesia sejak reformasi terus mengalami perubahan terutatan tentang lembaga yang bertugas untuk menegakan hukum Nasional. Jauh sebelum reformasi, para pemikir negara Indonesia bersikeras untuk menambah kewenangan menguji materi undang-undang terhadap UUD 1945. Proses sejarah malahirkan pembentukan dual yudiction lembaga yudikatif direalisasikan kedalam dua lembaga yudikatif yakni Supreme Court (MA) dan Contitutional Court (MK). Pengaruh para pendiri negara Indonesia menjadikan pembentukan lembaga yudikatif diwarnai berbagai pengaruh terutama dari negara-negara yang memiliki lembaga dalam menilai produk hukum yang dibuat oleh legislatif. Melalui teori Dual Yuridiction lembaga yudikatif sesua fakta ketatnegaraan Indonesia sangat menarik untuk mendapatkan perhatian. Teori tersebut digunakan sebagai pisau analisis untuk mengkaji permasalahan ketatanegaraan. Selain itu juga menggunakan penelitian yang meninjua dan mempelajari berbagai literatur yang berkaitan dengan pembahasan. Lembaga yudikatif memiliki peran berbeda dan mempunyai tujuan yang sama yakni menegakkan hukum nasional. Sejarah Ketatanegaran Indonesia pada dasarnya telah memainkan peranannya dalam perpolitikan di Indonesia. Ketatanegaraan Indonesia sendiri tidak terlepas dari pengaruh A Model Islamic Contitution pada amandemen. Hasilnya, Indonesia pada dasarnya bukan negara Islam melainkan negara yang mengadapsi beberapa ketentuan konstitusi Islam yang kemudian disesuaikan dengan ranah keIndonesiaan. Peran tersebut saat sekarang telah direalisasikan dalam sebuah lembaga yudikatif yakni Mahkamah Konstitusi Republik Indonesia sebagai amanah UUD 1945 hasil amandement.

Abstract

This study aims to provide input related to the plan to change Law no. 13 of 1998. The number of elderly people is increasing day by day, it is necessary to make revisions in order to realize prosperity. Lanisa with her limitations is a human being who has the same position and degree and must be protected and given welfare. Through the discussion method to provide input on the revised plan, it focuses more on the approach of local wisdom and religious teachings. The value of local wisdom chosen is the Sundanese tradition in the custody of the elderly, the religion chosen is Islam. However, he does not deny other traditions and teachings to study them as an effort to provide input for the welfare of the elderly. In the Sundanese tradition and Islamic teachings there are indeed differences in parental custody, the location of these differences is not substantial. However, to get an understanding of custody of the elderly, a solution must be found first in order to avoid the perception of custody which is always identified with custody of children. The essence of both lies in the race to take care of and respect parents regardless of whether it is a boy or a girl.
