Abstract

A juridical-philosophical analysis of the position of sharia compliance in Islamic banking in Indonesia aims to explore the understanding and legal foundation underlying the implementation of sharia principles within the Islamic banking industry. In this context, sharia compliance refers to adherence to Islamic legal principles that must be applied by Islamic banks in all aspects of their operations, including financial products and services. Islamic banking in Indonesia has a clear legal foundation, namely Law No. 21 of 2008 on Islamic Banking, which provides the legal basis for the development of Islamic banking in Indonesia. In this regard, sharia compliance becomes a crucial element to ensure that transactions and banking activities do not violate sharia principles such as the prohibition of riba (interest), gharar (uncertainty), and maysir (gambling). Philosophically, the implementation of sharia compliance in Islamic banking is not only related to legal aspects but also to moral and ethical aspects in Islam that prioritize justice, blessings, and social welfare. From this perspective, sharia compliance functions as a foundation to create an economic system that is fair, transparent, and based on adherence to religious values. However, challenges in implementing sharia compliance in Islamic banking in Indonesia still exist, particularly related to differences in interpreting the implementation of sharia principles, as well as the need to continuously align regulations and operational practices to keep pace with global economic developments. Therefore, the position of sharia compliance in Islamic banking in Indonesia is not only a legal obligation but also a commitment to integrate moral principles into the management of the financial sector, which ultimately aims to create the welfare of the community within a just economic system.

This study is a field research employing a descriptive qualitative approach. The subjects of this research are the owners of foodies accounts @kulinerpalangka, @abang.lapar, and @ngunyah.pky in Palangka Raya, as well as three informants who use foodies services. The Islamic economic perspective on foodies' activities emphasizes cooperation between business actors and foodies. Users of food services must meet the halal review criteria. The verse discussing the halal nature of a product is QS Al-Baqarah verse 29. Additionally, the concept of foodies includes an element of excessive eating, which contradicts Islamic teachings as stated in QS Al-A'raf verse 31

Abstract

Islam requires every mature individual to seek legal livelihood, one of which is through trade. However, some traders sometimes do not pay attention to the provisions of Islamic commercial transactions (muamalah). In this regard, there is an interesting phenomenon among some Banjar traders at the Pasar Besar in Palangka Raya. They emphasize more on the concept of "blessing" (barakah), so that trading (business) activities and worship are in balance. Each person and region understand "blessing" differently, both in terms of its meaning, causes, and benchmarks. This research examines the meaning of "blessing" according to the traders, as well as analyzing the anthropological aspects related to the trading practices oriented towards "blessing". This is a qualitative descriptive study with Banjar traders at the Pasar Besar in Palangka Raya as the research subjects. The findings show that the meaning of "blessing" in trading according to Banjar traders is the increase in goodness, abundance or increase in sustenance, beneficial for all, so that needs are met. "Blessing" is also interpreted as the achievement of pleasure, tranquility, peace, and comfort in life. The position of "blessing" in trading is very important, because the purpose of trading is to fulfill life's needs in accordance with Islamic sharia. Blessing will not be obtained if the provisions of Islamic business are ignored. Anthropologically, trading practices oriented towards "blessing" indicate a close relationship between economic activity and the belief system and religious values embraced by the Banjar trader community

Abstract

According to the banking law, a bank can have its business license revoked and be liquidated. In the bank dissolution system, the Deposit Insurance Corporation is very influential when it comes to handling bank customer capital returns. The granting of these powers and privileges is expected to increase the rate of recovery for the Store Protection Partnership, thereby maintaining the suitability of the store protection program. The emergence of Law No. 24 of 2004 concerning the Deposit Insurance Corporation represents another part of the public finance framework. The presence of the Deposit Insurance Corporation cannot be separated from efforts to develop security in the financial area and will rebuild public confidence in the financial sector. This assessment focuses on the performance and ability of the Deposit Insurance Company in fulfilling its obligations to hold, protect, and submit legal decisions to the people as bank users in the dissolution of banks based on financial regulations.

Abstract

Indonesia, with its vast maritime domain, faces significant challenges related to maritime crime, including illegal, unreported, and unregulated (IUU) fishing, piracy, human trafficking, and smuggling. The country’s strategic position, bordering key shipping routes like the Strait of Malacca and the Sunda Strait, exacerbates its vulnerability to transnational crimes. This study provides a spatio-temporal assessment of emerging trends and hotspots of marine crime in Indonesia during the period of 2022-2023. Through an analysis of crime incidents, the research identifies key areas of concern, such as the Java Sea, Sumatra, and Eastern Indonesia, where illegal activities have shown persistent and intensifying patterns. The Strait of Malacca and Aceh emerged as critical zones, with increased incidents of piracy and human trafficking, partly linked to the Rohingya refugee crisis. Additionally, the study highlights the environmental impact of illegal activities in ecologically sensitive regions, such as Papua and the Coral Triangle, where illegal logging, mining, and destructive fishing practices threaten marine ecosystems. The analysis also reveals seasonal trends, with the highest concentration of incidents occurring between July and September, coinciding with peak fishing activities. Despite efforts by the Indonesian government, including the Sinking of Foreign Vessels Policy and regional cooperation initiatives like ReCAAP, enforcement gaps remain, particularly in remote regions. The study identifies critical gaps in maritime security, including the need for improved technological surveillance and enhanced community engagement in enforcement efforts. The findings underscore the importance of spatial-temporal monitoring to inform targeted law enforcement and policy responses, thereby protecting Indonesia’s marine resources and enhancing national security.
