Abstract

In terms of public services within the Correctional Institution (Lapas) it certainly falls into the area of special public services involving certain publics. Even though it is special, it certainly does not reduce the quality of the public services that will be provided. Prisons as a training institution aim to make inmates into correctional facilities (WBP). The aim of this research is to determine public services for former inmates at the Banda Aceh Class II Correctional Center. This research method uses descriptive qualitative with data collection techniques through observation, interviews and documentation. Based on the results of research on all aspects of assessment based on the Regulation of the Minister of State Apparatus Empowerment and Bureaucratic Reform of the Republic of Indonesia Number 17 of 2017 concerning Guidelines for Performance Assessment of Public Service Providing Units with aspects of assessing service policies, professionalism of human resources, facilities and infrastructure, information systems, consultations and complaints, and public service innovations have been implemented well.

Abstract

The Acehnese in various regions face the challenge of reconciling Islamic teachings with local cultural realities. Addressing religion-based conflicts is particularly difficult because local cultures often contain norms and traditions that differ from Islamic teachings. This research aims to explore how the dynamics of conflict and consensus in fiqh siyasah shape the cultural life of the Acehnese. The research consolidates previous studies using a Systematic Literature Review (SLR). The findings indicate that the practice of siyasah jurisprudence is highly relevant in fostering social solidarity and tolerance. Local traditions and customs hold deep significance for the Acehnese community; however, conflicts often arise due to differences in approaches and interpretations of Islamic law, leading to tension, mistrust, and suspicion among individuals. Presently, religion-based conflicts are mediated solely by Sharia courts, raising concerns as the prevailing consensus favors a socio-cultural approach. Such resolution methods generate diverse perspectives, as decisions made by customary institutions may not endure in a dynamic socio-cultural context. Although the Acehnese community firmly adheres to a culture-based approach, religious issues remain difficult to compromise. These findings imply a need for harmonization between local customs and interpretations of Islamic law to reduce conflict.

Abstract

The implementation of the Smoke Free Areas (KTR) policy is felt to be still not optimal in coffee shops in Banda Aceh City, which is a workplace category stipulated in the Banda Aceh City Regulation is Qanun Kota Banda Aceh 5/2016 on Smoke Free Area and Banda Aceh Mayor Regulation. Having the nick name the city of 1000 coffee shops and the average coffee shop customer is an active smoker, KTR should be implemented as a form of creating a good and healthy living environment and protecting public health from the dangers of smoking. This study aims to describe the implementation of the KTR policy at the coffee shops in Banda Aceh City with a qualitative descriptive approach. The data analyze with data collection with in-depth interviews, observation by making more detailed observations at the research location is coffee shops and documentation related to documents and images. Then data reduction which is focused on the process of selecting, simplifying, abstracting and transforming raw data tailored to the needs and focus of the research. Finally, verification and conclusion drawing. The informants in this study consisted of one Head of Banda Aceh City Health Service and one Head of Satpol PP WH City of Banda Aceh, two coffee shop owners and two coffee shop customers. The results showed that the implementation of the KTR policy in coffee shops in Banda Aceh City had not yet obtained maximum results in terms of aspects, namely communication aspects in the form of very less socialization, aspects of budget resources and lack of human resources for the innovation team and bureaucratic aspects despite the existence of derivative regulations from the Qanun namely Banda Aceh Mayor Regulation on Technical Guidelines but there is no SOP for sustainability. The recommendation obtained from this research is that the government needs to conduct a more massive campaign on coffee shops in Banda Aceh City regarding KTR so that owners and customers understand the importance of KTR.

Abstract

The coexistence of Islamic law, customary law, and the national legal system within empirical societies remains an ongoing phenomenon. The consequences of such legal pluralism have implications for the protection of women and children. This study aims to examine the dynamics of legal relationships, the determination of diverse laws among the people of Aceh and West Nusa Tenggara, and the factors influencing the contestation of legal choices that impact legal favoritism towards women and children. This study employed a juridical empirical legal research method with a legal pluralism approach. Data were obtained by means of in-depth interview and document study. The interviews were conducted with customary leaders, religious leaders, and academics, whilst document analysis included journal articles, laws, and relevant books. The study took place in two locations: Aceh and West Nusa Tenggara Provinces. The findings of the study reveal that the dynamics of the relationship between customary law, religious law, and state law run concurrently in the context of the application of family law and criminal law. Some members of the community follow customary law and religious law, while others follow state law. The determination of law among the people of Aceh and Lombok is based on the legal consciousness of the community concerned. The choice of law in societal reality has an impact on favoritism towards women and children. The choice of state law tends to guarantee legal certainty and can provide legal protection for women and children. Conversely, the choice of religious law and customary law may sometimes be detrimental to women and children.

Abstract

This research examines extreme poverty in Aceh, particularly in North Aceh Regency, where the poverty rate reaches 16.86%, exceeding both national and provincial averages. The study aims to assess the synergy of government policies in poverty alleviation and the government's strategies in promoting sustainable development. The research method utilizes primary data collected through interviews and Focus Group Discussions (FGD) with the government of North Aceh Regency, as well as secondary data from the Central Statistics Agency and relevant institutions. The findings indicate that the synergy among stakeholders in sustainable development remains weak, with each institution operating independently without effective coordination. Furthermore, the legal framework related to poverty alleviation has not been ratified, and the formation of a coordination team has not been implemented. In conclusion, stronger synergy between the government and stakeholders is needed to improve sustainable poverty alleviation policies in Aceh.

Abstract

Children's issues are a matter of significant public concern, especially given their crucial role as the nation's next generation. As valuable national assets, children possess numerous rights that their countries must guarantee. This research aims to analyze child protection policies in ASEAN countries through a systematic literature review. The data synthesis process involved comparing 60 articles that met stringent quality assessment, inclusion, and exclusion criteria. The data was subsequently processed and presented in tabulated form. The results revealed various forms of violence against children prevalent in the ASEAN region, including sexual, domestic, and cyber violence, exploitation, and neglect. Furthermore, the nodality model is the most dominant child protection policy formulation model adopted by ASEAN countries, primarily focusing on law enforcement and the fulfillment of children's rights. However, existing policies are more oriented toward handling cases after children become victims rather than prioritizing preventive efforts. Most notably, while conventional policies often focus solely on children's rights post-birth, a compelling multi-area perspective emerges from Islamic teachings. These teachings comprehensively regulate child protection starting even before birth, through pre-marital guidance and pregnancy preparation, extending to the parenting stages with a strong emphasis on moral and spiritual character development, and encompassing the entire spectrum of formal and informal child education. This finding highlights a critical gap in child protection within the ASEAN region, underscoring the urgent need to strengthen preventive measures. This research is expected to contribute to the development of more comprehensive and effective child protection policies across the ASEAN region, potentially integrating these holistic Islamic principles.

Abstract

Perkembangan zaman telah merubah pola hidup manusia menjadi berpusat kepada teknologi. Cara manusia bersosialisai dan perkembangan akan kebutuhan telah membuat aspek politik dan pemerintahan harus menyesuaikan dengan keadaan. Masalah - masalah pelayanan publik yang dulunya tersembunyi secara publik, mulai terangkat ke permukaan dengan adanya teknologi. Pelayanan yang tidak pro rakyat, sifat informalitas yang diutamakan dalam memberikan pelaynan, pelayanan yang berbelit-belit menjadi perhatian pemerintah sejak publik mulai berani mengkritik penyelenggaraan pelayanan publik. Teknologi menjadi solusi memperbaiki citra buruk pelayanan publik, maka dalam penelitian ini, peneliti akan menjelaskan bagaimana penerapan Smart Governance dapat meningkatkan kualitas pelayanan publik. Metodelogi yang dipakai adalah pendekatan studi pustaka dan menganalisis data yang diperoleh secara deskriptif. Data yang dipakai berupa artikel-artikel berkaitan dengan apa yang menjadi tujuan penelitian ini, dikumpulkan dan dianalisis, kemudian di deskripsikan dalam bentuk narasi yang saling berkaitan membentuk suatu alur penelitian. Penerapan sistem Smart Governance perlu dilakukan demi meningkatkan kualitas dari pelayanan publik. Penerapan teknologi menawarkan perbaikan pelayanan publik agar lebih terbuka dan partisipatif. Dengan masyarakat yang lebih aktif akan membuat paradigma pelayanan yang dulunya “top-dowm” menjadi “bottom-up” yang lebih berorientasi kepada masyarakat yang menentukan apa yang menjadi kebutuhannya, tidak lagi menunggu keputusan dari pemerintah yang terkadang tidak sesuai dengan realitas didalam masyarakat.

Abstract

The pros and cons of the implementation of Qanun Number 11 of 2018 concerning Islamic Financial Institutions among the people of Aceh are a strategic problem to be studied because this policy concerns economic activities in Aceh. Some people think that the existence of Islamic banks is not much different from conventional banks. Other people claim that the Aceh Government made a unilateral decision when it decided that all financial activities in Aceh must use sharia principles. However, many also agree with the existence of this Qanun, to save the people of Aceh from the practice of usury that has occurred in conventional banks. This study aims to examine the stages of policy formulation in the formulation of the Qanun on Islamic Institutions in Aceh and to find out what efforts have been made by the Aceh Government in involving actor networks at the stage of formulating the Qanun on Islamic Financial Institutions in Aceh. This type of research is descriptive qualitative with data collection techniques through FGD activities, interviews and document reviews. The results of this study indicate that based on the objective of implementing Islamic law in financial transactions in Aceh, this qanun was formulated, which began with the formation of a PANSUS, the preparation of an academic paper, so that in 2018 the Qanun LKS in Aceh was ratified. Meanwhile, at the actor network stage in the formulation of this Qanun LKS, the elements involved are still very limited, for example the absence of elements from entrepreneurs, civil society, and Dayah scholars.
