Abstract

Perlindungan konsumen merupakan upaya untuk menjamin terpenuhinya hak-hak konsumen atas barang dan jasa yang aman, layak, dan sesuai standar. Kasus adulterasi Bahan Bakar Minyak (BBM) yang mengakibatkan kerusakan kendaraan dan kerugian finansial menimbulkan kebutuhan akan advokasi yang efektif bagi konsumen. Penelitian ini bertujuan untuk mengetahui upaya Lembaga Perlindungan Konsumen Nasional Indonesia (LPKNI) dalam mengadvokasi kerugian konsumen akibat adulterasi BBM serta menelaah kesesuaiannya dengan prinsip maqashid syariah. Penelitian menggunakan metode hukum empiris dengan pendekatan kualitatif. Data primer diperoleh melalui wawancara dan observasi di LPKNI, sedangkan data sekunder diperoleh dari peraturan perundang-undangan, literatur ilmiah, dan dokumen pendukung. Data dianalisis secara deskriptif kualitatif untuk menggambarkan proses advokasi yang dilakukan. Hasil penelitian menunjukkan bahwa LPKNI melaksanakan advokasi melalui penerimaan pengaduan, verifikasi kasus, konsultasi hukum, pendampingan konsumen, mediasi, serta fasilitasi penyelesaian sengketa dengan pelaku usaha. Namun, pelaksanaan advokasi masih menghadapi kendala berupa keterbatasan sumber daya manusia dan rendahnya kesadaran masyarakat terhadap hak-hak konsumen. Dalam perspektif maqashid syariah, upaya tersebut sejalan dengan tujuan perlindungan harta (hifz al-mal) dan perlindungan jiwa (hifz al-nafs) karena berorientasi pada pencegahan kerugian dan pemenuhan hak konsumen.

Abstract

The issue of Islamic law and culture is one of the central issues that generates different judgments in society. Some people think that Islamic law should be culturally sterile. while others believe that Islamic law can dialogue with culture with several aspects that must be considered to maintain the purity of Islamic law. This is closely related to the phenomenon where the model of understanding religious law and the religious behavior of adherents of religion (Islam) changes. This article attempts to consider the phenomenon of dialogue between religious law and culture in society and to describe the different characteristics of local Islamic law.

Abstract

The polemic of interfaith marriages is not a new problem at the legal level in Indonesia, especially with the issuance of Supreme Court Circular Letter (SEMA) Number 2 of 2023 for District Courts to reject requests for registration of interfaith marriages. This has caused pros and cons in the community. The purpose of this research is to elaborate on the impact on the independence of judges and the constitutional rights of marriage actors, as well as the position of SEMA when faced with the rights of interfaith marriages conducted abroad and brought to Indonesia. This research can enrich insights into the discourse of interfaith marriage in Indonesia. This research uses a normative legal research method that relies on primary, secondary, and tertiary legal materials analyzed prescriptively. The results of this study are, First, SEMA can interfere with the independence of judicial power itself, where the Supreme Court is one of the actor of SEMA. Secondly, SEMA impacts the non-fulfillment of the constitutional rights of actors of interfaith marriages to obtain legal certainty, equality before the law, and legal protection. Thirdly, SEMA can trigger smuggling of law in interfaith marriages where the legal consequences must be recognized based on the principles of rights derived from foreign law, the principle of reciprocity, and the principle of comitas gentium. These three principles underlie the inter legality of interfaith marriages, so they have transnational legality. This research recommends that the Supreme Court revoke the SEMA that has been issued.
