Abstract

The development of dental implant science and technology has developed rapidly, the installation of dental implants is an option in replacing missing teeth. Recently, the construction of denture bridges with implant supports has been widely used and is often successful, however this does not rule out the possibility of failure in dental implant treatment. Granting additional authority to dentists with the aim of equal distribution of health services in Indonesia, there are no rules that clearly regulate the authority of dentists in placing implant dentures. This research is structured using the type of normative legal research, namely research that is focused on examining legal norms in an applicable statutory regulation related to the subject matter. The purpose of this study was to analyze the authority of dental implant placement by dentists and to analyze the legal consequences associated with the risk of dental implant placement in patients. The results of this study indicate that dental implants are the clinical authority of specialist dentists, dentists' authority in installing dental implants is limited to theoretical understanding, regarding various types of dental implant therapy, mastering application theories in dental implant cases only. Regarding the risk of failure in installing dental implants by dentists, legal remedies that can be taken by patients for losses experienced are by way of a civil suit to the local district court on the basis of liability for losses due to unlawful acts

Abstract

Penelitian ini bertujuan untuk mengetahui tinjauan etik dan hukum tindakan dokter yang melakukan operasi darurat terhadap pasien yang mengalami kecelakaan tanpa persetujuan tindakan medis karena pasien tidak cakap dan tidak didampingi oleh keluarga. Selain itu juga untuk mengetahui perlindungan hukum bagi dokter yang melakukan tindakan tersebut. Metode penelitian yang digunakan adalah metode penelitian kualitatif secara yuridis normatif dengan pendekatan deskriptif. Teknik pengumpulan data yang digunakan adalah dengan cara studi literatur. Hasil penelitian menunjukkan bahwa secara etis dan legal seorang dokter wajib melakukan operasi darurat pada pasien kecelakaan walaupun tanpa persetujuan tindakan medis karena tindakan tersebut bertujuan untuk menyelamatkan nyawa dan mencegah pasien dari kecacatan. Dokter yang melakukan perbuatan tersebut harus mendapat perlindungan hukum. Pembedahan dapat dilakukan oleh dokter tanpa persetujuan medis dalam keadaan darurat, jika tindakan ditunda menunggu persetujuan medis akan mengancam jiwa atau menyebabkan kecacatan pada pasien. Atas saran yang diberikan oleh peneliti agar dokter terlindungi secara hukum dalam melakukan operasi darurat tanpa persetujuan medis, harus ada Standar Operasional Prosedur (SOP) dan dalam peraturan perundang-undangan yang mengatur tentang persetujuan tindakan medis, harus mencantumkan pengecualian yang kondusif seperti dalam keadaan darurat.

Abstract

The right to lactation is part of human rights that naturally belongs to a woman, including female health workers who are protected by the state.In carrying out their duty to fulfill the rights of patients, they often face conflicts with the fulfillment of lactation rights that they should get. As a legal country, Indonesia provides protection for the fulfillment of lactation rights in several lawsand regulations. This study uses the type of normative juridical law research, namely library law research, with statutory approaches, and conceptual. The problems and objectives of this study are to analyze the conflict between the lactation rights of health workers and the rights of patients in health services and the government's legal responsibility for fulfilling the rights of lactation for health workers. The results showed that the biggest clashes experienced by health workers in fulfilling lactation rights was as welthe disharmony of laws and regulations between the Labor Law or the Job Creation Law and the Government Employees Management Government Regulations with the Health Law and the Government Regulationson Exclusive Breastfeeding. The government is responsible for fulfilling the right to lactation. The government can be seen as a legal subject and legal object, which means that the government supervises as well as was upervised the implementation of the provisions for fulfilling the right to lactation for health workers.

Abstract

The objective of this research is to determine the legal framework regarding the role of the state in providing health services and to identify the legal safeguards available to impoverished individuals seeking healthcare in hospitals. This research employs normative juridical research methods, which involve a statutory and conceptual approach. The findings of this study indicate that the state's responsibility in fulfilling the right to health, as outlined in Law No. 17 of 2023 on Health and Law No. 24 on the Social Security Agency for Health (BPJS), lacks consistency in terms of the essence and substance of state responsibility. It has been demonstrated that there are still a significant number of economically disadvantaged individuals in Indonesia who qualify as recipients of contribution assistance (PBI). Additionally, patients are currently lacking legal protection in relation to their entitlement to receive services at a hospital, as stipulated in Article 189 of Law number 17. This refers to the state's obligation to ensure the right to health by offering sufficient and easily accessible healthcare facilities for all segments of the population. The state bears the primary obligation to ensure the fulfilment of its citizens' right to health as mandated by the constitution. States shall prioritise and ensure the realisation of the right to health without any kind of neglect or disregard.

Abstract

This research aims to analyse the basic legal ratio of the authority of the Indonesian Medical Council in issuing Registration Certificates for medical personnel and to analyze the legal consequences of issuing Registration Certificates for medical personnel by the Indonesian Medical Council after the issuance of Law Number 17 of 2023 concerning Health. The research approach used was normative juridical research. The legal materials used were primary and secondary legal materials. The technique for collecting legal materials in this research was by conducting a literature study. The research results showed that after the issuance of Law 17/2023, the central government through the Minister of Health is simplifying the practice requirements for medical personnel by introducing lifetime STR and SIP with the SKP system which is assessed directly by the Minister of Health and Regional Government. The legal consequences are not only a shift in norms, but also the formation of a new council with the latest structure, the SKP requirements shifted from the issuance of STR to SIP, and also the emergence of SKP management authority by the Regional Government c.q. Head of the Regency/City Health Service or Head of the Regency/City Regional Investment and One-Stop Integrated Services

Abstract

BPJS Kesehatan memiliki kewajiban membayar Fasilitas Pelayanan Kesehatan (FASKES) atas layanan yang telah diberikan paling lambat 15 (lima belas) hari kerja setelah berkas klaim diterima lengkap dan benar. Terkait klaim pelayanan oleh rumah sakit kepada BPJS Kesehatan sering ditemui permasalahan, seperti ketidaksesuaian tarif yang diajukan dengan tarif yang tercantum dalam paket INA CBGs dan yang dibayarkan oleh BPJS Kesehatan, ataupun keterlambatan pembayaran klaim oleh BPJS Kesehatan.  Persoalan ini timbul dikarenakan, pihak BPJS menganggap bahwa berkas klaim yang diajukan oleh pihak rumah sakit masih ditemukan ketidaksesuaian dengan prosedur pengajuan klaim, padahal pelayanan yang telah dilakukan di rumah sakit sebelumnya telah diverifikasi oleh TIM verifikator BPJS dan pihak rumah sakit telah menerima sejumlah pembayaran 70% dari total pengajuan. Namun, ketika ada audit atau post review klaim, rumah sakit diminta mengembalikan dana yang sudah dibayarkan sebagai jasa pelayanan bahkan sudah dibukukan dalam laporan pajak. Kata kunci:  Perlindungan Hukum, Pelayanan, Rumah Sakit

Abstract

This study explores the historical and contemporary practices of abortion, focusing on the legal and psychological implications for rape victims and the role of doctors as executors. Abortion has been practiced since ancient times using various methods across different cultures. Modern discussions about abortion remain contentious, especially concerning the rights of rape victims who often face severe psychological trauma. The primary objective of this research is to examine the evolution of abortion laws in Indonesia, particularly those providing legal protection for medical professionals. This normative juridical research employs statute and conceptual approaches to analyze laws, regulations, and legal doctrines, connecting them with current positive law to address the main thesis issues. Key findings indicate that Indonesian laws have progressively recognized the necessity of abortion in specific circumstances, culminating in the 2023 amendments to the Criminal Code and Health Law. These legal frameworks aim to protect women's mental health and uphold their human rights, as enshrined in international conventions. The research concludes that although legal provisions for abortion have progressed, there is still a need for improved implementation and support systems to safeguard medical professionals due to lingering ambiguities in the law.

Abstract

The public always asks whether the rights obtained by patients while being treated by  dentists compared to CoAss dentists are the same and whether they get legal protection while being treated by CoAss dentists. This research aims to discuss the legal protection of patients who are treated by CoAss dentists at the Dental Education Hospital. The method used in this study is a normative legal methodology and  descriptive analytical with an approach to Law no. 17 of 2023 concerning Health (Health Law). The results of the study show that patients have the right to fulfill their rights, including obtaining complete information, consent to medical actions, confidentiality, and legal protection from negligent acts regulated in the Health Law and PP 28 of 2024 concerning implementing regulations for the Health Law.. patient rights and legal responsibilities towards CoAss operating under the supervision of senior doctors/DPJP can be fulfilled. The findings show that even though CoAss doesn’t yet have a practice permit, patient rights at RSGMP are still fulfilled, with procedures that prioritize patient safety. This article emphasizes the importance of strict supervision from institutions,clear regulations regarding patient rights, and the need for a complaint mechanism to improve the quality of medical services.

Abstract

Program pengabdian kepada masyarakat ini bertujuan untuk memberikan pemahaman yang mendalam tentang aspek hukum tata kelola rumah sakit di Rumah sakit umum daerah Caruban kabupaten Madiun serta Meningkatkan kesadaran tenaga kesehatan untuk memberikan pelayanan maksimal kepada masyarakat. Metode yang diterapkan dalam pengabdian masyarakat ini berupa penyuluhan dan seminar terkait peningkatan pemahaman aspek hukum tata kelola rumah sakit di Rumah Sakit Umum Daerah Caruban kabupaten Madiun. Penyuluhan hukum ini dianggap penting mengingat Keserasian antara kepentingan pasien dengan kepentingan tenaga kesehatan merupakan salah satu penunjang keberhasilan pembangunan sistem kesehatan. Oleh karena itu perlindungan hukum terhadap kepentingan itu harus diutamakan. Di satu pihak pasien menaruh kepercayaan kepada kemampuan profesional tenaga kesehatan dan di lain pihak karena adanya kepercayaan itu, seyogyanya tentang kesehatan menurut standar profesi dan berpegang teguh pada kerahasiaan profesi. Setelah diadakan program pengabdian ini, para tenaga kesehatan di lingkungan RSUD Caruban memiliki pemahaman mendalam terkait kesadaran tenaga kesehatan untuk memberikan pelayanan maksimal kepada masyarakat dan memiliki pemahaman hukum dalam bidang kesehatan.

Abstract

Regulations for acupuncture practice in Indonesia are based on Law No. 17 of 2023 concerning health and Permenkes No. 34 of 2018 concerning license and practice regulation of acupuncture therapists. In Indonesia, acupuncture treatment consists of traditional acupuncture done by acupuncture therapists and medical acupuncture done by doctors, both acupuncture specialists and general practitioners. This research titled "Legality of General Practitioners in Carrying Out Acupuncture Treatment" aims to analyze the authority of general practitioners in carrying out acupuncture treatment and the liability between general practitioners and patients when carrying out acupuncture treatment. This research uses a normative juridical method with two approaches, namely the statuary approach and the conceptual approach. The results of this research are that currently, in Indonesia, there is a void of norms that regulate the authority of general practitioners in doing acupuncture treatment. Therefore, besides liability in the form of default and acts against the law in the field of civil penal law between doctors and patients, general practitioners can also be held responsible in the field of penal law and administrative penal law.
