Abstract

The practice of leasing farmland does not always run smoothly. One of the obstacles that are often faced is the excess of rental time by tenant farmers because the plants have not yet entered the harvest period when the rental period ends. On the other hand, the land owner does not want to lose the profit that can be obtained from the duration of the excess lease. This study aims to find alternative solutions to disputes over lease contracts (ijarah). This research is a field research that is used to answer questions related to the process of implementing the practice of leasing agricultural land, the impact of excess rent for owners and tenants, as well as a contract model that can be a solution to conflicts over time in the practice of leasing agricultural land. The data was collected through interviews, the results of which were analyzed using descriptive methods, then conclusions were obtained through an inductive mindset. The data resource comes from Kalikotes, Klaten Regency. This study concludes that the beginning of the lease agreement does not conflict with Islamic law because it has been mutually agreed between the two parties, but at the end of the lease process there is a contract discrepancy. The land owner immediately asks the tenant for compensation for the excess time. The non-compliance with the agreement made by the tenant was caused by things that were completely unpredictable, where the lease period had expired but the rice could not be harvested. Both parties can resolve this conflict in a win-win manner by making a contractnew ijarah or changing the form of the contract at the beginning by using the number of harvests, not the tempo of the year.

Abstract

The guarantee provisions in Indonesian positive law cannot be simply applied to Islamic banking, without reviewing and analyzing the provisions of Islamic law, because Islamic banks still have to implement sharia complieant systems and operations. The purpose of this study is to find out more about the status of guarantees in mudharabah profit sharing contracts in Islamic banking. Knowing the ideas in the development of guarantees from the perspective of positive law that applies in Islamic banks, and their compatibility with fiqh studies. This research is a qualitative library research. Data were collected from a number of publications related to the research topic, then the data were interpreted and analyzed descriptively. The results of this study indicate that the legitimacy of Islamic law allows taking material guarantees for the mudharabah contract as a guarantee against negligence or violations that may be committed by trust holders such as mudarib. Collateral is an important thing to be included in financing in Islamic banking with the reason of avoiding violations that may occur by the debtor. The permissibility or necessity of collateral in sharia law is also explained by an Islamic figure, namely Sheikh 'Ali al-'Adawi who asserts that it is legal to take collateral to guarantee trust contracts against moral hazard (borrower moral hazard) that may be carried out by the trust holder.

Abstract

This article aims to record the development of literature on religious moderation and its efforts to prevent radicalism. The research method used is Systematic Literature Review (SLR), which is a method of collecting several articles, identifying, analyzing data, and conducting a critical review of the collected research data. The results of this study are known that the development of religious moderation studies to eradicate radicalism has been limited over the past five years. Previous researchers tend to develop more literature studies, while field research is only centralized in educational institutions. Two tendencies of researchers examine this topic, namely first the study of texts or narratives, the existing research dismantles radical ideas that are veiled in society through counter-religious texts. Second, in the field, researchers agree that educational institutions are a potential forum for the spread of radical understanding. In the future, the authors can conduct further investigations on the empirical spread of radicalism among young people, especially social media users.TRANSLATE with x EnglishArabicHebrewPolishBulgarianHindiPortugueseCatalanHmong DawRomanianChinese SimplifiedHungarianRussianChinese TraditionalIndonesianSlovakCzechItalianSlovenianDanishJapaneseSpanishDutchKlingonSwedishEnglishKoreanThaiEstonianLatvianTurkishFinnishLithuanianUkrainianFrenchMalayUrduGermanMalteseVietnameseGreekNorwegianWelshHaitian CreolePersian //  TRANSLATE with COPY THE URL BELOW Back EMBED THE SNIPPET BELOW IN YOUR SITE Enable collaborative features and customize widget: Bing Webmaster PortalBack//

Abstract

Indonesian statistical data shows significant developments in the Islamic banking sector. This is evidenced by the increase in the number of 20 Islamic Commercial Banks (BUS) with an average asset of 478,831 billion and 13 Islamic Business Units (UUS) with an average asset of 255,943 billion. The purpose of this study was to determine the effect of profit sharing, ijarah funding and NPF on profitability (ROA) in Indonesian Islamic Business (UUS). Profit sharing and ijarah financing is a form of bank business to generate profits in accordance with sharia principles. NPF is bad credit that arises when bank funds are channeled, but can affect bank income. The data source for this research is secondary data in the form of UUS (Maybank Indonesia) financial reports for the 2017-2022 period using a quarterly model. The research method used is a quantitative approach using linear regression analysis techniques. The results of this study indicate that simultaneously profit-sharing financing, ijarah and NPF have a positive effect on ROA. Partial test results, profit sharing and ijarah financing have a significant effect on ROA, while NPF has no significant effect on ROA.
