Abstract

Simple procedures and quick service on fintech lending gives an ease for fulfilling capital needs. Indeed, it does not require any collateral which may constrain debtors to deal with it. However, although this activity brings convenience, efficiency, quickness, and simplicity in lending services, many possible risks such as debtors’ delayed payment or even default which may burden the creditors are likely to follow as well. Without any collateral as assurance, the risks may become much higher on fintech lending as the creditor becomes a concurrent creditor who only has relatively individual rights whose position is equal to the other creditors, no droit de suite principle, and the claim is individual with general assurance.

Abstract

The research entitled Legal Study of the Implementation of Termination of Employment for the Reason of the Covid-19 Pandemic aims first to analyze how the norms and provisions of laws and regulations are applied related to the implementation of termination of employment in Indonesia and find out how legal protection is for workers who experience termination of employment. During the current Covid-19 pandemic. The research method used in this study uses a normative juridical research method with a statutory and conceptual approach. Based on the results of the research, it can be concluded First: the legal basis for employers in carrying out mass termination of employment relations with workers/laborers during the current Covid-19 pandemic for the first time referred to the provisions of Article 164 paragraph (1) of the Manpower Law which became the basis for the existence of emergency due to an unwanted cause then proceed with the implementation of Article 151 of the Manpower Law which regulates the process of terminating workers. Second, namely, the legal protection provided by the State for workers due to termination of employment due to the current Covid-19 pandemic first must provide workers' rights as in Article 156 of the Labor Law and, in the current period, must pay attention to the provisions in the Minister of Manpower Circular Letter Number M/3/HK.04/III/2020 concerning Worker/Labor Protection and Business Continuity in the Context of Prevention and Mitigation Covid-19 and Article 6 of the Quarantine Law and Health.

Abstract

Introduction to the Problem: The digital era of technology has cut the role of third parties and made it easier for services to be run peer-to-peer; where parties can connect directly at a business scale. Business relations is always accompanied by contracts. However, nowadays conventional contracts have undergone disruption with the existence of blockchain technology. A smart contract is a contract model that uses technology that can execute the contents of the contract automatically. The existence of this technological sophistication also has implications for the exchange of data, particularly personal data. Personal data can be easily accessed through the data exchange process, but it is feared that data misuse will occur. In order to prevent the Electronic Data Interchange of personal data using this technology, data must be protected.Purpose/Objective Study: This study aims to examine the legal protection of users of the HARA platform who use smart contracts in electronic data interchange services.Design/Methodology/Approach: This research is normative juridical research with statutory and conceptual approaches.Findings: In this case, the protection includes preventive and repressive protection. Preventively through legislation with the presence of laws on ITE and laws on Personal Data Protection as well as internal regulation of platform providers, while repressively lawsuits can be carried out through litigation and non-litigation channels.Paper Type: Research Article

Abstract

The main objective of this study is to analyze the legal consequences of reducing the provision of additional income for health workers and to analyze the legal responsibility of local governments for reducing the right to provide additional income for health workers. The method used in this study is a normative juridical research method, so the approach taken in this research is a statutory approach (statute approach), historical approach (historical approach) and conceptual approach (conceptual approach). The results of the findings and studies in this study, it can be concluded that the legal consequences that occur if the actions taken by the local government to reduce the provision of additional income for Health Workforce Employees if they cannot be accounted for are revocable and invalid. So that the decision issued in February 2022 may be canceled, so that the Regent's regulation Number 1 of 2022 is reinstated. The legal responsibility of the local government regarding the reduction of the right to provide additional income for health workers is to return to the legal basis for providing additional income for employees based on government regulations number 12 of 2019 by looking at the principles of providing additional employee income which include the principles of justice, welfare and having legal certainty.

Abstract

Hospitals in improving service quality must have autonomy, hospitals are one form of public service reform so that public services can improve. Therefore, in an effort to improve hospital performance, it is necessary to provide guidance and supervision through the establishment of a Supervisory Board. The purpose of this study is to analyse the urgency of establishing a hospital supervisory board and the legal consequences for hospitals that do not have a supervisory board by using normative research methods and using statutory and conceptual approaches. In accordance with statutory provisions, hospitals that do not have a supervisory board do not violate statutory provisions as long as they do not fulfil the criteria required to form a supervisory board. However, legal protection of patients for hospitals that do not have a supervisory board must be guaranteed by the government through supervisory efforts by external supervisors and other stakeholders.

Abstract

Rumah sakit adalah salah satu fasilitas pelayanan kesehatan yang disediakan oleh pemerintah, yang dalam memberikan pelayanan kesehatan harus mematuhi peraturan perundang-undangan. Ketidakpatuhan terhadap beberapa peraturan perundang-undangan tersebut dapat mengakibatkan masalah hukum yang menuntut tanggung jawab hukum bagi rumah sakit. Salah satu masalah yang berpotensi menjadi masalah hukum di rumah sakit adalah terjadinya infeksi luka operasi (ILO) pada pasien bedah. Terjadinya ILO pada pasien bedah dapat menimbulkan kerugian bagi pasien yang berpotensi menimbulkan gugatan hukum, sehingga rumah sakit harus bertanggung jawab atas kerugian tersebut. Penelitian ini bertujuan untuk menganalisis potensi kerugian bagi pasien bedah akibat ILO dan tanggung jawab hukum rumah sakit terhadap pasien bedah akibat ILO. Jenis penelitian yang digunakan dalam penelitian ini adalah yuridis normatif dengan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan komparatif. Kesimpulannya, terjadinya ILO pada pasien bedah di rumah sakit berpotensi menimbulkan kerugian bagi pasien, yang dapat berujung pada masalah hukum dan menuntut tanggung jawab hukum bagi rumah sakit di bidang pidana, perdata, dan administratif.

Abstract

Penelitian ini bertujuan untuk mengkaji dan menganalisis penyelesaian sengketa medis di pengadilan menurut peraturan perundang-undangan di Indonesia dan peran pengadilan khusus kesehatan dapat memberikan rasa keadilan bagi dokter yang diduga melakukan malpraktik. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil penelitian ini menunjukkan bahwa penyelesaian perselisihan medis di pengadilan diatur oleh beberapa peraturan antara lain Kitab Undang-Undang Hukum Perdata, Kitab Undang-Undang Hukum Pidana, Undang-Undang Nomor 29 Tahun 2004 tentang Praktik Kedokteran, Undang-Undang No. 36 Tahun 2009 tentang Kesehatan, Undang-Undang Nomor 36 Tahun 2014 tentang Tenaga Kesehatan dan Undang-Undang No. 17 Tahun 2023 tentang Kesehatan. Mengenai peran pengadilan kesehatan khusus, mereka memiliki potensi untuk memastikan keadilan bagi dokter yang dituduh melakukan malpraktik. Dengan memiliki pengadilan khusus yang disesuaikan dengan kebutuhan sektor kesehatan, kasus malpraktik dapat ditangani dengan perspektif dan standar yang relevan, bersama dengan para hakim dan ahli yang memahami masalah medis teknis dan kompleks yang terlibat. This research aims to examine and analyze the resolution of medical disputes in court according to the legal regulations in Indonesia and the role of specialized health courts in providing a sense of justice for doctors who are alleged to have committed malpractice. This research is a normative legal research and using several approaches, namely statutory approaches, conceptual approaches, and comparative approaches. The research findings indicate that the settlement of medical disputes in the courts is governed by several regulations, The Civil Code, the Criminal Code, Law Number 29 of 2004 on Medical Practice, Law Number 36 of 2009 on Health, Law Number 36 of 2014 on Health Workers and Law Number 17 of 2023 on Health. The establishment of health judiciary in Indonesia involving ad hoc judges with knowledge and competence in the medical field is an important and relevant step to address medical dispute issues. This is because malpractice cases can be approached through relevant perspectives and standards, supported by the presence of judges and experts with adequate technical and medical competence.

Abstract

The development of dental implant science and technology has developed rapidly, the installation of dental implants is an option in replacing missing teeth. Recently, the construction of denture bridges with implant supports has been widely used and is often successful, however this does not rule out the possibility of failure in dental implant treatment. Granting additional authority to dentists with the aim of equal distribution of health services in Indonesia, there are no rules that clearly regulate the authority of dentists in placing implant dentures. This research is structured using the type of normative legal research, namely research that is focused on examining legal norms in an applicable statutory regulation related to the subject matter. The purpose of this study was to analyze the authority of dental implant placement by dentists and to analyze the legal consequences associated with the risk of dental implant placement in patients. The results of this study indicate that dental implants are the clinical authority of specialist dentists, dentists' authority in installing dental implants is limited to theoretical understanding, regarding various types of dental implant therapy, mastering application theories in dental implant cases only. Regarding the risk of failure in installing dental implants by dentists, legal remedies that can be taken by patients for losses experienced are by way of a civil suit to the local district court on the basis of liability for losses due to unlawful acts

Abstract

Penelitian ini akan membahas bagaimana perbandingan perlindungan hukum terhadap hak laktasi antara Indonesia dan Jerman. Hak laktasi atau hak menyusui merupakan hak kodrati yang diperoleh seorang perempuan, termasuk pada perempuan pekerja. Oleh karenanya, hak laktasi harus mendapatkan perlindungan hukum dari negara. Metode penelitian yang digunakan adalah metode penelitian yuridis normatif, yaitu penelitian hukum kepustakaan, dengan pendekatan peraturan perundang-undangan, pendekatan perbandingan dan pendekatan konseptual. Tujuan penelitian ini adalah untuk mengetahui perbandingan perlindungan hukum hak laktasi pada perempuan pekerja di Indonesia dan di Jerman. Hasil penelitian menunjukkan bahwa Indonesia dan Jerman yang sama-sama menganut Civil Law System, telah memberikan perlindungan hukum terhadap hak laktasi, baik pada pekerja perempuan swasta maupun pegawai negeri. Indonesia menjamin hak laktasi pada perempuan pekerja dengan memberikan cuti melahirkan selama 6-12 minggu, tanpa ada pengaturan kerja paruh waktu maupun cuti tanpa gaji untuk mendukung pelaksanaan pemberian ASI Eksklusif selama 6 bulan. Sementara Jerman mengatur cuti melahirkan selama 8-12 minggu, diperkenankan mengambil cuti tanpa gaji selama 6 bulan menyusui ataupun mengambil kerja paruh waktu dengan tetap mendapatkan upah.

for humanity. All actions of palliative care carried out by the palliative team, really need informed consent, so that they are not subject to administrative, criminal or civil sanctions. So in this study the aims were to analyze the legal ratio of informed consent in palliative care based on the Minister of Health Decree number 812/Menkes/SK/VII/2007 concerning Palliative Care Policy, and analyze legal liability for negligence in making informed consent in palliative care. The research method is normative juridical with a statute approach and conceptual approach. The results of this study are that in the process of palliative care carried out with multidisciplinary knowledge, these actions really require informed consent. And legal responsibility for negligence in making informed consent in palliative care can be in the form of administrative, criminal or civil sanctions.
