Abstract

The existence of traditional markets in urban areas from time to time further increasingly threatened by rampant construction of modern markets. Therefore, in this paper the authors are interested to explore some aspects zoning laws of modern markets and traditional markets. Based on the analysis, zoning traditional markets and modern market is the authority of local governments as stipulated in Presidential Regulation Number 112 Year 2007 concerning Settlement and Development of Traditional, Modern Shopping Centers and who is the embodiment of Law No. 5 Year 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition healthy. If the establishment of a modern market violates the provisions of Law No. 5 Year 1999 and Presidential Decree. 112 Year 1999 will be reported to the KPPU to be examined.In addition, with no establishment of zoning district regulations regarding local government market has resulted in unlawful acts and therefore can be sued by actio popularis lawsuit or citizen law suits.Keywords: zoning, traditional markets, modern markets

Abstract

The role notary in making the sale and purchase agreement deed and the deed of power to sell and sell not appropriate, so there is no legal certainty for the parties who enter into the agreement before the notary. Decision 1603K/PDT/2013, an agreement that was originally payable with a guarantee certificate, but the deed was made a sale and purchase agreement. This type of research is normative or doctrinal legal research. The results of the research and discussion show that the Notary Public does not carry out his role in accordance with the Law on Notary Position, namely not fulfilling the authentic deed making procedure, not reading the deed he has made. Legal consequences for Notaries who do not play the role of a notary according to the Notary Code of Ethics for the Honorary Council may impose sanctions on the Notary. Suggestions from a Notary Public authorized in making Deeds are obliged to implement the provisions of the Law on Notary Position and the code of ethics. The legal consequence for a notary should be that a notary who does not carry out his role has his license revoked.Keywords: Role of Notary, Sale and Purchase Agreement (PPJB), Power to Sell

Abstract

Notaries in the making of sharia contract acts are required to have an understanding of sharia contracts and laws. This study is to determine the application of the choice of forum in the settlement of Islamic banking disputes after the Constitutional Court decision Number 93 / PUU-X / 2012 concerning the Review of Law No. 21 of 2008 on Islamic Banking. As well as the role of the notary in making the Islamic banking deed and after the decision. The method used in this research is the normative legal method. There are three approaches used in this, as following: normative juridical research, namely the case, statutory and conceptual approach. The results of the research showed that after the issuance of Decision Number 93 / PUU-X / 2012, the settlement of Islamic banking disputes is an absolute authority within the Religious Courts (in litigation). This affirmation of the authority of the Religious Courts is supported by Perma Number 14 of 2016 concerning the Settlement of Sharia Economic Cases. The role of a notary in making sharia deeds must apply sharia principles in line with the Sharia Banking Law Number 21 of 2008 and it is important for a notary to have sharia certification so that its legality can be recognized. The role of the notary after the Constitutional Court Decision Number 93 / PUU-X / 2012 by stating that the settlement of sharia banking disputes is the absolute authority of the Religious Courts in making sharia deeds. Abstract

Notary profession is prone to legal entanglement. This is because notary internal factors such as carelessness, not complying with procedures, not carrying out professional ethics and external factors such as the behavior of the community. This research is intended to find out and analyze the limitations of the element of letter forgery by Notary Public and Notary Accountability for falsification of information in deed or letter according to positive law in Indonesia. Normative juridical research methods. The data source is secondary data. The results of the study in the form of narrative text. Analysis of legal materials used is qualitative normative. The results of the study showed the limitation of the element of forgery of letters by notary public, can be seen in terms of the actions of the perpetrators and the harmed parties. There is an element of wrongdoing made by the perpetrators and the injured parties are the parties in the deed made by notary public. Notary Accountability for falsification of information in deed or letter according to positive law in Indonesia there are three, namely criminal, civil, administrative / ethical accountability. Notary should be careful in carrying out its work so that there are no mistakes and harm to the parties so that it can cause sanctions in the form of accountability.Keywords: Notary, Letter Falsification, Accountability

Abstract

Legal aid for the poor people is a right, but in practice it is hard to do. There is a contradiction between law No. 16 of 2011 which gives obligation of the granting of legal aid is located at LAO which have been accredited, and the provisions of Article 22 (1) of law No. 18 of 2003 which gives obligation to the advocate as an individual. In the realm of practice, the granting of legal aid is not running properly because many advocate/LAO who still wear rate/fee, shifting ideology advocates from officium nobile to the commercialization, and the convoluted Government disbursements. Bantuan hukum bagi rakyat miskin merupakan hak yang dijamin oleh konstitusi, tetapi praktiknya terasa sulit. Metode penelitian hukum normatif dan empiris digunakan untuk mengungkap persoalan tersebut. Terdapat kontradiksi antara UU No. 16 Tahun 2011 dengan UU No. 18 Tahun 2003. Berdasar UU No. 16 Tahun 2011, kewajiban pemberian bantuan hukum terletak pada OBH yang telah terakreditasi, bukan pada advokat sebagai individu sebagaimana ketentuan Pasal 22 ayat (1) UU No. 18 Tahun 2003. Pada ranah praktik, pemberian bantuan hukum ini tak berjalan semestinya karena banyak advokat/OBH yang mengenakan tarif/bayaran kepada orang yang dibelanya, pergeseran ideologi advokat dari officium nobile ke komersialisasi perkara, dan pencairan dana pemerintah yang berbelit-belit.

Abstract

Cybercrime has resulted in astronomical losses for the business community. However, the reactive policy model must be more effective at preventing cybercrime, and the due process model is also inappropriate for combating cybercrime with a high level of speed and mobility. This study is normative legal research employing a conceptual strategy and case studies. The results indicate that the reactive model must be improved in order to prevent cybercrime. The model of due process is not appropriate for deterring cybercrime with a high degree of speed and mobility. The preventative law enforcement strategy is effective, but it requires a high level of law enforcement capability to detect and disable cybercrime, which is something that few Indonesian law enforcement officials possess. Prevention based on the user, which places responsibility on internet users, is fine for individuals but not for businesses. Based on collaboration between corporations, universities, civic society, and non-governmental groups, the collaborative model synthesizes the aforementioned paradigms. Because they are based on plans or roadmaps created by internet stakeholders, regulations, technical aspects, and law enforcement may be effectively implemented and developed.

Abstract

Regulation of the Minister of State for Agrarian Affairs/ Head of the National Land Agency No. 3 of 1997 concerning Provisions for the Implementation of Government Regulation Number 24 of 1997 concerning Land Registration contains regulations regarding the classification of the population in the preparation of a certificate of inheritance. At present, such arrangements are considered irrelevant, especially since there are already regulations concerning citizenship and population administration in a law. Therefore, this article discusses the ontological basis for regulating population classification in Indonesia. In order to answer these problems, three normative research approaches are used, in the form of a statutory approach, a historical approach and a conceptual approach. This study uses primary and secondary sources of legal material, which after an inventory has been processed and analyzed using a qualitative approach. The classification of the Indonesian population, when viewed from an ontological study, was a policy of the Dutch East Indies government to divide the Indonesian nation and reduce the power of customary law and Islamic law that developed in society. However, if judging from the existence of the Regulation of the State Minister of Agrarian Affairs/Head of the National Land Agency Number 3 of 1997, the classification of the population which has implications for the institution authorized to make certificates of inheritance is not due to the politics of dividing the Indonesian nation. This rule exists because it is still possible for people to submit to the law of inheritance of Burgelik Wetboek. This regulation in the statutory system is hierarchically positioned lower than the law. Even though this regulation is inferior and contradicts the Citizenship Law and the Population Administration Law, and therefore contradicts the principle of lex superior derogate legi inferiori, but to prevent a legal vacuum this Ministerial regulation is still in effect.

Abstract

Penelitian ini bertujuan untuk Mengetahui pelaksanaan eksekusi barang sitaan hasil tindak pidana pencurian kendaraan bermotor di kejaksaan negeri wonosobo dan Mengetahui hambatan dalam eksekusi barang sitaan hasil tindak pidana pencurian kendaraan bermotor, serta solusinya. Metode penelitian yang digunakan dalam penelitian ini adalah metode metode penelitian kualitatif menggunakan yuridis sosiologis. Kemudian data yang digunakan dalam penelitian ini adalah data primer dengan pengumpulan data melalui wawancara yang selanjutnya dianalisis dengan metode analisis normatif kualitatif. Adapun penyajian data ini disajikan dalam bentuk teks deskriptif naratif yang disusun secara sistematis sebagai suatu kesatuan yang utuh. Berdasarkan hasil penelitian, dapat disimpulkan bahwa pelaksanaan eksekusi barang sitaan hasil tindak pidana pencurian kendaraan bermotor telah sesuai dengan sistematika pelaksanaan eksekusi menurut Peraturan Jaksa Agung Republik Indonesia Nomor PER 036/A/JA/09/2011 BAB IX (EKSEKUSI) Pelaksanaan Putusan Pengadilan, dalam menjalankan Eksekusi terdapat beberapa hambatan yaitu dari faktor sarana dan prasarana yang tidak ada nya RUPBASAN di Wonosobo sehingga barang sitaan dititipkan di Kejaksaan, Kepolisian, Pengadilan, sehingga memerlukan biaya untuk melakukan perawatan barang sitaan. Faktor masyarakat, masyarakat cenderung tidak ingin tahu tentang hukum itu sendiri, dan faktor kebudayaan, hukum yang baik adalah peranan penegak hukum dalam menegakkan hukum itu serta masyarakat yang paham mengerti tentang hukum itu. Masyarakat kurang mengerti terhadap hukum, merasa bahwa hukum itu prosesnya yang lama, dan memakan biaya yang besar. Jaksa di Kejaksaan Negeri Wonosobo, mengerti tata alur, dan prosedur eksekusi, sebenarnya eksekusi itu dijalankan sesuai dengan putusan hakim. Pengembalian barang sitaan, tinggal sesuai apa yang ada didalam putusan hakim, nama, alamat lengkap, sedangkan dirampas untuk negara, jaksa menjalankan eksekusi sebagai pemohon lelang.Kata Kunci : Eksekusi, Barang sitaan, tindak pidana pencurian kendaraan bermotor
